Abstract

Peraturan daerah dalam penyelenggaraan pemerintahan daerah merupakan bagian yang tidak terpisahkan dari desentralisasi atau disebut otonomi daerah. Otonomi daerah bertujuan untuk mewujudkan pemerintahan mandiri yang benar dan bertanggung jawab yang menjamin pertumbuhan dan pembangunan daerah. Fenomena mengenai pedagang yang dipindahkan lokasi berjualannya merupakan hal yang lumrah terjadi, salah satunya adalah Taman Sari di Kota Serang. Kehadiran pedagang kaki lima sering menimbulkan permasalahan yang sering terjadi seperti mengganggu ketertiban dan kebersihan, mengganggu kenyamanan, bahkan merusak keindahan taman kota. Maka pemerintah disini perlu melaksanakan kebijakan relokasi kepada pedagang yang berjualan di kawasan Taman Sari. Satpol PP sangat penting bagi perangkat daerah yang menjalankan peraturan daerah dan menjaga ketertiban publik serta keharmonisan masyarakat. Teori desentralisasi sebagai teori madya, yang didukung oleh teori Lawrence M. Friedman, menyatakan bahwa keberhasilan penegakan hukum tergantung pada tiga komponen sistem hukum: struktur hukum, budaya hukum, dan substansi hukum. Penelitian ini menggunakan metode penelitian normatif, yang merupakan kajian aspek hukum dengan meneliti bahan pustaka atau bahan sekunder. Hasil dari penelitian yang telah dilakukan yaitu: pertama, Bagaimanakah peran atau fungsi peraturan daerah sebagai pelaksanaan Otonomi daerah? Kedua, apakah upaya relokasi pedagang sudah sesuai dengan peraturan daerah Kota Serang yang berlaku?

Abstract

Progressive BPHTB taxation constitutes a regional fiscal policy that functions not only as a revenue-raising (budgetary) instrument but also as a regulatory (regulerend) mechanism aimed at realizing social justice through a more equitable and fair distribution of land ownership. This study seeks to analyze the progressive taxation rules applicable to BPHTB from the perspective of tax justice and to identify potential disputes that may arise, as well as the role of the Tax Court in their resolution.The method employed in this study is a normative-juridical approach with a qualitative orientation. Its application relies on secondary data, encompassing primary legal materials in the form of statutory regulations and secondary legal materials in the form of books and scholarly journals. The discussion demonstrates that, philosophically, progressive taxation on BPHTB represents Aristotle’s concept of distributive justice, John Rawls’s difference principle, and modern theories of tax justice based on the ability-to-pay principle. All three emphasize proportional tax burdens according to individual capacity. The resulting tax revenues are subsequently utilized to enhance public welfare, particularly for groups considered less advantaged.Nevertheless, in practice, there is potential for disputes arising from disharmony between norms and their implementation, such as differences in the interpretation of the Tax Object Acquisition Value (NPOP), variations in Non-Taxable Acquisition Value (NOPTKP) policies among regions, and the perception that the application of progressive BPHTB taxation is disproportionate. The Tax Court plays a crucial role as a corrective mechanism to regional fiscal policies through objection, appeal, and judicial review procedures, ensuring that progressive BPHTB taxation remains within the legal framework and adheres to the principles of tax justice. Therefore, regulatory harmonization, transparency in determining NPOP, and the strengthening of the Tax Court are necessary to achieve a fair and sustainable regional taxation system.

Abstract

This research aims to find out the similarities and differences in the Implementation of Advocate Professional Education between Indonesia and the United States which will be used by Indonesia in forming an ideal Advocate Professional Education in Indonesia. Advocates are regulated in Law Number 18 of 2003 concerning Advocates, but in the Law there is still confusion when the Implementation of Advocate Professional Education is carried out by Advocate Organizations in the form of multi bars which should be single bars so that there is no standardization of Advocate Professional Education. Unlike the United States, which has an established and structured Advocate Professional Education with the Model Rules for Minimum Continuing Legal Education (MCLE) made by the American Bar Association (ABA). So that this raises two questions that will be discussed in this paper with the formulation of the problem in the form of how the similarities and differences in the Implementation of Advocate Professional Education between the two countries and how the ideal form of Advocate Professional Education in Indonesia. This paper uses a normative research method with a comparative approach. Overall, there are several indicators that can be compared in the Implementation of Advocate Professional Education in the two countries and in this case Indonesia must establish an Advocate Supervisory Board to improve the quality of Advocate Professional Education in Indonesia.

