Abstract

Law the Republic of Indonesia Number 41 of 1999 concerning Forestry defines Forest is a unit of ecosystem in the form of a stretch of land containing biological natural resources dominated by trees in their natural environment, which cannot be separated from one another, in this research researchers conduct research Large Kerinci Seblat National Park (BBTNKS) and at the location of Kerinci Seblat National Park (TNKS), where this study obtained data that in the TNKS area forest encroachment activities are activities for forest clearing with the aim of owning, controlling and utilizing the results forest without seeing and paying attention to the main functions carried out by a forest area. The forest encroachment activities carried out by the community in the TNKS area for agricultural activities which arise due to the need for agricultural land and only a few people in the TNKS area that has their own agricultural land. In this study discussed two things, namely regarding the authority of regional government supervision in overcoming forest encroachment in the TNKS area and the form of forest encroachment control by BBTNKS in the Kerinci National Park area. The research method used in this study is a non doctrinal (empirical) research method to discuss the incompatibility between dasolen and dasein, and to interview several parties that make it possible to provide information related to ongoing research.

Abstract

Undang-Undang Republik Indonesia Nomor 41 Tahun 1999 Tentang Kehutanan mendefinisikan Hutan adalah suatu kesatuan ekosistem berupa hamparan lahan berisi sumber daya alam hayati yang didominasi pepohonan dalam persekutuan alam lingkungannya, yang satu dengan yang lainnya tidak dapat dipisahkan, dalam penelitin ini peneliti melakukan penelitian pada Balai Besar Taman Nasional Kerinci Seblat (BBTNKS) dan pada lokasi Taman Nasional Kerinci Seblat (TNKS), yang mana penelitian ini mendapat data bahwa dalam kawasan TNKS kegiatan perambahan hutan yang mana kegiatan ini merupakan sebuah kegiatan pembukaan hutan dengan tujuan untuk memiliki, menguasai dan memanfaatkan hasil hutan tanpa melihat dan memperhatikan fungsi pokok yang diemban oleh suatu kawasan hutan. Kegiatan perambahan hutan yang dilakukan oleh masyakat pada kawasan TNKS adalah untuk kegiatan pertanian yang mana timbul dikarenakan adanya kebutuhan lahan pertanian dan hanya sedikit masyarakat yang berada dalam kawasan TNKS yang memiliki lahan pertanian sendiri. Dalam penelitian ini membahas dua hal, yaitu mengenai kewenangan pengawasan pemerintah daerah dalam penanggulangan perambahan hutan di kawasan TNKS dan bentuk penanggulangan perambahan hutan oleh BBTNKS di kawasan TNKS wilayah Kabupaten Kerinci. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian non doctrinal (empiris) untuk membahas ketidak serasian antara dasolen dan dasein, serta mewawancarai beberapa pihak yang memungkinkan memberikan informasi tetrkait dengan penelitian yang berlangsung.

Abstract

Writing this scientific article is a research with normative (doctrinal) research method which aims to find out the legal review of the regulation of revenue sharing of petroleum mining between the central government and regional governments. This study uses an analysis of secondary data that the authors obtained from various literatures using the law approach, conceptual approach and case approach that occurs in everyday life regarding petroleum. The difference in the mechanism of distribution of funds and profit sharing between the central government and local governments results in imbalances in economic growth between all regions in Indonesia. The results of the research and analysis carried out by the authors indicate that the regulation of mintak mining revenue sharing funds between the central government and local governments through general allocation funds, special allocation funds and revenue sharing funds is in line with the objectives of regional autonomy, but lack of attention from the central the regions that have the highest natural resource income and lack of attention to development will lead to inequality between revenue sharing funds from the central government and regional governments. Supposedly with equal distribution between central government and regional government through policies in the form of natural resource priorities, it will create a main goal of the law, namely legal certainty, justice for some people and the last is to provide benefits to the community.

