Abstract

The habit of the people of Nagari Padang Air Dingin to dry rice on the main road was the primary motivation for this research. This practice is clearly not in accordance with Article 9, Paragraph 1, letter h of South Solok Regency Regional Regulation No. 1 of 2020 concerning Public Peace and Order, and it has several negative impacts. These impacts include a reduction in the area's aesthetic appeal, roads becoming dirty due to rice residue, main roads becoming slippery, and traffic jams that disrupt public transportation. This research employs a normative-empirical legal methodology, collecting primary data from interviews with informants. The findings indicate that although South Solok Regency Regional Regulation No. 1 of 2020, particularly the section on the prohibition of drying agricultural products on the highway, has been implemented more effectively compared to previous years, there are still areas where enforcement remains less than optimal. Factors such as environmental conditions continue to pose challenges to achieving full compliance. Furthermore, this regulation aligns with the concept of siyasah tanfidziyah (administrative policy), as in Islamic jurisprudence, the main goal is to achieve public benefit and prevent harm. Thus, the enforcement of Article 9, Paragraph 1, letter h of Regional Regulation No. 1 of 2020 contributes to protecting individuals from potential accidents or conflicts within the community.

Abstract

This research examines the application of ta’zir punishment for adultery in Indonesian and Malaysian law from the perspective of Maqasid Sharia. It explores how society perceives, interprets, and responds to these regulations, with particular attention to whether their implementation aligns with the higher objectives of Islamic law in safeguarding religion, life, lineage, intellect, and property. Using a qualitative field research approach, data were collected through in-depth interviews with legal practitioners, Islamic scholars, and community leaders, complemented by observations and documentation analysis in both Indonesia and Malaysia. The findings reveal that in Malaysia, particularly in states with Syariah Criminal Enactments, adultery provisions are viewed as a religious duty to preserve morality and lineage, although enforcement remains constrained by federal constitutional limits. In Indonesia, the inclusion of adultery provisions in the new Criminal Code has triggered intense debates between groups advocating moral protection and those emphasizing human rights and pluralism. From a Maqasid Sharia perspective, both contexts reflect sincere efforts to safeguard lineage and public morality; however, challenges persist regarding justice, proportionality, and the balance between individual rights and collective interests. This study concludes that the discourse on adultery punishment represents deeper negotiations between Islamic values, constitutional frameworks, and contemporary social realities. Its academic contribution lies in demonstrating how Maqasid Sharia can be operationalized as an analytical framework for assessing ta’zir punishments, thereby enriching Islamic legal scholarship in Southeast Asia.

Abstract

This study aims to analyze the constitutionality of the parliamentary threshold for the 2029 general election following Constitutional Court Decision No. 116/PUU-XXI/2023. The research applies a normative juridical method with statutory and conceptual approaches, focusing on legal norms, constitutional principles, and relevant court decisions. Data are collected through literature review, including legislation, constitutional court rulings, and academic writings, and are analyzed qualitatively. The findings reveal that the parliamentary threshold remains constitutionally valid as a mechanism to simplify the party system and support the effectiveness of the presidential system. However, its implementation must adhere to democratic principles, particularly popular sovereignty, equality of political rights, and fair representation. The Constitutional Court’s decision reflects a model of conditional constitutionality, requiring that any threshold policy be rational, proportional, and not excessively limit political participation. This study concludes that future regulation of the parliamentary threshold must carefully balance electoral system efficiency with the protection of citizens’ constitutional rights. The academic contribution of this research lies in offering a comprehensive interpretation of constitutional law in the field of electoral governance, especially in linking democratic theory with constitutional adjudication. Additionally, this study provides insights into the broader implications of judicial review decisions on legislative policy-making and electoral reform in Indonesia.

