Abstract

The specific purpose and target of this research is to determine the role of family welfare empowerment organizations (PKK) in the prevention and early handling of women and children victims of violence. The reason for researching this topic is the increase in the number of victims of violence against women and children every year. Based on data from the Ministry of Women's Empowerment and Child Protection, it is shown that since 2012 it has increased from 18,718 to 54,041 cases in June 2017 and until February 2018 it has shown 374 cases of violence against women and children. In this case, the Government is responsible for providing optimal services needed by victims, both medical, psychological, and legal assistance in an effort to recover their condition. The government in providing services to victims should cooperate and partner with the community, especially in the prevention and early handling of victims of violence. Prevention and early handling of victims of violence at the village level can empower family welfare empowerment organizations (PKK) which are government partners that are considered effective in the prevention and early handling of women and children victims of violence in their areas. Based on these reasons, it is necessary to study in depth the role of the PKK organization in preventing and early handling of women and children victims of violence. To achieve specific goals and targets in this study, the research method used is a normative research method with a statue approach and a conceptual approach.The results of the study provide an overview 1) there is a clear regulation in the laws and regulations related to the participation of the PKK in preventing and early handling of victims of violence, what needs to be further regulated is regulation in the form of Village Regulations and customary law (awig-awig) related to the participation of PKK and indigenous women in the prevention and early handling of victims of violence. 2) the procedures for preventing and early handling of victims of violence need to be stated in the operational standards in the village and the traditional village paparem.

Abstract

Preventing early childhood marriage (ECM) can protect children’s rights from the perspective of human rights. There are several rules regarding the age limit for marriage. In Indonesia, the minimum age for marriage is nineteen years. However, in fact, early child marriage is still relatively high, with the seventh highest ranking in the world. This study aims to elaborate on the rights of children, which ECM potentially violates, and to identify who is responsible for minimizing and/or combating this phenomenon. This normative legal research with a human rights approach occurs in the childhood protection context. The results show that ECM has implications for violations against the right to life, the right to education, the right to develop, and the right to health. Thus, more stringently applying international and national law and combining with local wisdom (Balinese Customary Law) in protecting children's rights in the context of preventing ECM can prevent ECM effectively and minimize violations of other children's rights. Moreover, it is believed that the responsibility to reduce and combat ECM not only belongs to the government but also to all stakeholders within the community, such as families, academics, the media, non-profit organizations, entrepreneurs, and customary.

Abstract

This aim of this study was to identify, analyze and elaborate the arrangements regarding the protection of Traditional Cultural Expression in Indonesia as well as the model of the role of the Village to protect TCE in Bali. This study was a normative legal research using statutory approach and conceptual approach. The study indicated that in Indonesia, TCE is protected under the Copyright Law, namely in the provisions of Article 38 of the UUHC as well as through the Article 15 of the Cultural Promotion Law. In international law, protection against TCE is implicitly stipulated in Article 15 paragraph (4) of the Berne Convention 1967 and with regard to the model of setting the role of customary villages to protect traditional cultural expression in Bali can be done by applying a model of synergy and coordination between Customary Villages, Communities, Ministers and TCE through the establishment of “awig-awig” or “pararem”, which specifically regulates the protection of TCE in Bali. Tujuan penulisan ini adalah untuk mengidentifikasi, menganalisis dan mengelaborasi pengaturan mengenai perlindungan terhadap Ekspresi Budaya Tradisional di Indonesia serta model pengaturan peranan Desa dalam upaya perlindungan Ekspresi Budaya Tradisional di Bali. Tulisan ini merupakan penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan (statutory approach) dan pendekatan konsep (conceptual approach). Hasil penelitian menunjukkan bahwa dalam tatanan hukum nasional di Indonesia, EBT dilindungi berdasarkan UUHC, yaitu pada ketentuan Pasal 38 UUHC serta melalui Pasal 15 UU Pemajuan Kebudayaan. Dallam hukum internasional, perlindungan terhadap EBT diberikan secara implisit sebagaimana diatur dalam ketentuan Pasal 15 ayat (4) Konvensi Berne 1967 dan dalam kaitannya dengan model pengaturan peranan desa adat dalam upaya perlindungan ekspresi budaya tradisional di Bali dapat dilakukan dengan menerapkan model sinergi dan koordinasi antara Desa Adat, Masyarakat, Pemerintah dalam memebri perlindungan dan pelestarian EBT melalui pengaturan dalam “awig-awig” atau “pararem” yang secara khusus mengatur mengenai perlindungan EBT yang ada di Desa Adat.

