Abstract

This article discusses the integration of cross-sectoral oversight and the strengthening of national security in addressing illegal mineral transport via air routes. The study is motivated by the absence of explicit regulation governing the distribution of illegal minerals, creating legal loopholes despite prohibitions in the Mineral and Coal Law. This activity has led to significant economic losses, severe environmental degradation, and potential threats to national security. This research adopts a progressive normative-empirical approach with a policy-legal mapping method, combining regulatory analysis, authority mapping, and the incorporation of local values. The findings reveal weaknesses in oversight and coordination between agencies, as well as regulatory gaps and weak law enforcement. Impact analysis highlights economic losses, environmental damage, and risks to national security. This study emphasizes the need for integrated cross-sectoral oversight, enhanced coordination, and evidence-based policy reformulation to safeguard the distribution of strategic minerals. The findings are expected to form a foundation for effective policy implementation, supporting national economic, social, and security stability.

Abstract

This study aims to analyze the normative construction of waste management within the Indonesian environmental legal system by assessing the structure, substance, and coherence of the norms within the legal framework. Using normative legal research methods with a statutory and conceptual approach, data in the form of primary, secondary, and tertiary legal materials were obtained through literature studies and analyzed grammatically, systematically, and teleologically to test their vertical and horizontal consistency and systemic legitimacy. The results of the study indicate that waste management regulations have established a relatively systematic legal framework with a preventive orientation, grounded in the principle of reduction and corrective measures through administrative, civil, and criminal enforcement mechanisms and sanctions, which are conceptually aligned with the principles of sustainability, prudence, and polluters' responsibility. Normatively, this legal construction has been integrated into the national environmental protection and management regime. However, its effectiveness still requires harmonization of derivative regulations and consistent law enforcement to ensure the protection of the right to a good and healthy environment.

Abstract

Keberadaan becak motor (bentor) sebagai moda transportasi alternatif di Provinsi Gorontalo menimbulkan persoalan yuridis kompleks akibat ketidakharmonisan antara hukum nasional dan daerah. Penelitian ini menganalisis disharmoni regulasi bentor serta dilema penegakan hukum yang muncul antara tuntutan kepastian hukum, keselamatan publik, dan realitas sosial-ekonomi masyarakat. Menggunakan metode penelitian hukum yuridis normatif dengan pendekatan perundang-undangan dan konseptual, hasil penelitian menunjukkan bahwa Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan tidak mengakomodasi keberadaan kendaraan modifikasi seperti bentor, sementara Peraturan Daerah Provinsi Gorontalo Nomor 6 Tahun 2006 justru melegitimasi operasionalnya. Pertentangan normatif ini menempatkan bentor dalam ruang abu-abu hukum yang berimplikasi pada inkonsistensi penegakan hukum, tingginya risiko kecelakaan akibat ketiadaan standar teknis keselamatan, serta ketidakpastian hukum bagi pengemudi yang mayoritas berasal dari kelompok ekonomi lemah. Aparat penegak hukum menghadapi dilema antara menegakkan norma hukum nasional dan mempertimbangkan kemanfaatan sosial bagi ribuan pengemudi yang menggantungkan hidupnya pada bentor. Penelitian ini merekomendasikan perlunya harmonisasi regulasi melalui kebijakan hukum pidana yang komprehensif, tidak hanya bersifat represif tetapi juga mengakomodasi aspek pembinaan dan penyediaan alternatif mata pencaharian guna mewujudkan keseimbangan antara kepastian hukum, keadilan sosial, dan kemanfaatan bagi masyarakat Gorontalo.

Abstract

Penyalahgunaan narkotika di Indonesia meningkat signifikan, terutama di kalangan pekerja usia produktif, dengan multitafsir penerapan Pasal 112 (repressif) dan Pasal 127 (rehabilitatif) Undang-Undang Nomor 35 Tahun 2009 menyebabkan disparitas hukum dan PHK. Penelitian ini bertujuan menganalisis kedudukan, unsur tindak pidana, serta penerapan kedua pasal dalam penanggulangan penyalahgunaan narkoba di lingkungan pekerja. Jenis penelitian hukum normatif doktriner dengan pendekatan statute dan sosiologis; populasi data sekunder berupa peraturan, literatur, putusan hakim; sampel Undang-Undang Narkotika dan literatur terkait; instrumen studi pustaka; analisis kualitatif deskriptif. Hasil menunjukkan ambiguitas unsur penguasaan Pasal 112 sering salah kualifikasi penyalahguna sebagai pengedar, abaikan rehabilitasi Pasal 127, timbulkan ketidakadilan bagi pekerja. Kesimpulan merekomendasikan pedoman asesmen terpadu untuk proporsionalitas hukum dan lindungi hak ketenagakerjaan

Abstract

This study aims to examine the health impacts of mercury exposure on miners and communities, analyse patterns of regulatory compliance in the context of largely informal mining, and evaluate the effectiveness of policies and legal instruments designed to reduce mercury use and mitigate environmental impacts. This study synthesises toxicological and biomonitoring evidence, community-based qualitative studies on practices and risk perceptions, and regulatory analysis in relation to international obligations. Results show that mercury biomarkers remain persistently high and there are neurological impacts on exposed populations, while informality limits oversight and weakens compliance. Interventions focused on enforcement often trigger displacement of activities (mining), rather than changes to more sustainable extraction practices. Policy effectiveness increases when regulations are combined with livelihood-sensitive supporting factors, including cooperative-based formalisation, access to financing and training, and technological transition through integrated governance. The study proposes a governance-livelihood-Islamic norm model and a compliance architecture aligned with maqasid al-sharia.

