Abstract

Dualism dilemma between zakat and tax in Indonesia can be relatively mitigated by ratification of Act No. No. 38/1999 on Management of Zakat. In the regulation, zakat has been synergized with tax by placing zakat as a deduction from taxable income element (PKP). But so far it has not been given the significant impact on the acceptance of zakat and awareness of Muslims to pay zakat. There are also some problems in practical level that contribute to that fact. This article explores the zakat and tax synergy that have been achieved through Act No. 38 of 1999, the problems found in its execution, and of course an offer for a solution to optimize the role of zakat and tax for the people welfare. By examining same practice in some countries, this paper recommends zakat as a direct tax deduction (tax credit) as a strategic step in the effort to optimize the role of zakat.

Abstract

This paper proposes an idea of revitalization. This idea is based on by looking at the lawsuits occurred within the Islamic laws related to family, especially poligamy. This is proposed because polygamy is believed no longer relevant with the changing times which now requires equality of between man and woman. To address this problem, some ideas put forward to reform and re-interpretate some Islamic laws which lays into two major epistemologies: first, contextual interpretation over the texts which are the basis of the implementation of poligamy which in turn was not the core mission of Islam. Meanwhile, it is believed that the fundamental goal of marriage in Islam monogamous. The justification of poligamy by putting forward the texts do not eliminate but gradually endorse the practices of polygamy itself. Therefore, there is still a room to critique the context of polygamy by contextualizing the polygamy laws in which most previous studies were not objective and tend to justify the dominant discoureses on gender relation.

Abstract

Islam is a universal religion. Its validity beyond the boundaries of pace and time, have challenges while confronted to modernity. New issues emerged make legal problems that must be faced by Islam, in this case fiqh, are becoming increasingly complex and require answers that are not easy. Many attempts were made contemporary muslim intellectual response to the challenge. In general, the effort was focused on two of epistemology: contextual interpretation and emphasis on the principle of maslahah. Practically, both the offer did generate a lot of laws in accordance with the present conditions. But apparently, both contain serious problems if not addressed promptly can undermine the foundations of religion that threatens the authenticity of Islam as a religion of revelation

Abstract

Tulisan ini mengkaji pemberitaan media online atas peristiwa penganiayaan terhadap siswa SMP di Pontianak bernama Audrey oleh beberapa siswa SMA. Peristiwa ini terjadi di bulan April 2019 dan mendapatkan liputan yang luas dari berbagai media massa (online atau pun offline) sehingga menjadi viral. Kompas.com dan Republika Online (Republika.co.id) dipilih karena keduanya merupakan dua media massa arus utama yang terbit dalam dua paltform, online dan offline, dan memiliki ideologi yang berbeda. Kompas dikenal sebagai media nasionalis yang didirikan kalangan aktivis Kristen dengan bantuan beberapa petinggi militer. Sedangkan Republika merupakan media massa nasionalis yang diinisiasi aktivis Islam (ICMI) dengan dukungan beberapa petinggi pemerintah. Di sini penulis menggunakan  analisis wacananya Van Dijk untuk sebagai metode untuk mengkaji pemberitaan kasus penganiayaan Audrey di dua media tersebut. Dari kajian yang penulis lakukan didapatkan kesimpulan bahwa  Kompas.comMemberitakan peristiwa tersebut sesuai dengan ideologinya yaitu humanisme netral agama. Media ini memberitakan  kronologi dan respon masyarakat terkait tindakan kekerasan yang terjadi pada Audrey. Sedangkan Republika Online lebih menekankan pada pesan moral kepada masyarakat tentang kegagalan orang dewasa dalam mendidik anak. Republika Online menampilkan berita dengan menunjukan warna keislaman yang kental. This paper discusses online media coverage of the persecution of a junior high school student in Pontianak named Audrey by several high school students. This incident occurred in April 2019 and received wide coverage from various mass media (online or offline) so that it went viral. Kompas.com and Republika Online (Republika.co.id) were chosen because they are two mainstream mass media published on two platforms, online and offline, and have different ideologies. Kompas is known as a nationalist media founded by Christian activists with the help of several high-ranking military officials. Meanwhile, Republika is a nationalist mass media initiated by Islamic activists (ICMI) with the support of several high-ranking government officials. Here the author uses Van Dijk's discourse analysis as a method for studying the reporting of the Audrey persecution case in these two media. From the study that the author conducted, it was concluded that Kompas.com Reporting the event is in accordance with his ideology, namely religious neutral humanism. This media reports the chronology and public response regarding the violence that happened to Audrey. Meanwhile, Republika Online emphasizes more on moral messages to the public regarding the failures of adults in educating children. Republika Online displays news by showing a thick Islamic values.

