Abstract

This study explores the philosophical foundations of the objectives of Islamic law (maqāṣid al-sharī‘ah) through a systems approach as articulated by Jasser Auda in his work Maqāṣid Asy-Syarī‘ah Kafalsafah li At-Tasyri‘ Al-Islāmī: Ru’yah Mandhumiyah. The urgency of this research lies in the increasing demand to reinterpret Islamic law in order to address the complexities of contemporary society while maintaining its foundational principles. This study employs a qualitative method with a library research approach, focusing on Auda’s conceptual framework and its implications for the philosophy of Islamic law. The findings reveal that Auda’s systems approach redefines maqāṣid as a dynamic and holistic framework emphasizing justice, public interest, and human dignity. This perspective challenges rigid textual interpretations and proposes a flexible methodology that aligns Islamic law with the realities of modern life. Auda’s approach significantly contributes to contemporary discourse on Islamic jurisprudence by presenting maqāṣid as a living philosophy capable of adapting to evolving societal contexts

Abstract

This Community Service Program (Pengabdian kepada Masyarakat/PKM) focuses on strengthening the regulatory framework and management capacity of Village-Owned Enterprises (BUMDes) as a strategic instrument for local economic development. The program aims to optimize BUMDes management in fostering a creative, tourism-based village in Pademawu Timur Village, Pamekasan Regency. The main challenges faced by the community partner include limited understanding among BUMDes managers and village stakeholders regarding the roles, governance mechanisms, and regulatory foundations of BUMDes in supporting social services and sustainable village economic development. The program employed a participatory and sustainable community development approach involving 28 participants, consisting of BUMDes managers, village officials, local MSME actors, and community representatives. The activities were implemented through three sequential stages: (1) socialization of BUMDes roles and regulatory frameworks; (2) educational sessions on BUMDes governance, collaborative governance, and the entrepreneurial ecosystem; and (3) training and mentoring on optimizing BUMDes management through the integration of village tourism potential and local MSMEs. The results indicate a significant improvement in participants’ awareness and understanding of BUMDes as a village economic institution oriented not only toward profit generation but also toward community empowerment, professional governance, and business sustainability. This program is expected to strengthen BUMDes institutional capacity, promote the development of competitive village-based tourism, and contribute to inclusive and sustainable improvements in community welfare and the local village economy.

Abstract

The implementation of ḥawālah (transfer of debt liability) and kafālah (guarantee) in Indonesia’s Islamic banking reveals an increasing tension between formal Shariah compliance and institutional risk management imperatives. Although classically categorised as tabarruʿ-based and non-profit contracts, contemporary practices reposition them as fee-generating instruments and risk transfer mechanisms, raising concerns about substantive alignment with Islamic legal and ethical principles. This study critically examines the extent to which modern applications of ḥawālah and kafālah reflect their classical fiqh foundations and maqāṣid al-sharīʿah objectives, and analyses how regulatory frameworks and institutional risk management influence their reinterpretation. Using a normative, legal and comparative approach, the research analyses classical fiqh al-muʿāmalāt doctrines, AAOIFI Shariah standards, DSN–MUI fatwas, and Indonesia’s positive law governing Islamic banking, supplemented by semi-structured expert interviews. This analysis is based on two expert interviews with members of Shariah Supervisory Boards and DSN–MUI-affiliated practitioners involved in Islamic banking governance.The results reveal a significant conceptual and functional shift, where formal Shariah compliance often masks substantive transformation into institutional risk management tools, evidenced by fee-based structures, hybrid contractual arrangements, and standardised product designs that prioritise institutional risk governance over the original altruistic rationale of tabarruʿ. Empirical signals from the interviews indicate recurring fee structures exceeding administrative cost recovery thresholds, implicit use of ḥawālah in transfer products without explicit contractual labelling, and kafālah arrangements structured similarly to risk-priced service contracts. The study highlights the need for clearer governance standards and substantive regulatory guidance to mitigate Shariah dilution while accommodating legitimate risk management needs. From a policy perspective, regulators should establish clearer criteria for permissible fee structures and hybridisation boundaries to ensure alignment with maqāṣid al-sharīʿah while maintaining financial stability. By reconceptualising ḥawālah and kafālah as hybrid institutional contracts, this research advances a maqāṣid al-sharīʿah–oriented evaluative framework that transcends procedural conformity toward ethical and institutional coherence.