Abstract

Dengan fokus pada hambatan internal dan eksternal yang mempengaruhi implementasi Undang-Undang Nomor 32 Tahun 2024 tentang Konservasi Sumber Daya Alam dan Ekosistemnya, penelitian ini mengkaji kesulitan yang dihadapi Pemerintah Provinsi Gorontalo dalam menegakkan hukum pidana terhadap perdagangan satwa liar. Penelitian ini menggunakan teknik deskriptif-kualitatif dan strategi yuridis-empiris. Wawancara dengan petugas penegak hukum dan observasi lapangan di Wilayah Sulawesi dari Badan Penegak Hukum Kementerian Lingkungan Hidup dan Kehutanan (Balai Gakkum) dan Seksi Konservasi Sulawesi Utara II Wilayah Gorontalo dari Badan Konservasi Sumber Daya Alam (Balai KSDA) digunakan untuk mengumpulkan data. Temuan menunjukkan bahwa upaya penegakan hukum Gorontalo untuk memerangi perdagangan satwa liar tidak berhasil karena sejumlah masalah internal. Beberapa kendala internal termasuk koordinasi yang buruk antarinstansi, kekurangan sumber daya manusia dan sarana penunjang, dan kurangnya peraturan daerah yang mengatur mekanisme konservasi. Selain itu, ada hambatan dari sumber luar, yaitu kesadaran hukum masyarakat yang rendah, faktor ekonomi yang mendorong perdagangan satwa liar, dan partisipasi publik yang rendah dalam pengawasan konservasi. sehingganya, diperlukan tindakan strategis seperti membuat Peraturan Daerah tentang Perlindungan Satwa Liar, meningkatkan kemampuan penegak hukum, meningkatkan koordinasi lintas lembaga, dan membuat program edukasi hukum dan ekonomi yang lebih baik untuk komunitas lokal. Oleh karena itu, diharapkan penegakan hukum pidana terhadap perniagaan satwa liar di Gorontalo akan lebih efektif.

Abstract

General Background Cohabitation regulation in the National Criminal Code reflects a major transformation in criminal law reform by placing morality, marriage protection, legal certainty, and privacy within one normative framework. Specific Background Articles 411–412 regulate sexual intercourse outside marriage and living together as husband and wife outside a valid marriage, while positioning both provisions as complaint-based offences with restricted complainants. Knowledge Gap The absence of an operational definition of “living together as husband and wife” creates legal uncertainty, multiple interpretations, potential enforcement disparities, and risks of overcriminalization in citizens’ private lives. Aims This study describes the configuration of cohabitation offences in Articles 411–412, including offence elements, legal subjects, complaint mechanisms, and enforcement structure, and compares them with morality offences under the old Criminal Code. Results The findings show that cohabitation is formulated as living together as husband and wife outside legal marriage and is constructed as an absolute complaint offence, with complainants limited to husband or wife, parents, or children. The National Criminal Code expands the scope of criminalization beyond overspel in the old Criminal Code and shifts the criminal paradigm from an individualistic-colonial model to a communal-nationalistic model. Novelty This study clarifies the juridical configuration of cohabitation offences as a compromise between public morality and individual privacy. Implications Criminal law should operate as ultimum remedium through precise formulation, strict complaint limits, and proportional enforcement. Highlights • Absolute complaints restrict prosecution to parties with direct legal standing.• Broader criminalization shifts the paradigm from colonial to national values.• Ambiguous wording creates risks of uncertainty and enforcement disparity. Abstract

This study analyzes the urgency of strengthening the authority of Regional Governments to issue Small-scale Gold Mining Permits within the framework of the relationship between the Central Government and Provincial Governments, as part of equitable licensing decentralization. Strengthening regional authority is essential to support regional autonomy and improve the effectiveness of natural resource management based on local conditions and community needs. This research employs a juridical-empirical method with a qualitative approach, examining mining regulations and a case study in Gorontalo Province. Primary data were collected through interviews with relevant stakeholders, while secondary data were obtained from legal literature, policy documents, and official publications. The findings show that the current delegated authority system creates administrative limitations and delays in permit issuance. Therefore, this study proposes strengthening provincial government authority through an attributive model to accelerate licensing services, enhance administrative effectiveness, and reinforce the regional role in accountable and sustainable mineral and coal mining governance.

Abstract

Law/regulation on mining play a significant role, because mining sector is a potential sector for developing the economy of Indonesian. Law on Mining underwent several amendments, namely the era of Law Number 11 of 1967, Law Number 4 of 2009 and Law Number 3 of 2020. This article will analyze shiftss in mining sector regulations from each of these eras. This article uses normative juridical methods, with statutory, contextual, historical, and comparative approaches, and is analyzed qualitatively. The results of the study show that between Law No. 11 of 1967 to Law No. 4 of 2009 and Law no. 3 of 2020 underwent a change, namely from a centralized arrangement, where the mining sector holding power became a matter for the central government to decentralization, handed over to local governments. Another change is in the field of relations between the government and capital or investors, the contract of work model becomes licensing. The impact on the contract of work model is that the state is positioned as a 'party' to the contract, while in terms of licensing the government has a position that tends to be stronger. This Amendment Contract is adapted to Indonesian conditions and the protection of Article 33 of the Indonesian constitution.
