Abstract

Decision of the Constitutional Court Number 69/PUU-XIII/2015 and the Compilation of Islamic Law is one of the main foundations in marriage negotiations. MK Decision No. 69/PUU-XIII/2015 becomes a forum for positive law, and the Compilation of Islamic Law becomes an interpretation that makes it easier for people to understand marriage agreements in accordance with Islamic law. The purpose of this study was to determine the relevance and legal consequences of the Constitutional Court Decision Number 69/PUU-XIII/2015 and the Compilation of Islamic Law regarding marriage agreements. This research method uses normative juridical, with a traditional review approach to analyze data. The results of this study indicate, 1) The relevance of the two rules, namely the Constitutional Court Decision Number 69/PUU-XIII/2015 and the Compilation of Islamic Law have the same goal, namely to have a positive impact on households. The agreement was also made as an effort to respond to negative impacts if a bad possibility occurs, namely divorce in the household. 2) Separation of assets that are part of the marriage agreement is permissible as long as it does not conflict with applicable law. The legal consequences proposed in the marriage agreement, if the agreement is made according to the applicable provisions, then it has binding consequences and must be obeyed.

Abstract

Resolving illegal fishing through penalties does not necessarily result in justice for the parties. Theoretically, legal experts state that there are weaknesses in resolving cases using penalty measures. The typology of this research is sociological juridical. The data source comes from the primary data and is supported by secondary data consisting of primary, secondary and tertiary legal materials. The data collection method was carried out using directed interviews with sources and literature study. Data processing and analysis was carried out qualitatively using inductive methods. The urgency of using restorative justice in resolving illegal fishing is to minimize the weaknesses of penalty efforts which emphasize the element of retaliation solely for mistakes that have been made by providing suffering so that the perpetrator will repent. The concept of restorative justice places greater emphasis on restoring damage to be repaired by the perpetrator based on the agreement of the parties. Apart from that, it will also be able to lower the accumulation of cases in law enforcement agencies so that it will also reduce the overcapacity of correctional institutions which become a problem in Indonesia. The model for resolving illegal fishing using restorative justice in the Karimunjawa conservation area can be implemented with the criteria that the perpetrator is a local resident of Karimunjawa whose citizenship is an Indonesian and the losses incurred are not too large, both in terms of the number of fish and in terms of environmental damage and this is the first time this criminal act has been committed.

Abstract

This paper examines the Indonesian Ulama Council (MUI) fatwa in responding and tackling the spread of COVID-19 in Indonesia using the Maqashid Sharia perspective. Maqashid Sharia is the objective of Islam contained in every enforcement of religious rules. The approach used is juridical-phenomenological. Juridically, a fatwa can be an alternative law in dealing with the spread of COVID-19. The phenomenological approach seeks and discovers the meaning of essential phenomena regarding handling COVID-19 cases in Indonesia. The result shows that Maqashid Sharia applied in the MUI fatwa in avoiding COVID-19 appear in four aspects: First, maintaining health and avoiding everything that may cause exposure to the disease. Second, people affected by the COVID-19 disease are obliged to isolate themselves so that transmission does not occur to others. Third, it prohibits activities involving public gatherings and worship at home to break the chain of distribution of the COVID-19 virus. Fourth, prohibit all actions that cause panic and cause public harm, such as buying up and hoarding necessities, hand sanitizers, and hoarding masks. These four aspects relating to the Maquashid Sharia, follow its core values, which ultimately guard the soul.

Abstract

The aim of this article is to analyze and uncover the legal istinbāt̩ methodology used by the Nahdlatul ‘Ulama Advisory Board (LBMNU) in constructing the book of disability jurisprudence. To the best of the author's knowledge, there has been no prior article discussing this matter. This discourse is highly significant for discussion, as the book serves as a reference for Muslim individuals with disabilities in the field of jurisprudence, encompassing matters of worship, transactions, and law. The methodology employed in this research is library research, utilizing a content analysis approach. The research findings indicate that LBMNU constructs disability jurisprudence using three methodologies: Qouliy, Ilḥaqiy, and Manhajiy, with some fatwas found to employ a collaborative (mixed) method. The Qouliy method remains the most frequently utilized, followed by the Manhajiy, collaborative, and Ilḥaqiy methods. These three methodologies stem from the decisions of the National Assembly of Islamic Scholars and the National Conference of NU in Bandarlampung regarding the legal decision-making system in the Nahdlatul Ulama Advisory Board. Thus, in formulating the book of disability jurisprudence, LBMNU continues to utilize these three methods, while still considering the welfare of individuals with disabilities.

Abstract

The design of the regional elections (Pilkada, Pemilihan Kepala Daerah) court as a mechanism for resolving disputes over the results of the regional elections is experiencing changing dynamics. The dynamics of these changes are due to the different interpretations of Indonesia’s Constitutional Court (Mahkamah Konstitusi) on the regional election provisions in the 1945 Constitution. This study seeks to elaborate in depth on the inconsistencies in the Constitutional Court's interpretation of the constitutionality of regional elections, which caused ambivalence in the design of regional election dispute resolution. It employs a normative legal research model and a case approach. This research also shows the Constitutional Court's process and articulation of constitutional interpretation in constructing regional electoral justice. Based on the analysis, this study concludes that the shift in the constitutionality of regional election dispute resolution is caused by the constitutional interpretation of the phrase "democratically elected" in Article 18 paragraph (4), which has been interpreted dynamically and differently by the Constitutional Court. This is proven in several decisions, including Constitutional Court Decision No. 072-073/PUU-II/2004, No. 97/PUU-XI/2013, and No. 85/PUU-XX/2022. In line with developments in the constitutionality of general elections (Pemilu, Pemilihan Umum), the Constitutional Court has reconstructed regional elections as part of the general election. The Constitutional Court will always have the ability to settle regional election disputes. As a result, to protect electoral justice, it is vital to improve legislation and enhance the institution.