Abstract

Anak adalah amanah yang diberikan Allah SWT kepada manusia. Kehadirannya selalu dinantikan oleh setiap pasangan. Oleh karenanya orang tua berkewajiban untuk melindungi dan menjaga anaknya secara fisik dan fisikis sehingga terwujud rasa aman pada diri si anak. Disamping itu orang tua juga berkewajiban mendidik anaknya sehingga bisa mengantarkan anaknya menjadi insan kamil. Namun akhir-akhir ini rasa keamanan si anak kembali terusik dengan maraknya kasus penculikan terhadap si anak itu sendiri, mulai dari yang berumur balita sampai belasan tahun. Bahkan kuantitasnya selalu meningkat tahun demi tahun. Menurut Ketua Umum Komnas Anak, Arist Merdeka Sirait mengatakan: “bahwa pada tahun 2014 terjadi sebanyak 51 Kasus. Pada tahun 2015, kasus penculikan anak yang masuk ke lembaganya sebanyak 87 kasus. Untuk tahun 2016, jumlah kasus penculikan anak menjadi 112 kasus. Menurut Seto Mulyadi ada beberapa motif penculikan anak, di antaranya adalah: karena uang, pemerasan, mungkin juga dendam, mungkin masalah politik, mungkin juga eksploitasi seksual kemudian perdagangan anak sampai kepada diambil organ tubuhnya untuk diperdagangkan. Bagi Penculiknya menurut hukum Islam harus dikenai hukuman ta’zir baik berupa pidana penjara, denda, dan lain-lain.

Abstract

Although the practice of fines due to the cancellation of batando in Minangkabau society has received attention in studies of customary law and Islamic law, research that specifically analyzes the implementation of fines for the cancellation of batando in Nagari Taeh Bukik from the perspective of ‘urf remains limited. This study aims to analyze the implementation of fines resulting from the cancellation of batando and to assess their conformity with the concept of ‘urf in Islamic law. This study used a qualitative approach with a case study design. The research participants consisted of ninik mamak, customary leaders, community leaders, and parties who had been involved in the cancellation of batando, selected through purposive sampling. Data were collected through semi-structured interviews, observation, and documentation, then analyzed using an interactive analysis model comprising data reduction, data display, and conclusion drawing. The results show that a customary fine of five units of gold is imposed on the party who cancels the batando based on the agreement of the parties from the beginning of the proposal procession. The implementation of this fine aims to maintain family honor, strengthen responsibility, and prevent social conflict. Viewed from the perspective of ‘urf, this practice is a custom that lives within the community and can be accepted as long as it fulfills the principles of public benefit, justice, and does not contradict Islamic law. The conclusion of this study affirms that fines for the cancellation of batando can be understood as a customary mechanism that functions to maintain social harmony while also having relevance to the principles of Islamic law. The implications of this study include theoretical contributions to the development of Islamic family law studies, particularly regarding the relationship between Minangkabau customary law and the concept of ‘urf, as well as practical implications for customary communities and policymakers in resolving proposal disputes fairly, beneficially, and in accordance with the values of Islamic law.

Abstract

Dalam satu dekade terakhir, reformasi hukum pidana di Timur Tengah memperlihatkan dinamika yang berbeda, terutama dalam penanganan kekerasan seksual dan kejahatan siber. Penelitian ini membandingkan arah dan efektivitas reformasi hukum pidana di Arab Saudi dan Yaman serta menelaah pergeseran paradigma dari orientasi moralitas menuju perlindungan korban. Metode yang digunakan adalah penelitian kepustakaan dengan pendekatan kualitatif deskriptif-analitis dan yuridis-komparatif, mengkaji peraturan perundang-undangan, literatur akademik, dan laporan institusi terkait. Hasil menunjukkan Arab Saudi mengalami kemajuan signifikan melalui kodifikasi hukum, digitalisasi peradilan, dan pembentukan regulasi spesifik terhadap kekerasan seksual serta cybercrime yang meningkatkan mekanisme pelaporan dan sanksi hukum. Sebaliknya, Yaman masih terganggu oleh konflik berkepanjangan yang melemahkan institusi hukum sehingga pembaruan regulasi dan perlindungan korban berjalan lamban dan fragmentaris. Perbedaan ini mengindikasikan bahwa stabilitas politik, kapasitas lembaga, dan komitmen negara menjadi determinan utama keberhasilan reformasi pidana modern yang berpihak pada korban. Rekomendasi penelitian menekankan perlunya penguatan kapasitas institusi, kodifikasi lex specialis, dan integrasi pendekatan maqashid al‑syariah untuk menjamin perlindungan korban dalam konteks hukum Islam kontemporer.
