Abstract

One of the advantages of the presidential system is the president's authority to appoint ministers without the intervention of others. The President's authority has been confirmed in Article 17 paragraph (4) of the Constitution 1945 which states that the President appoints and dismisses ministers. This regulation is also emphasized by the existence of Law Number 39 of 2008 concerning the Ministry of the State which states that ministers are assistants to the president in leading Ministry. The State Ministry Law does not set limits on how persons can be elected by the president to become ministers, whether from political parties, professionals, academics, practitioners; it is all purely the authority of the president. Limitations on ministerial candidates are only regulated in the Constitutional Court Decision Number 79/PUU-IX/2011asserting that the positions of ministers and ministries may not be sold as a political gift to a person or a group. On that basis, the question regarding what legal principles in the state administrative law can be referred to by the president in forming a competent cabinet is raised. With normative-juridical methods, the purpose of this paper is to find out the principles in state administrative law in the implementation of government, especially in cabinet elections. The results of the study show that the principle of the orderly administration of the state must serve as a reference in the implementation of government, especially in cabinet elections. This principle involves the basis of order, harmony, and balance in state control and administration. Besides, the ministers appointed by the president must avoid and be aware of the occurrence of maladministration that leads to liability personal, not job responsibilities. To strengthen the principle of orderly state administration, The Ministry of State must include this principle in one of its articles.

Abstract

The aim of this research is to determine the disparity in constitutional court decisions regarding the age threshold for presidential and vice-presidential candidates. This research is a type of normative legal research that uses statutory, conceptual and case approach methods. The results of the research explain that if examined from the aspect of considerations of constitutional court judges in case number 29/PUU-XXI/2023, it is stated that determining the minimum age of the President and Vice President is the domain of law makers (open legal policy), while in case number 90/PUU- XXI/2023 the constitutional court interpreted that the existence of an open legal policy (open legal policy) although it can be accepted in constitutional practice, but in its development the constitutional court could ignore or set aside while giving a re-interpretation of the norm which is an open legal policy, while from the adoption procedure decision in the judge's deliberative meeting held in case Number 29/PUU-XXI/2023, the chairman of the constitutional court, Anwar Usman, did not participate in discussing and deciding to avoid conflicts of interest, while in case Number 90/PUU-XXI/2023 with the same constitutionality issue the chairman The constitutional court participated in discussing and deciding the case with the decision being granted in part, namely being at least 40 years old or having/currently held a position elected through general elections, including regional head elections.

Abstract

This study discusses the Corruption Eradication Commission (KPK) since 2019 there has been a significant change, because the second amendment to the KPK Law has been ratified through Law Number 19 of 2019, Indonesia's ranking index is at 115, amputated authority and declining performance. The study conducted a comparative approach between the Indonesian KPK and the corruption eradication institutions of Hong Kong, Japan, Australia and New Zealand. It was found that Asian and Australian countries have less authority, but are ranked high (3 to 14) in eradicating corruption compared to Indonesia which is ranked 115. The results of the study show that there has been a change in the position of the KPK institution in terms of state administration which is no longer an Auxiliary body but a state organ, full authority but requires permission from the supervisory board, accountability and full control by the government (executive).

Abstract

Law enforcement containing the proportional principle is how law enforcement runs in such a way, so that it does not only enforce the normative rules (aspects of legal certainty) but also the philosophical aspects (aspects and values of justice). Functional differentiation causes law enforcement practices by law enforcement officers to be fragmented and fragmentary because each component of law enforcement has different perceptions and meanings. This has an impact on the difficulty of realizing an integrated and integrated criminal justice system because there are often conflicts of interest and differences in interpretation between law enforcement components so that the products of the judiciary have not been able to meet the expectations of the people seeking justice. So in this systematic framework, the actions of one body will affect the other bodies. Research purposes namely analyzing the harmonization between investigators and advocates in the law enforcement process and analyzing the harmonization and synchronization between law enforcers. The research method in this case combines elements of normative law which are then supported by additional data or empirical elements. The system in the criminal justice system so that in practice it will have an effect on the implementation of the criminal justice system as a whole.

Abstract

The Ombudsman of the Republic of Indonesia or later called the Ombudsman is an independent state institution which has the authority to supervise the process of providing public services carried out by State and Government administrators including State-Owned Enterprises (BUMN), Regional-Owned Enterprises (BUMD), State-Owned and Private Legal Entities which have been given the task of providing certain public services. The research discusses the effectiveness of the Indonesian Ombudsman Representative of West Nusa Tenggara Province in Supervising Tourism Villages. This research is based on the large number of public reports submitted to the Ombudsman regarding alleged violations that occurred in the administration of the Tourism Village. For this reason, supervision by the Ombudsman is needed to manage public complaints and prevent repeated maladministration in the administration of Tourism Villages. This research is socio-legal research with a statutory approach, a conceptual approach and a sociological approach. Research results In supervising public services, apart from receiving reports from the public, the Ombudsman can also carry out on his own initiative through a systemic review, the results of which can be in the form of recommendations/suggestions. The Ombudsman's supervision in supervising the implementation of tourist villages can be said to be effective and running well in accordance with the indicators.

