Abstract

AbstractThe author conducted this research with the background of the implementation of Mediation in Kuningan Religious Court in Kuningan. The purposes of writing this paper are to know how the Implementation on Divorce Settlement in Kuningan Religious Court and to know the factors that affect the success of mediation in the Kuningan Religious Court. The method used in this research is with empirical juridical approach using primary data and secondary data and data collection techniques are interviews, observation and literature study. The results of this research are the mediation arrangements set out in the Supreme Court Regulation (PERMA ) Number 1 Year 2016 about Mediation Procedures in Courts and more specifically stipulated in the Decree of the Chief Justice Number 108 / KMA / AK / VI / 2016 on Mediation Governance at the Court. Mediation is the means of dispute resolution through the negotiation process to obtain agreement of the Parties with the assistance of the Mediator. Mediator is a Judge or any other party who has a Mediator Certificate as a neutral party assisting Parties in the negotiation process to see possible dispute resolution without resorting to the disconnection or enforcement of a settlement. Its implementation has been regulated in Law Number 1 Year 1974 about concerning Marriage, Compilation of Islamic Law, and Supreme Court RegulationNumber 1 of 2016 concerning Mediation Procedure in Court. The conclusion of this thesis writing is Mediation which should be one of the alternative process of dispute settlement which can give greater access to justice to the parties in finding satisfactory dispute settlement and to fulfill the sense of justice, and become one of the effective instrument to overcome the problem of case buildup especially for the case Divorce, in the end has not been effectively implemented.Keywords: Mediation, Divorce, Marriage. AbstrakPenulis melakukan penelitian ini dengan latar belakang yaitu bagaimana pelaksanaan Mediasi pada Pengadilan Agama Kuningan. Tujuan penulisan ini untuk mengetahui bagaimana Pelaksanaan pada Penyelesaian Perceraian di Pengadilan Agama Kuningan dan untuk mengetahui bagaimana faktor-faktor yang memepengaruhi keberhasilan mediasi di Pengadilan Agama Kuningan. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris dengan menggunakan data primer dan data sekunder serta alat pengumpulan data yang digunakan melalui wawancara, observasi dan studi pustaka. Hasil penelitian ini adalah pengaturan mediasi diatur dalam Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan dan lebih spesifik diatur dalam Keputusan Ketua Mahkamah Agung Nomor : 108/KMA/AK/VI/2016 tentang Tata Kelola Mediasi di Pengadilan. Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Mediator adalah Hakim atau pihak lain yang memiliki Sertifikat Mediator sebagai pihak netral yang membantu Para Pihak dalam proses perundingan guna mencari berbagai kemungkinan penyelesaian sengketa tanpa menggunakan cara memutus atau memaksakan sebuah penyelesaian. Pelaksanaannya telah di atur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkwinan, Kompilasi Hukum Islam, dan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Kesimpulan dari penulisan skripsi ini adalah Mediasi yang seharusnya menjadi salah satu alternatif proses penyelesaian sengketa yang dapat memberikan akses keadilan yang lebbesar kepada para pihak dalam menemukan penyelesaian sengketa yang memuaskan dan mmemenuhi rasa keadilan, serta menjadi salah satu instrumen efektif mengatasi masalah penumpukan perkara khususnya untuk perkara perceraian, pada akhirnya belum efektif dilaksanakan.Kata Kunci : Mediasi, Perceraian, Perdata

Abstract

Article 1 (1) of the 1945 Constitution states that, Indonesia is the law of the State in the form of Republic. Therefore, the provisions of the applicable legislation and set the life of the Indonesian nation comes from the law, whether written or unwritten law. One runway is used as basic guidelines in order to achieve justice for all Indonesian people, especially in the field of law, set forth in Article 27 paragraph (1) of the Act of 1945, which reads, "All citizens are equal before the law and government and must uphold the rule of law and without exception. " Protection of witnesses reporting the crime of pornography, the identity of a witness, obviously very secret and confidential examined by the police, even on a trial judge has no right to bring a witness, before the trial because the reporter's identity confidentiality is strictly protected by the Law No. 44 Year 2008 on pornography.  Factors that became penghamabat the police to provide protection against the crime of pornography reporting, that one of the eligibility period and the cost to hold the protection of witnesses and victims must require substantial funds, although basically the police have been very ready to implement the law , subject to the government in terms of a special budget for the program of protection, especially for operational costs in the field.  Keywords: Crime, Pornography, Witness, Protection.

