Abstract

The religious authority held by Islamic institutions is often confronted with issues of gender discrimination. In the modern era, Islamic organizations are faced with gender problems related to husband-wife relations in urban muslim communities. The proliferation of gender-biased narratives on social media and the shift in religious authority has challenged the discourse on gender equality in urban muslim communities. Meanwhile, in its development, Islamic organizations have produced progressive fatwas that show the movement for gender justice. This research uses Equilibrium Theory to analyze the periodic decisions of the Majelis Tarjih and Tajdid Muhammadiyah regarding the relationship between husband and wife. The results of the decision will be categorized through the typology of Islamic thought according to Ziba Mr-Hossen. This research is literature research that uses primary data in the form of decisions of the Majelis Tarjih and Tajdid Muhammadiyah compiled in Adāb al-Mar'ah fi al-Islām in 1982 and Keluarga Sakinah in 2014. The data was collected using the documentation method and analyzed using the content analysis technique. The results showed that the discourse of gender equality in Muhammadiyah influenced the balance of husband and wife roles in the Sakinah Family decision. The influence of gender equality does not necessarily make the results of the Sakinah Family decision fall into the category of modernism that is very open to Western thought. However, the decision only reaches the typology of neotraditionalism as a reflection of the moderatism of thought. The reason is that the fatwa decision still adopts the thoughts of classical scholars while still carrying the theme of renewal (tajdīd). Through its ijtihād, Muhammadiyah can create an inclusive dialogue space, accommodate various perspectives, and reflect the spirit of justice in the context of the diversity of urban muslim communities. This research is expected to be a symbol of dialogue between the discourse of gender equality and traditional religious authorities so that the dialectic can produce fatwas that are by the times.

Abstract

In an increasingly dynamic and modern urban context, understanding Islamic family law has become essential for Muslim individuals. This article aims to evaluate the level of understanding of the Gresik urban community about Islamic family law and how this law can be applied in everyday life. This study used a quantitative approach by distributing questionnaires to 56 respondents selected purposively from the Muslim community population in RT RW Gresik City, East Java. The research results show that in Gresik, the majority of respondents (76-100%) have a good understanding of Islamic family law, which is indicated by positive responses to the statements in the questionnaire, even though there are several obstacles faced by the head of the family such as inability to apply it practically due to diverse environmental conditions in society. This research contributes to understanding the perspective of urban Muslim communities towards Islamic family law and formulating policies and strategies appropriate to this era.

Abstract

Laws and regulations in Indonesia have regulated the existence of a new regulation on the marriage age limit, namely 19 years applicable to men and women, as stipulated in Law Number 16 of 2019 in response to the birth of the Constitutional Court Decision Number 22/PUUXV/2017, the marriage dispensation will be granted if two conditions are met, namely; First, it is urgent and has Second, it has sufficient evidence. This rule often makes it difficult for the community, so finally, many efforts to dispense Marriage are carried out to be able to carry out marriage contracts formally among urban Muslims. The problem is how the judge's efforts in responding to the application for marriage dispensation for children far from the minimum age limit of Marriage, which is 19 years for men and women, and what is their contribution to efforts to reform the marriage law in Indonesia? This research aims to contribute new thinking to the reform of marriage law scientifically and logically. This research is a type of literature research, with a scientific-ratio approach to the minimum age limit for Marriage in Law Number 16 of 2019, with the theory of sadd al-dzariah as an effort to be able to present legal justice. The conclusion is that the determination of the judge of the Religious Court regarding the dispensation of Marriage for urgent reasons is the main argument, so there are often decisions on marriage dispensation at the age of under 16 years. However, according to the evidence submitted, sadd al-dzariah is a solution that logically violates the scientific ratio rules.

Abstract

Tasawwuf is a part of the study that can explore mysticism in life to get nearer to God. The modern era has disrupted the essence of the role of religion and metaphysics to be something more material and substantial. As a consequence, there is a development of Islam with socio-moral reconstruction of urban society which is called neo-Sufism. The aim of this research is to see how Sa'id Nursi tried with his 'Aql (intellect) and Qalb (heart) to comprehend the al-Qur'an in order for human beings to reach the haqiqi (ultimate) truth. The type of this research is literature research (library research). In this regard, it is more focused on studying, analyzing, researching, and understanding the renewal of Sufism in the book of Kulliyyat Risale-I Nur. A thematic approach is also employed in interpreting Sa'id Nursi's Sufism. The finding in this study is that Said Nursi had provide neo-Sufism in tasawwuf is by making nature as a mediator between man and God by including an element of fikr between dzikr and shukr, where the other Sufis only use dzikr and shukr without fikr, for achieving makrifatullah. Also, it provides a reformation of Sa'id Nursi's tasawwuf in relation to the contextual-conditional factors and the spiritual aridity of twentieth-century urban Moslem society. Therefore, this neo-Tasawwuf could potentially serve a more positive functional role in contemporary society in all aspects.