Abstract

Penelitian ini berfokus pada proses pelaksanaan Pemilihan Umum (Pemilu) 2024 bagi Warga Negara Indonesia (WNI) yang tinggal di Jerman, dengan menyoroti peran Komisi Pemilihan Umum (KPU) dan Panitia Pemilihan Luar Negeri (PPLN) dalam mengelola dan memastikan hak pilih WNI di luar negeri. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan metode pengumpulan data melalui wawancara, observasi, dan analisis dokumen. Hasil penelitian menunjukkan bahwa persiapan pemilu yang lebih panjang dan matang dapat meningkatkan kualitas pemutakhiran data pemilih dan partisipasi masyarakat. Kendala utama yang dihadapi adalah terkait verifikasi data, kendala administratif, dan komunikasi antar lembaga. Terdapat juga masalah dalam penyebaran informasi yang terkadang terlambat dan tidak mempertimbangkan situasi panitia di luar negeri. Selain itu, kesadaran hukum WNI di Jerman terkait pemilu cenderung rendah, terutama bagi mereka yang telah lama menetap di sana. Namun, kampanye dan debat publik terbukti efektif dalam meningkatkan partisipasi masyarakat. Diharapkan pemerintah dan KPU dapat memperbaiki regulasi dan perencanaan pemilu untuk masa depan, termasuk pemanfaatan teknologi untuk verifikasi data dan penyebaran informasi. Dengan demikian, penelitian ini memberikan rekomendasi untuk meningkatkan koordinasi antara KPU, PPLN, dan WNI serta memperbaiki regulasi yang ada guna memastikan pemilu di luar negeri berjalan dengan lebih baik dan efisien.

Abstract

This study aims to determine the method of constitutional interpretation used by judges in formulating the decision of the Constitutional Court Number 97 / PUU-XIV / 2016. Interpretation of the constitution means to give the meaning or meaning of a term or collection of terms, in an article or paragraph contained in the Act.This research is prescriptive, when viewed from the objectives of this study it includes normative or doctrinal legal research. Sources of legal materials used in this study are primary legal materials, secondary legal materials and non-legal materials. Data collection techniques used are the study of documents or library materials. The data analysis technique used is deductive.The results showed that the type of constitutional interpretation used by the judge in interpreting the decision of the Constitutional Court Number 97 / PUU-XIV / 2016 related to the inclusion of a flow of trust in the Identity Card and Family Card, namely using the interpretation of originalism, namely textual interpretation.

Abstract

ABSTRACTThis study aims to determine whether the Constitutional Court Decision Number 39 / PUU-XVII / 2019 can be used as a legal basis for determining and assigning the winner of a presidential election. This research is a prescriptive normative legal research. The research approach that I use is a statutory approach with data sources obtained through primary and secondary data. Primary data were obtained from laws and rulings, while secondary data were obtained through literature studies, namely books, journals and scientific articles, legal dictionaries and materials from internet media. The data collection technique used is literature study, so that the writing of this law is then understood as writing literature, namely research on secondary data. Based on the results of this study, the authors conclude that theConstitutional Court’s decision does not yet have strong force to become the legal basis for determining the winners of the presidential and vice presidential electionsand even though the principles of justice and truth have been reached, there is no guarantee that the decision will be obeyed.Keywords: legal basis; judicial judgment; general election.

Abstract

The regional autonomy, giving authority to each region to set and managing availablity of natural resources.Through cooperation between the regions optimization the utilization of natural resources especially water to the welfare of all indonesians can be achieved .But in the fact, conflict / dispute often occur between regions caused by differences in perception/ philosophy to the utilization of natural resources itself and carefulness of local government in assessing cooperation made to rules regulations that constantly changing dynamically. Like dispute authority that occur between the Klaten district government with Surakarta government city in water resources Cokro utilization in Klaten district.

