Abstract

The goal of this research is twofold: to investigate and evaluate the existing model for the resolution of disputes concerning customary rights in Indonesia and to devise a model for the resolution of such conflicts that is founded on participatory justice and is appropriate for use in an era in which sustainable development is a priority. The Juridical Empirical approach is employed as the methodology for this investigation. According to the study’s findings, the lack of instruments or mechanisms for resolving ulayat land disputes will make it difficult for indigenous peoples to gain access to the magical religious values of indigenous peoples related to the spiritual, social, and cultural values of indigenous peoples. These magical religious values are tied to indigenous peoples’ traditional ways of life. Indigenous peoples’ rights can be protected through participatory justice by exerting influence over the processes and policies involved in the resolution of ulayat land disputes. This ensures that indigenous peoples will continue to have access to social rights and human rights about preserving their values, spiritual, social, and cultural qualities sustainably.

Abstract

The Toba Batak Community's customary law is one of the customary laws that is still alive with a kinship system that follows the father's lineage (patrilineal) which differentiates the position of sons and daughters. This research uses empirical methods. The results of the research explain that the position of widows and daughters in the Toba Batak tribe according to customary law is not as heirs, but based on the Supreme Court decision no. 179K/Sip/1961 Dated 23-10-1961 based on a sense of humanity and general justice, as well as on the nature of equal rights between women and men, the equal position between men and women can be seen in Presidential Instruction No. 9 of 2000 concerning Gender Mainstreaming in National Development. The Position of Divorced Widows in Batak Customary Inheritance Law. Gender Perspective. In the patrilineal kinship system adopted by Batak society, men are placed in a higher position. Societies that adhere to a partial kinship system of women have a very low position, so it is necessary to reformulate the position of women in the field of customary law, by establishing a national customary law of inheritance that is bilateral in nature

Abstract

Crime by corporations is increasingly diverse along with the Times. Corporate crime has a more massiveimpact than conventional crime. New provisions in the Criminal Code related to corporations, namelycorporations, have been made the subject of criminal law. It also regulates the main crime for corporations,namely fines, various types of additional crimes, one of which is the fulfillment of customary obligations.The problems in this study are related to the additional criminal formulation policy in the form of fulfillmentof local customs obligations for corporations in the Criminal Code and the ideal formulation policy relatedto the additional criminal form of fulfillment of local customs obligations for corporations in the CriminalCode. This study uses the method of normative analysis of research results to explain the policy formulationgiven in the draft law is part of the criminal law policy or criminal law politics. The additional criminalformulation policy in the form of fulfilling local customary obligations for corporations in the criminal codeis to realize legislation that can be used by law enforcement in handling cases involving corporations inaccordance with the provisions of Article 45 paragraph (1) of the Criminal Code and in imposing additionalcrimes judges can see the provisions of Article 120 of the Criminal Code. The ideal formulation policyrelating to additional crimes in the form of fulfilling customary obligations for corporations must formulatethe criminal fulfillment of customary obligations that apply to subjects of corporate law as well as theprovisions of Article 120 Paragraph (1) of the Criminal Code. In-depth research on Indigenous peoplesmust be carried out and must respect the decisions of the indigenous judiciary.

Abstract

Customary law in Indonesia, Vietnam, and Thailand plays a crucial role in preserving social harmony and local cultural values, despite facing challenges from modernization, differences in formal recognition, and pressures from national laws and government policies. This study aims to analyze the philosophy, essence, as well as the similarities and differences in the implementation of customary law in Indonesia, Vietnam, and Thailand, reflecting the cultural, social, and spiritual values of each society. The research employs a normative legal method with legislative, historical, comparative, and philosophical approaches to examine the philosophy, essence, and implementation of customary law in Indonesia, Vietnam, and Thailand through the study of legal documents, local traditions, as well as primary, secondary, and tertiary legal materials analyzed descriptively and qualitatively. The findings reveal that customary law in Indonesia, Vietnam, and Thailand reflects the cultural, social, and spiritual values of their communities through approaches of collectivity, harmony, and sustainability, particularly in resource management and local conflict resolution. In Indonesia, customary law formally recognized in the constitution emphasizes mutual cooperation and a harmonious relationship with nature, though it often clashes with formal law. Vietnam integrates Confucian values into customary law informally recognized at the community level, but it is frequently overshadowed by centralized state policies. Meanwhile, in Thailand, despite lacking official recognition, customary law rooted in Buddhist values remains respected as a social mechanism, especially among indigenous communities. All three countries face the challenges of modernization and globalization, which threaten the sustainability of customary law as a cultural identity and a means of maintaining social and environmental balance

Abstract

Introduction: This article to examine and analyze aspects of integration between national law and customary law in the context of the prismatic Pancasila state law, especially after the enactment of the draft criminal code (RKUHP) as a law.                                                                                             Purpose of The Research: This research seeks to answer two problem formulations, namely: integration of customary law and national law in the Pancasila law state and how are efforts to organize harmonious relations between customary law and national law in the perspective of the prismatic Pancasila state law, especially after the ratification of the RKUHP.Methods of Research: This study uses normative legal research methods based on authoritative legal products in the form of laws and regulations. The analysis was carried out by prioritizing the concept approach, historical approach, and statutory approach.                                                               Result of The Research: Even though customary law and national law are different in substance and character, but customary law and national law must be integrated because have important relations in relation to practice in society. Efforts to organize a harmonious relationship between customary law and national law in the perspective of the Pancasila prismatic state law, especially after the ratification of the RKUHP by optimizing the three year transitional provisions in the RKUHP to socialize as well as determining steps and efforts that can guarantee harmonious relations between customary law and national law.