Abstract

Polygamy is one of the actions that many men even desire even though many women refuse to be polygamous, but there are also some women who are willing to be polygamous with certain guarantees and conditions. Polygamy is very influential in the division of the household, this problem can be solved by using persuasive communication even though this is not the main factor to increase the harmonious family after polygamy. This study aims to analyse what efforts are made by married couples in re-improving family harmony after disputes due to polygamy, what models and principles of persuasive communication are used by husbands in persuading wives after quarrels due to polygamy. This research uses descriptive qualitative research. This research uses data collection techniques of observation, interviews, and documentation. Data analysis techniques use data reduction and conclusion drawing, and data validity with triangulation. The results of the study show that efforts to improve family harmony after polygamy can be done by persuading and convincing the wife, making a stamped agreement letter to divorce the second wife, asking for prayer and guidance from a kyai, and a husband arguing how his children will fare when fighting and divorcing. In the persuasive communication model, a husband uses probabilogical persuasiveness, and in the principle of persuasive communication, a husband uses the principle of hope.

Abstract

Corruption is one of the crucial problems in Indonesia which until now has not been able to be handled. Corruption occurs in almost all lines and structures of government, from the executive, and legislature to the judiciary, from government at the central level to the regional level. This research has the specific objective of examining the regulation of social sanctions in eradicating corruption in Indonesia from a sociological perspective. Methodologically, this research is library research conducted using a qualitative approach. After analyzing field data using the perspectives of legal sociology and corruption sociology, this study found that the idea of eradicating corruption through setting social sanctions from a sociological perspective means exile or castration. Social sanctions in this context contain the meaning of maximizing the social structure and institutions of society in an effort to exercise direct control as much as possible, both in the process of prevention and prosecution. These social institutions include educational institutions, political institutions, family institutions, religious institutions, and of course legal institutions.

Abstract

This article departs from the interlegality of marriage laws in Jambi society today, which discusses sumbong marriages. Sumbong marriage itself is a marriage that is legal according to religion, state, and custom. However, the ability to marry sumbong itself is considered valid by carrying out a customary settlement first, which was initially prohibited by customary law. The prohibition on marriage in Indonesia is contained in Article 8 of Law Number 1 of 1974 concerning Marriage and Article 39 of the Compilation of Islamic Law. Departing from this phenomenon, the author tries to examine the writing, which includes the implementation of marriage law in the Jambi community, the legal pluralism of the Jambi community, and the interlegality of customary, religious and state law in the marriage law of the Jambi community. The type of research carried out by the author is field research (Field Research) with qualitative methods. The nature of this research is analytical descriptive research. The approach used by the authors is a sociological empirical approach with interlegality. The author's findings clearly show that legal interactions in this tradition involve interactions between several laws, including religious, state, and customary laws used in sumbong marriage practices. By applying the legal interlegality theory approach, customary law, state law, and religious law become one unit. The concept of interlegality is found in adopting the values contained in the sumbong marriage tradition, whether based on state law, Islamic law, or Jambi customary law. This adoption process is based on the characteristics of the Jambi community's legal identity and its social environment, which is still steeped in customs, and the community also upholds the norms that apply in society and adheres firmly to "adat basandi syarak, syarak basandi kitabullah. "

Abstract

Kabupaten sorong memberlakukan secara khusus Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB) berbasis kearifan lokal cenderung tidak sama dengan umumnya yang mengacu pada Undang-Undang Nomor 28 Tahun 2009 Tentang Pajak Daerah Dan Retribusi Daerah yang memiliki standart minimal. Sejalan dengan itu, tulisan ini bertujuan untuk mendeskripsikan sekaligus menganalisis bagaimana Penerapan Pajak BPHTB berbasis maqashid syariah dan berimplikasi pada kehidupan rumah tangga serta masyarakat. Selain itu, tulisan ini juga merumuskan solusi bagi pemerintah daerah untuk mensejahterakan masyarakat yang tergolong pendapatan asli daerah yang relative rendah. Pengumpulan data dilakukan melalui observasi, wawancara,dan studi pustaka. Hasil penelitian memperlihatkan ternyata kabupaten sorong memili pandangan yang berbeda pada aspek penetapan pajak BPHTB bagi masyarakat yang melakukan transaksi jual beli tanah tetap memperhatikan ketentuan pada Undang-Undang 28 tahun 2009 Tentang Pajak Daerah dan Retribusi Daerah, dengan nilai-nilai kemasalahatan yang di bangun dengan tujuan program pembangunan berkelanjutan dan kesejahteraan masyarakat luas.

Abstract

This research aims to analyze the views of Islamic jurists on the use of piercing in a beautification context. The piercing phenomenon is widespread among Muslims, both men and women, in various Islamic countries. This research uses a qualitative type with a library research approach. This research methodology involves a comprehensive analysis of the views of various scholars and interpretations of verses from al-Qur’an, hadith, and fiqh books related to the topic of piercing in the context of religious law. From this research, the results showed that several scholars had different perspectives regarding this problem. Imam Ibnu Hajar al-Haitami considers piercing women's ears for jewelry purposes is permissible because it is part of 'urf (habit). However, al-Ghazali emphasized that piercing or self-harm and not permitted. There are prohibitions for men regarding piercing. Imam Ghazali and Ibn Hajar al-Haitami agree that nose piercing on women and men is forbidden because of the potential to cause painful wounds. Apart from that, making decorations in places other than ears is also prohibited because it can resemble the practices of infidels, wicked or immoral people. As a devout Muslim need to be careful and aware of the beautification jurisprudence so that it is under the principles and objectives of Islamic law.
