Abstract

This research investigates the legal implications and challenges of adapting ijab kabul (Islamic marriage contract) to the digital era in Indonesia. The rise of telecommunications technologies—especially video calls—has enabled remote marriages during the COVID-19 pandemic and in geographically separated contexts. While digital ijab kabul offers efficiency and broader access, questions persist regarding its legal validity, potential for fraud, and regulatory ambiguity. Currently, Indonesia’s Marriage Law No. 1 of 1974 requires physical presence for marriage to be legally valid. However, the Indonesian Ulema Council (MUI) has issued a fatwa allowing digital ijab kabul under specific conditions: real-time audiovisual communication, verified identities, and a shared session (ittihad al-majlis). These criteria demonstrate partial acceptance of digital presence under Islamic law, yet lack binding legal force. Using a normative juridical approach, this study analyzes statutory law, Islamic legal doctrines, and international comparisons with countries like Malaysia, Saudi Arabia, and the UAE. These nations have developed legal frameworks for digital marriage by enforcing identity verification (biometrics, e-signatures) and procedural integrity. The study proposes that Indonesia revise Article 26 of the Compilation of Islamic Law (KHI) to explicitly recognize digital ijab kabul, harmonizing it with Law No. 11/2008 on Electronic Information and Transactions (ITE Law). By formally acknowledging digital presence within ittihad al-majlis, Indonesia can ensure greater legal certainty and protect vulnerable parties. This legal reform supports Sustainable Development Goal (SDG) 16 by promoting access to justice, enhancing legal institutions, and fostering trust in digital innovations within religious and civil legal systems.

Abstract

MUI merupakan badan pemerintah yang menjadi naungan kalangan umat Islam dalam menyelesaikan kemaslahatan umat baik tentang kehalalan suatu produk maupun hal-hal yang menunjang kemaslahatan umat Islam. Seperti yang kita ketahui MUI meluncurkan fatwa yang menjadi pro dan kontra di berbagai kalangan lembaga tentang hukum pewarna makanan dan minuman dari serangga cochineal (Karmin). Dengan berbagai fatwa yang mencuat didukung dengan gagasan-gagasan ilmuwan serta ulama yang dapat membantu meluruskan hal yang sepatutnya dijelaskan kepada kalangan masyarakat Islam tentunya yang merasa cemas dengan beredarnya makanan dan minuman yang mengandung pewarna Karmin. Sejatinya pewarna makanan Karmin ini dianggap halal oleh MUI karena tidak terdapat madharat didalamnya, melalui ijtihad dari berbagai kalangan ulama diharapkan lewat fatwa ini memunculkan efek yang baik untuk umat. Kata Kunci: Fatwa, MUI, Pewarna Karmin.

Abstract

Women's participation in politics is still perceived as representation in political structures at the national and regional levels, which is felt to be inadequate. Even though the quantitative existence of women is even comparable to half of the population both at the national and regional levels. One of the inhibiting factors is the party culture. We can see directly in several political events or general elections that women only have a few seats and voting space. We can conclude that Indonesian people think that men are more competent to be leaders than men. The results of the study show that the position, role and function of women indicates that there is space for participation but women are still not actively involved, which is influenced by internal and external factors, including low levels of education, ancient thinking that considers men more competent than men. Woman. With this paper, the authors hope that there will be equality for men and women in participating in politics so that in the future the Indonesian people choose leaders by looking at their abilities, not from considerations of gender, race, ethnicity and culture, or religion. Because in truth every human being has the right to be treated equally in participating in politics.

Abstract

One of the results produced by Ijtima’ Ulama of the Indonesian Fatwa Commission III which was held by the MUI (Indonesian Ulema Council) in 2009 in Padang Pajang was a fatwa concerning smoking. In the fatwa issued by the MUI, there are three points in the legal provisions regarding the cigarette law, namely first they agreed that there would be a difference regarding the smoking law, namely between makruh and haram. Secondly, the ijtima participants agreed to give the mandate to the Central MUI to establish a fatwa for the makruh or haram of smoking. Third, the ijtima’ulama agreed that smoking law is illegal for four things, namely smoking in public places, for children, for pregnant women and for the members of the Indonesian Ulama Council. This article seeks to examine the MUI fatwa in terms of its methodology.

Abstract

This research aims to explore the portrayal of Javanese traditional performing arts within Merle Calvin Ricklefs' work on the history of Islamization in Java, recognized as one of the most comprehensive historical accounts on this subject. Ricklefs' trilogy includes "Mystic Synthesis in Java: A History of Islamization from the Fourteenth to the Early Nineteenth Centuries" (2006), "Polarising Javanese Society: Islamic and Other Visions, C. 1830-1930" (2007), and "Islamisation and Its Opponents in Java: A Political, Social, Cultural, and Religious History, C. 1930 to Present" (2012). The arts are an integral part of spiritual life within Islam, flourishing among Muslim societies worldwide, including among the Javanese. One form of the arts is performing arts, encompassing music, dance, and theater. Studies on this form of arts are part of the important way to uncover the multifaceted dynamics of society throughout history. For the contextualization of historical account, this research examines the empirical findings among PASER (Paguyuban Seni Relijius), a perfoming arts groups organization in Sleman, Yogyakarta. This research is underpinned by the Foucauldian concept of historical discontinuity, with content analysis employed as the methodological tool. Abstract

The aim of this research is to analyze the implementation of discipline character development at vocational high school. This study employs a qualitative approach of the phenomenological type. The research was conducted at SMK Negeri 1 Puring, Kebumen. The subjects of this study include the principal, teachers, staff, and students. Data collection techniques used are interviews, observations, and document studies. Triangulation techniques were applied to ensure data validity. Data analysis follows the Miles & Huberman & Saldana model. The results of the study indicate that the implementation of discipline character development at SMK Negeri 1 Puring involves systematic steps, including the formulation of school regulations, daily guidance, extracurricular activities, leadership and self-development programs, classroom learning, technology utilization, parental involvement, monitoring and evaluation, and fostering a school culture. Collaboration among all stakeholders, such as parents and the community, is crucial in instilling discipline character in students.

Abstract

A conducive learning environment impacts children's development. Schools, as educational institutions, play a crucial role in creating a supportive and child-friendly learning environment. The objective of this study is to analyze the implementation of a positive discipline approach in efforts to establish a conducive learning environment for elementary school students. This research employs a qualitative phenomenological approach. The study was conducted at Jemur Public Elementary School in Kebumen. The subjects of this study include the school principal, teachers, and students. Data collection techniques involve interviews, observations, and documentation studies. Triangulation techniques were used to ensure data validity. Data analysis was carried out using the Miles & Huberman & Saldana model. The results of the study indicate that the positive discipline approach has been implemented effectively at Jemur Public Elementary School in Kebumen. However, collaboration between parents and the school needs to be further enhanced to ensure children can learn comfortably wherever they are. Strong collaboration among schools, families, and the community is recommended based on this research.

Abstract

MSMEs have played considerable role in the socio-economic development in Indonesia. However, the institutions continue to experience numerous challenges and constrains in various aspects. Among the prominent issues include the financing structure, lack of qualified human resources, complexity of government regulations and bureaucracy in some areas such as business start-up and etc. There is hardly any literature that has critically surveyed the issue of why the MSMEs shy away and whether there is an alternative financing model that they can adopt. The present study critically assesses the related literatures and proposes a viable cash waqf-based model which has the potential to benefit Islamic MSMEs. To ensure the successful running of the cash-waqf based model, it is recommended for the model to be established under the umbrella of a respectable Islamic body, namely Indonesia Waqf Council/Badan Wakaf Indonesia (BWI).
