Abstract

Fenomena penolakan Pekerja Migran Indonesia (PMI) untuk bekerja di Malaysia semakin mencuat, terutama akibat dari kontinuitas eksploitasi terhadap kesejahteraan pekerja yang senantiasa terjadi dalam beberapa tahun terakhir. Fenomena ini dipicu oleh perlakuan yang tidak manusiawi terhadap Pekerja Migran Indonesia, termasuk tindak kekerasan, hak-hak pekerja yang diabaikan, dan lingkungan kerja yang tidak aman. Studi ini bertujuan untuk mengidentifikasi bentuk-bentuk eksploitasi kesejahteraan yang dialami oleh PMI di Malaysia dan menjadi faktor utama penolakan PMI bekerja di negara Malaysia, serta untuk menganalisis negara alternatif yang lebih sering dipilih oleh PMI sebagai tujuan bekerja. Pendekatan yang digunakan dalam penelitian ialah kualitatif dengan menganalisis berbagai kasus dan data yang diperoleh dari sumber yang memiliki kredibilitas. Jenis penelitian ini adalah yuridis-empiris, yang diperoleh melalui wawancara dan mengacu pada studi kajian hukum. Hasil penelitian menunjukkan bahwa faktor utama penyebab penolakan PMI untuk bekerja di Malaysia ialah atas pengalaman buruk yang meliputi kekerasan fisik dan psikologis, ketidakpastian atas hak memperoleh gaji, serta perdagangan orang. Pekerja Migran Indonesia lebih memilih negara, seperti Hong Kong dan Taiwan yang menjadi alternatif pilihan dalam mencari kondisi kerja yang lebih manusiawi. Penelitian ini diharapkan dapat membantu dalam upaya mengatasi permasalahan eksploitasi terhadap kesejahteraan PMI secara sistematis, sehingga dapat meningkatkan kesejahteraan PMI di luar negeri.

Abstract

Based on the National Socioeconomic Survey conducted by the Central Statistics Agency in 2022, 8% of Indonesian women (equivalent to 71,000 people) aged 15-49 chose to be childfree. This phenomenon is considered deviant from norms, religion, and culture. In addition, it also has a negative impact on the population and the existence of the country. This study aims to identify and analyze the causes of childfree in Indonesia and the government's response to this phenomenon. The research method used is sociological-legal with a qualitative approach. The results of the study indicate that childfree in Indonesia is caused by internal and external cultural impacts, economic and psychological factors, environmental and demographic issues, technological development, and reproductive health. Government actions to anticipate the spread of the childfree movement include developing programs that enhance family resilience and well-being. This study employs Schutz's phenomenological theory, gender theory (nature, nurture, and equilibrium), and James E. Anderson's public policy theory. Schutz's phenomenological theory helps understand the meaning of childfree for its adherents as an expression of individual freedom perceived to bring happiness. Gender theory explains the relationship between patriarchy and childfree. Patriarchy emerges from the nature approach, while childfree from nurture. Gender equilibrium theory serves as a mediating solution by balancing individual rights and social interests. James E. Anderson's public policy theory is used to assess the urgency of the issue and formulate relevant policies.

Abstract

Patriarchal ideology on the impact of gender inequality occurs due to several factors, including: Customs, Lack of public understanding, high rates of early marriage in girls and economic limitations of the family. The purpose of this study is first to identify and analyze the causes of patriarchal ideology on the impact of gender inequality on mutual education in farming families. Second, to analyze the efforts that will be made to overcome patriarchal ideology on the impact of gender inequality on mutual education in farming families. The research method used in this study is a qualitative approach with a sociological juridical research type. The data sources used in this study are primary, secondary and tertiary data sources. The results of this study indicate that patriarchal ideology on the impact of gender inequality that occurs in society is still strong and has an impact on education, especially for girls. Therefore, efforts need to be made by the government and families to overcome gender discrimination in order to realize gender equality in women's education in society. The theory in this study is (1) The theory of liberal feminism according to Mary Wallstonecraft is used to analyze gender discrimination that affects education and women's rights. The reason for using this theory is because it focuses on women's empowerment and the barriers that prevent women from gaining equal access to education with men. (2) Feminist legal theory according to Catharine Mackinon is used to analyze how legal efforts and government policies address gender inequality in education. The reason for using this theory is because this theory seeks to empower women by providing space for them to participate in the formation, implementation, and interpretation of law.

