Abstract

Error in Persona is an error in attracting a party who is considered to have the capacity or legal position to proceed according to the lawsuit filed. The mistake in drawing the party either as a plaintiff or as a defendant will result in the lawsuit containing formal defects. Error in Persona was filed by the defendant on the plaintiff's lawsuit because the lawsuit was directed at the wrong person / party. In a civil suit in the form of contetiosa, contentiosa is a civil suit containing a lawsuit for a dispute between the litigating parties, whose settlement examination is given and submitted to the court where the party filing the lawsuit is called the plaintiff and the party drawn in the lawsuit is called the defendant, the lawsuit is based on the arguments / legal reasons filed. Thus the party filing a lawsuit must be clear and careful in attracting the parties and it must be seen whether the person who is suing and being sued has the capacity and the right legal position.

Abstract

The Regional Head election event which is expected to be held in September has to be postponed until December of course the postponement of the schedule is not without reason, the widespread spread of the Covid-19 pandemic virus outbreak is a separate obstacle for the General Election Commission to be able to hold Regional Head Elections because Public safety is the main thing that must be considered by the General Election Commission because this virus can attack anyone and the worst impact is the death of a person, therefore the General Election Commission made a new method related to regional head elections, namely by implementing health protocols in place. voting which will be applied to all officers to people who already have voting rights under the law this mechanism will be applied to voters from normal body temperature, body temperature 37.3 degrees Celsius to voters exposed to Covid-19 In addition to a more complicated mechanism, the impact resulting from Covid-19 is a more complicated election than before and the cost of organizing it is more expensive because it has to use a health protocol tool that must be given to all officers and the public.

Abstract

A land certificate is important in a rule of law because it is the strongest proof of ownership owned by a person if the status of the land is to be recognized by the law, without a certificate it can be ascertained that the person who claims the land can be canceled. In addition, land certificates can also be sold or transferred to other people or inherited to their children. In the Making of Land Deeds / Certificates in Kuta Besi Village, Batu Brak District, West Lampung Regency, currently many people do not have official land certificates from BPN, therefore People who are aware of the law establish a Pokmas organization that collaborates directly with the West Lampung BPN as an effort to assist the community in making land certificates that are more efficient and effective, and also the purpose of establishing a community group organization is to provide direct socialization to the community regarding community rights to land ownership, methods This research uses a normative juridical approach using legislation related to Land Registration and an empirical approach, which is carried out by looking directly at the object of research by means of observation and interviews.

Abstract

Extortion and threats are an act against the law and the perpetrator is obliged to take responsibility for his actions as regulated in the Extortion Law with Threats is a complaint offense so that the authorities can act if there is a complaint and the victim of Tuiuan from this research is to find out the causative factor and how the perpetrator's criminal responsibility.  As for the problem in this research are, what are the factors that led to the Criminal Act Committing 672 Pid B2020 PN Tjk?  How is the criminal responsibility of the perpetrator involved and exchanging extortion with threats?  The research method used in writing the Jumal of this research is a nomative juridical approach and an empirical approach. Based on the results of the research, the factors that cause perpetrators to commit extortion crimes with threats include economic factors, environmental factors and the third factor.  Where the role of the perpetrator is concerned, how the perpetrator does it, the weight of the mitigation side, the facts of the trial. so the perpetrator is responsible for his actions with a criminal sanction of imprisonment.

Abstract

Penelitian ini bertujuan untuk menganalisis perbuatan melawan hukum dalam sengketa tanah lapangan bola di Dusun Jatisari Desa Jatimulyo Kecamatan Jati Agung Kabupaten Lampung Selatan, dimana berdasarkan Putusan Nomor: 17/Pdt.G/2020/PN Kla disebutkan bahwa mengabulkan gugatan Penggugat (M. Basyarruddin) untuk seluruhnya, menyatakan bahwa Para Tergugat (Sumarjo, Sugiyanto, Sarjiyo, Djumino dan Jumadi) telah melakukan perbuatan melawan hukum, menyatakan sah secara hukum atas objek tanah sengketa dimaksud. Metode penelitian menggunakan pendekatan yuridis normatif dan empiris. Sumber data normatif dan empiris. Pengumpulan data melalui penelitian kepustakaan (library research) dan penelitian lapangan (field research). Analisis data yang digunakan adalah yuridis kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa faktor penyebab terjadinya perbuatan melawan hukum dalam sengketa tanah lapangan bola di Dusun Jatisari Desa Jatimulyo Kecamatan Jati Agung Kabupaten Lampung Selatan berdasarkan Putusan Nomor 17/Pdt.G/2020/PN Kla adalah karena adanya kelalaian (culpa) atau karena kesengajaan (dolus) yang dilakukan Kecamatan Jati Agung dalam pembuatan surat tidak dalam sengketa atas tanah objek perkara sehingga Pihak Tergugat mendaftarkan tanah objek perkara ke kantor Badan Pertanahan Kabupaten Lampung Selatan. Oleh karena perbuatan karena kelalaian atau kesengajaan akan menghasilkan sertifikat yang cacat hukum atau adanya sertifikat ganda yang termasuk dalam kategori perbuatan melawan hukum.

