Abstract

The issue of ownership is regulated extensively in Muamalah fiqh in the fields of Al-Mal (property) and Al-Milk (property). Regarding ownership, it is regulated so that there is no violation of one's rights by other individuals, because humans have a tendency towards material things. Islamic recognition of property rights is reflected in the concept of haq al-adami, protection of individual ownership is also regulated in Islam by determining sanctions against people who rob them. This study aims to determine how the concept of Islam in regulating individual ownership rights and how the ethics that must be obeyed in the context of property ownership. This study uses secondary data with data collection methods carried out by means of library research, namely by studying, exploring and citing theories or concepts from a number of literatures such as journals, books, and others. The results of the study that the rules of ownership in Islam have implications for the potential for Islamic economic development, good application of the rules of ownership can have implications for reducing the amount of poverty and economic equity in society.

Abstract

Abstract. The development of online buying and selling has given Indonesian people many conveniences, both in terms of selling and buying, but in reality there are still many traders from traditional markets, not all of whom can adapt to the development of online sales, resulting in price differences between online and offline stores which has an impact on the decline. Income for some traditional market traders. The rules that apply as an effort to handle business competitiondue to price differences between online and offline stores are how Islamic business ethics and Law Number 7 of 2014 concerning trade influence price comparisons and competition between online stores and offline stores that occur at the Kopo Sayati Traditional Market. . The aim of this research is to analyze the price differences between online and offline shops in the Kopo Sayati Traditional market and then review it with Islamic business ethics and Law Number 7 of 2014 concerning trade. This research method uses field research, using descriptive analytical techniques to describe the competition that occurs in the Kopo Sayati traditional market with online stores. The results of the research show that the competition that occurs due to price differences between online and offline stores is not in accordance with the principles of Islamic business ethics and Law Number 7 of 2014 concerning trade because the competition that occurs is not based on healthy competition, and how the perpetrators should act efforts to prioritize healthy competition so that in the end no one party is harmed. Abstrak. Perkembangan jual beli online membuat masyarakat Indonesia diberikan banyak kemudahan, baik dalam hal menjual maupun membeli tetapi pada kenyataanya masih banyaknya pedagang dari pasar tradisional tidak semuanya bisa beradaptasi dengan perkembangan penjualan secara online ini, sehingga terjadinya perbedaan harga antara toko online dan offline yang berdampak kepada pernurunan pemasukan bagi sebagian pedagang pasar tradisional. Adapun aturan yang berlaku sebagai upaya menangani persaingan usaha akibat adanya perbedaan harga antara toko online dan offline yaitu bagaimana etika bisnis Islam dan Undang-Undang Nomor 7 Tahun 2014 tentang perdagangan memengaruhi perbandingan harga dan persaingan antara toko online dan toko offline yang terjadidi Pasar Tradisional Kopo Sayati. Adapun tujuan penelitian ini menganalisa perbedaan harga antara toko online dan offline di pasar Tradisional Kopo Sayati kemudian ditinjau dengan etika bisnis Islam dan Undang-Undang Nomor 7 Tahun 2014 tentang perdagangan. Metode penelitian ini menggunakan penelitian lapangan (field research), dengan menggunakan teknik analitis deskriptif demi menggambarkan persaingan yang terjadi di pasar tradisional Kopo Sayati dengan toko online. Hasil dari penelitian menunjukan bahwa persaingan yang terjadi akibat adanya perbedaan harga antara toko online dan offline tidak sesuai dengan prinsip etika bisnis Islam dan Undang- Undang Nomor 7 Tahun 2014 tentang perdagangan karena persainga yang terjadi tidak berasaskan pada persainngan yang sehat, dan seharusnya bagaimana para pelaku usaha mengedepankan persaingan yang sehat hingga akhirnya tidak ada salah satu pihak yang dirugikan.

