Abstract

Introduction: Medical Laboratory Technology Experts (ATLM) as one type of health worker, are authorized to organize or practice in the health sector according to their expertise. The ideal ratio of Community Health Centers (Puskesmas) to districts is at least 1 Puskesmas per sub-district, and the minimum staffing standard based on Minister of Health Regulation No. 43 of 2019 for ATLM personnel in Puskesmas is 1 (one), both in Urban, Rural, Remote, and Very Remote Puskesmas. Method: The purpose of this study is to analyze the suitability of ATLM personnel with minimum staffing standards based on the Minister of Health Regulation No. 43 of 2019 in Indonesia. The qualitative research method describes the availability of ATLM personnel at the district/city/provincial level in Indonesia, using secondary data from the Ministry of Health's Health Human Resources Information System (SISDMK) for 2022. Result: The results showed that there is still a shortage of medical laboratory technologists in Puskesmas at the district/city/provincial level in Indonesia, with 1,486 Puskesmas experiencing a shortage out of a total of 10,436 Puskesmas in Indonesia.

Abstract

Korupsi sebagai kejahatan luar biasa yang terjadi di Indonesia. Oleh sebab itu, korupsi sudah menjadi wabah penyakit moral yang sangat kronis saat ini di Indonesia. Maka dibutuhkan suatu kajian analisis sistematis dalam lintas akademik hukum harus dilakukan. analisis yang mengkaji unsur-unsur dalam tindak pidana korupsi meliputi unsur objektif perbuatan melawan hukum dan begitu juga unsur kerugian perekonomian negara dalam tindak pidana korupsi. Permasalahan dalam penelitian ini yakni bagaimana Konstruksi Unsur Objektif Perbuatan Melawan Hukum dan bagaimana pula konstruksi Unsur Kerugian Perekonomian Negara Dalam Tindak Pidana Korupsi di Indonesia? Tujuan penelitian ini adalah semata-mata untuk menjawab permasalahan yang dibahas. Penelitian ini menggunakan metode yuridis normatif dengan melakukan pendekatan perundang-undangan yang dilakukan dengan telaah kepustakaan untuk mengkajinya. Penelitian ini memperoleh hasil bahwa Konstruksi Unsur Objektif Perbuatan Melawan Hukum dalam tindak pidana korupsi di Indonesia adalah bergesernya sifat melanggar / melawan hukum dari sebelumnya bersifat melawan hukum formil maupun melawan hukum materil berdasarkan Penjelasan UU Pemberantasan Tindak Pidana Korupsi Nomor 31 Tahun 1999, namun sejak adanya Putusan Mahkamah Konstitusi No. 003/PUU-IV/2006 tanggal 25 Juli 2006 maka sifat melawan hukum dalam tindak pidana korupsi berubah menjadi bersifat melawan hukum formil, sedangkan konstruksi unsur perekonomian negara dalam tindak pidana korupsi yaitu bergesernya bentuk unsur kerugian perekonomian dari delik formil menjadi delik materil sejak adanya Putusan Mahkamah Konstitusi Nomor 25/PUU-XIV/2016 tanggal 25 Januari 2017 yang mewajibkan adanya kerugian nyata dan bisa dihitung (actual loss), bukan berdasarkan prakiraan atau potensial kerugian (potential loss).

Abstract

Restitution rights are problematic in fulfilling the rights of victims of crime, mainly due to misconceptions about restitution terminology. This research aims to explore and analyze the misconceptions of restitution terminology by the society and its impact on the fulfillment of the rights of victims of crime using the analysis of Social Construction Theory. This research uses an empirical juridical approach by utilizing primary data in the form questionnaires distributed to community service participants and the focused discussion process in Community Service activities and secondary data in the form of primary, secondary and tertiary legal materials. The findings of this study indicate that the misconception of restitution terminology is formed through the social construction of legal norms on the wrong meaning of restitution terminology These misconceptions take the form of restitution being understood as peace, restitution is the same as compensation and restitution results in the elimination of imprisonment for the perpetrator. These misconceptions have implications for the non-fulfillment of the rights of victims of crime, which will arrise in the difficulty in submitting requests for restitution, the victim's perception of justice is reduced and a negative impact on the victim's recovery process. This misconception will also lead to weak law enforcement against criminal offenders.

Abstract

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.

Abstract

Abstrak: Dengan meningkatnya kasus child grooming, kebutuhan untuk melindungi anak di era digital menjadi semakin mendesak. Penelitian ini bertujuan untuk mengevaluasi efektivitas UU Perlindungan Anak dan UU ITE dalam menangani kasus child grooming, serta mengidentifikasi hambatan dalam implementasi hukum untuk memberikan rekomendasi kebijakan yang lebih baik. Dalam penelitian kami, digunakan pendekatan yuridis normatif digunakan dengan teknik analisis kualitatif terhadap peraturan perundang-undangan, dokumen resmi, dan literatur terkait. Meskipun UU Perlindungan Anak dan UU ITE memberikan kerangka hukum yang memadai, kurangnya ketentuan spesifik tentang child grooming di dunia maya dan kelemahan dalam penegakan hukum menjadi hambatan utama. Kata Kunci: Perlindungan hukum, child grooming, media sosial, Abstract: With the increasing cases of child grooming, the need to protect children in the digital era is becoming increasingly urgent. This study aims to evaluate the effectiveness of the Child Protection Law and the ITE Law in dealing with child grooming cases, as well as to identify obstacles in the implementation of the law to provide better policy recommendations. In our study, a normative legal approach was used with qualitative analysis techniques on laws and regulations, official documents, and related literature. Although the Child Protection Law and the ITE Law provide an adequate legal framework, the lack of specific provisions on child grooming in cyberspace and weaknesses in law enforcement are major obstacles. Abstract

