Abstract

This article is intended to analyze the existence of local values that have become part of local wisdom prevailing in Bajo community. Type of research is legal anthropology, using interviews and focus group discussion. The results showed that the Bajo Gorontalo society, there are the local values associated with the management of fish resources in the sea. Local values mean that has been implemented since long time ago, and until this day the local values still remains valid. For the people of Bajo the values meant being a model society, thus forming a community adherence behavior in managing and treating fisheries resources in the sea, so that it becomes part of the public legal awareness. Therefore, it is important to identify the values that are still applicable and to make it as a basis for the development of laws related to fisheries, which is expected to be developed, as the expectations set forth in the legislation.

Abstract

Tulisan ini membahas tentang Apa saja dampak dari pencemaran lingkungan akibat sampah elektronik dalam prespektif hukum lingkungan dan membahas tentang pengaturan hukum pidana lingkungan terhadap pencemaran dan pengelolaan sampah elektronik (E-Waste) Di Indonesia. Dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup dan peraturan pemerintah nomor 101 tahun 2014 tentang pengelolaan limbah Bahan Berbaha Dan Beracun mengatur tentang bagaimana melakukan pengelolaan limbah elektronik. Namun sampai dengan saat ini setiap tahun Indonesia mengalami peningkatan terkait dengan sampah elektronik hal ini di sebabkan oleh perkembangan industri teknologi elektronik yang sangat cepat mengeluarkan dan menawarkan alat elektronik yang terbaru dan lebih canggih, hal tersebut menjadi salah satu pendorong meningkatnya jumlah sampah elektronik tiap tahunnya. Penelitian ini menggunakan penelitian Normatif yang menggunakan metode pengumupulan data dengan cara studi literatur mengenai judul penelitian tersebut. Hasil dari penelitian ini yaitu bahwa pengelolaan sampah elektronik Di Indonesia masih jauh dari kata sempurna selain itu juga untuk pengaturan sampah elelktronik sendiri belum diatur secara spesifik dalam satu peraturan

Abstract

Ihe housed crirne is one of the action against the Act No 39 year 1999 of Human Right, Act No 23 year 2004 of obliteration of housihold crime. As well, this hosedhold crimeis one of the offense toward the Internotional convention of Elimination of All forms of Discrimination Agains Woman (CEDAW). The emerging of the regulation of crime toward womem based on the throught that citizens hold the right to obtain the savety feeling end free from all crime beased on our basic constitution and the Purcasila Based on thoose thought, househotd crime and discrimination toward woman has to be elimination. therefore, the victim of the household crime, which mostly woman, have to obtain protectionfrim the government ang the communigt. this is in order to make them ovolded from crime or crime threats, torture, and anyother action which disgracing the human pride. Substantialy, Indonesian has many low tools to regulate this problem. Abstract

This research examines the Implementation of the Law of Evidence: Comparative of the State of Indonesia and the United States of America. This study aims to analyze the application of evidence in Indonesia and the United States. This study uses normative research methods. The results of this study explain that there is a comparison between the application of evidence before and during the process in trials between the two countries, but over time and Indonesian law has implemented several processes in evidence that were previously used by the United States. It is hoped that lawmakers in Indonesia will be able to quickly find a new law that will not hinder the process of proof, and will not complicate the judiciary.

Abstract

The rural population is the basic capital of national development, which belongs to the people and nation of Indonesia. Villages have developed in various forms as part of the government structure and must be empowered to be strong, advanced and democratic so that they are able to carry out governance. In accordance with the mandate of the Law on Villages, the Village Head has the obligation to resolve disputes within the Village community. So far, the position of the village head in resolving conflicts is not clear, especially when minor crimes occur within the village community. This writing aims to examine how the urgency of the reconstruction of the Law on Villages in the obligation of the Village Head to Resolve Disputes and Misdemeanors. The research method used in the framework of this research is normative legal research method. The results of the study show that solving a problem that occurs in the village by placing the Village Head as a peace judge is a form of discretion/executive policy in order to realize public services for the community so that it is better to carry out a reconstruction of 26 paragraph (4) of Law No. 6 of 2014 concerning Villages.%MCEPASTEBIN%

Abstract

Research findings show that the proportion of drug users who suffer from mental disorders is still very high compared to that of drug users who do not suffer from mental disorders. The reason is that the use of drugs can cause addiction, which means that users will continue to do so that which affects the central nervous system and results in mental disorders in drug users, for example in two cases in the Denpasar District Court with cases of narcotics abuse where the defendant had bipolar disorder. This study concludes that the judge's consideration includes the reasons for bipolar mental disorder as mitigating factors. In the case of abuse of narcotics, the Defendants BJJ and YAR, even though they were bipolar, still did not abolish the sentence against the two Defendants in these two different cases..

Abstract

This study aims to determinea form of tackling the crime of cockfighting gambling.The method used in this research is empirical or sociological research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive analysis techniques. The results of this study indicate thata form of countermeasure carried out to tackle the crime of cockfighting gambling by means of preventive and repressive measures. In the preventive action stage, basically, stakeholders try to take precautions before the crime occurs. However, the most important role in preventing the occurrence of a crime is the supervision of the local community who then cooperates with law enforcement so that the crime of cockfighting gambling is easily detected.The countermeasures carried out by the authorities should be carried out with good coordination and cooperation, so as to make countermeasures that are right on target.

Abstract

Now, the duties and authorities of PPTK who are responsible as financial managers by carrying out the duties of Commitment Making Officers are hereinafter abbreviated as PPK as procurement actors. This collaboration of authority between regional financial management and procurement actors will only have a negative impact on bureaucratic structuring to potentially open opportunities for fraud that leads to corruption in the procurement of local government goods/services.  The purpose of this study was to answer how the regulatory model for the duties and authorities of Technical Implementation Officers Activities in the implementation of procurement of goods and services. This type of research is a normative juridical with a statutory approach. The results showed that the ideal regulatory model is to maintain each task in the scope of PPTK as an administration of activity management and PPK as a work manager

Abstract

The purpose of this study is to analyze and construct a model of legal protection for victims of illegal investment crimes.  This research is a type of normative research using several approaches, namely the statute approach,  case approach, and conceptual approach.  The analytical technique used in this study is using analytical descriptive techniques. The results showed that the legal protection model for victims of illegal investment is to reform the Money Laundering Law with an asset recovery approach to the Corruption Eradication Law. The concept contained in Article 18 of the Corruption Eradication Law is an additional crime that can be conceptualized in the provisions of the Money Laundering Law.