Abstract

One contribution in the concept of socio-economic or commonly referred to as al-Irtifaqat is Shah Waliullah al Dahlawi, a Delhi scholar born in the 18th century. According to him there are at least four concepts in the development of civil society, namely; (1) Beginning with the lives of primitive communities that are only oriented to meeting basic needs. (2) Humans rise to the level and start thinking about how to get a decent life. (3) The level of city life, and (4) the final stage is how humans reach the peak of civilization. Using qualitative methods and analyzed descriptively through a historical-normative-philosophical approach this article tries to describe Shah Waliullah al-Dahlawi’s contribution in building the modern world civilization today, which in broadly outlines his ideas more on giving ideas about the concept of economic cooperation, taxation and responsibility state answer in the economy and so on. ABSTRAKSalah satu kontribusi dalam konsep sosio ekonomi atau biasa disebut dengan istilah al-Irtifaqat yaitu Shah Waliullah al Dahlawi seorang ulama Delhi yang lahir pada abad ke 18. Menurut beliau setidaknya ada empat konsep tahapan berkembangnya masyarakat madani yaitu; (1) Diawali dari kehidupan masyarakat primitif yang hanya berorientasi untuk memenuhi kebutuhan dasar. (2) Manusia naik setingkat dan mulai memikirkan bagaimana mendapatkan kehidupan yang layak. (3) Taraf kehidupan kota, dan (4) tahap akhir yaitu bagaimana manusia mencapai puncak peradaban. Dengan mengunakan metode kualitatif dan dianalisa secara deskriptif melalui pendekatan historisnormatif-filosofis artikel ini mencoba memaparkan kontribusi Shah Waliullah al-Dahlawi dalam membangunan peradaban dunia modern saat ini, yang secara garis besar pemikirannya lebih pada pemberian ide tentang konsep kerjasama ekonomi, pajak dan tanggung jawab negara dalam perekonomian dan lain sebagainya.

Abstract

Abstract. The practice of renting a house in Winduhaji Village, Sedong District, Cirebon Regency is carried out orally with several conditions given by the homeowner. These conditions include the tenant's responsibility for the damage that occurs and the tenant's obligation to maintain the house properly. However, it turned out to be a debate for both parties. This study aims to understand the practice of conditional renting houses in Winduhaji Village, Sedong District, Cirebon Regency, and analyze it based on the Compilation of Sharia Economic Law (KHES) and the Civil Code. This research method uses a qualitative approach with the type of normative–empirical research. Primary and secondary data are used as data sources, as well as data collection methods include observation, interviews, documentation, and literature studies. The data obtained was then analyzed using the qualitative descriptive data analysis method. The results of the study show that the practice of renting a conditional house in Winduhaji Village, Sedong District, Cirebon Regency is carried out orally without written evidence. Homeowners provide relatively cheap prices and do not provide a definite time limit for payment. However, the landlord gives several conditions to the tenant, such as taking good care of the house, cleaning all parts of the house, and fixing the damage with funds from the tenant. Based on the analysis of KHES and the Civil Code, the practice of renting a house in Winduhaji Village, Sedong District, Cirebon Regency is said to be null and void because of several conditions that are not by the provisions of the law. These conditions include Article 306, Article 313 (2), and Article 305 of the Criminal Code, as well as Articles 1320 (1) and (4), Article 1550 (2) and (3), and Article 1560 (1) of the Civil Code. Abstrak. Praktik penyewaan rumah di Desa Winduhaji, Kecamatan Sedong, Kabupaten Cirebon, dilakukan secara lisan dengan sejumlah syarat yang ditetapkan oleh pemilik rumah. Syarat-syarat tersebut mencakup tanggung jawab penyewa atas kerusakan yang terjadi serta kewajiban penyewa untuk merawat rumah dengan baik. Namun, hal ini menimbulkan perdebatan antara kedua belah pihak. Penelitian ini bertujuan untuk memahami praktik sewa rumah dengan syarat di Desa Winduhaji serta menganalisisnya berdasarkan Kompilasi Hukum Ekonomi Syariah (KHES) dan KUH Perdata. Metode penelitian menggunakan pendekatan kualitatif dengan jenis penelitian normatif-empiris. Data primer dan sekunder digunakan sebagai sumber informasi, dengan metode pengumpulan data meliputi observasi, wawancara, dokumentasi, dan studi pustaka. Data yang diperoleh dianalisis menggunakan metode analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa praktik sewa rumah dengan syarat di Desa Winduhaji dilakukan secara lisan tanpa bukti tertulis. Pemilik rumah menetapkan harga sewa yang relatif murah tanpa batasan waktu pembayaran yang jelas. Namun, pemilik rumah memberikan beberapa syarat kepada penyewa, seperti menjaga rumah dengan baik, membersihkan seluruh bagian rumah, dan memperbaiki kerusakan dengan biaya dari penyewa. Berdasarkan analisis KHES dan KUH Perdata, praktik sewa rumah di Desa Winduhaji ini dianggap batal demi hukum karena beberapa syarat yang tidak sesuai dengan ketentuan hukum. Syarat-syarat tersebut melanggar Pasal 306, Pasal 313 (2), dan Pasal 305 KHES, serta Pasal 1320 (1) dan (4), Pasal 1550 (2) dan (3), dan Pasal 1560 (1) KUH Perdata.