Criminal acts of terrorism are generally committed by men, but there is an interesting fact that these acts of terrorism are not only committed by adult men but also involve women and children in them. This is a new mode or strategy carried out by the perpetrators of terrorism in order to trick the security forces. The formulation of the problem in this thesis research is the first, namely what is the policy for punishing children who are involved in criminal acts of terrorism, second, what is the policy for punishing woman who are involved in criminal acts of terrorism, and the third, how are efforts to prevent terrorism crimes involving women and children in the future? will be reviewed based on statutory regulations. The research used is normative legal research supported by empirical juridical data by conducting interviews with North Sumatra Regional Police. The nature of this research is a descriptive analysis with a statutory approach (state approach) and an analytical approach (analytical approach) using qualitative methods to draw deductive conclusions. The results of the study show that firstly, the criminal policy for terrorism crimes involving children is that children who commit acts of terrorism cannot be subject to specific minimum criminal sanctions in Articles 6, 8 to 13 and 15 of Law Number 5 of 2018 while capital punishment or life imprisonment Life also cannot be enforced but replaced with a maximum imprisonment of 10 years. Second, the criminal policy against terrorism crimes involving women has been regulated in Law Number 5 of 2018, but nothing regulates non-penal policies against women who are involved in criminal acts of terrorism. Then the third, efforts to prevent terrorism crimes involving women and children in the future are reviewed based on laws and regulations, namely by preparing National Preparedness, Counter-Radicalization, and Deradicalization. Conclusions and suggestions can be seen that first, in the absence of laws governing the criminalization of children as terrorist actors, it is necessary to form a related regulation. Second, in the absence of anything that regulates women's non-penal policies against criminal acts of terrorism, it is necessary to establish a special regulation regarding this matter. Third, by preparing National Preparedness, Counter-Radicalization, and Deradicalization, synergy is needed between law enforcement officials, the government, the community, the private sector and other parties

Abstract

Compliance with traffic laws is a key indicator in ensuring order and safety on the roads. Traffic violations continue to occur in various regions, including Aceh Tenggara, particularly among Generation Z. This generation is characterized as dynamic, critical of authority, and highly influenced by social media in shaping their perceptions and behaviors. This phenomenon indicates that repressive law enforcement approaches are no longer fully effective without the support of social legitimacy toward authorities and law enforcement actions. This study aims to analyze the influence of perceived police legitimacy on traffic law compliance among Generation Z. Police legitimacy is understood as the public’s trust in the authority of law enforcement officers to uphold the law fairly, with integrity, and transparently. This research employs a qualitative approach grounded in the social constructivism paradigm of Peter Berger and Thomas Luckmann to understand how social reality is constructed through interactions between individuals and authoritative institutions. The findings show that perceptions of police legitimacy significantly influence compliance levels. Thus, the study affirms that social legitimacy cannot be built solely through formal authority and sanctions, but also through humanistic communication, equitable services, and the presence of officers who embody moral exemplarity within society.

Abstract

Asset confiscation serves as an instrument of social control to eliminate unlawfully obtained profits while simultaneously redressing institutional losses. However, in practice, significant discrepancies often arise between prosecutors' demands and judges' decisions. In a number of decisions, prosecutors consider that the evidence linking assets to the crime has not been met and therefore demand that the assets be returned to the defendant, while judges use judicial discretion to confiscate and return the assets to the victim, based on considerations not fully revealed in the formal evidentiary process. Conversely, there are also cases where prosecutors demand confiscation of assets because they are considered the proceeds or means of a crime, but judges decide differently, rejecting the confiscation because they consider that there is insufficient evidence or a strong causal relationship between the assets and the crime charged. Through a sociology of law approach and jurisprudential analysis, this study finds that this discrepancy is a manifestation of a conflict of authority between two centers of authority in the criminal justice system. Using Ralf Dahrendorf's conflict perspective, this study emphasizes the importance of increasing the transparency of judicial deliberations and the sociological capacity of law enforcement officials to minimize structural tensions between the authority of prosecutors and judges.

Abstract

Online Gender-Based Violence is a form of cybercrime that has significantly increased in Indonesia and presents complex challenges for the national legal system. This issue is not only related to regulatory and law-enforcement aspects but also to social constructs influenced by cultural norms and patriarchal gender relations. In this context, a socio-legal study is needed to understand how social processes shape the meanings of “crime” and “victim” in OGBV cases and how these meanings affect criminalization and legal handling. This research aims to analyze the social construction of cybercrime, particularly OGBV, through the perspective of Berger and Luckmann’s social constructivism theory. The study employs a qualitative approach with a sociological-juridical method through legal document analysis and media discourse studies. The analysis examines how interactions among society, the media, and legal institutions influence the interpretation of perpetrators and victims within the context of gender-based digital violence. The findings show that the criminalization of OGBV perpetrators is not solely based on juridical aspects but is also a product of social constructions shaped by patriarchal values and gender bias. Responses to victims still face obstacles such as victim blaming and the low gender sensitivity of law-enforcement officers. In conclusion, law serves a dual function as both a product and an instrument of social construction. Therefore, gender-sensitive legal policies grounded in a constructivist perspective are needed to achieve substantive justice for OGBV victims.
