Abstract

Tension between privacy and security is nothing new, however due to the development of information and communication technology use as well as more intensive efforts of terrorism eradication have affected to the increasing level of the conflict. The need for national security is often similar to the situation of state of emergency, which enables the state to conduct several limitations to the implementation of right to privacy. Many states use the said justification and further position the element of national security to be in the superior position compared to the protection of civil liberties, including right to privacy. As a result, the act of limitation to the implementation of right to privacy in the context of terrorism eradication is deemed as ordinary and justified by law. In addition to that, to legitimize such policy, the state often sustains the state of emergency situation with no clear time limit. Departing from such situation, there needs to build an equilibrium between security and protection of the right to privacy by adapting to the continually changing reality. Today's technology development enables the state to track the movement of each person and create detailed and comprehensive profile of its citizen's life, so that the limitation of privacy also changes. However, even with the reason of terrorism eradication, the actions executed by the state must refer to several specific principles to ensure the protection of rights and fundamental freedoms.

Abstract

In Indonesia, acts of terrorism that attack police officers and police facilities, it can be understood that terrorist groups actually do this because of feelings of revenge and also the motive that the authorities no longer have the trust of the community that they can provide security and maintain the peace of the country's life. Several cases that have occurred in Indonesia include the attack on the Headquarters of the Indonesian National Police on March 31, 2021 and the suicide bombing that occurred at the Astana Anyar Police Station on December 7, 2022. These two tragedies are clear examples of the urgency of increasing security at police stations. Things that make terrorist attacks on police facilities and officers can be described based on the existence of exposed, vital, iconic, legitimate, destructible, occupied, near, and easy. The success of an act of terrorism depends on several factors, including the terrorist group's ability to plan and execute an attack effectively, as well as security weaknesses at the target of the attack. To overcome this problem, it is necessary to improve the security system by applying the concept of Crime Prevention Through Environmental Design (CPTED) to prevent similar attacks in the future.

Abstract

This research investigates the application of restorative justice in Indonesia's approach to terrorism, highlighting its potential to transform traditional justice methods. It focuses on the benefits of restorative justice in empowering victims, promoting offender accountability, and enhancing community trust. The study acknowledges the challenges in implementation, including legal, security, and cultural barriers, as well as resource constraints. Proposed solutions involve legal reforms, heightened security protocols, and increased public awareness. The conclusion emphasizes that restorative justice, with its emphasis on healing and community engagement, is a crucial step towards a more inclusive and effective response to terrorism's societal impacts in Indonesia.

Abstract

Terrorism has experienced the development of the actors involved in it. Children are targets and new actors are being targeted to become cadres by terrorists, specifically by the Islamic State of Iraq and Syria (ISIS). The May 13, 2018, incident, the suicide bombing that occurred in Surabaya, East Java, involved four children as perpetrators. Four children who are siblings named Fadhil, Firman, Fadhila, and Famela have succeeded in creating public concern which creates a feeling of insecurity. This paper aims to analyze efforts to involve children as terrorist actors in the 2018 Surabaya Bombing case. The method used is a descriptive qualitative research method. Researchers collect primary data through interviews and secondary data from journals, books, and other writings on related issues. The results of this study found that the involvement of children as perpetrators of terror could occur after the child passed the six steps of the ladder for someone to become a terrorist by Fathali Moghaddam. The use of children as terrorists is due to several considerations, ranging from low cost, being able to attract media attention to being effective in physically touching targets.

Abstract

This article examines further how the Indonesian police carry out counter-radicalization enforcement in cyberspace. This is important because radicalism triggers a person to be violent towards different views, and this does not follow the nature of the diversity of the Indonesian nation. Radicalism is the embryo of terrorism. This situation becomes more dangerous when radicalization efforts are carried out through cyberspace, which can be accessed by the entire community, including impressionable teenagers. In this regard, the Indonesian National Police, which maintains security and order and protects the community, also takes part in counter-radicalization in cyberspace to ward off negative influences that underlie intolerant and radical actions. This particular observation of the role of the police against radicalism through online media is what then differentiates it from similar research. The discussion uses a qualitative research approach and literature study method, incorporating counter-radicalisation theory through the Internet. This paper finds that counter-radicalization in cyberspace by the police is cyber patrols and content takedown, establishing a social media task force, increasing the role of moderate religious mass organizations, strengthening religious literacy, and collaborating with national and international institutions and digital platforms. In addition, law enforcement is following the ITE Law and the Terrorism Law.

Abstract

The purpose of this paper is to study about repatriation of Foreign Terrorist Fighters (FTFs) to Indonesia who went to Syria by analyzing the factors such as risk of involving in terrorist attacks in Indonesia, which are influencing Indonesia's refusal and its implications on a state's counterterrorism efforts. The present study is carried out using qualitative research method and the data collected from secondary sources including research articles, newspapers and books related to the FTF phenomenon. To address this issue, the Indonesian government is considering a strategy to minimize negative consequences from the return of Indonesian individuals associated with terrorist activities from overseas. The results show that the Indonesian government has calculated the benefits and drawbacks of either returning foreign terrorist fighters' home or not. In the process, the government ultimately decided against the FTFs' repatriation, citing the need to safeguard millions of people's security from the danger of terrorism as a national priority for Indonesia. It concludes that the accepting repatriation of FTF by Indonesia would support human rights efforts in giving them fair trials if they have committed crimes and it will prevent them from being stateless.

