Abstract

This study aims to analyze the effectiveness of prosecutors at the Kepulauan Morotai District Attorney's Office as investigators and public prosecutors in handling corruption cases, as well as to identify the challenges faced during the process. The research employs a normative juridical-empirical method with a sociological law approach, combining secondary data from legal regulations with primary data from field observations. The findings indicate that the Kepulauan Morotai District Attorney's Office has effectively carried out its duties and authorities, as evidenced by its achievements in handling corruption cases from 2020 to 2022. However, several juridical and non-juridical obstacles hinder the resolution of cases. The study implies that further efforts are needed to address these challenges in order to enhance the performance of the District Attorney's Office in the future.

Abstract

This research aims to analyze the legal authority of public prosecutors to conduct wiretapping in corruption cases and to identify the regulatory weaknesses in the implementation of this authority. The research employs normative legal research, a process used to discover legal rules, legal principles, and legal doctrines to address the legal issues at hand. The normative research approach in this study focuses on three approaches: 1) the statute approach, 2) the conceptual approach, and 3) the comparative approach. The findings indicate that the legal authority of public prosecutors to conduct wiretapping is explicitly stipulated in Article 30C letter (i) of Law No. 11 of 2021, amending Law No. 16 of 2004 on the Prosecutor's Office of the Republic of Indonesia. However, there are several weaknesses in the regulations, including deficiencies in legal substance, legal structure, and legal culture. The weaknesses in legal substance include the absence of specific legislation on wiretapping. The weaknesses in legal structure involve overlapping authority among institutions such as the Prosecutor's Office, BIN, Police, and KPK, as well as the lack of digital forensic laboratories and skilled human resources in wiretapping operations.

Abstract

One of the cases where passengers were not transported due to an overcapacity of the aircraft (overseat) occurred on the Lion Air Manado - Jakarta flight with flight number JT 743 on 19 October 2011, in connection with this case there were two passengers who objected and suffered losses for this incident, and filed a civil suit to the Central Jakarta District Court for the settlement process with Decision Number: 42/Pdt.G/2012/PN.JKT. PST. and Decision Number: 260/Pdt.G/2014/PN.JKT.PST. This paper will discuss more deeply the basis for judges' considerations so that there are disparities in court decisions. The type of research used is juridical normative, with a statutory approach and a case approach. The data collected is then analyzed qualitatively. The results showed that District Court Decision Number 260/PDT.G/2014/PN.JKT.PST where the Plaintiff filed a lawsuit for act against the law but the Judge decided that the Defendant was guilty of default for the act of not carrying passengers on the grounds of aircraft capacity, this was related to the application of the passive judge principle and the ultra petitum partium principle which had broad meaning in good faith by the judge, then on District Court Decision Number 42/PDT.G/2012/PN.JKT.PST the judge decided that the Defendant was guilty of committing an unlawful act in terms of the absence of passengers on the grounds that the aircraft's capacity was in accordance with the Plaintiff's claim.