Abstract

Among various types of criminal acts in the community, falsification of letters becomes one of the criminal acts that are rife. For examples criminal cases of falsification of letters are contained in Number: 241/PID.B/2021 PN GNS. Defendant I Suradal and defendant II Efan Efendi committed the criminal act of falsifying documents in the form of STNK. In this study focus on the problem: (1) What are the factors supporting criminal offenders committing STNK counterfeiting crimes? (2) How is the accountability of the perpetrators of STNK counterfeiting? (3) How is the judge’s consideration of the perpetrators of STNK counterfeiting? In this study apply normative juridical approaches as well as empirical juridical. The process of data collection is carried out by field study steps as well as literature studies. The data obtained is then analyzed with qualitative techniques to reach conlcusions in the research conducted. In this study produced answers about what are the factors that cause the perpetrator to commit the crime of forgery, how the perpetrator is responsible and how the judge’s consideration of the perpetrator of the STNK forgery in Number: 241/PID.B/2021 PN GNS.

Abstract

Penyelenggaraan Pemilihan Umum Kepala Daerah yang baik harus menjadi harapan semua pihak dalam rangka mewujudkan pesta demokrasi dan diharapkan hasil Pemilihan Umum dapat menghasilkan kepala daerah yang berkualitas sesuai dengan keinginan masyarakat. Kontestasi politik dalam Pemilihan Umum Kepala Daerah harus berpedoman pada peraturan perundang-undangan yang berlaku. Undang-Undang Republik Indonesia Nomor 10 Tahun 2016 tentang Perubahan Kedua Atas Undang-Undang Nomor 1 Tahun 2015 tentang Pembentukan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 tentang Pemilihan Gubernur, Bupati dan Walikota menjadi Undang-Undang merupakan salah satu undang-undang dasar dalam penyelenggaraan Pemilihan Umum Kepala Daerah, dimana proses Pemilihan Umum Kepala Daerah harus mengutamakan prinsip kemandirian, kejujuran, keadilan, kepastian hukum, tertib penyelenggaraan Pemilihan Umum Kepala Daerah, kepentingan umum, keterbukaan, proporsionalitas, profesionalitas, akuntabilitas, efisiensi dan efektivitas. Pemilihan Umum Kepala Daerah yang jujur dan adil membutuhkan peraturan perundang-undangan dan pemilihan kepala daerah yang baik bersama dengan aparatur yang bertanggung jawab menegakkan peraturan perundang-undangan dalam mewujudkan kualitas Pemilihan Umum Kepala Daerah dengan menumbuhkan terciptanya integritas dan profesionalisme dalam penyelenggaraan Pemilihan Umum Kepala Daerah. Namun dalam setiap pelaksanaannya terkadang sering ditemukan oknum-oknum yang melakukan pelanggaran dalam Pemilihan Umum Kepala Daerah, yang pada kenyataannya ditemukan penyelenggara Pemilihan Umum Kepala Daerah telah melakukan pelanggaran pemilihan umum yang dalam hal ini dilakukan oleh aparatur sipil negara.