Abstract

This paper speaks of something unusual. Exlusive Islam has been commonly branded as untolerant, while the inclusive Islam has been identified as tolerant. This paper tries to prove the reverse that the exclusive Islam can be tolerant too. It addresses first the problem of religion-based conflict in Indonesia arguing it is this problem that provoked the birth of such liberal font of Islam called Jaringan Islam Liberal (JIL). Born to propagate the polite Islam, the movement turned out to be just another defect within the Muslim society. The fact is that, majority of Muslims in the country are not happy with it. The reaction of Muslims varied, and culminated in the issuance of the Indonesian Council of Ulama (Majelis Ulama Indonesia/ MUI) that such notion as religious pluralism that the movement is busy campaigning for is forbidden religiously. This paper is an attempt to reconstruct the pluralistic discourse in a way that would not iritate the conservative segment of Muslim society. It also tries to understand why majority of Muslims in this country rejected the idea of religious pluralism propounded by the liberals.

Abstract

This article examines power struggle in the discourse of Islam Nusantara which becomes very popular in contemporary Indonesian Islam. The idea of Islam Nusantara is not different from Islam in general, but with distinctive charactericstics, such as tawâzun, i‘tidâl, and tawassut}. The proponents of this idea claim that their intellectual framework is based on the principle of maslah}ah mursalah, istih}sân, and ‘urf. Using critical discourse analysis, this article attempts to see the other side of Islam Nusantara discourse. This study is based on an assumption that language and discourse are not only an instrument to convey ideas, but also a means to construct social reality. Social activities are always related to and constructed by their social settings. This article argues that the discourse of Islam Nusantara emerges as a part of struggle for influence between mainstream Islamic movements, such as Nahdlatul Ulama and Muhammadiyah, and new transnational Islamic movements, such as Tarbiyah, Hizbut Tahrir, and Salafis. The use of the term Islam Nusantara is indeed the effort of mainstream Islamic movements to create the image of indigenous Islamic movements, different from the newly imported Islamic movements. However, the discourse of Islam Nusantara seems to be reductionist and monolithic in perceiving diverse realities of Islam in Nusantara.

Abstract

The purpose of this study is to examine the Tahfiz al-Qur'an Curriculum and Tahfiz learning management at the “Daarul Qur'an” Islamic Boarding School of Tahfiz, Tangerang, Banten. This study is a qualitative research presented in a descriptive-analytical way. The data were collected through interviews, observations, and document studies. This research was conducted at the Tahfiz Daarul Quran Islamic Boarding School in Tangerang in 2018. The conclusion of this research is that Pesantren Tahfiz Daarul Qur'an Tangerang is managed by modern management while maintaining traditional values. In addition to tahfiz activities, students also get non-tahfiz learning. However, the right curriculum makes the students not divided in their concentration in memorizing the Qur'an. This actually encourages the development of the potential of students in other fields at the same time. However, there is still a need to improve the curriculum to further refine it

Abstract

The study on the Ulama in the Eastern Part of Indonesia, especially Bima and its surrounding area was scarcely limited, especially related to the Ulama Network in Nusantara during the XVIII-XX centuries. This study is expected to not only contribute to this lack of knowledge about the subject but also to pave a way for sustainable study on the network of Ulama from Bima in Nusantara. This paper will investigate one of the Ulama or Tuan Guru who lived in the XX century, which was the last generation of Ulama from Bima’s involvement in the Ulama Network of Nusantara, called Tuan Guru H. M. Said Amin. This study is focused on the intellectuality chain hence, its correlation with the Ulama Network of Nusantara can be found and this paper is concluded with several of his thoughts in Islamic law.