Abstract

Abstract. The implementation ta'widh cancellation of online transportation on the Grab application is a policy set by the company to the application user, where consumers who cancel after the specified time will be charged a cancellation fee. Cancellation fees are charged to consumers who have not received the benefits of the service. This research aims to know, understand, and analyze the application of ta'widh cancellation of online transportation on the Grab application according to the KHES and Law No. 8 of 1999 concerning Consumer Protection. The research method used is qualitative research with a normative juridical approach. The data source is obtained from secondary data supported by primary data. The data collection techniques used are literature study, interviews, and documentation. The results of the study show that the implementation of ta'widh is in accordance with Articles 36 and 38 of the KHES, consumers are still declared to have broken their promises because they have canceled the order and can be subject to compensation fees. According to the Consumer Protection Law, consumers in addition to having the right to receive true, clear, and honest information about the cancellation fee policy, such as the sustainability of information on the application, consumers are also obliged to follow the rules of consumer obligations, in this case consumers as application users are required to read the rules or provisions on the application before using the service, so that consumers can understand what are the provisions that have been approved in the Terms and Conditions of Application. Abstrak. Penerapan ta’widh pembatalan transportasi online pada aplikasi Grab adalah suatu kebjiakan yang ditetapkan pihak perusahaan pada pengguna aplikasi, di mana konsumen yang membatalkan setelah waktu yang ditentukan akan dikenakan biaya pembatalan. Biaya pembatalan dikenakan pada konsumen yang belum menerima manfaat layanan. Peneltian ini memiliki tujuan untuk mengetahui, memahami, dan menganalisis penerapan ta’widh pembatalan transportasi online pada aplikasi Grab menurut KHES dan UU No. 8 Tahun 1999 mengenai Perlindungan Konsumen. Pendekatan yuridis normatif dengan metode kualitatif diaplikasikan pada penelitian ini. Sumber data didapatkan dari data sekunder yang didukung data primer. Teknik pengumpulan data berlangsung dengan metode studi pustaka, dokumentasi, dan wawancara. Hasil penelitian memperlihatkan bahwa penerapan ta’widh sudah sesuai dengan Pasal 36 dan 38 KHES, konsumen tetap dinyatakan ingkar janji karena telah membatallkan pesanan dan dapat dikenakan biaya ganti rugi. Menurut UU Perlindungan Konsumen, konsumen selain berhak untuk memperoleh informasi yang akurat, jujur, dan jelas, tentang kebijakan biaya pembatalan, seperti keberlanjutan informasi pada aplikasi, konsumen juga wajb untuk mengikuti aturan kewajiban konsumen, dalam hal ini konsumen sebagai pengguna aplikasi wajib membaca aturan atau ketentuan yang ada pada aplikasi sebelum menggunakan layanannya, agar konsumen dapat memahami apa saja ketentuan yang telah disetujui pada syarat ketentuan aplikasi.

Abstract

Abstract. BSI Giro products with wadiah contracts are one of the important funding products for banks to generate profits. However, the implementation of wadiah contracts on this product must comply with the provisions of muamalah jurisprudence and applicable regulations. This study aims to examine the implementation of wadiah contracts on giro products in general and specifically on wadiah giro products at BSI Bengkulu City. This study uses a descriptive analysis method to evaluate the implementation of BSI Giro products at BSI Bengkulu City in accordance with the perspective of muamalah jurisprudence and existing regulations. The results of the study indicate that the implementation of wadiah contracts on BSI Giro products uses the wadiah yad dhammah type, where Islamic banks can manage customer funds and are entitled to profits from managing these funds and receive compensation from deposit services. This implementation is in accordance with muamalah jurisprudence and applicable regulations.‎ Abstrak. Produk Giro BSI dengan akad wadiah adalah salah satu produk pendanaan yang penting bagi bank untuk menghasilkan keuntungan. Namun, pelaksanaan akad wadiah pada produk ini harus mematuhi ketentuan fikih muamalah dan peraturan yang berlaku. Penelitian ini bertujuan untuk mengkaji penerapan akad wadiah pada produk giro secara umum dan khususnya pada produk giro wadiah di BSI Kota Bengkulu. Penelitian ini menggunakan metode analisis deskriptif untuk mengevaluasi pelaksanaan produk Giro BSI di BSI Kota Bengkulu sesuai dengan perspektif fikih muamalah dan peraturan yang ada. Hasil penelitian menunjukkan bahwa implementasi akad wadiah pada produk Giro BSI menggunakan jenis wadiah yad dhammah, di mana bank syariah dapat mengelola dana nasabah dan berhak atas keuntungan dari pengelolaan dana tersebut serta mendapatkan imbalan dari jasa titipan. Implementasi ini telah sesuai dengan fikih muamalah dan peraturan yang berlaku.‎

