Abstract

Kemerdekaan menyampaikan pendapat di muka umum adalah hak asasi manusia yang dijamin oleh UUD 1945 dan deklarasi universal hak-hak asasi manusia. Kemerdekaan setiap warga negara untuk menyampaikan pendapat di muka umum merupakan pewvujudan demokrasi dalam tatanan kehidupan masyarakat berbangsa dan bernegara. Kendati telah adanya aturan baku tentang tata cara penanggulangan serta tindakan yang harus dilakukan dalam menanggulangi aksi unjuk rasa yang telah dikeluarkan oleh Kepala Kepolisian Negara Republik Indonesia tersebut, namun dalam praktik penyelenggaraan pelayanan pengamanan serta pengendalian massa unjuk rasa, anggota Kepolisian Negara Republik Indonesia akan mengambil tindakan tidak berdasarkan peraturan yang telah dibentuk tersebut. Dalam hal ini anggota kepolisian sering kali bukan melakukan pengamanan dan meredam aksi massa, melainkan anggota kepolisian juga tidak dapat mengendalikan emosi dan ikut terpancing. Hal tersebut menimbulkan sikap arogan dan emosional polisi yang langsung mengejar, membalas melempar pelaku aksi intimidasi, bahkan melakukan penangkapan pelaku unjuk rasa dengan cara kekerasan seperti menganiaya dan memukul. Pengamanan Dan Penanganan Perkara Penyampaian Pendapat Di Muka Umum ditegaskan bahwa dalam penerapan upaya paksa harus dihindari adanya tindakan yang kontra seperti membalas pelemparan pelaku, mengejar dan menangkap dengan kasar, menganiaya, dan memukul, serta tindakan aparat yang melakukan kekerasan, mengunci, mengucapkan, dan melanggar HAM. Rumusan permasalahan dalam tesis ini yaitu bagaimana hak anggota Kepolisian Republik Indonesia dalam menanggulangi kekerasan dalam aksi unjuk rasa di Kota Makassar serta faktor penyebab aparat Kepolisian melakukan tindakan kekerasan yang melawan hukum dalam pengamanan massa pengunjuk rasa di Kota Makassar. Hasil penelitian yaitu 1) Hak Anggota Kepolisian Republik Indonesia dalam menanggulangi kekerasan dalam aksi unjuk rasa yaitu menggunakan kekuatan secara proporsional, membubarkan pengunjuk rasa dan melakukan tindakan preventif. 2) Faktor penyebab aparat Kepolisian melakukan tindakan kekerasan yang melawan hukum dalam keamanan massa pengunjuk rasa yaitu massa pengunjuk rasa yang tidak sesuai prosedur, pelanggaran pengendalian diri dari anggota Kepolisian dan penyerangan massa terhadap anggota Kepolisian

Abstract

Fundamentally, a bank is an institution that collects funds from the public in the form of deposits and redistributes them to the public in the form of credit. One indication that sometimes becomes a problem in banking is that it's not just about distributing credit, but how that credit can be returned according to the agreed-upon time period and interest rewards by both parties. This classifies a bank as healthy when both the distribution and return of credit can run smoothly and continue to experience improvements in terms of both quality and quantity. Non-performing loans represent one of the problems faced by banking institutions, including Bank Rakyat Indonesia (BRI), which can affect the bank's financial health, disrupt liquidity, and damage reputation. Non-performing loans occur when customers fail to pay installments according to the agreed-upon agreement. One approach that can be taken is the non-litigation route, which prioritizes peaceful resolution through negotiation and restructuring, without involving legal processes or courts. This non-litigation route has become an increasingly chosen alternative by banks in Indonesia, including Bank BRI, to address non-performing loans. The formulation of the problem in this thesis is how the mechanism for resolving non-performing loans through non-litigation channels in banking works, particularly at Bank BRI, as well as the factors that influence Bank BRI in choosing non-litigation channels as a solution for resolving non-performing loans. Meanwhile, this research was conducted with the aim of understanding the mechanism for resolving non-performing loans through non-litigation channels in banking, particularly at Bank BRI, and to identify the factors that influence Bank BRI in choosing non-litigation channels as a solution for resolving non-performing loans.

