Abstract

Desa Jipang merupakan salah satu desa di wilayah Kecamatan Karanglewas Kabupaten Banyumas yang perlu meningkatkan kesadaran hukum melalui pemberdayaan masyarakat untuk menghadapi dan mengatasi perubahan sosial di masyarakat. Hukum sebagai alat rekayasa sosial mampu untuk mengatur manusia dalam bertingkah laku. Desa yang kuat, maju, mandiri, dan demokratis adalah sebuah tatanan pemerintahan lokal yang ditopang oleh adanya partisipasi masyarakat yang aktif dalam dinamika hidup di desa. Warga desa yang aktif dalam berpartisipasi akan mampu melibatkan dirinya tata pemerintahan desa yang demokratis khususnya dalam musyawarah desa dan penyusunan produk hukum di desa. Penguatan Desa mensyaratkan adanya pemberdayaan masyarakat sebagai upaya meningkatkan kemampuan masyarakat itu sendiri dalam mengatasi masalah dan mengelola sumberdaya di lingkungannya. Tujuan pengabdian yaitu untuk mengetahui pemahaman masyarakat terkait kesadaran hukum dan untuk meningkatan kesadaran hukum melalui pemberdayaan masyarakat di Desa Jipang, Kecamatan Karanglewas Kabupaten Banyumas. Metode yang digunakan adalah yuridis empiris dengan pendekatan kualitatif terkait keyakinan peneliti sesuai pengalaman penelitian dan sifat permasalahan. Hasil kegiatan pengabdian menujukan bahwa pemahaman kesadaran hukum di Desa Jipang sudah cukup baik, hal ini dilihat dari kuesioner yang telah diisi oleh berbagai unsur masyarakat yang ada di Desa Jipang. Peningkatan kesadaran hukum melalui pemberdayaan masyarakat di Desa Jipang yang dilakukan dengan focus group discussion (FGD) mendapatkan hasil yang baik. FGD sudah efektif untuk meningkatkan partisipasi masyarakat terkait kesadaran hukum.

Abstract

Dewan Perwakilan Daerah lahir dari perubahan ketiga Undang-Undang DasarNegara Republik Indonesia Tahun 1945 (UUD NRI 1945). Gagasanpembentukan DPD adalah dalam rangka menghadirkan sistem checks andbalances baik antar cabang kekuasaan maupun dalam internal lembagalegislatif yang disebut sistem parlemen dua kamar (bicameralism).Namun,dalam pengaturan kewenangan fungsi pengawasan DPD tidak diatur samakuat dengan DPR sehingga menjadikan pelaksanaan fungsi pengawasanDPD tidak maksimal, hal tersebut juga menjadikan sistem checks andbalances di internal parlemen tidak berjalan sebagaimana yang diharapkan.Penelitian ini bertujuan untuk mengetahui implementasi fungsi pengawasanDPD berdasarkan UUD NRI 1945. Jenis penelitian yang digunakan adalahyuridis normatif yaitu penelitian yang dilakukan dengan cara meneliti datasekunder. Sumber data yang digunakan data sekunder yang bersumber daribahan hukum primer dan sekunder. Metode pengumpulan bahan hukummenggunakan studi kepustakaan. Analisis bahan hukum secara normatifkualitatif. Hasil penelitian diperoleh bahwa eksistensi fungsi pengawasan DPDterdapat dalam UUD NRI 1945, UU No. 17 Tahun 2014 tentang MPR, DPR,DPD dan DPRD (MD3) dan Peraturan DPD No. 2 Tahun 2019 tentang TataTertib. Pelaksanaan fungsi pengawasan DPD terdiri dari pengawasan kelembagaan dan pengawasan perseorangan, dimana pengawasan kelembagaan meliputi pengawasan atas pelaksanaan undang-undang dan pengawasan terhadap keuangan negara serta pengawasan perseorangan mengawasi terkait pelaksanaan undang-undang oleh pemerintah daerah. Hasil dari pengawasan DPD nantinya diserahkan kepada DPR sebagai bahan pertimbangan untuk ditindaklanjuti. Untuk mempertanggunjawabkan hasil pengawasanya kepada masyarakat DPD mempublikasi hasil pengawasan tersebut melalui media cetak dan elektronik.Kata Kunci: Dewan Perwakilan Daerah (DPD), Fungsi Pengawasan

