Abstract

Dugong merupakan hewan dilindungi yang tercantum dalam Peraturan Pemerintah Nomor 7 Tahun 1999 tentang Pengawetan Jenis Tumbuhan dan Satwa. Jika terjadi penangkapan dan pembunuhan dugong dengan sengaja maka akan mengacu pada sanksi pidana pada Undang- Undang Nomor 5 Tahun 1990 tentang Sumberdaya Alam Hayati dan Ekosistemnya Pasal 21 ayat (2). Penelitian ini menggunakan metode penelitian yuridis empiris. Mengkaji bahan hukum primer dan sekunder dan melakukan wawancara. Dengan pendekatan masalah peraturan Hukum dan Sosial Masyarakat. Kampung Kelam Pagi bukan merupakan habitat dari dugong sehingga tidak dijadikan daerah konservasi dugong. Dengan rumusan masalah Penegakan hukum Terhadap Masyarakat Kampung Kelam Pagi sudah tepat, karena mereka tidak memiliki pengetahuan yang banyak terhadap dugong dan sanksi apa yang akan mereka terima jika melakukan tindakan penjualan dugong. Balai Pengelolaan Sumberdaya Pesisir dan Laut (BPSPL) dan Balai Konservasi Sumberdaya Alam (BKSDA) sudah melakukan langkah tepat dengan melaporkan tindakan penjualan dugong yang dilakukan kepada polisi sehingga memberikan efek jera bagi masyarakat. Penanggulangan terjadinya pembunuhan satwa yang dilindungi di masa yang akan datang perlu dilakukan sosialisasi dan penyuluhan hukum dan pembuatan peraturan daerah tentang satwa yang dilindungi tentang jenis hewan yang dilindungi kepada masyarakat pesisir Kepulaun Riau sehingga tidak terjadi lagi tindak pidana penjualan hewan yang dilindungi.

Abstract

Virtual account is an electronic application that is created to connect to a large computer network when using the internet. This is very vulnerable to the threat of online crime, virtual accounts must provide security for customers. The aim of the research is to find out what electronic system crimes are, analyze the application of data protection laws, and legal sanctions for perpetrators of account burglary crimes. The research method is normative juridical. The research results show that the electronic systems currently in force in Indonesia are Mobile Banking, SMS Banking and Internet Banking. Regarding data protection in banking, it is regulated in article 40 (1) of Law no. 10 of 1998 concerning banking, namely that banks are obliged to keep confidential information regarding depositors and their deposits. Even though the Laws and Regulations have strictly regulated the protection of customer data, the fact is that in the field there is still a lot of misuse of customer personal data by irresponsible parties. Prohibitions for perpetrators of virtual account burglary crimes are regulated in Law Number 19 of 2016 concerning Information and Electronic Transactions Article 31 Paragraphs 1, 2, 3 and 4. The conclusion is that the application of the law regarding data protection in banking is regulated in Article 40 (1) of the Law No. 10 of 1998 concerning banking, namely that "banks are obliged to keep confidential information regarding depositors and their deposits.

Abstract

Corruption is a crime that harms state finances and the people's economy. On KPK website, cases of budget misuse data based on region, from 2004 to 2021 there are as many as 402 cases. So, extraordinary enforcement and extraordinary measures are needed. The research purpose is to analyze the regulation of corruption crimes committed during natural disasters, analyze the weaknesses of regulation corruption in social assistance funds, and analyze the prevention of corruption during natural disasters. This study uses statute approach with secondary legal literature research techniques and uses prescriptive analysis. The result of this journal is regulation of Corruption Crimes during natural disasters is regulated in Law Number 24 of 2007 about Disaster Control, Law Number 31 of 1999 about Eradication of Corruption Crimes, and PERPU Number 24 of 1960 about Investigation, Prosecution and Examination of Corruption Crimes. Provisions for the death penalty are regulated in Article 2 paragraph 2 Law Number 31 of 1999, namely in event that criminal act of corruption as referred to in paragraph (1) is committed under certain circumstances, the death penalty can be imposed, and prevention of corruption during a natural disaster can be carried out by penal and non-penal.