Abstract

The culture of toxic masculinity is still a significant obstacle in handling rape cases against adult men. The view that men should always be strong and unlikely to be victims leads to low reporting and weak institutional attention. This study aims to analyze the factors of rape of adult men in the struggle of toxic masculinity culture and examine the responsiveness of law in its handling using Nonet and Selznick's responsive legal theory as an analytical framework. This research uses a qualitative approach with a socio-legal research type, which combines observation, interviews, questionnaires and literature studies. The results of the study show that toxic masculinity functions as a structural barrier that suppresses the victim's courage to report, triggers the bias of law enforcement officials, and increases the risk of secondary victimization. Although Indonesia's positive law has moved towards more inclusive victim recognition through the Indonesia Criminal Code Number 1 of 2023, legal implementation still faces challenges in terms of institutional sensitivity and substantive protection of victims. This study emphasizes the importance of strengthening gender-justice-oriented responsive laws in ensuring protection and recovery for adult male rape victims.

Abstract

Waqf land is a religious asset that has a key role function in supporting worship activities and social welfare. However, in practice, there is still a lot waqf land with no official land certificate. In this case, the government issued a policy to accelerate waqf land certification to ensure legal certainty. The government encourages the acceleration of waqf land certification through digital transformation in public services. This article aims to analyze determinants of cause the acceleration of waqf land certification in the digital era and its implementation in achieving legal certainty. This study employs an empirical legal research method with a qualitative approach, through the collection of primary data obtained from interviews and secondary data sourced from laws and regulations and literature studies. The results of the study indicate that in Kebumen Regency, there is still a lot of uncertified waqf land and its implementation is said to be still suboptimal. The factors causing the acceleration of waqf land certification are influenced by several factors, including government regulations and policies, synergy of cooperation between institutions, the active role of officials and assistance to nadzir, increased public legal awareness, and the digitalization of land services. While its implementation demonstrates that actions to accelerate waqf land certification are progressing, strengthening is still need to optimally achieve the set targets. Furthermore, the acceleration of waqf land certification is supported by inter-agency synergy and the use of digital-based information systems.

Abstract

The practice of flaunting a luxurious lifestyle among public officials through social media has drawn widespread attention, indicating a shift in political communication and self-representation patterns that have the potential to influence public trust and shape a consumerist culture in society. This phenomenon is problematic because it not only touches on social and ethical dimensions but can also lead to legal consequences related to the principles of propriety, integrity, and responsibility through the position obtained. This research has an urgency to legal studies that have not been optimally comprehensive and requires a special study regarding the relationship between officials' flexing with legal principles, government ethics, and social norms in the digital era. This study uses a qualitative method with a normative juridical approach and is supported by non-doctrinal studies through social concept analysis, with data collection techniques in the form of library studies of laws and regulations, legal doctrine, and relevant literature. The results of the study indicate that the flexing phenomenon is influenced by the theory of symbolic consumption and social dramaturgy in the form of the use of modern lifestyles as a means of image formation and status legitimacy. The originality of this research lies in the link between consumer flexing behavior and the legal ethics of public officials in the digital age. This study concludes that there is a need to strengthen ethical regulations and social media oversight mechanisms for legislators.

Abstract

The persistence of gender-based killings in Indonesia reflects structural challenges in legal recognition, data integration, and institutional coordination in addressing violence against women. Although various laws on the protection of women have been enacted, Indonesian positive law does not explicitly recognise femicide as a gender-based category of homicide, and national data systems do not consistently provide gender-disaggregated monitoring of such cases. This study aims to analyse the urgency of establishing a Femicide Watch mechanism in Indonesia as a strategic instrument to prevent femicide and to examine its relevance within the framework of Sustainable Development Goal (SDG) 5. This research employs a qualitative empirical approach using a socio-legal perspective. Data were collected through in-depth interviews with a legal practitioner and psychologist, as well as officials from a regional women and child protection unit, complemented by secondary data from legislation, judicial developments, institutional reports, and provincial statistics on violence against women. Comparative analysis of international practices was also conducted. The facts show that although a rapid response mechanism for protection services has been established at the national level, the judicial system remains reactive and lacks a comprehensive governance framework to address gender issues. The state's refusal to recognize femicide means that data is not classified, making it difficult to accurately monitor progress. The establishment of mechanisms to systematically monitor killings of women will strengthen legal protections and increase accountability, reaffirming Indonesia's commitment to gender equality and violence reduction in line with the Sustainable Development Goals (SDGs).
