Abstract

Gorontalo Province is an area rich in traditional culture. Protection of Traditional Cultural Expressions in Gorontalo has been regulated in Regional Regulation (Perda) Number 7 of 2017. This regulation also regulates protection of Traditional Cultural Expressions of Gorontalo Province. This study aims to find out how the Traditional Cultural Expressions of the people of Gorontalo Province are Protected and to find out the roles and responsibilities of the local government for the Protection of the Traditional Cultural Expressions of the people of Gorontalo Province. Researchers use this type of normative research. Namely the type of legal research that places law as a building system of norms. The process of collecting data from research objects is using primary, secondary and tertiary data. The data obtained was then processed using qualitative analysis by describing analytically and prescriptively descriptively. The results of the research found: (1) The protection of traditional cultural expressions in Gorontalo has been regulated in Regional Regulation Number 7 of 2017. This regional regulation has not been fully effective in providing protection for traditional cultural expressions. It can be seen from the data obtained that there are still 20 Gorontalo cultures that have been included in the preparation of recording and documentation but are not attached to the regional regulation. (2) The Provincial Government of Gorontalo has carried out its roles and responsibilities in efforts to protect cultural expressions by recording and documenting as well as outreach. However, in reality this is not enough to maintain Gorontalo's cultural wealth. One example is the absence of an art building that the government should pay attention to to build so that cultural heritage and its protection can be maintained.

Abstract

This research aims to determine the effectiveness of ownership of operational permits for wastewater disposal installations as factors inhibiting this effectiveness in the Randangan District Health Center. This research is a sociological or empirical study, with the aim of presenting as complete data as possible regarding the effectiveness of permit ownership for Community Health Centers in Randangan District, as stated in Law Number 32 of 2009. The types of data used include primary data and secondary data, and the data collection techniques used are field research and literature study. Based on the research in the results of the discussion, conclusions are drawn; Firstly, the Motolohu Community Health Center in Randangan District has been operating an IPAL since 2017 but until 2023 it has not received a permit from the Pohuwato Regency Environmental Service, even though according to the regulations, IPALs that have been operated must have a permit. Second, factors that hinder effectiveness include legal factors, law enforcement factors, legal advice and facilities, and community factors.

Abstract

This research aims to analyze and examine the existence of the application of diversion in providing protection for children's rights. This research is normative juridical research, normative juridical is a statutory approach, because what will be studied are various rules of law that become the focus and central theme of a study. Legal analysis produced by a normative research using a statutory approach will produce more accurate research. Based on the results of the research obtained, the answer to the existing problem is that the application of diversion as a settlement of juvenile crimes is very important to protect children's rights and encourage restorative justice. Diversion not only avoids children from matters related to the formal legal process, but also provides an opportunity to improve social relations and restore the situation after a criminal offense. Despite challenges in its implementation, such as a lack of understanding among law enforcement and the community, successful diversion can improve children's welfare and achieve better justice goals. Therefore, further efforts are needed in socialization and education regarding diversion to ensure its effective implementation in the criminal justice system.

Abstract

This study aims to find out what are the factors that cause children to become victims of same-sex abuse in Bone Bolango and how the law protects victims of same-sex abuse by the PPA unit of the Bone Bolango Police. This study uses empirical legal research methods which are conducted by collecting data through observation and interviews. The results of the study show that children are vulnerable to becoming victims of crime. Children are often considered to be sexual objects by adults in society, so children are seen as victims who are weak and easy to be controlled by adults, especially in committing crimes. Factors that cause children to become victims of sexual abuse are due to internal factors: personality, faith; and external factors: family supervision, community environment, technology and mass media. The legal protection provided by the PPA Unit of the Bone Bolango Police to children as victims of same-sex abuse is in the form of protection for the victim's safety, providing psychosocial rehabilitation medical assistance and counseling services, providing legal assistance, providing information in terms of the convict being released, and outreach. However, the provision of legal protection is still not optimal for victims so that victims do not feel safe and recover from their trauma. Counseling and outreach provided by the police and P2TP2A should be carried out in a comprehensive manner, on target and able to utilize existing technology, this is to prevent victims of criminal acts of same-sex obscenity underage, and can increase the understanding and legal awareness of the community towards human rights. -the rights of victims and guarantees of legal protection for victims of criminal acts of same-sex obscenity to minors. Every member of society, especially parents and adolescents, needs to be given adequate understanding of the risks and consequences of crimes of sexual abuse against children. In addition, parents/families are expected to be able to be actively involved in supervising the activities of their children when they are outside the home, and to provide extra supervision to family members wisely so that they do not become perpetrators or victims of same-sex obscenity crimes.

