Abstract

Regional Head Election (Election) directly represent the democratic party will choose direct Regional Head, things in the most tangible manifestation of sovereignty in the hands of the people, as well as the most concrete manifestation in the state administration. Therefore, the system and the organization of the elections is a major concern because through compliance and quality system, the organization of the elections are expected to be able to truly realize of, by and for the people. In this election there are six (6) issues, namely: (1) election marred by political money and the high cost. (2) Election marred lack of neutrality and the movement of Bureaucracy. (3) That would create horizontal conflicts. (4) Sustainability Political Dynasty. (5) a single candidate in the elections (closing the independent candidates and all buy all political party) and (6) Role of Head highly strategic to the success of the elections. Based on the background of the problem dissertation problem is formulated as follows : (1) Why legal protection Head in the elections this time has not been based on values of justice (2) any constraints faced regarding the protection Head in the elections this time? and (3) How rekonstruksi Head of legal protection in the implementation of the elections based on values of justice? This research is a qualitative sociological juridical approach (Socio Legal Approach). This research approach based on the existing problems want to find a deep meaning and details of the implementation and assessment rbagai legal aspects of relations with non-legal aspects of the working of the law in society. Legal research sociological research follows the pattern of the social sciences in particular so-called socio Legal research research. This study aims to reveal the legal protection Head tasks in the implementation of the elections based on values of justice. The research findings indicate that the Head of Legal Reconstruction in the implementation of local elections is dialam Article 70 (1) c Undang-- Law Number 10 Year No. I of 2014 on the Election of governors, regents and mayors into Law - Law, reads: in the campaign of the candidate pairs banned involves: c. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana hukum administrasi dan sistem peradilan di Indonesia yang berkeadilan sesuai asas-asas Pancasila, serta sinergitasnya dalam hukum administrasi. Indonesia yang berlandaskan pada Pancasila dan UUD 1945, selayaknya pula bahwa tujuan dari administrasi negaranya berdasar dan bersumber pada nilai-nilai Pancasila dan UUD 1945. Metode penelitian yang digunakan adalah penelitian kualitatif yaitu penelitian yang dimaksudkan untuk memahami fenomena tentang apa yang dialami oleh subyek penelitian, secara holistik dengan cara deskripsi dalam bentuk kata-kata naratif. Hasil penelitian menunjukkan bahwa hukum administrasi dan sistem peradilan di Indonesia yang berkeadilan sesuai asas-asas Pancasila merupakan kristalisasi nilai-nilai yang hidup dan berkembang dalam masyarakat sejatinya menjadi sumber utama dalam pembentukan hukum administrasi pemerintahan. Landasan ideal yang terformulasi sebagai dasar negara dan terumus dalam lima sila pada hakekatnya mengandung ajaran moral bangsa, ajaran tentang akhlak, bagaimana seseorang bertingkah laku yang baik, yang beretika, bersusila. Sinergitas asas-asas Pancasila sangat relevan dengan hukum administrasi dengan cita-cita bernegara dalam mewujudkan demokrasi yang berpijak pada politik dan nomokrasi yang berpijak pada kedaulatan hukum, sehingga semangat bernegara yang terilhami dalam lima sila Pancasila dalam diwujudkan dalam kehidupan berbangsa dan bernegara.

Abstract

This research aims to analyze the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on protected rice fields in Tegal Regency and the impact of the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on protected lands in Tegal Regency. The urgency of this research is so that the community can obtain legal certainty regarding the status of the land they own after the stipulation of Minister of Agrarian Regulation Number 1589, so that business actors can continue their business again. This type of research is sociological. Sociological jurisprudence is research that aims to obtain legal knowledge empirically by going directly into the object or experimenting with analysis. The results of this research show that the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on rice fields in Lindugi in Tegal Regency has complied with the applicable regulations from the central government, but in its implementation obstacles were encountered, namely the differences in land zone maps between the central and regional governments. Minister of Agrarian Affairs Regulation No. 1589/SK-HK.02.01/XII/2021 regarding rice fields in Lindugi is the legal umbrella for implementing control over the conversion of rice fields in Tegal Regency.

