Abstract

Abstract

Introduction to The Problem: Motive, if related to crime, refers to the urge contained in the mental attitude of the actor to implement that mens rea in an act that is committed to a crime actus reus. The incorporation of motive in cases involving premeditated murder under the legal framework of Article 340 of the Indonesian Criminal Code remains a contentious issue, lacking a consensus. While some individuals posit that premeditated murder necessitates the presence of a motive, contrasting viewpoints contend that the crime can be established without requiring evidence of a motive.Purpose: This study aims to provide an overview and analysis of the significance of understanding motives as a means for judges to find out the background of the premeditated murder so that the panel of judges renders a decision accurately and proportionately.Methodology: The method used in this research is the normative juridical approach that focuses on the study of literature and legislation with the specifications of analytical descriptive research.Findings: The study suggested that Article 340 of the Criminal Code lacks a comprehensive explanation of the presence of motives. Consequently, the implementation of motives is limited to the interpretation provided by legal scholars and the subjective discretion of the presiding judge in each individual instance. In the absence of an interpretation of this motive, the Panel of Judges is not obliged to find a motive for the murder. As a result, this leads to different decisions, some resulting in acquittal and others in conviction of the defendant, because the judge did not discover a motive for the murder during the presentation of evidence. Meanwhile, according to the Indonesian version of the Criminal Code, namely Law No. 1 of 2023, the existence of the motive is mandatory in sentencing as stated in Article 54 paragraph (11) sub b of the Criminal Code.Paper Type: Research Article

Abstract

Translation quality refers to how accurately, fluently, and appropriately a translated text conveys the meaning, tone, and intent of the original (source) text in the target language. High translation quality ensures that the target audience receives the message as intended, without confusion, distortion, or loss of meaning. The primary objective of this study is to evaluate the quality of translated children's storybooks from English into Indonesian. This research adopts a qualitative method by analyzing available data sources using a translation quality assessment instrument based on the model developed by Nababan et al. The data were obtained from storybooks published on the official website of the Language Development and Fostering Agency, and their translations were examined using the TQA model. The study aims to assess the translation quality in terms of accuracy, acceptability, and readability in accordance with the TQA framework. The findings reveal a considerable discrepancy between the translation from the perspective of the source language and that of the target language. These results underscore the importance of applying the TQA model to assess translation quality in order to produce natural and acceptable translations in the target language.

Abstract

This study investigates the preservation of imaginative and mythological components in the Indonesian translation of J.R.R. Tolkien's "Far Over the Misty Mountains Cold." The words are abundant in fantastical places, mythical figures, and vibrant natural imagery that establish an enchanting ambiance. Translating such a text necessitates meticulous attention to preserve symbolic significance, aesthetic elegance, and cultural subtleties. This research employs a descriptive qualitative methodology utilizing comparative text analysis between the source and target texts. The results indicate that although the translation effectively preserves mythical names and the fundamental narrative structure, essential poetic elements like melody, rhyme, and metaphorical richness are often diminished. This influences the interpretive depth and the poetic ambiance of the original. The study emphasizes that while the fundamental content is retained, the preservation of poetic aesthetics is a significant challenge. It suggests further solutions including footnotes, adaptable rhythmic variations, and innovative methods to maintain the imaginative and symbolic dimensions for the intended audience.

Abstract

Project-Based Learning (PBL) is known as a student-centered approach that fosters active learning, cooperation and authentic use of language in English as a Foreign Language (EFL) class. This study explores EFL learners’ opinions and experiences of PBL, especially their motivation, engagement, attitudes, preferences, obstacles, and support needs. The design was an explanatory sequential mixed techniques design. Quantitative data were collected from 135 undergraduate EFL learners through a structured questionnaire, and qualitative data were obtained through open-ended questionnaire replies to give more in-depth insights into learners’ experiences. Descriptive statistics were used to evaluate quantitative data and qualitative responses were thematically analyzed. The results indicated that learners’ perceptions of PBL were typically good. The perception item that received the highest score was “PBL makes English learning more interesting” (M = 4.06, SD = 0.95) while the highest score for motivation and engagement was active participation during project activities (M = 3.98, SD = 0.92). Learners also indicated positive perceptions about PBL, with the statement “I participate more when project topics are interesting” having the highest mean score (M = 4.11, SD = 0.96). The most preferred characteristic of PBL was creative activities (82.2%), followed by technological integration (63.7%). The most important criteria driving participation were interesting themes for projects (85.9%) and the opportunity to develop new skills (74.1%). Learners experienced some drawbacks with these benefits including Unequal group involvement (74.1%), Communication problems with group members (65.9%) and concerns over unfair marks (56.3%). The most important sorts of assistance for teachers were feedback (84.4%) and clear guidance (83.0%). The study suggests that PBL offers significant collaborative and engaging English language learning experiences. However, its success depends on good group administration, open assessment processes and continued teacher assistance.