Abstract

Marriage is a marriage ceremony binding ceremony that is celebrated or carried out by two people to formalize the marriage bond in religious law, state law, and customary law. Early marriage is a great institution to tie two teenage opposite sex people into one family bond. Several factors cause first marriage, namely personal factors and family factors. So far, there are still many communities, including students who do not know the impact of early marriage. Therefore it is necessary to do Community Service in the form of students' understanding of Semarang Regency Miftahul Ulum Vocational School about Prevention of Early Marriage to Realize Superior Generation. This service is doing by lecturing, and direct question and answer and evaluation after the activity carried out. This service carried out in a team. The implementation was carried out by the University of Semarang Faculty of Law Lecturer, who was competent in mastering the material regarding the prevention of early marriage to realize superior generations. Community service was held with a concentration on the prevention of first marriage for the sake of the realization of excellent productions.

Abstract

Komposisi penduduk Indonesia diwarnai oleh porsi penduduk muda yang besar. Pemuda pada rentang usia 16-30 tahun, mengikuti batasan Undang-Undang 40/2009, meliputi kira-kira seperempat dari total penduduk Indonesia. Jumlah penduduk pemuda yang berjumlah sekitar 60 juta jiwa ini merupakan jumlah yang terbesar dalam sejarah demografi Indonesia. Peran pemuda selalu sentral dalam perubahan, mengingat dalam jiwa pemuda selalu ada hasrat yang dinamis. Proses pemberdayaan dalam konteks aktualisasi diri berkaitan dengan upaya untuk meningkatkan kemampuan individu dengan menggali segala potensi yang dimiliki oleh individu tersebut baik menurut kemampuan keahlian (skill) ataupun pengetahuan (knowledge). Tujuan kegiatan pengabdian ini adalah memberikan informasi yang tepat dan benar kepada masyarakat, khususnya para santri Pondok Pesantren Monash Institute Kota Semarang, mengenai peran pemuda dalam pembangunan terhadap Undang-Undang Nomor 40 Tahun 2009 tentang Kepemudaan. Kegiatan ini dilakukan dengan metode ceramah (Penyuluhan) dan tanya jawab atau diskusi. Berdasarkan evaluasi yang dilakukan melalui penyuluhan sesudah dilakukan maka diperoleh hasil evaluasi mengenai peningkatan pemahaman para santri Pondok Pesantren Monash Institute Kota Semarang terhadap Undang-Undang Nomor 40 Tahun 2009 tentang Kepemudaan. Abstract

This study aims to analyze the legal reasoning of the judges and the legal consequences of the annulment of marriage on the grounds of coercion in Decision Number 1671/Pdt.G/2024/PA.Sr. The research focuses on the annulment of a marriage resulting from coercion that deprived the parties of their free and genuine consent to marry. Pursuant to Articles 27 and 28 of Law Number 1 of 1974 on Marriage, as amended by Law Number 16 of 2019, and Article 71(f) of the Compilation of Islamic Law, the annulment of a marriage may only be granted by a court decision where a defect in consent, including coercion, is established. This study employs a normative juridical method with a case approach and applies qualitative analysis to statutory regulations, legal literature, and the court decision. The findings reveal that the panel of judges granted the petition for annulment after determining that the marriage had been concluded under psychological and social pressure, thereby eliminating the parties' free will to consent to the marriage. Consequently, the subjective legal requirements for a valid marriage under Indonesian marriage law and the principles of Islamic law were not fulfilled. The legal consequences include the annulment of the marriage by court decision, the restoration of the parties to their previous legal status, the invalidation of the marriage registration, and the non-existence of marital joint property. Nevertheless, the law continues to protect parties acting in good faith and guarantees the legal status of children born from the marriage.   Abstrak Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dan akibat hukum pembatalan perkawinan karena paksaan dalam Putusan Nomor 1671/Pdt.G/2024/PA.Sr. Permasalahan penelitian berfokus pada pembatalan perkawinan yang didasarkan pada adanya paksaan sehingga menghilangkan persetujuan bebas para pihak dalam melangsungkan perkawinan. Berdasarkan Pasal 27 dan Pasal 28 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan sebagaimana telah diubah dengan Undang-Undang Nomor 16 Tahun 2019 serta Pasal 71 huruf (f) Kompilasi Hukum Islam, pembatalan perkawinan hanya dapat ditetapkan melalui putusan pengadilan apabila terbukti terdapat cacat kehendak berupa paksaan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kasus (case approach) serta dianalisis secara kualitatif berdasarkan peraturan perundang-undangan, literatur hukum, dan salinan putusan pengadilan. Hasil penelitian menunjukkan bahwa majelis hakim mengabulkan permohonan pembatalan karena terbukti adanya tekanan psikis dan sosial yang menghilangkan kehendak bebas para pihak dalam memberikan persetujuan perkawinan. Keadaan tersebut menyebabkan tidak terpenuhinya syarat subjektif perkawinan menurut hukum perkawinan nasional dan prinsip hukum Islam. Akibat hukumnya, perkawinan dinyatakan batal berdasarkan putusan pengadilan, para pihak dikembalikan pada status hukum semula, pencatatan perkawinan tidak mempunyai kekuatan hukum, serta harta bersama tidak terbentuk. Namun demikian, hukum tetap memberikan perlindungan kepada pihak yang beritikad baik serta menjamin status hukum anak yang lahir dari perkawinan tersebut.