Abstract

The positive fictitious principle in the Law No. 11 of 2020 concerning Job Creation (CK Law) exists to facilitate investment and simplify licensing. However, the provisions in the CK Law, which exclude the role of the Administrative Court in fictitious applications have the potential to cause injustice and legal uncertainty in society. That research focuses on examining the positive fictitious principle's existence after the CK Law's enactment in the paradigm of prophetic law. The paradigm of prophetic regulation was chosen in this study as an effort to explore the theological (divine) and human dimensions in positive fictitious formulations as in CK Law. This research is a normative legal type of research with a concept and statutory approach. The results of the study confirm that in terms of the three aspects of prophetic law, namely transcendence, liberation, and humanization, the provisions of the CK Law, which no longer involve the role of the Administrative Court and have not issued Presidential Regulations regarding positive fiction can cause uncertainty and injustice in society. That makes the substance of the prophetic law in the positive fictitious provisions in the CK Law not be realized optimally. Orientation based on the prophetic legal paradigm in regulating the positive fictitious principle after regulation in the CK Law, according to the author, can be done by revising the positive fictitious provisions in the CK Law by returning the competence of the State Administrative Court.

Abstract

The aim of this research is to analyze the mechanism of the open proportional system in the General Election of the People's Representative Council in Indonesia by referring to Law Number 7 of 2017 concerning General Elections which regulates the open list Proportional Election System, where this system can give rise to a polemic in the struggle for seats. in a very competitive parliament that has the effect of giving birth to an unhealthy model of competition between candidates that only aims to gain as many votes as possible from voters by relying solely on money and popularity. This research method uses normative juridical in answering the problems in this paper. Meanwhile, the results of the research obtained are that an open Proportional System makes it possible for anyone to nominate themselves as members of the legislature. In this system, a person who gets the most votes can take a seat as a member of the People's Representative Council even though the person concerned is at the bottom of the ballot paper.

Abstract

The current research aims to depict how the principle of responsive justice is incorporated in the process of electoral law modification in Indonesia, India, and Australia, as well as to explain the reasons for their differences and the problems of achieving responsive justice in these countries. These objectives are attained through a normative legal approach which includes, but is not limited to, comparative studies, descriptive and explanatory analysis, as well as library research on the electoral legal frameworks of these three nations to determine their compliance with the principle of responsive justice. The results show that the socio-political and economic environment of each country shapes the responsive justice principles to electoral law reforms in the three nations. An open proportional system, coupled with the guarantee of women’s representation is formulated in Indonesia, but suffers from money politics and party system fragmentation. Though the fact governance infrastructure and configurations of elections e.g. government style and usage of Electronic Voting Machines (EVM) technology brings a lot of complexity, India does use the first-past-the-post (FPTP) system, which is less proportional. The EVM technology and FPTP system allow for reserved seats for the marginalized groups as well. Australia stands out with preferential voting, mandatory voting, and accessibility for marginalized groups, although campaign finance transparency remains an issue. Challenges include the influence of political elites, weak legal oversight, and disproportionate representation, while opportunities lie in the use of technology, improved political education, and more transparent and accountable inclusive policies This research is significant because it addresses both theoretical and practical needs in electoral law reform, provides valuable comparative insights, and offers an approach oriented toward substantive justice. These three countries offer valuable lessons in developing electoral systems responsive to societal needs and the challenges of modern democracy.