Abstract. As one of the largest Islamic banks in Indonesia, BSI implements a Service Quality system to attract sympathy from customers and potential customers. This Service Quality system, which is based on Islamic teachings, is known as Islamic Service Quality and covers a wider dimension than conventional service systems. However, in practice, there are still some complaints from customers regarding product service information provided by frontline officers. Therefore, this study aims to analyze the implementation of policies and service implementation through the Islamic Service Quality system at BSI KC Citarum, Bandung City, and to assess how the concept of Islamic Service Quality is applied in customer service there. The research method used is descriptive with data collection techniques through interviews, documentation, and observation, and data analysis is carried out qualitatively. The results of the study indicate that the implementation of policies and services through the Service Quality system at BSI KC Citarum, Bandung City is based on a corporate culture that reflects the characteristics of the Prophet SAW, namely Shiddiq, Istiqamah, Fathonah, Amanah, and Tabligh. In addition, customer service at BSI KC Citarum, Bandung City has been running well and in accordance with the concept of Islamic Service Quality.‎ Abstrak. Sebagai salah satu bank syariah terbesar di Indonesia, BSI menerapkan sistem Service Quality untuk menarik simpati dari nasabah dan calon nasabah. Sistem Service Quality ini, yang didasarkan pada ajaran Islam, dikenal sebagai Islamic Service Quality dan mencakup dimensi yang lebih luas dibandingkan sistem pelayanan konvensional. Namun, dalam praktiknya, masih ada beberapa keluhan dari nasabah mengenai informasi layanan produk yang diberikan oleh petugas frontliner. Oleh karena itu, penelitian ini bertujuan untuk menganalisis penerapan kebijakan dan pelaksanaan pelayanan melalui sistem Islamic Service Quality di BSI KC Citarum Kota Bandung, serta menilai bagaimana konsep Islamic Service Quality diterapkan dalam pelayanan nasabah di sana. Metode penelitian yang digunakan adalah deskriptif dengan teknik pengumpulan data melalui wawancara, dokumentasi, dan observasi, serta analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa penerapan kebijakan dan pelayanan melalui sistem Service Quality di BSI KC Citarum Kota Bandung didasarkan pada budaya perusahaan yang mencerminkan karakteristik Nabi SAW, yaitu Shiddiq, Istiqamah, Fathonah, Amanah, dan Tabligh. Selain itu, pelayanan nasabah di BSI KC Citarum Kota Bandung telah berjalan dengan baik dan sesuai dengan konsep Islamic Service Quality.‎

Abstract. Go-Pay, as a form of electronic money, has a significant impact on increasing non-cash transactions in Indonesia. Go-Pay is used for various types of payments, including in the GO-JEK application which is widely used by the public, including Muslims. Therefore, it is important to examine the validity of Go-Pay top-ups from the perspective of sharia economic law. Based on the background description, this study aims to analyze the Go-Pay balance top-up mechanism on the GO-JEK application in Bandung City and see its compliance with DSN Fatwa No. 116 / DSN-MUI / IX / 2017 concerning Sharia Electronic Money. The research method used is qualitative descriptive with a juridical-empirical approach. The results of the study show that Go-Pay top-ups in Bandung City are carried out through four methods, namely bank transfers (ATM or Mobile Banking), payments at minimarkets or retail partners, the Gojek application, and transfers between GoPay users. This top-up mechanism is in accordance with the Ijarah contract according to DSN Fatwa No. 116/DSN-MUI/IX/2017. Abstrak. Go-Pay, sebagai salah satu bentuk uang elektronik, memiliki dampak signifikan terhadap peningkatan transaksi non-tunai di Indonesia. Go-Pay digunakan untuk berbagai jenis pembayaran, termasuk dalam aplikasi GO-JEK yang banyak digunakan oleh masyarakat, termasuk umat Islam. Karena itu, penting untuk meneliti keabsahan top-up Go-Pay dari perspektif hukum ekonomi syariah. Berdasarkan uraian latar belakang tersebut, maka penelitian ini bertujuan untuk menganalisis mekanisme top-up saldo Go-Pay pada aplikasi GO-JEK di Kota Bandung serta melihat kesesuaiannya dengan Fatwa DSN No 116/DSN-MUI/IX/2017 tentang Uang Elektronik Syariah. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pendekatan yuridis-empiris. Hasil penelitian menunjukkan bahwa top-up Go-Pay di Kota Bandung dilakukan melalui empat metode, yaitu transfer bank (ATM atau Mobile Banking), pembayaran di minimarket atau retail partner, aplikasi Gojek, dan transfer antar pengguna GoPay. Mekanisme top-up ini sudah sesuai dengan akad Ijarah menurut Fatwa DSN No 116/DSN-MUI/IX/2017.