Abstract

AbstractThe purpose of this research is to know the security arrangement at Penitentiary Institution and House of Detainee against security system of correctional institution and implementation of security in Class IIA Penitentiary Kuningan. This type of descriptive analysis research with empirical juridical approach. The result of the research stated that the Regulation of Permenkumham Number 33 Year 2015 concerning Security at Penitentiary and House of Detainees has been arranged in detail and complete but in its implementation there are various obstacles so that in Class IIA Kuningan Class has not fully applied maximally, especially in guarding and guarding at the time of assimilation which should be supervised and supervised but only accompanied by regular staff assigned. The conclusion is that to optimize security requires human resources and other resources such as technology, infrastructure.Keywords: Implementation, Security System, Penitentiary AbstrakTujuan penelitian ini adalah untuk mengetahui pengaturan pengamanan pada Lembaga Pemasyarakatan dan Rumah Tahanan Negara terhadap sistem keamanan lembaga pemasyarakatan dan implementasi pengamanan di Lembaga Pemasyarakatan Kelas IIA Kuningan. Jenis penelitian deskriptif analisis dengan pendekatan yuridis empiris. Hasil penelitian mengemukakan bahwa pengaturan Permenkumham Nomor 33 Tahun 2015 tentang Pengamanan pada Lembaga Pemasyarakatan dan Rumah Tahanan Negara telah diatur secara terperinci dan lengkap namun dalam pelaksanaannya terdapat berbagai hambatan sehingga di Lapas Kelas IIA Kuningan belum sepenuhnya diterapkan secara maksimal terutama dalam penjagaan dan pengawalan pada saat asimilasi yang seharusnya dilakukan pengawasan dan pengawalam tetapi hanya didampingi oleh staf biasa yang ditugaskan. Kesimpulannya yaitu untuk mengoptimalkan pengamanan memerlukan sumber daya manusia dan sumber daya lainnya seperti teknologi, sarana prasarana.Kata Kunci: Implementasi, Sistem Keamanan, Lembaga Pemasyarakatan

Abstract

Pemerintah dalam arti luas adalah semua lembaga negara yang terdiri dari lembaga-lembaga legislatif, eksekutif dan yudikatif. Dalam arti sempit pemerintahan adalah segala kegiatan, fungsi, tugas dan kewajiban yang dijalankan oleh lembaga eksekutif untuk mencapai tujuan negara. Pemerintahan dalam arti luas adalah segala kegiatan yang terorganisir yang bersumber pada kedaulatan dan kemerdekaan, berlandaskan pada dasar negara, rakyat atau penduduk dan wilayah negara itu demi tercapainya tujuan negara. Di samping itu dari segi struktural fungsional pemerintahan dapat didefinisikan pula sebagai suatu sistem struktur dan organisasi dari berbagai macam fungsi yang dilaksanakan atas dasar-dasar tertentu untuk mewujudkan tujuan Negara. Dalam UUD 1945 Pasal 1 ayat (1), dinyatakan bahwa “Negara Indonesia ialah Negara Kesatuan yang berbentuk Republik”. Sejalan dengan pasal tersebut keutuhan suatu negara atau yang disebut juga integritas negara adalah suatu hal yang paling penting  yang menjadi dasar eksistensi setiap negara. Ketika negara bebas dari ancaman disintegrasi, maka sesungguhnya eksistensi negara tersebut telah kuat tak tergoyahkan. Hal yang sama berlaku bagi Negara Kesatuan Republik Indonesia (NKRI). Integritas Indonesia, yang disebut dengan keutuhan Negara Kesatuan Republik Indonesia. Keutuhan NKRI adalah fungsi dari pengertian dan tujuan negara, sebagaimana termaktub di dalam penjelasan Pembukaan UUD 1945. Itulah sebabnya sejak awal NKRI didirikan pemerintah dan berbagai elemen rakyat terus menerus berupaya mempertahankan persatuan dan kesatuan nasional. Setiap negara menganut sistem pemerintahan yang sesuai dengan dasar negara dan Undang-Undang Dasar yang dimilikinya. Indonesia memiliki dasar negara, yaitu Pancasila dan Undang Undang Dasar 1945. Oleh karena itu, Indonesia menganut sistem pemerintahan yang sesuai dengan dasar negara, yaitu Pancasila dan Undang Undang Dasar 1945. Kata kunci : Dana, Otonomi, Kebijakan.