Abstract

The purpose of paper is to analyze the control costs for becak motor transportation operational permits in accordance with the authorities owned and the suitability of the contents of the Tidore Islands Mayor Regulation Number 3 Year 2016 concerning v Operational Permits with Types and Hierarchy in the Formation of Legislative Regulations. The type of research used is socio-juridical research, which is research that is focused on examining the application of the rules or norms in positive law. This research uses a statutory approach and a case approach. The data collected is then analyzed qualitatively, namely data obtained from both library research is grouped and selected then combined with the problems to be studied according to quality and truth so that they will answer the existing problems. The Regional Government of Tidore City does not have the authority to collect fees for controlling the operational license for becak motor vehicles because these charges are against the provisions of Article 2 paragraph (3) and Article 150 of Law Number 28 Year 2009 concerning Regional Taxes and Regional Levies and Article 286 paragraph 2) Law Number 23 Year 2014 concerning Regional Government, in which the authority to determine other types of levies other than those regulated in law is centralized through non-decentralized Government Regulations through regional legal products. So that the regional head regulation that regulates the collection of costs for controlling the operational license for becak motor does not have a legal standing. The type of becak motor vehicle is not classified into the type of vehicle that can function as public transportation as stipulated in Article 47 paragraph (3) of Law Number 22 Year 2009 concerning Traffic and Road Transportation so that the regulation of the becak motor Operational Permit contained in the Mayor of Tidore Islands Regulation Number 3 Year 2016 concerning the becak motor Operational Permit is disharmonious with the regulations in Law Number 22 Year 2009 Traffic and Road Transportation There is a discrepancy between the types and the content contained in the Mayor of Tidore Islands Regulation Number 3 Year 2016 concerning this becak motor Operational Permit where it is not there is an order from a higher level statutory law or regional law or not established based on authority. So that its existence should not be recognized as stipulated in Article 8 paragraph (2) of Law Number 12 Year 2011 concerning the Formation of Shrimp Legislation.

Abstract

By the promulgation of Law Number 23 of 2014 concerning Regional Government, there has been a shift in the institutional design of the Regional House of Representatives (DPRD in Bahasa Indonesia), especially in the aspects of the legislative function and its authority. There is an affirmation of the understanding of the DPRD as an element of regional government administration. In this context, the House of Representatives (DPR in Bahasa Indonesia) and the President deliberately combine the two types of power functions, the legislative and the executive, into one institution called the DPRD in the local government system in Indonesia. Shifting of institutional design above indicates that Regional Government Law is principally no longer categorizes the DPRD as a legislative agency but instead as an executive institution playing a role in supervising the implementation of Regional Government. Based on this Regulation, the theoretical interpretation of DPRD’s existence is interpreted as an executive institution running the legislative function.

Abstract

Corruption significantly threatens state financial stability and governance integrity. This study explores optimizing the role of the Government Internal Supervisory Apparatus (Aparatur Pengawasan Intern Pemerintah, APIP) in preventing corruption in Halmahera Selatan Regency. It aims to analyze APIP’s effectiveness and identify challenges in fulfilling its supervisory role. A combined juridical-normative and juridical-empirical approach was applied. The juridical-normative method analyzed legal frameworks, including laws and policies regulating APIP’s role. The juridical-empirical approach involved primary data collection through interviews with APIP officials and regional government representatives, complemented by secondary data from literature and case studies. Qualitative analysis was conducted to identify key patterns and insights. Findings indicate that APIP’s role in corruption prevention is limited by weak institutional independence, inadequate budget allocation, and low human resource competency. These constraints reduce its ability to perform effective oversight. The study recommends institutional reforms to strengthen APIP’s independence, increase budget allocations, and provide continuous training for personnel. These measures are crucial for effective corruption prevention and fostering transparent and accountable governance at the regional level.