Abstract

ABSTRAK Tujuan daripada studi ini adalah untuk mengkaji pengaturan investasi saham berbasis online dan mendalami bagaimana legalitas dari investasi saham berbasis online tersebut berdasarkan hukum indonesia. Metode penulis gunakan adalah metode normatif melalui cara deskriptif pendekatan konseptual serta peraturan perundang-undangan. Hasil dari studi ini menunjukan bahwa untuk pengaturan terhadap investasi saham berbasis online belum memiliki regulasi peraturan ataupun perlindungan hukum yang pasti, tetapi pengaturan terhadap saham ditemukan dalam Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas(UU PT), untuk legalitas investasi saham berbasis online terdapat pada Pasal 2 POJK No.24/POJK.04/2014, untuk legalitas dari Perusahaan Sekuritas diatur dalam POJK No. 20/POJK.04/2016. Kata Kunci : Investasi, Saham, Online, Perusahaan Sekuritas ABSTRACT The purpose of this study is to examine the regulation of online-based stock investments and analyze the legality of online-based stock investments based on Indonesian law. The method used is a normative method with a descriptive way through a conceptual approach and legislation. The results of the study show that online-based stock investment arrangements do not yet have definite arrangements, but arrangements for shares can be found in Law no. 40 of 2007 concerning Limited Liability Companies, the legality of online-based stock investments is contained in Article 2 of POJK No.24/POJK.04/2014, for the legality of Securities Companies it is regulated in PJOK No. 20/PJOK.04/2016. Abstract

The heirs of women are limited heirs, meaning that women are only entitled to a share of the inheritance for the wealth of their parents, but it becomes a problem if the woman is not married. The purpose of this research is to examine and analyze the position of inheritance rights for unmarried Balinese women and the portion that can be received by unmarried Balinese women in enjoying the inheritance. This study uses normative legal research methods with statutory approaches, conceptual approaches and case approaches. This research explains that in Balinese customary law, daughters/dahatua are not heirs, this is in line with the kinship system that applies in Balinese customary society, namely Patrilineal or kepurusa, where it is the son's obligation to continue all obligations. Women who have not married during their lifetime (dahatua), their right to enjoy the inheritance continues as long as they are still alive. Thus, daughters are entitled to share in the family inheritance, not as owners. Ahli waris kaum perempuan merupakan ahli waris terbatas, artinya kaum perempuan hanya berhak atas bagian harta warisan guna kaya orangtuanya, namun menjadi permasalahan apabila wanita tersebut tidak kawin. Tujuan dari penelitian ini adalah untuk mengkaji dan menganalisis kedudukan hak waris Wanita Bali yang tidak kawin serta bagian yang dapat di terima wanita bali yang tidak kawin dalam menikmati warisan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendeketan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Penelitian ini menjelaskan bahwa dalam hukum adat Bali, anak perempuan/daha tua bukanlah ahli waris, hal ini sejalan dengan sistem kekerabatan yang berlaku dalam masyarakat adat Bali, yaitu Patrilineal atau kepurusa, dimana kewajiban anak laki-lakilah yang melanjutkan segala kewajiban. Wanita yang selama hidupnya tidak melakukan perkawinan (daha tua), haknya untuk menikmati harta warisan tetap berlangsung selama ia masih hidup. Dengan demikian, anak wanita berhak atas bagian harta warisan keluarga, bukan sebagai pemilik.

Abstract

The direction of this research is to understand what causes damage to goods in transit and how consumer protection law validates sender liability for shipping services. This study uses prescriptive rules research with a rules approach. As a result of our research, we found this shipping service to be very useful as it allows us to deliver the goods we want in an easy and practical manner. A freight forwarding service is a form of public service that facilitates the safe delivery of goods from one place to another and can be billed for that service. Delivery of objects can take the form of written data, logistics, electronic products, etc. Unfortunately, many consumers also suffer losses during the delivery of their goods, so more must be done to protect consumers and respect their rights. The carrier will be responsible for the goods damaged in transit and compensate for the damage caused by the owner of the goods. We need laws to protect the people involved, especially consumers. Provisions for consumer legal protection against damage to goods during shipping are contained in the Consumer Protection Act No. 8 of 1999.