Abstract

Penetapan pandemi Covid-19 oleh WHO membuat Indonesia menetapkan keadaan ini sebagai keadaan darurat melalui Keppres No.11 Tahun 2020 tentang Penetapan Kedaruratan Kesehatan Masyarakat Covid-19. Penetapan tersebut mengharuskan dilakukannya Pembatasan Sosial Berskala Besar (PSBB) yang kemudian digantikan dengan Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM). PPKM saat penelitian ini dilakukan ditetapkan melalui Instruksi Mendagri No.39 Tahun 2021 yang selain mengatur PPKM, juga mengatur kewajiban menggunakan aplikasi PeduliLindungi sebagai syarat masuk fasilitas umum bagi masyarakat. Pada sisi lainnya, data Badan Pusat Statistik (BPS) tahun 2020 menggambarkan jika sepertiga masyarakat Indonesia tidak memiliki ponsel dan terancam tidak dapat menggunakan PeduliLindungi. Kebijakan PeduliLindungi sebagai syarat masuk fasilitas umum tersebut menjadi inspirasi dimana dalam penelitian ini hendak dicari tahu implikasi kebijakan PeduliLindungi terhadap HAM, khususnya mengenai hak masyarakat non pemilik ponsel untuk bebas bergerak dan tidak mendapat diskriminasi. Metode yang digunakan dalam penelitian yuridis normatif ini adalah metode kualitatif dengan pendekatan perundang-undangan. Dari penelitian ini diperoleh kesimpulan jika kewajiban menggunakan PeduliLindungi berpotensi melanggar hak bebas dan dapat menyebabkan diskriminasi terkhusus kepada warga yang tidak memiliki ponsel.Kata Kunci: Covid-19, PPKM, PeduliLindungi, Hak Asasi Manusia

Abstract

The implementation of work employment and wages is not in line between labor and Islamic law. This study aimed to review and analyze labor employment and wage arrangements from perspectives on labor law and Islamic law. This research used a normative juridical method with a contextual approach, rules and regulations, the Quran, and hadith. The results showed that Islamic and labor laws have the same goal: that workers can live decent lives. In labor law, work relations are born from work agreements, and wages are the right of workers after obligations are carried out. However, in Islamic law, work relations are based on justice without exploitation, are efficient, and do not violate other sharia principles, and wages are included in the study of Ijarah. The concept of employment is based on time, type of work, and targets obtained. F or work relations and wages to fulfill human dignity, it is necessary to contain labor regulations that pay attention to the principles of relations and wages in Islamic law.

Abstract

The practice of judicial activism, though not formally defined within the jurisdiction of the Constitutional Court (MK), is implicitly recognized as an integral element of independent judicial power. The importance of this independence is underscored as a fundamental necessity for the preservation of law and justice. This research utilized a normative juridical methodology, incorporating conceptual, comparative, and case-based analysis. The study findings reveal that judicial activism, as practiced within the Constitutional Court, is underpinned by independent judicial authority. Moreover, this practice aligns with the tenets of progressive legal doctrines, which not only acknowledge the significance of codified legal provisions but also endorse legal innovations for the pursuit of justice. The practice of judicial activism within the Constitutional Court is indispensable for reinforcing the principle of checks and balances. The subjective and abstract nature of judicial activism, however, necessitates objective validation through the principle of virtue jurisprudence.

