Abstract

The purpose of this paper is to analyze the meaning of certain reasons in the Notary Ethics Code, related to the obligation to carry out positions in his office and the consequences of violating these provisions on the authenticity of the deed. The method used is a normative juridical method with a statutory approach and a conceptual approach. The results of the study indicate that the meaning of "certain reasons" referred to in Article 3 number 15 of the Notary Ethics Code is the reasoning allowed by the Law, namely related to the making of a deed that is not possible to be carried out in a notary's office. If the notary public violates the provisions of Article 3 Number 15 in making an authentic deed, but in making it does not violate any or even all of the terms of authenticity of the deed, then the deed remains an authentic deed. This article aims to determine the background of this type of research that is normative legal research using literature and interviews to obtain data in this study. The method used in the literature approach is used to analyze various laws and regulations related to the Regional Supervisory Assembly in exercising its authority. The results of this study state that the authority of the Supervisory Council based on the Law of Notary Position only covers violations of the UUJN itself, when there is a violation of the notary code of ethics,Keywords: Supervision; Notary Public; Code of Ethics, Obligations; Position AbstrakTujuan penulisan ini adalah menganalisis makna alasan-alasan tertentu dalam Kode Etik Notaris, terkait kewajiban untuk menjalankan jabatan di kantornya dan konsekuensi pelanggaran ketentuan tersebut terhadap otentisitas akta. Metode yang digunakan adalah metode yuridis normatif dengan pendekatan peraturan perundang undangan dan pendekatan konseptual. Hasil kajian menunjukan bahwa makna “alasan-alasan tertentu” yang dimaksud dalam Pasal 3 angka 15 Kode Etik Notaris adalah alasanalasan yang diperbolehkan oleh Undang-Undang, yakni terkait pembuatan akta relaas yang tidak dimungkinkan dilaksanakan di kantor notaris. Apabila notaris melakukan pelanggaran terhadap ketentuan Pasal 3 Angka 15 dalam pembuatan akta otentik, namun dalam pembuatannya tidak melanggar salah satu ataupun beberapa bahkan semua syarat otentisitas akta, maka akta tersebut tetap merupakan suatu akta otentik. Artikel ini bertujuan untuk mengetahui latar belakang Jenis penelitian ini yaitu penelitian hukum normatif dengan menggunakan studi pustaka dan wawancara guna mendapatkan data dalam penelitian ini. Metode yang digunakan pendekatan secara pustaka digunakan untuk menganalisis berbagai peraturan perundangundangan terkait dengan Majelis Pengawsas Daerah dalam menjalankan kewenangannya. Abstract

The purpose of this study is to find out and analyze how the arrangements regarding the principles of good governance in Indonesia. The research method uses a normative juridical approach. The results of the study are found that the arrangements regarding the principles of good governance have been regulated in Law Number 28 of 1999 concerning State Administration that is Clean of Corruption, Collusion and Nepotism, Article 24 of Law Number 6 of 2014 concerning Villages, Article 58 Act Number 23 of 2014 concerning Regional Government and Article 10 of Act Number 30 of 2014 concerning Government Administration. Conclusion that the regulation of the principles of good governance in Indonesia has been very good, the administration of government depends on a shared commitment to run the wheels of government in accordance with the objectives of the state.Keywords: principles of good governance, good governance, governanceAbstrakTujuan penelitian ini adalah untuk mengetahui dan menganalisis bagaimana pengaturan mengenai asas-asas penyelenggaraan pemerintahan yang baik di Indonesia. Hasil penelitian yaitu ditemukan bahawa pengaturan mengenai asas-asas penyelenggaraan pemerintahan yang baik sudah diatur dalam Undang-Undang Nomor 28 tahun 1999 tentang Penyelenggaraan Negara yang Bersih Bebas dari Korupsi, Kolusi dan Nepotisme, Pasal 24 Undang-Undang  Nomor 6 Tahun 2014 tentang Desa, Pasal 58 Undang-Undang  Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dan Pasal 10 Undang-Undang  Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan. Simpulan bahwa pengaturan mengenai asas-asas penyelenggraan pemerinthan yang baik di Indonesia sudah sangat baik, penyelenggaraan pemerintahan tergantung komitmen bersama dalam menjalankan roda pemerintahan yang sesuai dengan tujuan bernegara.Kata Kunci: asas-asas penyelenggaraan pemerintahan yang baik, good governance, pemerintahan