Abstract

Land is a very important thing in human life, since ancient society to modern society now land has a decisive role in human economic activity. The vital role the soil causes the various interests play in it, until eventually arise various problems of land that until now still can not be resolved by the State as policy makers such as; eviction, mutual ownership claims etc. This paper attempts to unravel how the position of the State in dealing with public ownership, especially the land issue absentee, by conducting a comparative study between the Law No. 5, 1960 (UUPA) and the rules of Islam on issues related to the distribution and land management. Literature research results found be in agreement regarding the position of the country (Indonesia) in dealing with public ownership (absentee land issues) as stipulated in Law No. 5 of 1960 on Agrarian Reform, especially article 10, with the provisions of Islamic law.

Abstract

Indonesia mengalami lonjakan signifikan dalam penggunaan uang digital, dengan transaksi melalui Quick Response Code Indonesian Standard (QRIS) meningkat hingga 226,54% pada pertengahan 2024. Hal ini menunjukkan percepatan transformasi sistem pembayaran digital, dengan 50,5 juta pengguna dan 32,7 juta merchant. Penelitian ini bertujuan untuk mengeksplorasi bagaimana inovasi teknologi dapat diselaraskan dengan prinsip syariah dalam konteks keuangan digital. Fokus utama penelitian adalah untuk mengembangkan panduan desain layanan fintech berbasis maqashid syariah, agar dapat memenuhi kebutuhan masyarakat Muslim di era digital. Uang digital memiliki karakteristik non-fisik, fleksibel, efisien, serta memiliki fitur keamanan yang baik. Namun, penerapannya harus sesuai dengan prinsip ekonomi syariah, seperti larangan riba (bunga) dan gharar (ketidakpastian). Fatwa Majelis Ulama Indonesia (MUI) menjadi acuan untuk memastikan transaksi uang digital sesuai dengan syariah. Dalam layanan fintech syariah, akad-akad yang digunakan harus bebas dari riba, gharar, dan haram, serta menggunakan akad seperti mudharabah dan musyarakah. Penelitian ini menggunakan pendekatan kualitatif dengan desain deskriptif, dengan sumber data yang mencakup literatur ilmiah, jurnal, buku, dan laporan resmi dari lembaga pemerintah. Hasil penelitian menunjukkan bahwa QRIS memiliki relevansi yang kuat dalam mendukung inklusi keuangan syariah, memberikan perlindungan harta melalui keamanan transaksi, serta memperluas akses masyarakat ke layanan keuangan berbasis syariah. Penelitian ini diharapkan dapat memberikan kontribusi penting dalam mendukunIndonesia has seen a significant surge in digital currency usage, with transactions through the Quick Response Code Indonesian Standard (QRIS) increasing by 226.54% in mid-2024. This research explores how technological innovation can align with Islamic values in the context of digital finance. It aims to develop guidelines for fintech services based on maqashid syariah, catering to the needs of Muslims in the digital era. Digital currency offers features such as non-physical transactions, flexibility, speed, cost-efficiency, and security, but its implementation must adhere to Islamic economic principles, particularly the prohibition of riba (interest) and gharar (uncertainty). The Indonesian Ulema Council (MUI) fatwa serves as a key reference for ensuring that digital transactions align with Islamic law. Islamic fintech services should be free from riba, gharar, and haram practices, utilizing contracts like mudharabah and musyarakah. This qualitative research, using descriptive design, draws from scholarly literature, journals, books, and government reports to examine the relationship between digital currency and Islamic economic principles. Findings suggest that QRIS is highly relevant in promoting financial inclusion under Islamic law, offering secure transactions and broadening access to sharia-compliant financial services for those without access to conventional banking. This study aims to contribute to advancing sharia financial inclusion, enhancing digital economic competitiveness, and supporting national economic recovery.