Abstract

In the process of investigating a crime of ordinary or premeditated murder, it is necessary to have evidence to prove that the crime has been committed. One of the means of evidence referred to is regulated in Law no. 8/1981 is Expert Statement in written form, in this case it is Visum et Repertum. Visum et Repertum is a written report made by a doctor or other forensic expert that contains what they found on the victim's body. However, Visum et Repertum usually differs from what actually happened and also from the testimony of the accused that was previously made. This research was conducted using a descriptive research type with normative-empirical legal research. The role of Visum et Repertum is to explain to Judges and Investigators regarding the preparation and planning of crimes committed by the suspect beforehand by looking at the instructions written in the Visum et Repertum; for example time of death, cause of death, type of injury to the victim, and so on. Visum et Repertum can be replaced or re-examined if the results received do not provide sufficient information to the Judge. Meanwhile, the testimony of the defendant can be rejected if the Judge knows that it is a false statement or does not match other evidence.

The results of the research on the Application of Sanctions Against Recidivist Perpetrators of Narcotics Crime Seen from a Penitensier Legal Perspective are not optimal. The application of sanctions against recidivists of narcotics crimes in the perspective of penitential law must include aspects of prevention, rehabilitation, fair treatment and strict supervision. This aims to reduce the level of recidivism, improve the behavior of perpetrators, and prepare for reintegration into society. law enforcement and government. Abstract

Penelitian ini bertujuan untuk menganalisis upaya penyidik dalam menangani tindak pidana penganiayaan yang dilakukan oleh anak di wilayah hukum Polres Gorontalo, dengan mengacu pada Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA). Fokus penelitian mencakup implementasi prinsip keadilan restoratif, pendekatan humanis, serta kendala yang dihadapi penyidik selama proses penyelidikan. Penelitian ini menggunakan metode hukum empiris dengan pendekatan deskriptif-kualitatif, di mana data primer diperoleh melalui wawancara dengan penyidik Unit Perlindungan Perempuan dan Anak (PPA) Polres Gorontalo, sementara data sekunder diperoleh dari dokumen resmi, literatur, dan peraturan perundang-undangan yang relevan. Hasil penelitian menunjukkan bahwa penyidik mengedepankan pendekatan keadilan restoratif dan ramah anak melalui mediasi, rehabilitasi, serta edukasi kepada masyarakat. Kendala yang dihadapi meliputi keterbatasan sarana dan prasarana, tekanan sosial, kurangnya pemahaman masyarakat tentang pentingnya perlindungan anak, serta tantangan dalam pelaksanaan diversi. Penyidik juga menghadapi hambatan dalam memastikan kepatuhan pihak-pihak yang terlibat, seperti anak pelaku, korban, dan saksi, selama proses penyelidikan. Meskipun demikian, langkah-langkah seperti koordinasi lintas sektoral, penggunaan metode wawancara ramah anak, dan percepatan proses penyelidikan telah dilakukan untuk mengatasi hambatan tersebut. Penelitian ini menyimpulkan bahwa upaya penyidik yang berorientasi pada rehabilitasi anak harus terus didukung melalui peningkatan kapasitas penyidik, sosialisasi hukum kepada masyarakat, dan kolaborasi dengan lembaga terkait untuk menciptakan sistem peradilan pidana anak yang lebih efektif dan manusiawi.