Abstract

Otonomi daerah dengan konsep desentralisasi yang penyerahan wewenang pemerintahan kepada pemerintah daerah untuk mengatur dan mengurus urusan pemerintahannya secara mandiri maka masyarakat hukum adat memiliki posisi dan peran yang sangat strategis. Masyarakat hukum adat yang berada di Kepulauan Kei Maluku Tenggara telah bertahun-tahun memiliki hukum yang tidak tertulis yang di kenal dengan hukum adat Larwul Ngabal sebagai hukum yang hidup (living law),yang jadikan sebagai pegangan dalam mengatur berbagai aktivitas kehidupan masyarakat baik itu secara formal maupun informal. Dalam konteks tersebut maka otonomi daerah benar-benar menjadi milik masyarakat termasuk juga masyarakat hukum adat di Kepulauan Kei.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh Sistem Hukum Terhadap Kerugian Keuangan Negara dalam perjalanan Fiktif pada Sekretariat Daerah Kabupatan Pulau Morotai. Penelitian ini merupakan penelitian hukum empiris, dengan lokasi penelitian pada Sekretariat Daerah Kabupaten Pulau Morotai dan Kejaksaan Negeri Morotai. Data yang digunakan dalam penelitian ini berupa data primer diperoleh secara langsung dari lapangan dan data sekunder yang diperoleh melalui studi kepustakaan. Selanjutnya data yang terkumpul diolah dalam bentuk analisis kualitatif. Dapat disimpulkan bahwa Konsep kerugian keuangan negara dalam perjalanan dinas fiktif pada aspek hukum administrasi negara, mengharuskan adanya pengembalian keuangan negara dan memulihkan penyebab kerugian keuangan negara tersebut. Sedangkan pada aspek hukum pidana kerugian keuangan negara dipandang sebagai unsur tindak pidana korupsi. Substansi hukum yang baik berperan dalam mencegah terjadinya perjalanan dinas fiktif melalui, penetapan prosedur dan dokumentasi yang ketat untuk perjalanan dinas, Pengaturan sanksi yang tegas bagi pelaku dan kewajiban pelaporan dan pertanggungjawaban yang detail. Struktur hukum memiliki pengaruh signifikan melalui perbaikan sistem pengawasan, peningkatan koordinasi antar lembaga, pengembangan SDM, serta pemanfaatan teknologi merupakan langkah-langkah penting dalam mengoptimalkan peran struktur hukum. Budaya hukum yang lemah dapat menjadi faktor pendorong terjadinya praktik-praktik koruptif tersebut. Budaya hukum mengacu pada sikap, nilai, dan kepercayaan masyarakat terhadap hukum dan sistem hukum.

Abstract

Indonesia's legal pluralism allows customary and national laws to coexist, presenting challenges in inheritance and gender justice. The Sahu Tribe's inheritance system in West Halmahera follows patriarchal, patrilineal principles, where inheritance is restricted to male heirs, leaving women without rights, even in the case of only daughters. This creates gender inequality and contradicts civil law, which guarantees equal inheritance rights. This normative legal research, using a comparative approach, analyzes the alignment of the Sahu Tribe's inheritance system with justice principles and compares it with civil law’s inclusive protection of women’s rights. The study proposes harmonizing customary and national law to create a fairer inheritance system. Findings suggest that civil law intervention, through reinterpretation of customary values, human rights alignment, and shifts in community attitudes, is necessary to reduce gender injustice. A more inclusive, bilateral inheritance codification is needed to preserve customary diversity while ensuring justice, with gender-responsive laws promoting equality and encouraging indigenous communities toward a more egalitarian system.

Abstract

This study analyzes the inconsistencies in child marriage regulations in Indonesia, which result in legal uncertainty in efforts to protect children through the marriage dispensation process. By employing both normative and sociological approaches, the study examines the legal implications of these regulatory disparities and assesses the marriage dispensation process from a benefit-based perspective. The findings reveal that the inconsistency in regulations leads to unequal legal protection for children involved in marriage, highlighting the urgent need for harmonizing laws and strengthening child protection mechanisms. Improvements are necessary not only in the Child Protection Law but also in the revision of the Marriage Law, taking into account the broader responsibility of the state in safeguarding children. Although the Marriage Law sets a minimum age for marriage, it still allows for loopholes through marriage dispensation, reflecting an inconsistency in legislative efforts to protect children. The overlap between different legal provisions creates uncertainty in the legality of child marriages, as different interpretations of the laws can lead to varying legal outcomes. This study identifies two key issues: the legal consequences of regulatory inconsistencies in child marriages and how marriage dispensation is viewed from a benefit perspective. Using a normative legal research method, the study draws on primary, secondary, and tertiary legal sources, including legislation and court decisions, and analyzes the data qualitatively. The results indicate that the regulatory inconsistencies create legal uncertainty in the protection of children in marriages approved through dispensation. Therefore, protecting these marriages from a benefit perspective is essential, as the dispensation process serves as a form of legal protection for children, rather than defying the rule of law.