Abstract

Abstract This paper examines the potential of religion as the main source of harmony in a plural society. This paper itself is motivated by the fact that religion has two different faces: integrative and confrontational. On the one hand religion can encourage integration in society, however religion also has the potential to cause conflict and tension in the community, especially in the people with complex levels of diversity. In multicultural societies, integrative religious attitudes are needed to avoid conflicts. But making it happen is not as easy as turning our hand. The factor of understanding religious texts that are exclusive and based on hatred is one of the challenges. This will be further complicated when external factors (economic, political) are involved. By using philosophical-reflective methods, the writer offers two ways of religious that can create harmony in different cultures and beliefs, namely: exclusivenes-tolerance religious, and willingness to engage in interfaith dialogue. With these two things the writer believes that religious people still feel comfortable with the truth of their own religion, and at the same time they live in peace with people of different religions. Abstrak Tulisan ini mengkaji tentang potensi agama sebagai sumber utama harmoni dalam masyarakat majemuk. Tulisan ini sendiri dilatar belakangi oleh kenyataan bahwa agama memiliki dua wajah yang saling berbeda: integratif dan konfrontatif. Di satu sisi agama bisa mendorong terjadinya integrasi dalam masyarakat, namun demikian agama juga berpotensi menimbulkan konflik dan ketegangan di tengah masyarakat, khususnya masyarakat dengan tingkat keragaman yang kompleks.Dalam masyarakat multikultural, sikap beragama yang integratif sangat diperlukan agar tidak terjadi konflik. Namun mewujudkannya tidak semudah membalikkan tangan. Faktor pemahaman terhadap teks-teks keagamaan yang tertutup dan didasari kebencian menjadi salah satu tantangan. Ini akan semakin rumit ketika faktor-faktor eksternal (ekonomi, politik) turut terlibat. Dengan menggunakan metode filosofis-reflektif penulis menawarkan dua cara beragama yang bisa mewujudkan harmoni dalam masyarakat yang berbeda budaya dan keyakinan, yaitu: keberagamaan yang ekslusif-toleran, dan kesediaan diri untuk melakukan dialog antarumat beragama. Dengan dua hal ini penulis meyakini umat beragama tetap merasa nyaman dengan kebenaran agamanya sendiri, dan di saat bersamaan mereka hidup damai dengan umat agama yang berbeda. Kata Kunci : Keberagamaan, Konflik, Masyarakat Multikultural, Ekslusif-Toleran, Dialog Antaragama.

Abstract

Abstrak: Radikalisme atas nama Islam kembali marak di Dunia Islam kontemporer. Gerakan ini mewujud dalam berbagai aksi kekerasan dan perlawanan terhadap kelompok-kelompok yang dianggap sebagai musuh Islam. Faktor politik, ekonomi, dan ketidakadilan global yang dbungkus dengan sentimen keagamaan menjadi pendorong kebangkitan gerakan ini. Dengan ideologi “jihad”-nya, mereka menyebarkan pahamnya ke berbagai belahan dunia, tak terkecuali Indonesia. Dengan pendekatan sosio-politik, kajian ini hendak mengkaji ideologi gerakan Jihad Global, pengaruh, dan jaringannya di Indonesia. Dari kajian ini terlihat bahwa gerakan Jihad Global memiliki kaitan erat dengan gerakan reformasi Islam yang merupakan respons atas kemunduran Dunia Islam berhadapan dengan Dunia Barat. Pengembangan ide ini oleh Sayyid Quthb membuat gerakan reformasi bukan sekedar sebagai otokritik atas kondisi umat, namun juga mengeras menjadi ideologi perlawanan terhadap sistem yang dianggap menindas. Ideologi perlawanan inilah yang kemudian mengilhami berbagai gerakan ekstrem di Indonesia pasca reformasi. Abstract: Radicalism in the name of Islam is re-emerging in the contemporary Islamic world. This movement manifested in various acts of violence and resistance against “enemies of Islam”. Political, economic, and global injustice factors wrapped in religious sentiments are the driving forces for the revival of this movement. With ideology of "jihad", they spread their understanding to various parts of the world, including Indonesia. With a socio-political approach, this study aims to examine the ideology of the Global Jihad movement, its influence, and its network in Indonesia. From this study, it can be seen that the Global Jihad movement is closely related to the Islamic reform movement which is a response to the decline of the Islamic world in dealing with the West. The development of this idea by Sayyid Qutb made the reform movement not only as an autocritic of the condition of the ummah, but also hardened into an ideology of resistance to a system that is considered oppressive. This ideology of resistance then inspired various extreme movements in post-reform Indonesia.