Abstract

ABSTRAKPenelitian ini bertujuan untuk membahas tentang pengaturan Gerakan 2019 Ganti Presiden yang berkaitan dengan agenda Pemilihan Umum Presiden yang berlangsung setiap 5 tahun sekali di Indonesia, Untuk mengetahui apakah gerakan tersebut melanggar aturan perundang-undangan di Indonesia atau tidak. Penelitian ini merupakan penelitian hukum (yuridis) normatif, yaitu dengan mengkaji bahan-bahan pustaka (studi kepustakaan), sifat penelitian yang normatif, praktis dan preskriptif. Karena itu, data yang digunakan dalam penelitian ini adalah data sekunder, yang mencakup bahan hukum primer, sekunder, dan tersier, sumber data penelitian berasal dari beberapa bahan hukum yang relevan dengan Pemilu Presiden di Indonesia seperti Undang-Undang Nomor 42 Tahun 2008 Tentang Pemilihan Umum Presiden dan Wakil Presiden, Kitab Undang-Undang Hukum Pidana, Undang-undang Nomor 7 Tahun 2017 yang berhubungan dengan Pemilu. Dokumen tersebut akan dianalisis dan kemudian disusun secara sistematis yang pada akhirnya digunakan sebagai bahan penarikan kesimpulan, sehingga dapat menjawab permasalahan. Pendekatan penelitian menggunakan pendekatan undangundang dan pendekatan kasus. Dalam teknik pengumpulan data menggunakan teknik analisis data dengan logika deduktif, logika deduktif atau pengolahan bahan hukum dengan cara deduktif yaitu menjelaskan suatu hal yang bersifat umum kemudian menariknya menjadi kesimpulan yang lebih khusus.Kata Kunci : Gerakan 2019 Ganti Presiden, Undang-Undang Nomor 7 Tahun 2017, Pemilihan Umum, Kampanye Media Sosial.ABSTRACTThis research discusses about regulating the 2019 Movement to Change the President which discusses for the agenda of the Presidential Election which is held every 5 years in Indonesia, To study whether the movement break the regulations  in Indonesia or not. This research is a normative (juridical) legal research, namely  by examining library materials (literature studies), the normative, practical and prescriptive nature of the research. Therefore, the data used in this study are secondary data, which includes primary, secondary and tertiary legal materials, research data sources related to several legal materials that are relevant to the Presidential Election in Indonesia such as Law Number 42 Year 2008 Regarding Presidential Elections and Vice President, Criminal Law Act, Law Number 7 Year 2017 related to Elections. This document will be analyzed and finalized compiled finally used as conclusions, so as to answer questions. About research using laws and regulations. In data collection techniques using data analysis techniques with deductive logic, deductive logic or the processing of legal materials in a deductive way that is to explain a general thing and then draw more specific conclusions.

Abstract

This study aims to understand the use of medical cannabis for fulfilling citizens' health rights based on scientific research. The study examines the potential positive impacts of legalizing medical cannabis and the potential risks that might occur when a country legalizes medical cannabis. Additionally, it analyzes whether Indonesia should legalize medical cannabis based on existing scientific research. This study employs normative legal research and has a prescriptive- analytical nature, using statutory approaches, historical approaches, case approaches, comparative approaches, and conceptual approaches. This study uses primary legal materials, which are legal materials issued by official government institutions, and secondary legal materials, consisting of document publications not officially issued by state agencies. The results of the study indicate that scientific research on the potential benefits of legalizing medical cannabis is still limited. The lack of comprehensive research means that medical cannabis is not yet fully understood, and many potential benefits and risks still need to be validated. Moreover, in the context of medical cannabis, the supervision of drug distribution plays a crucial role in preventing the misuse of medical cannabis itself.Considering the known potential benefits and risks, Indonesia should not rush to legalize the use of cannabis for medical purposes. Just because many countries have started to legalize the use of cannabis for medical purposes does not mean Indonesia should force itself to legalize medical cannabis, especially since the scientific research is still in its early stages and requires further investigation

Abstract

ABSTRACTIndonesia is one of the countries that often experience child sexual abuse. The cases number significantly increase. The regulations in law Number 35 of 2014 concerning Child Protection are unable to provide a deterrent effect on perpetrators of child sexual abuse. That’s why chemical castration punishment was born. The application of this punishment becomes controversial, some people thought it was appropriate to have a deterrent effect. But on the other hand, this punishment is  considered to violate human rights. The problem in this research is: Does chemical  castration punishment for pedophiles violate human rights?  and what’s the ideal castration punishment to not to violate human rights? the research method used is normative legal research. The purpose of this study is to find out whether castration punishment violates human rights and to find out the ideal way of chemical castration punishment. The theoretical benefit of this research is to develop science, especially in human rights. while the practical benefits of this research are the consideration of the stakeholders in making government regulations related to the method of implementing castration punishment in Indonesia.Keywords  : human rights; chemical castration; sexual abuse.
