Abstract

Peatland management in Kutai Kartanegara faces major challenges, especially due to the expansion of the coal mining industry. Regional Regulation No. 1 of 2016 is designed to protect peat swamp ecosystems and support the welfare of local communities, but its effectiveness is questionable amid the rapid exploitation of natural resources. This study aims to evaluate the effectiveness of the 2016 Regional Regulation in maintaining ecological and social balance through normative juridical law analysis that includes related laws and John Rawls' distributive justice theory approach. The Normative Juridical Citation Method and data are collected from primary legal sources, including Law Number 26 of 2007 concerning Spatial Planning, Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining, as well as Kutai Kartanegara Regional Regulation Number 1 of 2016 itself and secondary legal sources in the form of relevant literature, such as books, journals, articles and internet sources as well as mass media, both print and online and allow data triangulation to be carried out. The study results show that weak supervision and the absence of strict sanctions for mining companies hinder the optimal implementation of the Regional Regulation, causing adverse impacts on the environment and community welfare. The analysis shows that these regulations are not entirely fair to local communities that are vulnerable to the negative impacts of the mining industry. This study recommends the revision of the Regional Regulation to add strict environmental sanctions provisions and strengthen community participation in peatland management to achieve ecological justice that is in line with regional economic development.

Abstract

Penelitian ini menganalisis aspek yuridis penggunaan Artificial Intelligence (AI) dalam transaksi bisnis online, khususnya terkait privasi data dan keamanan konsumen. AI telah meningkatkan efisiensi dan personalisasi layanan e-commerce, namun juga menimbulkan tantangan hukum, terutama dalam perlindungan data pribadi. Dengan metode yuridis-normatif, studi ini mengkaji regulasi seperti UU ITE, UU PDP, dan PP No. 80 Tahun 2019. Hasil penelitian menunjukkan bahwa meskipun regulasi sudah ada, masih terdapat kekosongan dan kelemahan hukum dalam penerapan serta pengawasan. Oleh karena itu, diperlukan penguatan regulasi dan kolaborasi antara pemerintah, pelaku usaha, dan masyarakat guna menciptakan ekosistem bisnis online yang aman dan bertanggung jawab. Studi ini diharapkan dapat berkontribusi dalam memperkuat kerangka hukum terkait AI serta mendukung perlindungan hak-hak konsumen di Indonesia.

Abstract

Corruption is a special crime that is different from general crimes because it requires state financial losses as a basic element. Constitutional Court Decision No. 25/PUU-XIV/2016 emphasizes that corruption must be viewed as a material crime, so that the element of real and definite state losses (actual loss) must be proven investigatively. This concept requires an accurate and final calculation of state losses as part of at least two valid pieces of evidence as specified in Article 184 of the Criminal Procedure Code. This study aims to examine the judge's error in the Pretrial Decision No. 113/Pid.Pra/2024/PN Jkt.Sel, which does not make actual loss a valid piece of evidence in the application of coercive measures against corruption suspects. Using normative research methods through a legal approach and case studies, as well as qualitative analysis, it was found that pretrial judges still use a formal crime approach and accept evidence that does not meet the actual loss standard. This error has implications for legal uncertainty and has the potential to harm the suspect's rights in the criminal process.

Abstract

Kegiatan pengabdian kepada masyarakat ini merupakan implementasi Tri Dharma Perguruan Tinggi yang bertujuan untuk meningkatkan pemahaman masyarakat dan mahasiswa mengenai sistem pembuktian tindak pidana siber di Indonesia. Permasalahan utama mitra adalah rendahnya pemahaman terkait validitas alat bukti elektronik dan disharmoni antara Kitab Undang-Undang Hukum Acara Pidana (KUHAP) dengan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), yang berakibat pada lemahnya tindak lanjut hukum terhadap laporan kejahatan siber. Untuk menjawab permasalahan tersebut, kegiatan sosialisasi dilaksanakan di Kelurahan Sidodadi, Samarinda, diikuti oleh 30 orang mahasiswa dan 20 orang dari mayarakat umum dengan metode ceramah normatif-yuridis, diskusi interaktif, dan studi kasus. Hasil kegiatan menunjukkan bahwa peserta memperoleh peningkatan pemahaman tentang validitas alat bukti digital dari sisi formil dan materiil, serta pentingnya dokumentasi forensik dalam proses penyidikan. Diskusi juga menyoroti perlunya harmonisasi regulasi dan pendampingan hukum bagi korban kejahatan siber agar proses pelaporan tidak terhambat karena kekurangan alat bukti. Kesimpulannya, kegiatan ini berkontribusi dalam memperkuat kesadaran hukum, meningkatkan kapasitas masyarakat dalam menghadapi cybercrime, dan mendorong reformasi hukum acara pidana yang responsif terhadap perkembangan teknologi informasi.