Abstract

Artikel ilmiah ini meneliti mengenai penegakan hukum terhadap kegiatan illegal drilling yang marak terjadi pada Desa Pompa Air dan Desa Bungku Kecamatan Bajubang Kabupaten Batanghari Provinsi Jambi. Sektor minyak merupakan sektor yang sangat membuat sektor ini rentan akan berbagai tindak kejahatan, pencurian minyak terjadi hampir setiap hari dalam tiga modus yaitu illegal tapping, illegal drilling dan penyelewengan bahan bakar minyak (BBM) bersubsidi. Kegiatan pencurian minyak melalui illegal drilling seakan menjadi cerita yang tidak berkesudahan khususnya untuk masyarakat Kecamatan Bajubang Kabupaten Batanghari, semenjak tahun 2017 sudah terdapat empat kasus dan pada tahun 2018 terdapat sembilan kasus dengan 31 orang tersangka yang mana semua di tuntut dengan Undang-Undang Republik Indondesia Nomor 22 Tahun 2001 Tentang Minyak dan Gas Bumi dengan tuntutan empat tahun sampai dengan enam tahun penjara dan denda sebesar 60 Milyar Rupiah. Metode penelitian yang digunakan dalam artikel ilmuah ini adalah metode penelitian nondoktrinal (empiris). Berdasarkan hasil penelitian dilapangan terhadap penegakan hukum terhadap illegal drilling didapat kesimpulan bahwa penegakan hukum terhadap kegiatan illegal linin belum dilaksanakan sevara optimal dikarenakan belum ada payung hukum yang kuat dimiliki oleh pemerintah daerah karena kewenangan untuk menangani penertiban dari kegiatan illegal tersebut merupakan wewenang dari pemerintah pusat.

Abstract

This research focuses on the implementation of Village Funds in Jambi Luar Kota Subdistrict, Muaro Jambi Regency in the preservation of customary villages, where villages are autonomous regions with the passing of Law Number 6 of 2014 concerning Villages. The Village Law also provides a breath of fresh air regarding the escape of customary villages, where the previous regulations have not yet brought back the customary village clearly and firmly, but with the emergence of the Village Law it is sufficient to accommodate the Village to continue to maintain and maintain the values ​​of local wisdom. This study uses a descriptive approach, with interview data collection techniques. The Village Adat Institution must be able to cover all aspects, both in terms of customary Village management, supervision of traditional villages, customary Village government to customary Village Regulations, with the presence of Customary Institutions and having a significant role in maintaining and maintaining local cultural values ​​amidst diversity. in society, being able to implement its role without injuring the law, religious values, diversity and so on, but accelerating the realization of an Independent Village without having to erode the original culture of Jambi Luar Kota Subdistrict. The results of this research show that the implementation has been proven proven by ratifying it. The customary institutions in Jambi Luar Kota Subdistrict, it's just not optimal, because the Customary Institution is still focused on internal organizations, customary village regulations and the procurement of Sombolis infentary which is considered one of the local cultural treasures.

Abstract

The existence of exploitation of forest resources that are dangerous for the survival of the forest is illegal logging activities carried out without going through a selection or selective logging process and permission from the government. So related to this, this scientific article discusses the "Authority of Illegal Logging Timber Auctions," using normative juridical research methods. The normative juridical research approach is a legal research with a literature approach that is carried out by conducting research on library materials or mere secondary data. As for what is studied in this scientific article is about the mechanism of auctioning confiscated wood from illegal logging outside the conservation forest of Jambi Province. So based on this, it is obtained data that related to the auction of confiscated wood from illegal logging outside the conservation forest of Jambi Province, those who have authority in cases of confiscated wood are the forestry service and investigators/public prosecutors. However, there are also contradictions in the rule of law related to the auction of illegal logging results, namely between Article 23 number (1) of the Minister of Finance Regulation Number 213/PMK.06/2020 and Article 4 Number 2 of the Minister of Forestry Regulation Number P. 47/Menhut-II/2009 regarding the Amendment to Regulation of the Minister of Forestry Number P.48/Menhut/2006.