Abstract

This study offers a sociological and normative analysis of the persistent stigmatisation of former drug offenders and its implications for the implementation of restorative justice and Islamic ethical values in the contemporary Indonesian context. Employing a qualitative approach through field research and literature review, the study investigates the socio-cultural dynamics, public perceptions, and institutional obstacles that hinder the effective reintegration of ex-offenders into society. The findings indicate that former drug offenders often face multilayered stigma—manifesting in social exclusion, limited employment opportunities, and distrust within their communities—which significantly undermines the objectives of restorative justice. These challenges prolong the cycle of marginalisation and contradict the restorative principles of reconciliation, rehabilitation, and social healing. Moreover, the study reveals a gap between legal-normative frameworks and community practices, where punitive attitudes prevail over rehabilitative intentions. From the perspective of Islamic ethics, values such as rahmah (compassion), tawbah (repentance), and islah (reconciliation) serve as essential moral foundations that advocate for the acceptance and reintegration of reformed individuals. These values emphasise the potential for personal transformation and the collective responsibility of society to facilitate restorative outcomes. This study recommends a holistic synergy between restorative justice mechanisms, Islamic ethical values, and public education initiatives to dismantle stigma, promote inclusivity, and foster a more humane justice system. The academic contribution of this research lies in its integrative framework that combines socio-legal theory with Islamic moral philosophy to critically assess the structural and cultural barriers to reintegration, offering a contextualised model for human-centred restorative justice in Muslim-majority societies.

Abstract

Salak Padang Sidempuan sudah terkenal menjadi ikon Kota Padang Sidempuan dan merupakan salah satu sumber penghasilan masyarakat setempat. Kandungan serat dan vitamin Salak bermanfaat bagi kebutuhan dari mulai anak-anak, remaja, dewasa hingga lanjut usia. Memiliki kandungan yang baik untuk Kesehatan mata, terhindar dari rabun, katarak dan kerusakan mata lainnya. Diusia lanjut (lansia) dapat memperkuat memori otak, demikian juga untuk anak-anak. Kandungan Kalium bermanfaat membuat jantung sehat, memberikan energi dan stamina tubuh untuk diet. Mitra pelaku usaha UMKM di desa Sidapdap memiliki permasalahan dalam memasarkan Produk sebab masih bersifat konvensional dan belum memahami Teknik pemasaran. Kurang pengetahuan dalam memasarkan produknya secara digitak, kurang inovasi dalam citarasa produk bolu salak. Diperlukan solusi untuk Peningkatan teknik pemasaran dengan teknologi Digital melalui Pelatihan kewirausahaan, Penyuluhan Pelatihan Packaging, design produk. Penyuluhan tata cara Perizinan usaha, SIUP dan TDP sehingga pelaku usaha UMKM, memiliki surat izin usaha dan mendapatkan Hak Merek. Pelaksanaan program tentunya akan memberikan pemahaman tentang perlindungan konsumen dan pengetahuan dibidang hukum bisnis. Memberikan pengetahuan pentingnya standar mutu dan keamanan pangan olahan khususnya Bolu Salak dan gizi yang sesuai dengan kebutuhan. Kegiatan pengabdian kepada Masyarakat ini merupakan implementasi dari Visi Misi UNPRI yaitu Sociotecnopreneurship. Luaran dalam kegiatan Pengabdian Kepada Masyarakat yaitu Publikasi di Jurnal Nasional, Video Kegiatan di Upload pada youtube dan berita di media cetak.

Abstract

The state has an obligation to protect, supervise every product that is circulated for consumption by the public. This study aims to identify and analyze the form of legal protection for consumers so that illegal drug and food circulation which is circulated through social media does not occur, analyze the criteria for drugs and food without a distribution permit, and forms of accountability for business actors who commit acts normative juridical research methodology using literature study. The data analysis of this research used a qualitative approach. Law Number 80 of 2017 concerning Drug and Food Control was established to protect the public against any drug product whose registration is not registered based on applicable regulations. Accountability for the distribution of illegal drugs can be subject to criminal sanctions based on Article 196 jo 197 of Law Number 30 of 2009 concerning health if it meets the elements of error and unlawful acts.