Abstract

KPK is a new institution with the authority which is often referred to as a superbody institution which has extra authority compared to other state institutions. The Corruption Eradication Commission was formed with the aim of increasing the efficiency and effectiveness of efforts to eradicate corruption. Corruption is indeed an extraordinary crime, and therefore its eradication must also be carried out in an extraordinary way. The purpose of this paper is to find out how the authority of the Corruption Eradication Commission (KPK) in the Corruption Eradication Code of Ethics and how the Theory of the State of Law in the Eradication of Corruption Crimes. The method used in writing this paper is normative juridical. Sources of data used are primary and secondary data sources. The results of this study are in carrying out the task of coordinating with agencies, supervising agencies, conducting investigations, investigations, and prosecutions, taking preventive actions, monitoring the implementation of state government, the authority of the Corruption Eradication Commission is regulated in Articles 7 to 14 of the Law. Law Number 30 of 2002 concerning the Commission for the Eradication of Criminal Acts of Corruption. In order to achieve the legal objectives as stated in Article 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia that Indonesia is a state of law, a State Institution that is Special in terms of eradicating Corruption Crimes is needed for the implementation of law and justice.

Abstract

The purpose of this research is to find out how the code and conduct guidelines are set for judges and how to apply sanctions due to violations of the Code of Profession Ethics. The method of research used is normative, which is the method of approach by reviewing the laws that are conceptualized as the norm or the rules that apply to the community, and become the reference of everyone's behaviour. Data collection tools through library studies. Secondary use, i.e. data obtained through documentation studies by reading scientific books, magazines, internet, newspapers and other readings related to research. The results of the research are the settings regarding the code of ethics and the conduct of the judges as legal profession where the judges have obligations of liability or legal responsibility. So that all his deeds are supervised by law. Metode penelitian yang digunakan adalah yuridis normatif, yaitu metode pendekatan dengan mengkaji hukum yang dikonsepkan sebagai norma atau kaidah yang berlaku dalam masyarakat, dan menjadi acuan perilaku setiap orang. alat pengumpul data melalui studi kepustakaan. yang digunakan sekunder, yaitu data yang diperoleh melalui studi dokumentasi dengan cara membaca buku-buku ilmiah, majalah, internet, surat kabar dan bacaan-bacaan lain yang berhubungan dengan penelitian. Hasil penelitian yaitu Pengaturan mengenai Kode etik dan pedoan Perilaku Hakim sebagai Profesi Hukum dimana hakim mempunyai kewajiban kewajiban atau tanggung jawab hukum. Sehingga segala perbuatannya diawasi oleh hukum. Abstract

Notary Supervisory Council, which is a body that has the authority and obligation to supervise and develop notaries. Article 66 paragraph (1) of Law Number 2 of 2014 concerning amendments to law number 30 of 2004 concerning the position of a notary determines: For the purposes of the judicial process, investigators, public prosecutors, take a photocopy of the minutes of the deed and/or the attached documents. in the minutes of the deed or the notary protocol, as well as the summons of the notary to be present at the examination related to the deed he made, or the notary protocol, with the approval of the MPD. The Constitutional Court in its decision Number 49/PUU-X/2012, stated that the phrase “with the approval of the Regional Supervisory Council” in Article 66, is contrary to the 1945 Constitution and has no legal force. The juridical issues are: What are the powers of the MPD after the Constitutional Court's decision no. 49/PUU-X/2012 ? and What is the mechanism for notary inspection by MPD? With this type of normative legal research, the problem is answered, that the duties and authorities of the MPD after the Constitutional Court Decision. No. 49/PUU-X/2012 only to conduct periodic inspections and/or if deemed necessary, as well as conduct a notary check if there are complaints from the public. The duties and authorities of a notary as referred to in Article 66 of Law Number 2 of 2014 concerning amendments to Law number 30 of 2004 concerning the position of a notary, are carried out by the Notary Honorary Council. Regarding the mechanism of a Notary examination, it must be carried out in accordance with Law Number 30 of 2004, Law Number 2 of 2014, Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number M.02.PR.08.10 of 2004 concerning Procedures for Appointing Members, Dismissing Members, Organizational Structure, Work Procedures, and Procedures for Notary Examination; and Decree of the Minister of Law and Human Rights of the Republic of Indonesia No. M.39-PW.07.10 of 2004 concerning Guidelines for the Implementation of the Duties of the Notary Supervisory Council.

Abstract

Limbah industri harus ditangani dengan baik dan serius oleh Pemerintah Daerah dimana wilayahnya terdapat industri. Pemerintah harus mengawasi pembuangan limbah industri dengan sungguh-sungguh. Pelaku industri harus melakukan cara-cara pencegahan pencemaran lingkungan dengan melaksanakan teknologi bersih, memasang alat pencegahan pencemaran, melakukan proses daur ulang dan yang terpenting harus melakukan pengolahan limbah industri guna menghilangkan bahan pencemaran atau paling tidak meminimalkan bahan pencemaran hingga batas yang diperbolehkan. Di samping itu perlu dilakukan penelitian atau kajian-kajian lebih banyak lagi mengenai dampak limbah industri yang spesifik (sesuai jenis industrinya) terhadap lingkungan serta mencari metoda atau teknologi tepat guna untuk pencegahan masalahnya. Oleh sebab itu, sudah menjadi kewajiban kita menjaga kelestarian tanah sehingga tetap dapat mendukung kehidupan di muka bumi ini. Akan tetapi, sebagaimana halnya pencemaran air dan udara, pencemaran tanah pun akibat kegiatan manusia juga.