Abstract

In many developing countries, there are still many public sector institutions that do not yet have the capacity to provide good quality public services. The Provincial Government of D.I. Yogyakarta is one of the institutions that is currently intensively carrying out various public service improvements throughout innovations. One of many innovations that has been implemented is an application called Jogjaplan, which is an e-planning (electronic planning) system that is also capable in not just actualizing, but also making improvement in public participation through open access towards information and by creating a public forum for aspirations regarding development planning. This study aims to determine the role of innovation in the form of the Jogjaplan application in increasing community participation in the governance of the Province of D.I. Yogyakarta. This study uses descriptive qualitative methods with data collection techniques in the form of literature studies based on relevant books, scientific journals, news articles, and official government websites. Based on this research, Jogjaplan was proven to be capable of simplifying the planning process in terms of processing data and documents. However, the use of the Jogjaplan application in the context of public participation is still not optimal. The number of people who access and provide suggestions regarding program planning in D.I.Y is still relatively low. This is due to the lack of socialization carried out by the local government to the public which is also exacerbated by the low responsiveness of the government towards the inputs made by the public.

Abstract

Penelitian ini mengkaji pencemaran nama baik dalam perspektif hukum Indonesia, khususnya terkait dengan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik (ITE) serta perlindungan hak asasi manusia. Dalam era digital yang serba cepat, pencemaran nama baik melalui media sosial menjadi isu penting, mengingat dampaknya terhadap reputasi individu serta potensi pengaruh psikologis dan sosial. Rumusan masalah penelitian ini mencakup kajian hukum tentang pencemaran nama baik menurut UU ITE, upaya perlindungan hak asasi manusia berdasarkan UU No. 39 Tahun 1999, kendala dalam penegakan hukum, dan strategi penyelesaian kasus secara preventif, kuratif, dan non-yudisial. Metode penelitian yang digunakan adalah pendekatan undang-undang dan konseptual dengan analisis kasus. Hasil penelitian menunjukkan bahwa meskipun UU ITE memberikan perlindungan terhadap pencemaran nama baik, implementasinya sering kali menimbulkan kontroversi, terutama terkait dengan kebebasan berekspresi. Saran penelitian mencakup perlunya reformulasi Pasal 27 ayat (3) UU ITE agar lebih jelas, penguatan literasi digital di masyarakat, serta optimalisasi mekanisme penyelesaian sengketa non-yudisial seperti mediasi untuk menciptakan keadilan yang lebih cepat dan tidak represif.

Abstract

This research is motivated by the gap between the constitutional recognition of indigenous peoples and the reality of customary rights protection, which are often neglected by investment interests and the state's right to control. Although Article 18B Paragraph 2 of the 1945 Constitution guarantees the existence of indigenous peoples, this recognition is conditional and weak in technical implementation. The main problem in this study is the ineffectiveness of East Luwu Regency Regional Regulation Number 1 of 2022 in protecting the customary rights of the Padoe Indigenous Peoples from mining company expansion. The research method used is normative juridical with a statutory and conceptual approach. The results show that the recognition of customary rights in the Basic Agrarian Law is still sectoral and has not been followed by comprehensive special legislation. In East Luwu Regency, the role of the local government is still very limited due to the lack of an inventory of customary territories and the existence of sectoral egos in natural resource management. In conclusion, de jure recognition does not automatically provide de facto protection for indigenous peoples without the government's political will to implement the regulation effectively. Researchers recommend accelerating the formation of the Customary Law Communities Law and establishing specific customary land boundaries through a Regent's Decree to ensure legal certainty and justice for indigenous communities.

Abstract

Land conflicts are complex issues that frequently occur in various regions in Indonesia and impact the social, economic, and political stability of communities. Local governments play a crucial role in resolving land conflicts because they are closest to the community and have authority over regional management. This study aims to analyze the role of local governments in resolving land conflicts and identify obstacles encountered in their implementation. The research method used is a qualitative approach, collecting data through interviews, searching for relevant literature, and documenting relevant parties. The results indicate that local governments play a role in providing preventive and repressive legal protection in resolving land conflicts. However, this role is not yet optimal due to obstacles such as a lack of good faith from each party and the continued refusal of parties to implement peace agreements. Strengthening institutional capacity and increasing synergy between parties is needed to create a just, transparent, and sustainable resolution of land conflicts.