Abstract

Kemampuan bahasa Inggris, khususnya pada aspek Structure and Written Expression dalam tes TOEFL, masih menjadi  tantangan  bagi  banyak  mahasiswa,  termasuk  mahasiswa  pada  program  studi  Ekonomi Syariah. Keterbatasan penguasaan tata bahasa (grammar), minimnya latihan terarah, serta kurangnya pembiasaan  dalam  mengerjakan  soal-soal  TOEFL  menjadi  faktor  yang  menyebabkan  rendahnya kemampuan peserta dalam memahami struktur kalimat bahasa Inggris secara tepat. Kondisi ini berdampak pada belum optimalnya kesiapan mahasiswa dalam menghadapi kebutuhan akademik dan profesional yang mensyaratkan sertifikasi kemampuan bahasa Inggris. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk  meningkatkan  pemahaman  dan  keterampilan  mahasiswa  dalam  mengerjakan  soal  TOEFL  pada bagian Structure  and  Written  Expression.  Selain  itu,  kegiatan  ini juga  bertujuan  untuk  meningkatkan kemampuan  analisis  tata  bahasa  serta  strategi  dalam  menjawab  soal  secara  efektif  melalui  pendekatan pembelajaran interaktif. Metode pelaksanaan kegiatan dilakukan melalui pelatihan partisipatif yang terdiri dari pemaparan materi (presentasi), sesi tanya jawab interaktif, serta pengerjaan soal TOEFL secara bersamasama yang disertai pembahasan langsung. Kegiatan ini dilaksanakan pada tanggal 23 April 2026 di Fakultas Keislaman Universitas Trunodjoyo Madura dengan peserta sebanyak 60 mahasiswa Program Studi Ekonomi Syariah. Hasil kegiatan menunjukkan bahwa peserta mengalami peningkatan pemahaman terhadap konsep dasar struktur kalimat bahasa Inggris serta mampu menerapkan strategi pengerjaan soal TOEFL secara lebih sistematis. Melalui sesi diskusi dan pengerjaan soal bersama, peserta menjadi lebih aktif, responsif, dan mampu mengidentifikasi kesalahan struktur kalimat dengan lebih baik. Kegiatan ini terbukti efektif  dalam  meningkatkan  kompetensi Structure  and  Written  Expression TOEFL  mahasiswa  serta memberikan pengalaman belajar yang lebih interaktif dan aplikatif.

Abstract

This study addresses a gap in existing scholarship on Sufi orders, which has largely focused on individual spiritual experience while paying limited attention to socio-religious transformation within urban religious communities. It examines how members of the Qadiriyah Naqshbandiyah Order (TQN) at PP Sabilul Muttaqin in Mojokerto City construct religious meaning and experience socio-religious transformation in an urban context. Using a qualitative approach with an interpretative phenomenological design, the study involved disciples, pesantren administrators, and key religious figures, including the mursyid and khalifah. Data were collected through in-depth interviews, participant observation, and document analysis, then analyzed using Interpretative Phenomenological Analysis (IPA) supported by social construction and social change perspectives. The findings demonstrate that the urban tarekat community functions not only as a space for spiritual practice, but also as a socio-religious institution that shapes collective behavior and social engagement. Religious rituals and guidance within the tarekat encourage stronger religious discipline, self-control, solidarity, and active participation in community life. In the urban setting of Mojokerto City, the tarekat also provides members with moral orientation and social stability amid the challenges of modern urban life. The study highlights the novelty of understanding urban tarekat communities as agents of socio-religious transformation that integrate spirituality with everyday social practices. It further suggests the need for comparative and longitudinal studies on the sustainability of tarekat-based transformation in contemporary urban societies.

Abstract

The rapid development of the Islamic finance industry requires adaptive legal reasoning capable of responding to the increasing complexity of modern economic transactions. In Indonesia, fatwas issued by the National Sharia Council of the Indonesian Ulama Council (DSN-MUI) play a crucial role in establishing the normative framework of Islamic economic practices. This study aims to examine the use of necessity-based legal maxims (qawāʿid al-ḍarūra) in DSN-MUI fatwas and to analyze their methodological implications for the development of contemporary Islamic economic jurisprudence. Employing a qualitative approach with documentary analysis and content analysis methods, this research analyzes 165 DSN-MUI fatwas issued during the early phase of Islamic economic development in Indonesia. The findings reveal that 89 fatwas, representing approximately 53.9% of the total sample, explicitly employ legal maxims related to necessity, harm removal, or urgent need as the basis of legal reasoning. The most frequently applied maxims include al-ḍarar yuzāl, al-ḍarar yudfaʿ bi-qadr al-imkān, and al-ḥājah tanzil manzilat al-ḍarūra. These maxims are predominantly applied within sectors characterized by high transactional complexity, particularly Islamic banking, Islamic capital markets, and modern financial industries. The findings indicate that necessity-based maxims no longer function solely as exceptional mechanisms in classical Islamic jurisprudence but have evolved into methodological tools for adapting Islamic law to the dynamics of modern economic systems. This study contributes to the theoretical discourse on Islamic legal methodology by highlighting the strategic role of qawāʿid fiqhiyyah in the evolution of contemporary fiqh al-muʿāmalāt

Abstract

The expiration of the phased implementation of mandatory halal certification on 17 October 2024 marked a transition from a facilitative to an enforcement-oriented policy phase, creating significant implementation pressures for local governments and micro and small enterprises facing legal, market, and administrative risks. While previous studies have examined halal certification from normative legal and governance perspectives, limited research integrates empirical public policy analysis with a maqasid al-syarī’ah framework to evaluate local government interventions during this post-transition period. Using a qualitative policy analysis approach, this study identifies six local intervention strategies: structured multi-stakeholder coordination; optimization of the self-declare assistance scheme; targeted digital literacy and social media outreach; affirmative programs for remote villages; development of a regional Halal Hub ecosystem; and preventive regulatory socialization for the 2026 mandatory phase. Empirically, 4,053 halal certificates were issued by January 2026, 3,933 through the self-declare scheme, with over 90% of assisted MSMEs completing registration on time. These results indicate that proactive facilitation and adaptive local governance significantly reduced non-compliance risks during the transition. From a maqasid al-syarī’ah perspective, the interventions operationalize multidimensional protection: religion (hifz al-dīn), life (hifz al-nafs), wealth (hifz al-māl), intellect (hifz al-’aql), and lineage (hifz al-nasl). Conceptually, this study proposes a maqasid-based evaluation model linking Islamic normative principles with measurable governance indicators. Theoretically and practically, it positions maqasid as an applied analytical framework and provides evidence-based guidance for adaptive and sustainability-oriented halal governance.