Abstract

The formation of responsive laws is an ideal form and a must in a country that adheres to democracy, the involvement of the community in the formation of laws and regulations is a form of implementation of democracy and popular sovereignty, so far the principles of the Formation of Legislation are regulated in Article 5 of Law Number 12 of 2011, but these principles are still formally operational and are considered unable to provide space for the community in conveying input that needs to be fulfilled in the mechanism of forming laws, so there needs to be an update on the principles of its formation. This research aims to find out how the idea of updating the norms of principles in the formation of laws in the future, the method in research uses legal research methods through approaches, data analysis is descriptive qualitative statute approach, conceptual approach, and case approach. the results of the study show that the formation of laws and regulations must certainly begin with a response to the existence of a legal problem that develops in society and there must be a regulatory solution, so that the formation of laws and regulations is not always based on political interests, certain groups or other interests, it is to avoid overregulation. The concept of responsiveness becomes urgent to be prioritized as a new norm of principles in the formation of good laws and regulations, because it can provide a two-way space between the legislator and the public quickly. the concept of responsiveness becomes a new idea in the new norm of the principles of good law formation, which has the character of strengthening the root foundation of the principle of openness and as a supporter (supporting) to the provisions of Article 96  Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislative Regulations.

Abstract

Public participation has a significant role in the law-making process. As a manifestation of a democratic legal state, it acts as a direct form of check and balance from the people. The problem discussed in this study are: 1) what is the urgency of meaningful participation in forming legislation as a manifestation of a democratic rule of law? and 2) what are the obstacles to meaningful participation in forming legislation as a manifestation of a democratic rule of law? The research uses the normative juridical method with a statute and case Approach. Abstract

Regional Regulations are an instrument for administering regional government formed by the Regional Legislative Institutions and the Regional Government. Regional Legislative Institutions has the right to submit the Initiative Regional Regulation Draft to the head of Regional Legislative Institutions consists of explanation and Principal Number. The Draft was given Bapemperda to review. The results are reported to the head of Regional Legislative Institutions to be presented at the Plenary Meeting. The Regent and Regional Legislative Institutions discussing Regional Regulations. The formation of legal products is mandate of Act Numb. 12 of 2011 jo. 13 of 2022 about the Legislation Development and Numb. 80 of 2015 jo. Numb. 120 of 2018 about the Regional Legislation. The issues that will be discussed are the process of submitting Initiative Regional Regulation Draft and the problem. The research method is qualitative using a normative juridical and empirical juridical approach. The research location was carried out within the Kebumen Regional Legislative Institutions and Kebumen Regency Legal Section. The results of the research show that there is a need for Regulation that specifically about Initiative Regional Regulation Draft.

Abstract

Sustainable Development Goals Desa (SDGs Desa) are integrated efforts of village development to accelerate the achievement of sustainable development goals. Since 2021, the village government in Banyumas Regency has implemented SDGs Desa program with an achievement score of 46.94. Therefore, this study aimed to determine the implementation of SDGs Desa and increase the achievement of the program by optimizing the role of experts to fulfill human rights in Banyumas Regency. An empirical juridical method was adopted using primary data in the form of FGDs, interviews, questionnaires, and documentation studies. Furthermore, FGD was conducted with representatives of officials from 49 villages and the data was in the form of primary, secondary, and tertiary legal materials. The results showed that the SDGs Desa program was implemented in line with the village even though there were obstacles in the data collection process. These comprised server errors, and inadequate internet network conditions, including village government knowledge related to minimal system use. Conceptually, this program has similarities with the Saansad Adarsh Gram Yojana (SAGY) program in India. Future studies could be performed because the regulations regarding villages and their derivatives regulated SDGs Desa including planning, implementation, and development mechanisms. Expert assistance was also important for increasing community participation and optimizing budget allocation to harness income sources and realize their full potential.

Abstract

Solution of Raperda in regional parliament has entangled governmental element, parliament and society. Involvement of society assessed before existence of formal solution of Raperda is at hearing public process and empirical facts analysis by SKPD. When solution of Raperda, society can follow to involve actively at level I, II and of IV in plenary meeting. Besides that, after perda have done, society still enabled to involve in public test. In this case, legal status between woman and men is same.  The women's involvement in making of regional law, especially in Banyumas, still experience of various constraint. In this case, role of woman (generally) still assumed lower or not yet maximal. Opportunity have been given by government but woman still not yet earned the rights maximally. There are role of woman in attendance  but role in input form is not yet maximal. In general, arising out constraint to women involvement in making regional law is come from society mindset concerning woman, cultural and quality of the Human Resources.  Kata Kunci : Keterlibatan Perempuan, Produk Hukum Daerah