Abstract

The aim of this research is to determine the impact of the Israeli and Palestinian conflict on Indonesian legal politics. To obtain quality research results, the method used in this research is a normative-empirical legal research method. Where research examines regulations related to agrarian law regulation and expert opinions (law in the book), as well as looking at its implementation through the media (the Israeli – Palestinian conflict in the field) in order to find out how it is implemented in the field (law in action). In order to make this research easier, this research uses a statutory approach (legislative approach), a contextual approach (conceptual approach) and a sociological approach (sociological approach). The resulting research results are that no life is worth dying for purely political interests (territory of the country), Israel and Palestine must find a solution to sit down together so that there are no more conflicts and victims. Psychologically, Indonesia supports Palestinian sovereignty, while also trading with Israel. Indonesia is a country with a middle position and is expected to become a mediator for peace between Israel and Palestine

Abstract

Tujuan penelitian ini untuk mengetahui disparitas putusan mahkamah konstitusi terkait ambang batas usia calon presiden dan wakil presiden, penelitian ini merupakan jenis penelitian hukum normatif yang menggunakan metode pendekatan perundang-undangan, konseptual dan kasus. Hasil penelitian menjelaskan bahwa jika dikaji dari aspek pertimbangan hakim mahkamah konstitusi dalam perkara nomor 29/PUU-XXI/2023 menyatakan penentuan usia minimal Presiden dan Wakil Presiden menjadi ranah pembentuk undang-undang (open legal policy), sementara dalam perkara nomor 90/PUU-XXI/2023 mahkamah konstitusi memberi tafsir bahwa Keberadaan kebijakan hukum terbuka (open legal policy) meskipun dapat diterima dalam praktik ketatanegaraan namun dalam perkembangannya Mahkamah konstitusi bisa saja mengabaikan atau mengesampingkan seraya memberi tafsir ulang terhadap norma yang merupakan open legal policy tersebut, sementara dari prosedur pengambilan keputusan dalam Rapat permusyawaratan hakim yang dilakukan dalam perkara Nomor 29/PUU-XXI/2023 ketua mahkamah konstitusi Anwar Usman tidak ikut serta membahas dan memutus untuk menghindari konflik kepentingan, sementara dalam perkara Nomor 90/PUU-XXI/2023 dengan isu konstitusionalitas yang sama ketua mahkamah konstitusi ikut membahas dan memutus perkara dengan putusan dikabulkan sebagian yakni berusia paling rendah 40 tahun atau pernah/sedang menduduki jabatan yang dipilih melalui pemilihan umum termasuk pemilihan kepala daerah.

Abstract

The regulation of the execution of State Administrative Court (TUN) decisions in Law Number 51 of 2009 concerning the Second Amendment to Law Number 5 of 1986 on State Administrative Court does not include a mechanism for executing TUN decisions, which in practice has caused many problems that undermine legal certainty and justice for the public. The focus of the writing is to provide an understanding to the public about the urgency of implementing execution in administrative court decisions. The main issues include two aspects: the obstacles faced by administrative officials in executing administrative court decisions, and solutions to address the compliance problems of administrative officials in executing administrative court decisions. The research method used is a normative research method. The research findings indicate that the obstacles in the implementation of TUN Decisions are due to the non-compliance of TUN officials and the lack of enforcement power for TUN decisions. The solution to address the compliance issues of TUN officials in executing TUN Decisions is to file a maladministration complaint with the Indonesian Ombudsman to exert pressure and revise the PTUN law to provide enforcement measures against the relevant TUN officials.

Abstract

Pembangunan desa sebagai bagian dari otonomi desa memiliki peranan penting dalam pembangunan nasional, di mana desa tidak hanya menjadi objek, tetapi juga subjek pembangunan. Salah satu upaya pemerintah untuk mengoptimalkan otonomi desa adalah melalui pendirian Badan Usaha Milik Desa (BUMDes). Berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa, BUMDes dibentuk untuk memperkuat perekonomian desa dan meningkatkan kesejahteraan masyarakat. BUMDes berfungsi sebagai lembaga yang memiliki peran ganda, yakni sebagai lembaga sosial yang bertujuan untuk kepentingan masyarakat dan sebagai lembaga komersial yang mencari keuntungan. Namun, dalam implementasinya, BUMDes sering menghadapi berbagai tantangan, seperti kerancuan posisi antara institusi sosial dan komersial, rendahnya partisipasi masyarakat, kurangnya pemahaman perangkat desa mengenai pengelolaan BUMDes, serta masalah kepemimpinan dan manajerial. Penelitian ini bertujuan untuk mengidentifikasi tantangan yang dihadapi oleh BUMDes dalam mewujudkan kemandirian desa serta mencari solusi untuk mengatasi masalah-masalah tersebut. Hasil penelitian diharapkan dapat memberikan wawasan mengenai peran BUMDes dalam membangun desa yang mandiri dan meningkatkan kesejahteraan masyarakat pedesaan.

Abstract

The rise of various cases against teachers in carrying out their professional duties is proof that the legal protection of the teaching profession has not been running properly or as it should be. This study aims to understand, explain, and analyze the legal protection for teachers in carrying out their duties to discipline students. This research uses a normative legal research method. This study concludes that legal protection for teachers is one of the efforts to fulfill their rights, as mandated in Law No. 14 of 2005 on Teachers and Lecturers, Article 14. In the administration of education, the government has essentially made efforts to provide legal protection for teachers and other education personnel. However, these efforts are sometimes still inadequate and weak in their implementation. Teachers must perform their duties according to human rights principles (HAM). Teachers can discipline students firmly while still respecting human rights values, creating a positive learning environment, and shaping students' character without violating their fundamental rights. Several laws, such as Law No. 39 of 1999 on Human Rights, and Article 28B, paragraph (2) of the 1945 Constitution of the Republic of Indonesia, regulate the protection of students from the national legal perspective. The number of cases affecting teachers while carrying out their professional duties indicates that legal protection for the teaching profession has not been well implemented or as it should be.