Abstract

Artikel ini berupaya mengkaji lebih lanjut tentang bagaimana upaya kepolisian Indonesia dalam menanggulangi konten radikalisme yang disebarkan melalui dunia maya. Hal ini menjadi penting karena radikalisme memicu seseorang untuk bersikap keras terhadap perbedaan pandangan, dan hal ini jelas tidak sesuai dengan hakikat keberagaman yang dimiliki bangsa Indonesia. Bahkan, radikalisme merupakan embrio lahirnya terorisme. Keadaan ini menjadi lebih berbahaya ketika upaya radikalisasi dilakukan melalui dunia maya yang dapat diakses seluruh masyarakat termasuk remaja yang mudah terpengaruh. Terkait hal ini, Kepolisian Negara Republik Indonesia (Polri) yang di antaranya memiliki peran menjaga keamanan dan ketertiban serta melindung masyarakat turut mengambil peran dalam kontra radikalisasi di ruang siber guna menangkal pengaruh-pengaruh negatif yang melatarbelakangi tindakan intoleran dan radikal. Pengamatan khusus terhadap peran kepolisian terhadap radikalisme melalui media daring ini yang kemudian menjadi pembeda dengan riset sejenis. Dalam pembahasannya, digunakan pendekatan penelitian yang bersifat kualitatif dan metode studi kepustakaan, dengan menyertakan teori kontra radikalisasi melalui internet. Tulisan ini memperoleh temuan bahwa kontra radikalisasi di ruang siber oleh kepolisian adalah patroli siber dan take down konten, pembentukan satuan tugas media sosial, peningkatan peran ormas agama moderat, penguatan literasi keagamaan, serta kerja sama dengan lembaga nasional, internasional, dan platform digital. Selain itu, penindakan hukum sesuai UU ITE dan UU Terorisme.

Abstract

Konflik di kawasan Timur Tengah merupakan salah satu topik pembahasan yang sering dibicarakan di dalam ranah akademis dengan konteks politik internasional, literatur akademik, dan pemberitaan terkait dinamika negara-negaranya. Konflik yang terjadi bervariasi, mulai dari konflik antar etnis, perang saudara, dan konflik perebutan kawasan. Salah satu konflik yang sering menjadi perbincangan dan telah berjalan hampir 50 tahun lebih adalah konflik antara Israel dan Palestina.  Selama 50 tahun, berbagai usaha untuk melakukan proses perdamaian telah dicapai oleh kedua belah pihak, namun belum mendapatkan titik terang walaupun sudah dimediasi oleh negara-negara lainnya.Berbagai macam usaha dalam menciptakan proses Peacemaking atau penciptaan perdamaian dilakukan oleh berbagai pihak, namun selalu mengalami deadlock atau tidak adanya solusi yang mampu menciptakan perdamaian di konflik tersebut. Penulis berpendapat bahwa hal ini terjadi disebabkan karena dua faktor, yaitu (1) pemberian hak veto dari Amerika Serikat terhadap beberapa resolusi perdamaian dan (2) normalisasi hubungan beberapa negara-negara di kawasan Timur Tengah dengan Israel. Penulis akan mencoba menjelaskan kedua faktor tersebut dengan menggunakan kerangka perspektif power-dependence relations dari Emerson. Oleh karena itu, penulis akan menjelaskan terlebih dahulu maksud dari perspektif power-dependence relations dari Emerson.

Abstract

The financing of terrorism in Indonesia, has become increasingly complex due to the involvement of various domestic terrorist organizations. These groups obtain funds through diverse sources such as direct donations, membership fees, self-funding, and the misuse of non-profit organizations (NPOs). This study aims to explore and analyze the potential and challenges of utilizing advanced technologies, particularly Artificial Intelligence (AI) and Machine Learning (ML), in preventing terrorist financing in Indonesia. The research employs a qualitative descriptive approach, utilizing secondary data from FATF reports and related literature. The findings indicate that AI and ML can significantly enhance the detection and investigation of suspicious financial activities, provide real-time transaction monitoring, and facilitate inter-agency collaboration. However, challenges such as data limitations, regulatory complexity, high implementation costs, and data security and privacy issues must be addressed to fully leverage these technologies. This study provides recommendations for developing a supportive regulatory framework, enhancing inter-agency cooperation, and investing in better data infrastructure to effectively utilize AI and ML in combating terrorist financing.

Abstract

Terrorism is currently classified as an international crime which aims to pose a threat and fear to humanity. The presence of a deradicalization program is believed to be able to minimize and even eliminate extreme ideology which is the initial cause of acts of terrorism. Deradicalization is carried out for terrorist prisoners with the aim of eliminating extreme ideas and opening the way for terrorist prisoners to return to the basic ideology of a country and deradicalization is also carried out for society so that they can avoid extreme ideas. Each country has its own method, especially Indonesia and India, in its efforts to deradicalize terrorist convicts. However, does the deradicalization method used by Indonesia have any effect when applied to terrorist prisoners in India and vice versa. To see whether the deradicalization program between Indonesia and India has similarities, further observations are needed regarding the comparison of deradicalization programs between Indonesia and India. The method used in this research is a qualitative method whose sources are centered on literature related to the subject of discussion. The results of this research explain whether deradicalization programs in Indonesia and India have similarities and how effective these programs are in efforts to deradicalize terrorist convicts.