Abstract

This research analyzes the legal responsibility of family singing house business actors toward minor consumers in the context of digital content transformation in Makassar City. Family singing homes as a fast-growing entertainment industry face significant challenges regarding the protection of child consumers from digital content that contains pornographic elements. This research identifies the gap between legal provisions and practical implementation in the field through a juridical-empirical approach with a case study method. The results show that digital content transformation in family singing homes has changed the character, accessibility, and potential impact of content on child consumers. In business practices, it was found that there was an absence of a content filtering system, access restrictions based on age, and supervision of the activities of child consumers. The main obstacles in implementing the legal responsibilities of business actors include regulatory, technical, economic, and sociocultural aspects. This research proposes an alternative model of child consumer protection that integrates co-regulation, technological solutions, community governance, and diversified liability. The study's novelty lies in analyzing the multi-disciplinary intersection of law, the empirical exploration of digital content transformation, developing alternative models of child consumer protection, and contextualizing consumer protection law in local wisdom. The findings of this research have implications for reforming digital entertainment industry regulations, developing best practices, and consumer education and empowerment to ensure adequate protection for child consumers in the digital transformation era

Abstract

Daun simpur air  (Dillenia Suffruitcosa L.) secara tradisional telah banyak digunakan untuk mengobati berbagai penyakit seperti diare, demam, rematik, penyembuhan luka dan menghamat pertumbuhan sel kanker. Tanaman ini juga berpotensi menjadi sumber pengembangan produk kesehatan modern dengan berbagai metabolit sekunder yang memberikan kontribusi signifikan terhadap manfaat kesehatan, seperti flavonoid dan alkaloid, dengan sifat antioksidan dan antibakteri yang mendukung kesehatan. Tujuan penelitian ini untuk mengidentifikasi senyawa bioaktif dalam daun simpur air yang di ekstraksi menggunakan etanol 96%. Analisis dilakukan dengan menggunakan GC-MS untuk memisahkan, mengidentifikasi, dan menentukan struktur dan berat molekul senyawa. Identifikasi senyawa ekstrak etanol daun simpur air (Dillenia Suffruiticosa L) dengan GC-MS ditemukan 17 senyawa dengan enam senyawa dominan yaitu n-Hexadecanic Acid; γ-sitosterol; Neophytadine; Sitosterone; Octadecadienoic; dan Phytol. Ekstrak etanol daun simpur air (Dillenia Suffruiticosa L.) berpotensi untuk dikembangkan tanaman obat karena kandungan ekstrak memiliki berbagai aktivitas biologis yang bermanfaat seperti antiinflamasi, antioksidan, antikanker, antidiabetik, antibakteri, dan antijamur

Abstract

Penggunaan larvasida kimiawi konvensional secara terus menerus sebagai salah satu upaya penanggulangan DBD akan meningkatkan resistensi populasi vektor sehingga membutuhkan dosis insektisida yang lebih tinggi serta menimbulkan efek toksik bagi manusia, hewan, dan lingkungan. Oleh karena itu diperlukan larvasida alternatif khususnya yang berbahan alami sehingga tidak mencemari lingkungan dan relatif aman bagi manusia. Penelitian ini bertujuan untuk mengetahui senyawa metabolit sekunder dan menguji efektivitas fraksi n-heksana daun lada putih Bangka (Piper nigrum L.) terhadap mortalitas larva instar III nyamuk Aedes aegypti. Penelitian ini merupakan penelitian eksperimental dengan rancangan Randomized Post Test Only Control Group Design yang terdiri dari 7 kelompok (kontrol positif, kontrol negatif, konsentrasi 60 ppm, 80 ppm, 100 ppm, 120 ppm dan 140 ppm). Masing-masing kelompok diberikan larva uji sebanyak 25 larva kemudian diamati mortalitasnya dalam waktu 24 jam. Data kemudian dianalisis dengan uji Probit, uji Independent T, dan uji Mann Whitney. Berdasarkan uji fitokimia didapatkan senyawa metabolit sekunder yang terkandung di dalam fraksi n-heksana yaitu senyawa steroid, saponin, dan alkaloid. Kematian larva uji tertinggi fraksi n-heksana dalam waktu 24 jam didapatkan pada konsentrasi 140 ppm. Hasil uji probit didapatkan nilai LC50 sebesar 105,006 ppm. Hasil uji Mann-Whitney tidak terdapat perbedaan jumlah kematian larva instar III nyamuk Aedes aegypti pada semua konsentrasi fraksi n-heksana dengan kelompok kontrol positif (p0,05). Hal ini berarti fraksi n-heksana daun lada putih Bangka (Piper nigrum L.) efektif dalam mortalitas larva instar III nyamuk Aedes aegypti.