Abstract

Desa memiliki hak asal usul dan hak tradisional dalam mengatur dan mengurus kepentingan masyarakat setempat, termasuk pengangkatan Perangkat Desa. Namun dalam hal pengangkatan Perangkat Desa masih sering mengedepankan prinsip kekeluargaan. Tujuan dari penelitian ini yaitu pertama, ingin mengetahui pengaturan tentang pengankatan Perangkat Desa, kedua untuk mengetahui dan mengkaji bagaimana penerapan asas keterbukaan dalam pengangkatan Perangkat Desa di Kabupaten Kuningan. Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian menunjukan bahwa pengaturan pengangkatan Perangkat Desa baik di tingkat pusat maupun daerah sudah di desain sesuai kebutuhan yang ada di masyarakat, kemudian implemtasi penerapan asas keterbukaan dalam pengangkatan Perangkat Desa di Kabupaten Kuningan sejauh ini masih belum dilaksanakan sebagaimana ketentuan yang berlaku disebabkan partisipasi masyarakat yang rendah juga perlu terobosan baru sosialisasi melalui medis sosial.

Abstract

Marine pollution is the entry/inclusion of living things, energy substances and or other components into the marine environment by human activities so that the quality decreases to a certain level which causes the marine environment to no longer comply with quality standards and/or functions. One of the cases related to environmental pollution that caused damage to the marine environment was the Oil Spill in the Back Sea Waters of Padang, Batam, Riau Islands Province. The purpose of this paper is to find out how the policy in the petroleum sector in Indonesia is, how is the regulation of Indonesian national law to prevent, reduce and control the problem of marine pollution by oil, how is the impact of oil spills in sea waters from oil and gas industry activities on the environment. The method used in this research is the normative juridical method. Using qualitative analysis with the resulting data in the form of secondary data obtained from previous research, laws and regulations and other sources. The result of this research is that the policy of the petroleum sector in Indonesia to achieve energy security is pursued by applying the concept of State Controlling Rights (HMN). The philosophy of "control by the state" is the creation of national security in the energy sector in the Unitary State of the Republic of Indonesia with the main target of providing and distributing energy throughout its territory. Regulation of national law through Government Regulation concerning Control of Marine Pollution and/or Destruction, which was followed up with the issuance of Presidential Regulation concerning the Handling of Marine Debris. The impact of waste in the form of oil spills specifically shows an important negative effect on the coastal and marine environment, especially through direct contact with aquatic organisms, direct impacts on fisheries activities including marine tourism and indirect impacts through disturbances to the environment.

Kuningan, local government districts declared as a conservation district. Kuningan district government coordination and cooperation with regard to conservation, namely: First, they Policy-makers need to understand how awareness of water conservation can help solve water shortage pro-blems while providing economic and social benefits, making environmental regulations that support conservation; Second, Water managers and the role of experts involved in the planning, develop-ment, and management of the water system, including managers and scientists working for the preservation of the environment is to create a reservoir as well as the urban forest in order to streng-then the conservation and Third ). Mass Media and Educators, their knowledge of the water sector may be little but they are experts in public relations, communications, marketing, and education is to create programs that support conservation programs such as Seruling (Students are concerned about the environment), Apel (Apparatus care environment) Pepeling (Bridal care for the environ-ment) and the Car Free day car-free day program. Kuningan district invites the public to play a role in realizing kuningan participate as a conservation district that is the existence of programs that support the conservation of water resources. Abstract

The study aims to examine the Regional Head authority in the regional autonomy and to investigate the authority relationship between the Regional Head authority and his Deputy from legal and political perspectives. This study employed a doctrinal research method involving legal material sources (the laws and regulations), court decisions/judgments, legal theories, and scholars' perspectives. The findings revealed the Regional Head authority is clearly stated in Article 65 of Law Number 9 of 2015 concerning Regional Government, such as to lead the implementation of government affairs–the regional authority based on the laws and policies established with the DPRD, to maintain public peace and orderliness, and to compile and to submit regional regulations draft. Normatively,  the Regional Head and his Deputy have their respective duties, the authority relationship. In this case, the Deputy Regional Head assists the Regional Head in the governance to acquire the fullest services for the community. In short, in terms of authority, the Regional Head is an extension of the President-- the full holder of goverment power. In terms of the authority relationship, different opinions between the Regional Head and his Deputy are frequently occurred as in the political views
