Abstract

This study aims to explain the cybersecurity and legal protection of dropshipping transactions from the Indonesian and Islamic economic law perspective. The normative and comparative judicial approaches were applied to achieve the research objectives. Descriptive and prospective analysis methods are used, and data are collected through primary and secondary sources. The findings revealed that despite the continuous growth of dropshipping contracts, Indonesia has no direct laws and regulations that particularly deal with the dropshipping mechanism and provide this cyber security to the system. In Islam, the dropshipping mechanism is linked with three types of contracts: Salam, Samsarah, and Wakalah. However, each type carries certain limitations as per Islamic/Sharia principles. Simultaneously, along with the cyber security laws available in financial transactions, the Islamic Fatwa can be regarded as a guide for dealing with dropshipping agreements and preventing cyber security. Furthermore, considering the increasing trend of dropshipping businesses, which is beneficial for the economic system, the existing cybersecurity laws and regulations must be amended to explicitly cover drop-shipping mechanisms.

Abstract

This paper discusses the Rida controversy with hadith scholars. The controversy stems from Rida’s a priori to the traditions that are popular and well-known among hadith scholars, especially the category of khabar al-ahad hadith. The root of their problem lies in Rida’s rational critique of the categories and implications of khabar al-ahad. He considers dilalah (connotation) of khabar al-ahad to be nothing more than just zanni al-dilalah (presumption and uncertainty). The implication is that hadith in this category cannot be used as a basis for belief because belief is based on qat’i al-dilalah (certainty of proposition). The research method used was descriptive-analytic method. This method was combined with a historical-philosophical approach. Therefore, analyzing and describing Rida’s thoughts as a whole is the main work in this article. The next step was to combine the analytical-philosophical approach to the roadmap from the genuine part of Rida’s line of thought. This activity is expected to help the author in finding answers on how Rida rationalizes khabar al-ahad and its implications. Finally, this article finds the conclusions, including: a) Rida’s efforts in rationalizing khabar al-ahad are based on the views of the mutakallimūn (theologians), manat}iqah (logic experts) and falasifah (philosophers), b) Rida has been trapped in his own over a priori thinking on khabar al-ahad, c) Rashid Rida’s rationalization of khabar al-ahad actually leads to ambiguity and uncertainty.

Abstract

The high divorce rate in Indonesia often has a significant impact on the mental well-being of children, particularly due to the absence of a father figure and emotional instability within the family. This study focuses on the impact of single mothers’ remarriage on children’s mental development from the perspective of maqāṣid al-sharīʿah. The primary issue explored is how the presence of a stepfather influences the emotional, social, and intellectual stability of children in post-divorce families. The study employs a qualitative approach with a phenomenological design, involving in-depth interviews with six single mothers who have remarried in Negararatu Village, South Lampung. The findings reveal that the presence of a stepfather positively contributes to the reinforcement of religious values (ḥifẓ ad-dīn), emotional well-being (ḥifẓ an-nafs), intellectual development (ḥifẓ al-‘aql), family relations (ḥifẓ an-naṣl), and economic stability (ḥifẓ al-māl). From the perspective of maqāṣid al-sharīʿah, remarriage not only strengthens family structure but also supports the psychological recovery of children after divorce. The novelty of this study lies in integrating the maqāṣid al-sharīʿah framework with the modern family context to explain the role of stepfathers in enhancing children’s mental well-being holistically.

The indigenous people of Lampung Saibatin are adherents of the Islamic religion. However, in the marriage tradition, there are still several gender-biased customs that are not in harmony or even contrary to the values of Islamic teachings. The formulation of the problem in this article is how is the level of compatibility between the marriages of the Lampung Saibatin indigenous people and the teachings of Islam they believe? The purpose of this article is to describe the concept of marriage in the Qur'an and marriage customs in the Lampung Saibatin indigenous community and their compatibility with Islamic teachings through the study of gender verses in the Qur'an. The method used is qualitative, with a sociological approach. The focus of this study is to present an interpretation of the gender verse, then relate it to what is practiced by the Lampung Saibatin indigenous people in their marriage customs. The results of the study show: First, there is still a gap between the teachings adopted by the Lampung Saibatin indigenous people and their marriage customs. Second, gender inequality is still often practiced in the marriage customs of the Lampung Saibatin indigenous people. Third, referring to the values of religious teachings adopted by the indigenous people of Lampung Saibatin, it is a solution to the gender injustice in their marriage customs. Fourth, the local wisdom in the marriage of the Lampung Saibatin indigenous people in ending conflicts between families and minimizing the divorce rate. The results of this study contribute to explaining the marriage customs in the internal Lampung Saibatin indigenous community and enlightening the external parties that it is not always what is traditions by a Muslim community is a representation of their religious teachings. Besides, not all marriage practices in the traditional Lampung Saibatin community are poor because there are the values of local wisdom in their marriage customs.

Abstract

This research discusses the right to work for wives and its implementation of the formation of the sakinah family in the perspective of contemporary interpretation. With the development of the times, many women work in the public sector to help the family economy. However, this phenomenon has various impacts, both positive and negative, on household life. This study uses a qualitative approach with a literature study method, referring to contemporary interpretations such as Tafsir Al-Mishbah by M. Quraish Shihab. The results of the study show that Islam does not prohibit women from working, as long as they continue to fulfill their responsibilities in the family and maintain religious and moral values.

Abstract

In marriage, the presence of a child is one of the greatest blessings granted by Allah SWT to a husband and wife. The arrival of a child can be a source of joy and comfort for the parents, and the child can also be a adornment for both parents. However, it is important to recognize that a child can also become a fitnah for the parents, as mentioned in Q.S. at-Tagābun verse 15. When examining the verses concerning fitnah in the Qur'an, we find that there are many different meanings of fitnah, which may vary significantly when compared to its definition in the Indonesian Dictionary. This study aims to explore the understanding of the concept of "Children as Fitnah" from the perspective of Islamic Family Law. This research is based on the analysis of relevant Qur'anic verses and hadiths, as well as their application in Islamic family law. Furthermore, this article also examines the views of several Tafsir lecturers at UIN Raden Intan Lampung, who refer to various Tafsir interpretations. This study is qualitative in nature, utilizing a descriptive writing technique. The data sources include primary data from the thoughts of Tafsir lecturers referring to various Tafsir interpretations, and secondary data from journals and books related to this concept and its impact on parenting patterns and parental responsibilities in a modern context. The research findings highlight the importance of understanding the rights and responsibilities of each family member and instilling key values in the family, particularly to children from an early age. These include teaching faith and belief, encouraging kindness and affection, promoting regular worship, setting a good example, and providing halal and ṭoyyib sustenance to the family.