Abstract

People started looking for information about Fintech Peer-To-Peer (P2P). Online loans have become attached a negative stigma; on the other hand, online credit platforms are very much needed by the community. Through the Financial Services Authority, the government uses this momentum to carry out digital financial literacy regarding online credit. In line with the government's goals, the purpose of Community Service activities from the Master of Law Study Program Universitas Semarang (USM) is to increase understanding, insight, and financial knowledge about Fintech P2P Lending to MSME Groups in Sendangmulyo Village, Semarang City. The material provided includes the development of Fintech P2P Lending in Indonesia. Second, explain the benefits and risks and how to choose an online loan platform registered and licensed at the OJK. Third, explain the consequences and legal protection for ordinary people so they do not worry when facing legal problems with illegal online credit companies. Fourth is the existence of an Investment Alert Task Force (SWI), which was formed to prevent and handle alleged unlawful acts by illegal online loan companies. This activity hopes that the community and MSME actors can choose a legal online credit platform and avoid the entanglement of illegal online credit. Masyarakat mulai mencari informasi mengenai Fintech Peer-To-Peer (P2P) Lending atau pinjaman online menjadi dikenal masyarakat setelah muncul berita maraknya jeratan pinjaman online ilegal. Pinjaman online menjadi lekat dengan stigma negatif, di sisi lain platform pinjaman online sangat dibutuhkan oleh masyarakat. Selaras dengan tujuan pemerintah maka tujuan dari kegiatan Pengabdian Kepada Masyarakat (PKM) adalah meningkatkan pemahaman, wawasan, pengetahuan keuangan digital mengenai Fintech P2P Lending kepada Kelompok UMKM di Kelurahan Sendangmulyo Kota Semarang. Materi yang diberikan meliputi perkembangan Fintech P2P Lending di Indonesia. Kedua, menjelaskan manfaat serta risiko serta bagaimana memilih platform pinjaman online yang terdaftar dan berijin di OJK. Ketiga, memberi penjelasan konsekuensi dan perlindungan hukum bagi masyarakat awam agar tidak khawatir saat menghadapi masalah hukum dengan perusahaan pinjaman online ilegal. Keempat, keberadaan Satuan Tugas Waspada Investasi (SWI) yang dibentuk pemerintah dalam rangka pencegahan dan penanganan dugaan tindakan melawan hukum oleh perusahaan pinjaman online ilegal. Harapan dari kegiatan ini adalah agar masyarakat dan pelaku UMKM dapat memilih platform pinjaman online yang legal serta terhindar dari jeratan pinjaman online ilegal.

Abstract

Introduction: Elections are a vital democratic mechanism in channeling people's voices, electing leaders, and determining policies, with the principles of transparency, fairness, and effective oversight. Although there are still challenges in citizen participation, elections play a crucial role in peaceful transitions of power and socio-political stability.Purposes of the Research: This study aims to analyze efforts to reform electoral law from a responsive justice perspective by comparing laws between Indonesia, India, and Thailand.Methods of the Research: This research is a normative legal research with a conceptual, legislative, and comparative approach.Results of the Research: Election law reform, which includes the implementation of the principles of direct, free, and fair, is needed to create a more democratic system that is responsive to social needs. In Indonesia, India, and Thailand, election law reform focuses on improving the quality of democracy, justice, and voter participation through system changes and revisions to laws. The role of the Constitutional Court and the Supreme Court in each country is very important in ensuring more transparent and fair elections, and reflecting the will of the people.

Abstract

Pemilu merupakan alat yang digunakan sebagai bentuk perwujudan kedaulatan rakyat pada suatu sistem demokrasi. Studi literatur menjelaskan terkait dengan pelanggaran administratif pada pemilu yang dimaksudkan tersebut mencakup beberapa dari aktivitas yang bertentangan dengan mekanisme, prosedur, serta tata cara dalam penyelenggaraan pemilu yang ditetapkan berdasarkan peraturan undang-undang. Tujuan dari penelitian ini yaitu memberikan hasil analisis terkait dengan kesiapan hukum pemilu di Indonesia terhadap digitalisasi pemilu dalam penanganan pelanggaran administratif. Metode penelitian penulisan ini menggunakan jenis penelitian yuridis normatif. Hasil temuan penelitian yaitu beberapa contoh dari pelanggaran administrasi yang dimaksudkan yaitu adanya sistem yang memiliki potensi gagal serta memiliki dampak terhadap hak pemilih atau peserta, akses tidak sah terhadap sistem pemilu, tidak terpenuhinya standar keamanan dan transparansi sistem, kelalaian pengelolaan sistem informasi pemilu, dan manipulasi data atau kesalahan input data. Beberapa contoh dari sistem pelanggaran tersebut tidak memiliki sifat pidana. Akan tetapi, secara tidak langsung jenis pelanggaran yang dimaksudkan tersebut memiliki dampak yang signifikan terhadap legitimasi pemilu serta keadilan. Kesiapan hukum pemilu di Indonesia terhadap digitalisasi pemilu dalam penanganan pelanggaran administratif memaparkan Indonesia belum sepenuhnya siap pada hukum guna menghadapi kompleksitas pemilu berbasis teknologi. Dalam hal ini diperlukan penyesuaian mekanisme pembuktian, penguatan kelembagaan, serta pembaharuan regulasi dengan jelas agar digitalisasi pemilu tidak memiliki potensi dalam melemahkan beberapa prinsip dari pemilu yang demokratis, adil, dan jujur.
