Abstract

Law/regulation on mining play a significant role, because mining sector is a potential sector for developing the economy of Indonesian. Law on Mining underwent several amendments, namely the era of Law Number 11 of 1967, Law Number 4 of 2009 and Law Number 3 of 2020. This article will analyze shiftss in mining sector regulations from each of these eras. This article uses normative juridical methods, with statutory, contextual, historical, and comparative approaches, and is analyzed qualitatively. The results of the study show that between Law No. 11 of 1967 to Law No. 4 of 2009 and Law no. 3 of 2020 underwent a change, namely from a centralized arrangement, where the mining sector holding power became a matter for the central government to decentralization, handed over to local governments. Another change is in the field of relations between the government and capital or investors, the contract of work model becomes licensing. The impact on the contract of work model is that the state is positioned as a 'party' to the contract, while in terms of licensing the government has a position that tends to be stronger. This Amendment Contract is adapted to Indonesian conditions and the protection of Article 33 of the Indonesian constitution.

Abstract

The purpose of this study was to identify and analyze criminal liability for users of online prostitution services from the aspects of Indonesian criminal policy and the ius constituendum for criminal liability for users of online prostitution services in Indonesia. The type of research used is Normative Law research, using a statute approach and a conceptual approach. Furthermore, it is arranged systematically to obtain a complete picture, and the researcher processes it using analytical descriptive techniques. The results of this study indicate that the criminal responsibility of users of online prostitution services in Indonesia can be seen in the regulations contained in the scale of laws and regional regulations. Meanwhile, in several of these laws there is still a legal void for users of prostitution services to be subject to criminal liability. Furthermore, the criminal responsibility of users of online prostitution services in the upcoming criminal policy (ius constituendum) is expected to be able to answer the problem of online prostitution crimes. As far as its development goes, the regulations that apply are no longer in accordance with the needs of the community or what the community aspires to have a deterrent effect on users of prostitution services. Thus, there is no longer any form of legalized sexual intercourse that can harm society in material and moral forms.

Abstract

AbstrakArtikel ini bertujuan untuk menganalisis implikasi yuridis tentang pengaturan penghentian penyidikan atas dasar pembelaan terpaksa (noodweer) ditinjau dari kepentingan tersangka. Penelitian ini bersifat normative dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan kasus serta pendekatan deskriptif kualitatif. Data yang dikumpulkan dikelompokkan dan diseleksi menurut kualitas dan kebenarannya, kemudian dihubungkan dengan teori-teori, asas-asas dan kaidah-kaidah hukum yang diperoleh dari studi kepustakaan sehingga diperoleh jawaban atas permasalahan yang dirumuskan. Subyek penelitian ini adalah para informan yang berasal dari Kepolisian dan Kejaksaan yang berupa data yang dibutuhkan peneliti. Hasil penelitian menunjukkan bahwa Implikasi yuridis dari pengaturan penghentian penyidikan berdasarkan pembelaan terpaksa (noodweer) harus mempertimbangkan kepentingan tersangka, di mana penghentian penyidikan harus dapat dipertanggungjawabkan secara hukum. Penghentian penyidikan harus didasarkan pada fakta-fakta yang ada yang secara hukum membenarkan penghentian tersebut. Jika penghentian dilakukan tanpa alasan yang cukup, hal ini dapat merusak citra kepolisian sebagai penyidik di mata masyarakat.AbstractThis article aims to analyze the juridical implications of the regulation of termination of investigation on the basis of forced defense (noodweer) in terms of the interests of the suspect. This research is normative in nature using a statutory approach and a case approach as well as a qualitative descriptive approach. The data collected is grouped and selected according to its quality and truth, then connected with theories, principles and legal rules obtained from literature studies so as to obtain answers to the problems formulated. The subjects of this research are informants from the Police and the Prosecutor's Office in the form of data needed by researchers. The results showed that the juridical implications of the regulation of termination of investigation based on forced defense (noodweer) must consider the interests of the suspect, where the termination of the investigation must be legally accountable. The termination of the investigation must be based on existing facts that legally justify the termination. If the termination is done without sufficient reason, it can damage the image of the police as investigators in the eyes of the public. Keyword : Juridical Implications; Noodwer Investigation; Suspected Interest.