Abstract

AbstrakTujuan dari penelitian ini yaitu untuk mengetahui, memahami dan menganalisis Bagaimana upaya Pemerintah Provinsi Nusa Tenggara Timur khususnya Kabupaten Manggarai Barat dalam menegaskan penerapan UMP berdasarkan Pasal 88 Undang-Undang Nomor 11 Tahun 2020 tentang  Cipta Kerja, Apa yang menjadi faktor penghambat ketidakseimbangan penerapan UMP di Provinsi Nusa Tenggara Timur khususnya Kabupaten Manggarai Barat berdasarkan Pasal 88 Undang-Undang Nomor 11 Tahun 2020 tentang  Cipta Kerja.Metode penelitian yang digunakan dalam penelitian ini menggunakan pendekatan yuridis normatif dan empiris, pendekatan yuridis normatif dilaksanakan dengan mempelajari norma atau kaidah, sedangkan pendekatan empiris dilakukan dengan wawancara terhadap narasumber Kewenangan dalam menetapkan upah minimum di wilayah provinsi atau kabupaten/kota terletak pada kewenangan kepala daerah dalam hal ini Gubernur yang mengacu pada peraturan perundang-undangan.  Kata kunci :  Penerapan; Upah Minimum Provinsi;Cipta Kerja,Undang-Undang. AbstractThe purpose of this study is to find out, understand and analyze how the efforts of the East Nusa Tenggara Provincial Government, especially West Manggarai Regency in strengthening the implementation of the UMP based on Article 88 of Law Number 11 of 2020 concerning Job Creation, what are the inhibiting factors for the imbalance in the implementation of the UMP in the Province of Nusa East Southeast especially West Manggarai Regency based on Article 88 of Law Number 11 of 2020 concerning Job Creation. The research method used in this study uses a normative and empirical juridical approach, the normative juridical approach is carried out by studying norms or rules, while the empirical approach is carried out by interviewing sources. The authority to determine the minimum wage in the province or district/city is under the authority of the regional head, in this case the governor, which refers to the laws and regulations. Keywords: Application; Provincial Minimum Wage; Job Creation, Law.

Abstract

Hampir seluruh wilayah di dunia mengalami pandemi global bernama Severe Acute Respiratory Syndrome Corona Virus 2 (SARS-CoV-2) yang lebih dikenal dengan nama virus Corona adalah jenis baru dari coronavirus yang menyerang sistem pernapasan kemudian menular ke manusia. Permasalahan yang akan dibahas mengenai implementasi Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM) di Kota Bandar Lampung berdasarkan surat edaran Gubernur nomor: 045.2/87/VI/POSKO/2021 dan penerapan sanksi pidana bagi masyarakat kota BandarLampung yang melanggar Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM). Metode penelitian yang digunakan yaitu penelitian normatif. Pemerintah sendiri mengambil kebijakan pembatasan kegiatan masyarakat untuk menekan penyebaran Covid-19, mulai dari PPKM, PPKM Mikro, PPKM Darurat, hingga PPKM Berlevel. PPKM merupakan rambu-rambu masyarakat yang dimana aktivitas dan mobilitas masyarakat dibatasi atau tidak diperbolehkan. Karena adanya peningkatan kontak dan interaksi antar manusia akan membuat virus corona cepat menyebar, terlebih lagi ada varian terbaru yaitu delta yang lebih sangat cepat menular dari sebelumnya.

Abstract

Health quarantine is an effort to prevent the impact of infectious disease outbreaks that can attack a place, region, even a country, by closing access in and out and limiting the activities or activities of people in the area that is implementing quarantine. For the sake of implementing a proper health quarantine, it is necessary to pay attention to and consider several factors, such as the economic condition of the community, health services, educational services, and working conditions. The implementation of health quarantine is the responsibility of the Government as a manifestation of the State to be able to fulfill all the factors that can support the implementation of health quarantine in an area without causing new problems in people's lives. The government enforces health quarantine with various patterns, such as the implementation of Large-Scale Social Restrictions (PSBB) to the Enforcement of Restrictions on Community Activities (PPKM). As a state of law, Indonesia certainly underlies the implementation of health quarantine by referring to the constitution of the State of Indonesia, namely Law number 6 of 2018 concerning Health Quarantine. The purpose of this study is to analyze the implementation of Article 55 of Law Number 6 of 2018 concerning Health Quarantine in Bandar Lampung City and analyze the fulfillment of citizens' rights in the implementation of Community Activity Restrictions (PPKM) in Bandar Lampung City. The method used in this research is normative juridical and empirical juridical. The data that has been systematically arranged were analyzed qualitatively. In this data analysis process, a series of data that has been systematically arranged according to its classification, is then described and analyzed in a normative and empirical juridical manner, namely the approach taken based on the main legal material by examining theories, concepts, principles and laws and regulations related to this research as well as the results of interviewing parties related to the results of this study.