Abstract

Indonesia, as a state based on law as stipulated in Article 1 paragraph (3) of the 1945 Constitution, is obliged to guarantee the protection of human rights, including the rights of children as a vulnerable group. Child protection is reinforced through Article 28B of the 1945 Constitution and Law No. 35 of 2014 in conjunction with Law No. 17 of 2016, which explicitly prohibit all forms of sexual violence against children. Philosophically, child protection reflects respect for human dignity; juridically, it is a constitutional mandate and statutory obligation; while sociologically, it is necessary to prevent the destruction of future generations caused by sexual violence. The urgency of this research arises from the increasing number of sexual violence cases against children and the presence of sentencing disparities, as reflected in Decision No. 21/Pid.Sus/2019/PN Pdp and Decision No. 172/Pid.Sus/2020/PN Sbs. This study aims to analyze judicial considerations in both decisions and identify their implications for victims, perpetrators, and society. The research applies a normative juridical method with statutory and case approaches, supported by primary and secondary legal materials analyzed descriptively and analytically. The findings show that judges based their rulings on Article 82 paragraph (1) of the Child Protection Law, taking into account trial evidence, psychological impacts on victims, and violated social values. However, disparities emerged: six years’ imprisonment with an IDR 800 million fine in the Pdp case, and seven years’ imprisonment with only an IDR 60 million fine in the Sbs case. Such inconsistencies undermine legal certainty and judicial legitimacy. In conclusion, although sentencing has reflected criminal accountability, a balance between retributive and restorative aspects is lacking. Clear sentencing guidelines and stronger protection and recovery measures for child victims are therefore recommended to realize substantive justice.

Abstract

This study examines the legal reasoning employed by judges in resolving civil cases involving insufficient parties (in persona) within credit agreement disputes, and evaluates the consistency of judicial considerations across three levels of the court system: District Court, High Court, and the Supreme Court. The issue arises due to the absence of clear standards regarding which parties must be included in civil lawsuits, particularly in credit agreements that often involve more than two parties. Using a normative juridical method with a statutory and case approach, this research analyzes three decisions: No. 30/Pdt.G/2022/PN WNG, No. 133/PDT/2023/PT SMG, and No. 469 K/Pdt/2024. The findings reveal differing judicial orientations: the District Court prioritizes the substance of default, the High Court emphasizes formal completeness of parties, and the Supreme Court seeks a balance between both. The study concludes that there is no uniformity in judicial assessment concerning party sufficiency in credit agreement disputes, indicating the need for the Supreme Court to issue clear guidelines to ensure legal certainty and the protection of all parties involved.

Abstract

This study examines Constitutional Court Decision No. 224/PHPU.BUP-XXIII/2025, which annulled the results of the 2024 Mahakam Ulu Regency Regional Head Election due to proven serious violations of the principle of neutrality of the State Civil Apparatus (ASN) and abuse of authority by the incumbent regent in supporting his biological child’s candidacy for regional head. Employing a normative juridical method and a case study approach, the research focuses on analyzing the Constitutional Court’s legal reasoning and the juridical implications of annulling the decision of the Mahakam Ulu General Election Commission (KPU). The findings indicate that the actions of the public official in question met the criteria for structured, systematic, and massive (TSM) violations, significantly undermining electoral integrity and fairness. The Constitutional Court’s ruling is regarded as a form of constitutional protection of voters’ rights as well as a reinforcement of the rule of law and substantive democracy. This study underscores the urgency of reforming the electoral oversight system and strictly enforcing the principle of bureaucratic neutrality in the conduct of regional elections in Indonesia.

Abstract

Perdebatan tentang polemik ambang batas dalam pencalonan presiden dan wakil presiden sudah saatnya diakhiri. Demikian juga dinamika koalisi partai politik berpotensid mempengaruhi stabilitas politik dan arah kebijakan pemerintahan. Energi yang dimiliki parpol semestinya dipusatkan dan digunakan untuk memformulasi dan merumuskan agenda perubahan yang subtansial ditengah percaturan dan persiangan global. Penelitian ini menggunakan metode penelitian yuridis normatif dengan menganalisis secara sistematis dan deskriptif. Agenda mendesak yang perlu dilakukan adalah rekonstruksi hukum terhadap presidential threshold dan Koalisi Partai Politik. Kedepan kita berharap agar koalisi partai politik terbentuk didasarkan pada kepentingan politik, kesamaan visi, misi, dan tujuan untuk kebaikan rakyat. Sehingga yang ada hanya satu komitmen, yaitu komitmen dalam mensejahterakan dan memastikan keadilan sosial bagi seluruh rakyat Indonesia sebagaiman yang dimanatkan dalam sila ke 5 dan termaktub dalam konstitusi. Abstract

This research aims to determine the legal provisions regarding judge's decisions that reveal the child's identity. Understand the legal implications of disclosing the identity of child perpetrators or victims of criminal acts in court decisions regarding children's rights. The approach method applied in this research is a normative method, which includes research into the literature studied. Using a statutory approach regarding the protection of children's identities in the criminal justice system, while an empirical approach is used to study the implementation of these regulations in judicial practice, especially in decision number 14/Pid.Sus- Anak/2021/PN Srg. The legal materials used consist of primary legal materials and secondary legal materials. The results of this research are that protecting children in conflict with the law is the state's obligation to protect every right they have. This obligation is aimed at the best interests of the child and prevents the child from being mistreated by any party. One of these rights is that it is not permissible to publish a child's identity in conflict with the law, whether in print/electronic media. A court decision that reveals a child's identity can be considered a criminal offense because it violates legal provisions regarding the confidentiality of a child's identity which must be protected. One of the main principles of child protection is the best interests of the child. In this case, the judge is also obliged to keep the identity of the child as the perpetrator of the crime secret during the trial process. In conflict with the law, children's identities must be kept confidential, both in print and electronic media. Children are the nation's generation and figures who greatly influence the continuity of the nation's life, where they have rights that must be protected, respected and fulfilled. The confidentiality of the identity of children in conflict with the law is one of the rights given to them to protect their reputation.
