The history of political configurations appears to be alternating between democratic and authoritarian political configurations. Likewise, the character of the legal product produced is responsive or autonomous with repressive or conservative or orthodox character. The resulting legal product is a reflection of the political configuration that gave birth to it. The purpose of this research is to know the history of the development of political configuration on the character of Indonesian legal products. This type of research is normative showing that politics is influential in Indonesia's democratic system. The development of the political vision of the community will determine the character of the legal product. A regime that shows that it is more responsive and aspirational for the legal products it produces will create a more democratic life of the nation and state. Period I 1945-1959 During the Liberal Democratic Revolution, the political configuration was democratic, the character of legal products was responsive, the role of political parties as parliaments was very prominent. Period II 1959-1966 During the Old Order of Guided Democracy or Parliamentary political configuration, the character of orthodox legal products, there were deviations from constitutional democracy which showed people's democracy. Period III 1966-1998 The New Order period of Pancasila Democracy was configured with authoritarian politics with the character of orthodox legal products, constitutional democracy, namely Pancasila, with a prominent presidential system. Period IV 1998 The Constitutional Democratic Reform Period has a democratic political configuration, with the character of responsive legal products, the hope of upholding a democratic system of political freedom.

The purpose of this study is to find out some of the dialectical or problematic regulations of sharia-based peer to peer lending financial technology in Indonesia. The discussion in particular, this study explores the problems that arise related to the regulations used in Islamic peer to peer lending fintech which are regulated using the Financial Services Authority Regulation (POJK) Number 77 of 2016 concerning Information Technology-Based Lending and Borrowing Services. In addition, this study will also discuss the urgency behind the importance of establishing sharia-based fintech peer to peer lending regulations as well as ideas about content material that should be included in the formation of special regulations regarding sharia peer to peer lending fintech. This research is a library research through a statute approach. This research uses data collection method in the form of literature study. Through literature study, researchers collect documents and data to be processed using content analysis method. The results of this study indicate that in the regulation of sharia peer to peer lending fintech there are several problems related to the regulations used, the first is that POJK Number 77 of 2016 which is used to regulate sharia peer to peer lending fintech has more connotations of conventional peer to peer lending fintech , so that there is confusion in terms of separating the rules of conventional peer to peer lending from sharia peer to peer lending, Second, the emergence of legal uncertainty because currently sharia peer to peer lending fintech must comply with POJK rules Number 77 of 2016 and the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN MUI Fatwa) Number 117 of 2018. Even though the fatwa should not be a statutory regulation that used to regulate because fatwas are not included in the hierarchy of laws and regulations according to Law Number 12 of 2011 concerning the Establishment of Legislations. Third, there is no regulation regarding the Sharia Supervisory Board in charge of supervising sharia compliance and is closely related to consumer protection, and fourth, POJK Number 11 of 2016 has not regulated in detail the dispute resolution mechanism

Fintech companies that have recently grown rapidly in Indonesia, besides bringing various conveniences for their users, also have risks that need to be understood. One of the risks that can occur is default. Therefore, it is necessary to understand how to resolve this risk. The formulation of this research problem discusses how the risks that occur in Islamic fintech and how to solve the risk of default by borrowers in Islamic fintech. This study aims to describe the settlement of the risk of default by borrowers in Islamic fintech based on a qualitative non-doctrinal approach. Therefore, this study focuses on primary data collected by interview and observation which is supported by secondary data collected by literature study. The results of the study indicate that there is a risk of default, the settlement mechanism has been determined by OJK.Keywords: Fintech; Risk; Failed to Pay.AbstrakPerusahaan fintech yang belakangan berkembang pesat di Indonesia disamping membawa berbagai kemudahan bagi penggunanya juga memiliki risiko- risiko yang perlu dipahami. Salah satu risiko yang dapat terjadi adalah wanprestasi. Oleh karena itu perlu dipahami pula bagaimana penyelesaian jika terjadi risiko tersebut. Rumusan masalah penelitian ini membahas mengenai bagaimana risiko yang terjadi pada fintech syariah dan bagaimana penyelesaian terhadap risiko gagal bayar oleh peminjam pada fintech syariah. Penelitian ini bertujuan untuk mendiskripsikan penyelesaian terhadap risiko gagal bayar oleh peminjam pada fintech syariah dengan mendasarkan pada metode pendekatan non doktrinal kualitatif. Oleh karena itu dalam penelitian ini lebih mengutamakan pada data primer yang dikumpulkan dengan wawancara dan observasi yang didukung dengan data skunder yang dikumpulkan dengan studi kepustakaan. Hasil penelitian menunjukkan bahwa terdapat risiko wanprestasi yang mekanisme penyelesaiannya telah di tetapkan oleh OJK.Kata kunci: Fintech; Risiko; Gagal Bayar