Abstract

Bureaucratic reform is essentially an attempt to reform and fundamental changes to the systems of governance in order to reach the goal of bureaucratic reform to accelerate achievement of good governance and efforts to improve support for local government in Increasing performance. Bureaucracy reform program running which consisted principally of institutional reform, human resources management reform and information technology support in the licensing process. Institutional reform is to establish a new agency that handles the licensing process in the past, integrated licensing process to go through the different agencies and with the reform of the bureaucracy in the licensing process united in one body that is unified, improve human resources through training and increase the transparency of information through the management information technology support. Bureaucratic reform in investment licensing and the area is already under way in an effort to improve service to the community that good governance is not just adream and soon became a reality.Keywords: Licensing, Service, Bureaucratic Reform.

Abstract

Abstrak : Desentralisasi yang berkembang di Indonesia memiliki suatu tujuan dalam perkembangan ekonomi di Indonesia, yaitu meningkatkan perekonomian dari sector terkecil yang terdapat di daerah. Berdasarkan hal tersebut pemerintah daerah mendapatkan delegasi kewenangan dari pemerintahan pusat untuk membentuk suatu kebijakan yang mendukung peningkatan perekonomian daerah. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis bagaimana pengaturan tentang Bangunan yang melanggar ketentuan Garis Sempadan Jalan di Pasar Darma Kabupaten Kuningan sesuai Peraturan Daerah Nomor 8 Tahun 2013 tentang Garis Sepadan Jalan dan Bagaimana Implementasi dari Pasal 6 Peraturan Daerah Nomor 8 tahun 2013 tentang Garis Sempadan Jalan di Pasar Darma Kecamatan Darma Kabupaten Kuningan?. Penelitian ini dilakukan dengan metode pendekatan yuridis emipis dengan spesifikasi penelirian deskriptif analitis yang melibatkan penelitian kepustakaan dan penelitian lapangan dengan menggunakan data primer dan data sekunder serta metode penarikan kesimpulan analisis yuridis kualitatif, data yang terkumpul kemudian dianalisis secara kualitatif. Hasil penelitian ini menemukan bahwa ketidaksesuaian fungsi ruang garis sempa dan jalan yang itu terdapat bangunan di area garis sempadan jalan tersebut. Peraturan Daerah Nomor 8 Tahun 2013 tentang Garis Sepadan Jalan terdapat ketentuan pidana bagi pelanggar area garis sempadan jalan. Selain itu implementasi dari Pasal 6 Peraturan Daerah Kabupaten Kuningan Nomor 8 Tahun 2013 tidak sesuai dengan yang diharapkan aturan tersebut, yaitu jarak garis sempadan jalan yang seharusnya 14.5 meter dari garis tengah jalan ditemukan hanya kurang dari 10 meter dari garis tengah jalan. Kesimpulannya perlunya dilakukan penataan dan sosialisasi kepada masyarakat terkait dengan garis sepadan jalan.Kata Kunci  : izin, jalan, pelanggaran THE IMPLEMENTATION OF REGIONAL REGULATION NUMBER 8 YEAR 2013 ABOUT BOUNDARY LINE IN KUNINGAN  REGENCY Abstract : The decentralization that developed in Indonesia has a goal in economic development in Indonesia is to improve the economy of the smallest sector in the region. Based on this the local government gets delegation of authority from the central government to form a policy that supports the improvement of the regional economy. The purpose of this study is to find out and analyze how the arrangement of the building that violates the provisions of the boundary line in Pasar Darma Kuningan district according to Local Regulation No. 8 of 2013 on the boundary line and how to implementation of Article 6 of Regional Regulation No. 8 of 2013 on boundary line in Darma Market, Darma District, Kuningan Regency. This research using the method of juridical emipis approach with descriptive analytical specification involving library research and field research using primary, secondary data and method of conclusion of qualitative juridical analysis, analyzed qualitatively. The results of this study found that the mismatch of boundary line and building space functions in the area of the boundary line. In the regional regulations there is a criminal provision for offenders of the boundary line area. The implementation of Article 6 of Regional Regulation of Kuningan Regency Number 8 of 2013 is not in accordance with the regulation, ie the distance of the boundary line  that should be 14.5 meters from the center line of the road is found to be less than 10 meters from the center line of the road. Abstract