Abstract

AbstrakPrinsip Akuntabilitas menjadi hal yang sangat penting bagi sebuah organisasi dan tak terkecuali untuk organisasi perangkat daerah. Penelitian ini  bertujuan untuk menganalisis dan mengetahui mengenai peran Aparat Pengawas Intern Pemerintah dalam mewujudkan prinsip akuntabilitas pada pemerintahan daerah. Metode yang digunakan dalam penelitian ini ialah Normatif Empiris dengan menggunakan pendekatan studi kasus. Hasil dari penelitian  menunjukan bahwa prinsip akuntabilitas yang dinilai oleh pemerintah pusat melalui Sistem Akuntabilitas Kinerja Instansi Pemerintah (SAKIP) diwilayah Kota Gorontalo masih mengalami kesulitan utnuk mencapai titik terbaik dalam penilaian meskipun dalam beberapa tahun terakhir ini mengalami trend peningkatan pada sub-komponennya. Hasil penelitian ini juga memberikan gambaran tentang bagaimana wujud akuntabilitas yang ada di pemerintah kota gorontalo dalam hal penilaian kinerja individu dan organisasi. Penelitian ini dapat membantu dalam pengembangan akuntabilitas organisasi yang ada di pemerintah kota gorontalo kedepannya serta memberikan informasi yang mendalam untuk kepentingan penelitian berikutnya Kata Kunci : Akuntabilitas; Organisasi Perangkat Daerah; Aparat Pengawas Intern Pemerintah. Abstract The principle of accountability is crucial for any organization, including local government entities. This research aims to analyze and understand the role of the Government Internal Supervisory Apparatus (APIP) in realizing the principle of accountability in local government. The research methodology employed is a Normative Empirical approach using a case study. The research findings indicate that the accountability principle assessed by the central government through the Government Performance Accountability System (SAKIP) in the Gorontalo City area still faces challenges in achieving the optimal evaluation point, despite showing improvement in its sub-components in recent years. The research also provides an overview of the existing accountability practices in Gorontalo City regarding individual and organizational performance assessments. This study can contribute to the future development of organizational accountability in Gorontalo City's government and provide in-depth information for future research purposes Keyword : Accountability; Local Government Organization; Government Internal Supervisory Apparatus.

Abstract

AbstrakTujuan penelitian ini adalah untuk mengetahui dan menganalisis pengaturan perlindungan data pribadi sebagai bentuk hak privasi di Indonesia dan  menganalisis dan mengkonstruksikan gagasan ideal pengaturan perlindungan data pribadi sebagai bentuk hak privasi di Indonesia. Jenis penelitian yang digunakan adalah penelitian Hukum Normatif, menggunakan pendekatan pendekatan perundang-undangan “statute approach”, pendekatan komparasi “comparative approach”, dan pendekatan konseptual “conceptual approach”. Selanjutnya disusun secara sistematis untuk diperoleh gambaran yang utuh dan peneliti mengolahnya dengan menggunakan teknik deskriptif analitis.  Hasil penelitian ini menunjukkan bahwa dalam Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi terdapat pengecualian hak subjek data pribadi yang meliputi untuk kepentingan pertahanan dan keamanan nasional; kepentingan proses penegakan hukum; kepentingan umum dalam rangka penyelenggaraan negara; kepentingan pengawasan sektor jasa keuangan, moneter, sistem pembayaran, dan stabilitas sistem keuangan yang dilakukan dalam rangka penyelenggaraan negara; atau kepentingan statistik dan penelitian ilmiah. Kelemahanya, pengecualian tersebut tidak dijabarkan secara detail mengenai batasan dan mekanismenya, sehingga potensi yang terjadi ialah penyalahgunaan wewenang (abuse of power) dalam pelaksanaannya. Adapun perihal transfer data transfer Data Pribadi di luar wilayah hukum Negara Republik Indonesia yang tidak mencantumkan persetujuan subyek data sehingga mengakibatkan hak privasi pemilik data pribadi diabaikan dan tidak memiliki nilai tambah bagi perlidungan data pribadi, baik di dalam negeri maupun di negara lain.  Kata Kunci : Perlindungan; Data Pribadi; Hak Privasi. AbstractThe purpose of this study is to identify and analyze personal data protection arrangements as a form of privacy rights in Indonesia and to analyze and construct the ideal idea of personal data protection arrangements as a form of privacy rights in Indonesia. The type of research used is Normative Law research, using a statutory approach "statute approach", a comparative approach "comparative approach", and a conceptual approach "conceptual approach". Furthermore, it is arranged systematically to obtain a complete picture and the researcher processes it using analytical descriptive techniques. The results of this study indicate that in Law Number 27 of 2022 concerning Protection of Personal Data there are exceptions to the rights of personal data subjects which include the interests of national defense and security; the interests of the law enforcement process; public interest in the context of administering the state; the interest of supervising the financial services sector, monetary, payment systems, and financial system stability carried out in the context of administering the state; or statistical interests and scientific research. The weakness is that these exceptions are not spelled out in detail regarding the limitations and mechanisms, so that the potential for what occurs is abuse of power in its implementation. As for data transfers, transfers of personal data outside the jurisdiction of the Republic of Indonesia do not include data subject consent, resulting in the privacy rights of owners of personal data being ignored and having no added value for the protection of personal data, both domestically and in other countries.  Keyword : Protection; Personal data; Privacy Rights .