Environmental damage caused by forest conversion in Bima was quite worrying, the impacts were quite diverse. preliminary observations found that Bima Regional Forests were mostly critical because of conversion. On the other hand, there were no visible signs for stopping the natural disasters. Research Objectives: first; to describe an environmental damage of forest conversion; second; to describe policies on overcoming environmental damage and concepts in tackling the sustainable development. Research method were qualitative analysis. The results of this study, environmental damage in Bima were caused by illegal logging, forest encroachment, land conversion by farmers. The factors are due to economic demands, lack of public awareness, lack of socialization from the government, in overcoming prevention and enforcement, in terms of policies carried out by: 1) Mitigation, especially in residential areas, 2) Reforestation; 3) tracing or installation of supporting stones in deforested areas; 4) socialization and guidance, by calling the community to be educated and given knowledge about forest utilization and sustainability, 5) distributing circulars, 6) spraying plants planted on forest land that is functioned.

Pengaturan mengenai Perbankan syariah diperkuat dengan dikeluarkan UU No. 21 Tahun 2008 mengenai Perbankan Syariah. Pada pasal 68 UU ini terkandung pengaturan mengenai kapitalisasi perbankan syariah. Pasal ini menyatakan bahwa UUS yang sudah memiliki modal sebesar 50% atau telah beroperasi selama 15 tahun sejak disahkannya UU ini maka diharuskan untuk melakukan pemisahan/spin-off unit syariahnya tersebut. Tenggat waktu pelaksanaan pasal tersebut tinggal maksimal 2 tahun lagi, dimana terdapat sanksi berupa sanksi administratif maupun penutupan unit apabila tidak dapat memenuhi deadline tersebut. Mandat dari Pasal tersebut berpotensi menimbulkan masalah apabila UUS yang hendak dipisahkan tersebut ternyata belum mampu secara permodalan dan juga infrastruktur untuk dipisah dari bank induknya. Karena struktur organisasi dari UUS ini menjadi berbeda karena pada awalnya hanya merupakan sebuah unit dari perbankan konvensional. Sehingga secara organisatoris merupakan sebuah divisi dimana segala bentuk sistem organisasi masih didukung oleh bank induknya. Mandat pasal ini banyak mendapat tantangan dari pelaku industri perbankan syariah yang merasa belum siap untuk melakukan spin-off. Untuk itu penelitian ini berusaha untuk mencari suatu solusi legal supaya mandat pasal 68 tersebut dapat berubah menjadi corporate action. Solusi ini tetap menjadikan spin-off sebagai suatu keharusan akan tetapi bukan sebagai mandat UU tapi corporate action sehingga pemberlakuannya tidak dibatasi waktu pembatasan bisa dilakukan dengan analisa modal dari UUS sebesar 50% modal bank induknya.

In the industrial era 4.0 as it is today, the ease and speed of getting things are highly sought after, including the ease and speed of getting financial services. The convenience of banking services is an advantage for consumers in choosing the services provided at the bank. This is what banks do to form services from conventional banks to open digital services. However, from a juridical aspect, in Indonesia there is no specific regulation governing digital banks. As a country that adheres to the civil law system, it has become a real consequence that all applicable laws must be codified and regulated in accordance with applicable laws. Problems arise when digital banks operate but there is no legal basis that specifically regulates dealing with it. Through normative juridical methods, research results showed that there are no specific rules governing digital banks in the form of laws in Indonesia, so a special rule is needed regarding digital banks because there are significant differences from conventional banks.