The purpose of writing this paper is to find out how to regulate the authority of the Regional Representatives Council and to find out the obstacles of the Regional Representative Council in carrying out the Formation and Expansion of Regions in West Java Province. The method used in this study is an empirical juridical approach using primary and secondary data and data collection techniques used through interviews, observations and literature studies. The result of this research is the regulation on the authority of the Regional Representatives Council based on Article 22 D of the 1945 Constitution of the Republic of Indonesia and Government Regulation Number 78 of 2007 concerning Procedures for the Establishment, Abolition and Merger of Regions, the implementation of these regulations has been in accordance with the existence of a new autonomous region candidate. An effort to equalize public services, it's just that the regulation of the authority of the Regional Representatives Council is strengthened so that it is more capable of carrying out legislative functions for the benefit of the region, as well as obstacles to the Regional Representative Council starting from the absence of approval of the new regional head candidate to the last moratorium. The conclusion of this research is that the regulation of the Regional Representatives Council Authority has not provided a balance in the constitutional system because of the imbalance between the Regional Representatives Council and the People's Representative Council in the legislative function in parliament and the Regional Representative Council still has obstacles in carrying out regional expansion. As the suggetion of this research is that it needs a regulation that clearly regulates the authority of the Regional Representatives Council in the State Administration system in Indonesia so that the Regional Representative Council is more capable of carrying out legislative functions for the benefit of the region, as well as regulations or rules regarding the Formation and Expansion of Regions should have legal certainty dimensions so that they are not ambiguous in regarding the implementation of Regional Formation and Expansion.

Abstract

An insurance agreement occurs where the policyholder transfers the risk to the insurance company. Legal protection regarding to life insurance policy holders is regulated in the Law of the Republic of Indonesia Number 40 of 2014 concerning Insurance. Life insurance claims are in the form of claims from the insured party where the policy holder asks for his rights in the life insurance policy agreement to make payments on the life insurance benefits. This study aims to determine the legal protection for life insurance policy holders and the procedure for settlement of life insurance claims. Life insurance claims often have difficulty in filing, because the company has standards in submitting claims listed in the provisions of the life insurance policy book. Therefore, if the claim submitted by the policyholder has met the specified requirements, the life insurance claim will be unlikely to be rejected. The formulation of the problems in this study are how to regulate legal protection for life insurance policy holders in Indonesia, and how the procedure for resolving insurance claims is for life insurance policy holders. The research method used is descriptive-analytical with a normative juridical approach. The results of the study indicate that the regulation regarding legal protection for life insurance policy holders is regulated in the Law of the Republic of Indonesia Number 40 of 2014 concerning Insurance which is described in the Government Regulation of the Republic of Indonesia Number 87 of 2019 concerning Insurance Companies in the Form of Joint Ventures and other implementing regulations. The insurance claim settlement procedure for life insurance policy holders can be carried out if it is in accordance with what is stated in the standard clauses or provisions of the life insurance policy agreement.

Abstract

Pemilihan kepala daerah secara langsung dan serentak merupakan bentuk nyata pelaksanaan otonomi daerah karena rakyat bisa memilih secara langsung para pemimpin yang dikehendakinya. Oleh karena itu pemerintah telah menyiapkan perangkat perundang-undangan untuk mendukung kegiatan pemilihan kepala daerah secara langsung tersebut. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana pelaksanaan serta permasalahan yang terjadi dalam Pemilihan kepala daerah secara langsung dan serentak serta upaya yang bisa dilakukan untuk menyelesaikan problematika tersebut untuk mewujudkan pemilihan yang lebih demokratis dan ideal bagi daerah. Metode penelitian berupa penelitian hukum empiris yang bersifat deskriptif dengan pendekatan socio legal research. Hasil penelitian menunjukan bahwa pelaksanaan pemilihan kepala daerah secara langsung dan serentak pada tahun 2015, 2017 dan 2018 masih ditemukan berbagai permasalahan dari sejak tahapan dimulai sampai pada hasil Pemilihan, untuk itu perlu dilakukan pembaharuan perundang-undangan Pemilihan kepala daerah berdasarkan prinsip-prinsip demokrasi yang rasional agar pelaksanaan pemilihan kepala daerah berikutnya dapat terlaksana lebih demokratis sesuai aspirasi masyarakat dan kondisi daerah.   The direct and simultaneous election of regional heads is a tangible form of implementing regional autonomy because the people can directly elect the leaders they want. Therefore, the government has prepared legislation to support the direct election of regional heads. The problems discussed in this study are how the implementation and problems that occur in direct and simultaneous regional head elections and the efforts that can be made to resolve these problems to realize a more democratic and ideal election for the region. The research method is in the form of descriptive empirical legal research with a socio legal research approach. The results of the study show that the implementation of direct and simultaneous regional head elections in 2015, 2017 and 2018 still found various problems from the stage starting to the election results, for this reason it is necessary to reform the legislation on regional head elections based on rational democratic principles. so that the implementation of the next regional head election can be carried out more democratically according to the aspirations of the people and regional conditions.