Abstract

A strong philosophical foundation in the management of santri alumni management is expected to maintain the values that have been instilled during the education process in Pesantren when they are already in the community. However, modernity and reality in urban areas become a challenge for alumni in maintaining the religious character formed on traditional values in pesantren. The purpose of this article is to examine the implementation of the Panca Dharma and Panca Jiwa paradigms in the management of alumni and pesantren networks in urban areas. This research is a descriptive-analytical qualitative research using a case study approach. Primary data is in the form of observations and interviews with figures in the alumni management process at Pesantren Darunnajah and Pesantren Darussalam Gontor. While secondary data is in the form of written sources and scientific references including books, journal articles, theses, and theses related to the research topic. Data were collected using observation and interview methods and analysed using the content analysis method. The results showed that the principles of Panca Dharma and Panca Jiwa are formed on the emotional relationship between santri and kyai, which results in obedience and compliance. This is an effort of pesantren in maintaining religious santri in urban areas to remain in the frame of religious attitude inclusivism. Alumni's pride and appreciation for the pesantren can be seen from their awareness of worship and achievement in the community. Through a strong philosophical foundation, pesantren have succeeded in giving birth to thousands of alumni with various professions such as politicians, judges, businessmen, clerics and religious leaders with their pesantren, officials of state agencies, private sector, military and others. The orientation of pesantren education that prioritises society makes them more flexible in moving amid the dynamics of urban reality.

Abstract

Animal trafficking in Medan City often involves illegal practices, including udder engineering. This research aims to analyze this practice within the framework of Sharia economic law, particularly through the lens of relevant Hadiths, and to provide actionable recommendations based on the findings. A qualitative approach, utilizing literature analysis, was employed to gather data from Hadiths, fatwas of Islamic scholars, and related Sharia economic law literature. The analysis was conducted both descriptively and analytically to explore the Sharia implications of udder engineering. The results indicate that udder engineering is a form of fraud explicitly prohibited in Islam. A Hadith narrated by Abu Hurairah forbids the mixing of milk from camels or goats to deceive buyers, allowing them to return the animal within three days if deceived and receive compensation. Sharia economic law emphasizes honesty, fairness, and transparency in trade. Udder engineering violates these principles by deceiving buyers, constituting a form of tadlis (fraud) that is prohibited in Islamic law. The study concludes that udder engineering not only undermines market trust and integrity but also directly contravenes key principles of Sharia economic law, particularly those related to honesty and fairness in transactions.

Abstract

This research examines the legal certainty of joint property, defined as assets jointly acquired by spouses during marriage, particularly within the context of urban Muslim society. Using a descriptive-analytical method, it explores the relevance of joint property in the lives of married couples and its division post-divorce. The study highlights the legal ambiguities in Indonesia's current framework, particularly in Law No. 1 of 1974 on Marriage and the Compilation of Islamic Law (KHI). These regulations often fail to address modern family dynamics, such as when the wife is the primary breadwinner. This gap has resulted in inconsistent rulings in religious courts, particularly in urban areas where economic roles and gender dynamics are rapidly evolving. Focusing on the Bandung High Religious Court, the research emphasizes the importance of equitable asset division that reflects fairness, justice, and the lived realities of urban Muslim families. Findings suggest that while courts generally provide justice and legal certainty, there is a growing need for updated legal interpretations that accommodate changes in societal roles and expectations.

Abstract

This study explores the implementation of character education in two urban-based student Islamic boarding schools affiliated with Islamic universities in Yogyakarta: The Islamic University of Indonesia (UII) and Ma’had Aly bin Abi Talib at Muhammadiyah University of Yogyakarta (UMY). While character education is a key feature in both classical and modern pesantren, this research investigates how these two institutions adapt their strategies to address the moral and social challenges faced by contemporary urban Muslim students in higher education contexts. Using a qualitative field approach, data were collected through interviews with caregivers, lecturers, and students, as well as observations and institutional document analysis during the 2022–2023 academic year. The findings reveal that UII emphasizes structured mentoring, leadership development, and integrative academic-religious programs, while UMY focuses on project-based learning through da’wah and tahfidz activities to shape students’ religious, social, and leadership character. Unlike pesantren in rural or traditional contexts, these urban-based institutions integrate academic demands, digital technology, and modern social dynamics into their character education framework. This study contributes to a contextual understanding of character development for contemporary urban Muslim students in Islamic higher education institutions.

Abstract

This paper argues that the National Commission on Muslim Filipinos (NCMF) plays a vital role in facilitating the inclusion and participation of marginalized Muslim minorities into the Philippine nation-state's development framework. While there have been extensive studies on how Wasaṭiyya was adopted by some Southeast Asian countries, little is known about this principle in the Philippines and how the government can utilize its state institutions like NCMF to address inclusion and welfare of its Muslim minority population. This study asks: How does the NCMF embodies and implements Wasaṭiyya principles in its mandates and programs for Muslim Filipinos? Specifically, through its diverse government programs and activities across key domains, NCMF substantively actualizes the principles of Wasaṭiyya - the Islamic values of moderation, justice, balance, ease, striving for excellence, and public good. The NCMF was chosen as the focus due to its unique position as the primary state body for Muslim affairs, offering a contemporary lens on minority governance. Thereby, it translates the abstract philosophical virtues into practical accommodation policies and arrangements that oblige the state's commitments and responsibilities towards respecting and upholding the identity, rights, welfare, and dignity of Muslim Filipinos. Furthermore, this paper argues that rather than coercive assimilation under a forced 'Filipino' identity construction, the Philippine government’s accommodation policies through the NCMF's cultivation of cultural sensitivity allow groups to access equitable progress and development of Muslim Filipino minorities. NCMF’s interventions enable vulnerable minorities to transition towards becoming stakeholders shaping an inclusive shared future. Institutionalizing Wasaṭiyya through the NCMF is crucial for the Philippines as it provides a culturally sensitive approach to Muslim minority integration, potentially mitigating historical tensions and fostering sustainable peace. Embedding Wasaṭiyya principles in responsive governance infrastructure, the NCMF plays an invaluable role in reconciling the Philippines' complex past tensions between state and minorities to effect sustainable conflict transformation through prudent accommodation.