Abstract

The main problem in this research is the process of investigating criminal acts of incest committed by the biological father against the child in the jurisdiction of the East City Police. biological father of the child at the East City Police. The aim of the research is to find out and explain the implementation and investigation of criminal acts of incest committed by the biological father against the child (Incest) at the East City Police. Abstract

The aim of this research is to find out the form of customary law that is resolved in customary justice in the Deisa Toiruakat community, Dumoiga subdistrict, Boilaang Moingoindoiw district and to find out the legal process of customary law in Deisa Toiruakat, Dumoiga subdistrict, Boilaang Moingoindoiw district. The Meitoidei Peineilitian that is used is a combined type of research between Noirmative Huikuim Peineilitian and Eimpirical Huikuim Peineilitian. Noirmative-Eimpirical Huikuim Research is a type of research theory which in this case combines noirmative legal science which is coincided with the addition of data or empirical science. The research results obtained by the customary settlement process in Toruakat Village do not violate existing legal norms in Indonesia because the Guhanga Lipu (Traditional Institution) of Toruakat Village and customary courts are recognized by the Government both through laws, regional regulations and village regulations. The conclusion is that there are differences between the traditional regulations of Toruakat Village and the practice of carrying out customary trials that are carried out, because the sound of the articles mentioned in the trial process is different from the sound of the articles in Toruakat Village Regulation Number: 01 of 2020 Concerning the Customary and Customary Procedures of Toruakat Village and the number of sanctions imposed This also differs from the provisions for giving sanctions in the village regulations and in the research process the researcher found that indeed the traditional council did not comply with the traditional village regulations of Toruakat Village, they only relied on knowledge from their parents and from books that their ancestors had left to them.

Abstract

This research discusses changes in Indonesian criminal law regarding legal forgiveness, as one type of decision in criminal cases. The journal aims to understand the urgency and purpose of studying the values of Pancasila that underlie the regulations and implementation of legal forgiveness. The research uses a normative juridical approach with a legislative and conceptual approach. The journal finds that judicial forgiveness is a manifestation of Pancasila values in the process of enforcing criminal law and is part of an effort to Indonesianize those regulations. Criminal law, which has hitherto been based on principles of colonial states.

Abstract

This article aims to know the consumer protection in transactioncross border e-commerceand consumer dispute resolution due to losses experienced by consumers in the transaction. This research is a normative legal research that uses secondary data such as legislation. Legal protection of consumers in transactions e-commerceis regulated by Law No. 8 of 1999 on Consumer Protection and Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions. Zincleta settlement in cross border e-commerceinvolves various problems, especially related to standard clauses referring to foreign jurisdictions. The ITE Law provides a legal basis for e-commerce,but does not specifically regulate cross-border agreements, various methods of dispute resolution, such as mediation, arbitration, and ODR (Online Dispute Resolution) becomes relevant in this context. In conclusion, legal protection of consumers in cross-border e-commerceneeds to be strengthened. Dispute resolution involves the role of institutions such as the Consumer Dispute Resolution Agency (BPSK) and the Indonesian National Arbitration Board (BANI), but the implementation of ODR can be an innovative solution to handle disputes efficiently, especially in the international sphere.need to be strengthened.

Abstract

This article aims to determine the role of Law of the Republic of Indonesia No. 32 of 2009 concerning environmental protection and management towards the environment in Tambo'o Village which is experiencing environmental damage and pollution. This article also examines the factors that hinder the implementation of environmental pollution sanctions due to coconut shell burning and the implementation of criminal sanctions for environmental pollution according to Law Number 32 of 2009. In this study, the author uses an empirical legal research method. Namely by directly observing the field to obtain data related to coconut shell burning in Tambo'o Village. This study uses a descriptive approach in analyzing the data obtained. This study was conducted with residents who were selected purposively (sampling). The results of this study indicate that the role of Law of the Republic of Indonesia No. 32 of 2009 concerning environmental protection and management towards the environment in Tambo'o Village has not run according to expectations. And the factors that hinder the implementation of sanctions are due to weak law enforcement and suboptimal law enforcement. Many complaints from residents about the condition of their environment that has been polluted by smoke produced from burning coconut shells and the perpetrators have never been sanctioned by the government because of the lack of community and government participation in reporting cases of environmental pollution around them. The resolution of the deliberation is not good and stops there.