Abstract

A reform intended to ensure legal certainty and improve the quality of evidence is the sale and purchase of land, which was previously sufficient to be completed in the presence of the village head but now needs to be completed in the presence of the PPAT per land regulations. The issue at hand pertains to the proper methods for purchasing and disposing of customary land within Kalisalak village, as well as the challenges that may arise. This study employed an empirical juridical research design with analytical descriptive research criteria. The study's findings indicate that, despite certain barriers to customary land purchasing and selling, the community's continued practice of land transactions based on custom is still permitted as long as the "cash" and "clear" requirements are satisfied. To avoid disputes in the sale and purchase of land, the government must provide clearer regulations for oversight and implementation. Additionally, legal knowledge about these restrictions must be widely distributed. In order to acquire legal clarity regarding land rights, the PTSL program significantly benefits the community and makes obtaining property certificates simple. This research suggests that in order for current legislation to be relevant to current trends, the government should evaluate its customary land regulations

Abstract

This study examines the urgency of establishing and implementing regulations for carbon taxation in Indonesia and formulates an ideal regulatory model to support the achievement of Indonesia’s Nationally Determined Contribution (NDC) targets. Although carbon taxation has been legally recognized under the Harmonization of Tax Regulations Law and Presidential Regulation on Carbon Economic Value, its implementation remains ineffective due to the absence of comprehensive implementing regulations governing emission measurement and verification, tariff calculation, tax collection, supervision, and incentive mechanisms. This research employs a normative juridical method using statutory, conceptual, and comparative approaches by analyzing carbon tax regulations in Indonesia, Singapore, Finland, and India. The findings demonstrate that the lack of operational legal instruments has created legal uncertainty and hindered the effectiveness of carbon taxation as an environmental fiscal policy instrument. This study further argues that a Government Regulation is required to operationalize Article 13 of the Harmonization of Tax Regulations Law and provide legal certainty for stakeholders. The novelty of this research lies in its integrative analysis linking the absence of implementing regulations with the obstacles to achieving Indonesia’s NDC targets, while proposing a comparative and adaptive regulatory framework suited to Indonesia’s legal and economic conditions. The study contributes theoretically to the development of environmental tax law and practically to the formulation of a more effective, equitable, and sustainable carbon tax policy in Indonesia.   Penelitian ini menganalisis urgensi pembentukan regulasi pelaksana pajak karbon di Indonesia serta merumuskan model pengaturan yang ideal guna mendukung pencapaian target Nationally Determined Contribution (NDC) Indonesia. Meskipun pajak karbon telah memiliki dasar hukum melalui Undang-Undang Harmonisasi Peraturan Perpajakan dan Peraturan Presiden tentang Nilai Ekonomi Karbon, implementasinya belum berjalan optimal akibat belum adanya regulasi pelaksana yang mengatur secara komprehensif mekanisme pengukuran dan verifikasi emisi, penetapan tarif, pemungutan, pengawasan, dan pemberian insentif. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan melalui analisis pengaturan pajak karbon di Indonesia, Singapura, Finlandia, dan India. Hasil penelitian menunjukkan bahwa kekosongan instrumen hukum operasional telah menimbulkan ketidakpastian hukum dan menghambat efektivitas pajak karbon sebagai instrumen kebijakan fiskal lingkungan. Penelitian ini berpendapat bahwa peraturan pemerintah diperlukan untuk mengoperasionalkan Pasal 13 Undang-Undang Harmonisasi Peraturan Perpajakan dan memberikan kepastian hukum bagi para pihak. Kebaruan penelitian ini terletak pada analisis integratif mengenai hubungan antara kekosongan regulasi pelaksana dan hambatan pencapaian target NDC Indonesia, sekaligus menawarkan model regulasi komparatif dan adaptif yang sesuai dengan sistem hukum serta kondisi ekonomi nasional. Kontribusi penelitian ini memberikan penguatan teoretis dalam pengembangan hukum pajak lingkungan dan kontribusi praktis bagi pembentukan kebijakan pajak karbon yang lebih efektif, berkeadilan, dan berkelanjutan di Indonesia.