Abstract

Business activities to establish a café require permission from Medan City government agencies. Licensing is one of the government tools as a legal tool used to control the behavior of its citizens, the permit is the approval of the authorities based on government laws or regulations, so it does not deviate from the provisions that prohibit the law. However, there are still many café business actors in Medan City who do not have licenses to carry out business activities. The focus of this research is how is the implementation of the implementation of the café establishment business license in the city of Medan?, what are the obstacles arising from the implementation of the application of a café establishment business license in the city of Medan? and how are sanctions applied to Kafes that do not have a café establishment business license in the city of Medan? The objectives of this study are to determine the implementation of the implementation of the café establishment business license in Medan City, to find out the obstacles arising from the implementation of the application of a café establishment business license in Medan City and to find out the application of sanctions against Kafes that do not have a café establishment business license in Medan City. The type of research used in the preparation of this research is a type of empirical normative legal research. This study used a data collection method which is an interview and literature research that is analyzed descriptively. The conclusion of the results of this study is business actors apply for NIB related first, NIB applications can be made through the OSS or SiCantik pages. Business actors must register business activities in TDUP. Business actors in obtaining NIB are required to register TDUP through informatics techniques made by the government in the form of a website, namely SiCantik which is made from the OSS system, with the aim of easing the burden of OSS applications so as to speed up and maximize the business activity permit process. However, there is a lack of knowledge of business actors in using electronic applications that have an online base so that business actors have difficulty in operating SiCantik. Based on Article 456 of Government Regulation No. 5 of 2021, every Business Actor who, based on the results of supervision, is found to have committed nonconformities or violations of Business Licensing in the tourism sector is subject to administrative sanctions in the form of warnings, Temporary suspension of business activities, administrative fines, and revocation of business licenses.

Abstract

It is important to know the rights of the auction winner in every auction procedure. This includes legal protection for the winning bidder for assets confiscated through the State Wealth and Auction Service Office (KPKNL). This research will reveal the legal protection section of agrarian disputes over the auction of bppn confiscated assets through KPKNL in Medan City. Data collection used Normative Juridical review. Research informants only focus on employees and parties who have problems related to the agrarian suspicion of the auction of confiscated assets by the Indonesian Bank Restructuring Agency, confiscate through KPKNL in the Medan branch. The conclusion is that legally the auction, there are inappropriate regulations by the Central KPKNL and the Medan city area. There are also problems with policies made by agraria confiscate, where the regulations are not well integrated. KPKNL has conducted an auction, but has not provided certainty for the auction winner. In this case, the auction winner gets a loss because he has followed all procedures and did not receive what has been stipulated by KPKNL.

Abstract

This article aims to analyze efforts to prevent the crime of murder within the family environment from a criminological perspective and to examine criminal responsibility and punishment imposed on perpetrators. The problem is focused on the occurrence of murder cases within the family environment in North Sumatra Province and the factors contributing to these crimes, based on seven reported cases from online media news between 2021 and 2024. In order to approach this problem, criminological theory and criminal law theory are used as the theoretical references to understand the causes of crime and the application of criminal liability. The data is collected through a normative-empirical legal research method, including literature studies, analysis of statutory regulations such as the Criminal Code (KUHP), Law Number 23 of 2004 concerning the Elimination of Domestic Violence, Law Number 1 of 2023, and the examination of relevant online media reports, and analyzed qualitatively. This study concludes that efforts to prevent the crime of murder in the family can be carried out through penal and non-penal approaches. Penal efforts emphasize the enforcement of criminal sanctions, while non-penal efforts focus on preventive measures through education, strengthening family resilience, the role of religious institutions, police involvement, and psychological assistance. The causative factors include emotional instability, parenting patterns, economic pressure, social environment, and weak law enforcement. Effective prevention requires cross-sectoral collaboration to create a just, preventive, and sustainable crime prevention system, while punishment serves both retributive and rehabilitative purposes.

Abstract

The land issue is an issue that affects the most basic rights of the people. Because it has a social function other than economic value, so that individual interests on land are sacrificed for common purposes. The purpose of this study is to analyze the payment of compensation for land acquisition in cash and in kind, to identify and analyze the land acquisition process based on Law no. 2 of 2012, as well as explaining the concept and its provisions. To investigate and analyze. This is done by searching for relevant regulations and literature through the search for library materials as a starting material for investigation, using normative legal procedures for problem analysis. Depending on the issue being investigated, the matter will be carried out to analyze the legal regulations in the area of ​​implementing the release of property rights. The results of the examination show that the payment of compensation for the purchase of land can be in the form of cash or non-cash. Change of money, land, resettlement. The land acquisition process that is being developed based on Law no. 2 of 2012 through three stages: The process of planning, compiling and implementing remuneration, concepts and regulations in land acquisition must be carried out in accordance with laws and regulations so that it is fair and does not harm the government or land owners.