Abstract

Secara empiris, penyandang disabilitas sering mendapat pelakuan diskriminatif dalam kehidupan sosial yang berakibat pada pengabaian terhadap terpenuhinya hak hak penyandang disabilitas, meskipun secara yuridis, seperti di Bali, telah ada produk hukum Daerah yang memberikan perlindungan terhadap hak-hak penyandang disabilitas. Penelitian ini bertujuan untuk menganailisis bagaimana bentuk-bentuk perlindungan hukum yang diberikan kepada penyandang disabilitas dan bagaimana pelaksanaan hak-hak penyandang disabilitas tersebut dikaitkan dengan budaya Bali. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan peraturan perundang-undangan (statue approach) dan pendekatan konsep. Hasil penelitian ini menunjukkan bahwa perlindungan hukum dan pemenuhan hak penyandang disabilitas yang diatur melalui Perda Provinsi Bali Nomor 9 Tahun 2015 telah memuat hak-hak penyandang disabilitas yang cukup komprehensif, serta juga memuat kewajiban dari Pemerintah Daerah dalam melakukan pemenuhan hak penyandang disabilitas. Namun, demikian dalam hak keberagamaan penyandang disabilitas, memilik potensi untuk tidak dapat diterapkan karena cenderung tidak sejalan dengan adat dan budaya Bali yang sudah turun-temurun.Empirically, people with disabilities often get discriminatory treatment in social life which results in neglect of the fulfillment of the rights of persons with disabilities, although juridically, as in Bali, there are already regional legal products that provide protection for the rights of persons with disabilities. This study aims to analyze how forms of legal protection given to people with disabilities and how the implementation of the rights of persons with disabilities is associated with Balinese culture. This study uses normative research methods with the approach of legislation (statue approach) and conceptual approach. The results of this study indicate that legal protection and the fulfillment of the rights of persons with disabilities regulated through the Bali Provincial Regulation Number 9 of 2015 has contained the rights of persons with disabilities that are quite comprehensive, as well as the obligations of the Regional Government in fulfilling the rights of persons with disabilities. However, as in the rights of religious persons with disabilities, they have the potential not to be applied because they tend to be inconsistent with Balinese customs and culture that has been passed down through generations.

Abstract

This study aimed to analyze the setting of childfriendly schools to prevent child violence and the standardsetting model for child-friendly schools to protect children’s rights. This study used normative legal research with statutory regulations, concept approaches, and analytical approaches. Collection of secondary legal materials used document study techniques. The data that had been obtained was analyzed using an interpretation technique, namely legal hermeneutics. The study results showed that child-friendly schools were indicators of child-friendly district or city development by the Regulation of the Minister of Women’s Empowerment and Child Protection Number 11 of 2011 to protect children’s rights from violence in the educational environment. The standardization of child-friendly school development based on the Minister of Women’s Empowerment and Child Protection Regulation Number 8 of 2014 required essential components, including policies, curriculum implementation, educators and education personnel trained in children’s rights, child-friendly learning processes, child-friendly facilities and infrastructure, child participation, as well as the involvement of parents, alumni, community organizations, and the business world.

Abstract

Drug abuse is a serious problem that requires attention and collaborative action from various parties, including the government, social institutions, and the community, especially the Traditional Village. This study aims to explore the role of the Bali Provincial Government and Traditional Villages in efforts to prevent and eradicate drug abuse. The research method used is normative law with a legislative approach and qualitative analysis. The results of the study indicate that the Bali Provincial Government has implemented various programs, such as collaboration with the National Narcotics Agency (BNN), socialization to the community, strengthening regulations, and providing rehabilitation facilities for drug users. In addition, Traditional Villages play an important role in educating the community about the dangers of drugs, forming anti-drug cadres, and providing social support for individuals at risk. Cooperation between Traditional Villages and the government, as well as a cultural-based approach, are key to creating a safe and drug-free environment. This study emphasizes the importance of collaboration between the government, institutions, and the community in overcoming drug abuse in Bali, in order to create a healthy society that is free from the dangers of drugs.