Abstract

This research aims to determine legal protection for agricultural land conservation in Bolaang Mongondow Regency based on social justice and to determine the implementation of Law Number 41 of 2009 concerning Sustainable Food Agricultural Land Protection regarding Agricultural Land Conservation in Bolaang Mongondow Regency. This research method uses empirical legal research methods.The results of the research that legal protection for agricultural land conservation in Bolaang Mongondow Regency based on social justice requires special attention. That farmers in the area have limited knowledge about agricultural land protection laws, which creates uncertainty in dealing with changes in land use and threats to the sustainability of agricultural land. Farmers' concerns about changes in land use illustrate the need to increase legal awareness and education among them. This increase in knowledge not only involves rights and obligations related to agricultural land, but also understanding the importance of active participation in decision making regarding agricultural land. Implementation of Law Number 41 of 2009 concerning Protection of Sustainable Food Agricultural Land, there are findings that although this law sets clear requirements for the transfer of agricultural land, practices in the field still indicate a threat to the sustainability of agricultural land. The need for active involvement of local governments in preventing practices that are detrimental to farmers and threaten the sustainability of agricultural land needs to be increased. Protection of farmers' rights, agricultural sustainability and social justice must be the main focus in ensuring that the implementation of the law achieves the desired objectives. Evaluation of cooperation between factories, local governments and farmers is also important to ensure balance and fairness in the distribution of economic benefits and legal protection.

Abstract

The implementation of fines as a legal instrument plays a crucial role in shaping public behavior concerning waste management. Despite the existence of numerous regulations governing waste management, the effectiveness of imposing fines remains limited in raising legal awareness and reducing waste volume in society. This study aims to explore the ideal framework for implementing fines to enhance legal awareness and minimize waste, emphasizing more effective and systematic law enforcement. Utilizing a normative juridical and sociological approach, the study analyzes existing regulations and identifies obstacles in the application of fines in Indonesia. The findings reveal that while fines have the potential to reduce waste, the main challenges include insufficient public education, weak law enforcement, and inconsistencies between the amount of fines imposed and their intended deterrent effects. The study recommends strengthening waste management regulations, increasing community participation, and implementing proportional fines coupled with stringent monitoring systems to achieve significant waste reduction. With a more ideal regulatory framework, it is hoped that public legal awareness will improve, paving the way for sustainable waste management practices.

Abstract

This research aims For discussing the application of diversion for children who are perpetrators of the crime of distributing pornographic videos from the perspective of legal protection against children's rights as victims and causal factors . The method used in the research is legal empirical with qualitative descriptive data analysis that describes and explains data and field facts. The results of the study show that the application of diversion to children who are perpetrators of the crime of distributing pornographic videos, viewed from the legal protection of children as victims in Gorontalo, is basically to protect children as perpetrators of crimes and provide them with the opportunity to improve themselves and not affect their future. This is also one of the legal policies in the context of protecting children as perpetrators of pornography crimes. However, the implementation of diversion still has an impact on the existence of mental/psychological and physical pressure on children as victims. Therefore, from the aspect of protection for victims, the implementation of diversion in cases of the distribution of pornographic videos does not pay enough attention to the rights and mentality of the victim, because the perpetrator continues to distribute the video to his friends during the mediation process. However, the PPA unit of the Gorontalo Regional Police prioritizes the resolution of children's cases outside the court through this diversion and is the main choice in its resolution, on the grounds that there is no deviation from the requirements of diversion, namely criminal acts with a threat of less than 7 years and not a repetition of the crime. The factors that influence the implementation of diversion against children who are perpetrators of the crime of distributing pornographic videos at the Gorontalo Regional Police are the Intention of the Perpetrator and Family and economic capacity limitations; Lack of public understanding; and The absence of LPSK in Gorontalo thus hindering and influencing the provision of decisions on compensation that must be received by families and victims of the distribution of pornographic content in Gorontalo.