Digital banks in Indonesia are growing rapidly. This phenomenon has given rise to legal disharmony in laws and regulations, considering that banks are institutions with many regulations (fully regulated). Legal disharmony occurs because of the many weaknesses in the current banking regulations, which still focus on the Banking Laws. Law Number 10 of 1998 concerning banking was formed specifically to regulate conventional banking transactions, while the concept of digital banks in its implementation utilizes technology. This difference creates a gap leading to a legal vacuum. By interpreting the articles of Law Number 10 of 1998 concerning banking using a textual approach (focusing on text), this study unveiled that, as the basis for regulating digital banks, this law was still extremely low, limited and no longer compatible with the development of digital banks. Therefore, it is necessary to establish regulations for digital banks to provide legal protection to realize the legal goal of creating justice and legal certainty for the current and future development of the digital banking industry.

Advances in internet technology have given development to buying and selling online. This causes the consumer's position to become weaker in front of the seller because the product to be purchased cannot be checked directly, so if defects are hidden, this can harm consumers. Due to the large number of cases of product defects that occur, this paper will discuss liability for product defects both from the perspective of the electronic transaction information law and according to marketplace policies. According to the ITE Law liability can be in the form of imprisonment and according to the marketplace policy, it will get accumulated penalty points. This study uses normative research methods whereas the data collection technique uses library research. The purpose of this research is so that people who are victims of product defects know what steps to take in seeking accountability according to applicable laws and policies.

Land registration is an important thing that must be done so that legal certainty and legal guarantees can be realized immediately. In this case, the purpose of this dedication is so that the people of Cangkol Village can understand and understand how vital land registration is. The method used in this service is to conduct legal counseling for the people of Cangkol Village and follow up with legal consultations. The service results are increasing legal awareness among the people of Cangkol Village, most of whom have understood and understand the importance of registering their land to protect their rights. The success of this service is that almost all the land in Cengkol Village has been registered and certified.

This paper aims to instigate the implementation of Article 68 of the Islamic Banking Act, which obliges Islamic divisions to be separated from their parent banks. This study attempted to reveal a legal solution so that the obligations can be turned into a corporate action. The argument presented by a critical review approach based on a literature review using secondary data. The solution still considers spin-offs a necessity, not a mandate. It is supposed to be considered a corporate action that its implemented based on readiness so the article needs to be amended. This paper proposes changes to the article on spin-offs for the development of Islamic Banking in Indonesia with practical benefits. Alternative changes can be completed in three ways: first, by issuing Financial Services Authority Regulation (FSAR), which makes the spin-off a corporate action. This method is unconstitutional because FSAR is structurally under the Constitution. The second alternative is done by submitting a judicial review of Article 68 to the Constitutional Court. Finally, the third is by enacting the omnibus law of Islamic economics. Those three options have both advantages and disadvantages. Thus, it is necessary to further find out which solution is most prospective for advancing Islamic banking.Artikel ini bertujuan untuk mendorong penerapan Pasal 68 Undang-Undang Perbankan Syariah yang mewajibkan divisi syariah dipisahkan dari bank induknya. Kajian ini mencoba mengungkap solusi hukum agar kewajiban tersebut dapat berubah menjadi aksi korporasi. Argumen yang disajikan menggunakan pendekatan Solusinya tetap menganggap spin off sebagai kebutuhan, bukan sebagai mandat. Hal ini seharusnya dianggap sebagai corporate action yang pelaksanaannya berdasarkan kesiapan sehingga pasal tersebut perlu diubah. Makalah ini mengusulkan perubahan pasal spin-off untuk perkembangan perbankan syariah di Indonesia dengan manfaat praktis. Alternatif perubahan bisa dilakukan dengan tiga cara, pertama dengan menerbitkan Peraturan Otoritas Jasa Keuangan (POJK) yang menjadikan spin off sebagai corporate action. Cara ini inkonstitusional karena POJK secara struktural berada di bawah konstitusi. Alternatif kedua dilakukan dengan mengajukan uji materi pasal 68 ke Mahkamah Konstitusi. Terakhir, yang ketiga adalah dengan pengundangan omnibus law ekonomi syariah. Ketiga pilihan tersebut memiliki kelebihan dan kekurangan. Untuk itu perlu dikaji lebih lanjut solusi mana yang paling prospektif untuk memajukan perbankan syariah.
