Abstract

Pada zaman modern sekarang ini, sebagai manusia cara kita bermuamalah semakin beragam dan begitu banyak alternatifnya selain tentunya juga begitu banyak kemudahan. Dahulu, untuk berbelanja kebutuhan harian, kita harus pergi ke pasar tradisional ataupun warung-warung klontong, namun dengan pesatnya kemajuan zaman, saat ini semuanya sudah bisa dipenuhi dengan pergi ke minimarket ataupun supermarket. Tidak bisa kita pungkiri dengan kita berbelanja ke minimarket contohnya, ada saat di mana pembeli membayar dengan uang lebih barang belanjaannya karena memang tidak ada uang pas, namun di waktu yang sama kasirpun menawarkan kepada pihak konsumen untuk memberikan donasi dari uang kembalian yang biasanya berupa recehan (re: ratusan rupiah) yang nantinya donasi tersebut diperuntukkan kepada pihak yang layak menerimanya. Uang kembalian tersebut jika dialihkan sebagai donasi yang walaupun bernilai ibadah namun tanpa persetujuan konsumen atau dengan keterpaksaan tentunya dapat menimbulkan penyimpangan dari kaidah hukum Islam.

Abstract

In the world of Indonesian state finance, there are many types and varieties of financial products in circulation. As a society with the 4th largest population in the world, Indonesia is a very lucrative market share. This is often the main discussion in international organizations where Indonesia as a developing country is heading to a developed country. One product that is in great demand from year to year is retail sukuk. There are 15 Retail Sukuk products called Retail Sukuk 015. The products offered by the Indonesian government are very profitable on a certain scale. Where Retail Sukuk (retail sukuk) are a Sharia investment product offered by the government to individual Indonesian citizens. The management presented by Retail Sukuk must be based on Sharia principles, avoiding the elements of maysir (gambling), gharar (obscurity) and no usury (usury). The concept offered has also received a guarantee from the DSN MUI so that the contract used to issue Retail Sukuk is Ijarah-Asset to be leased. The existing capital turnover was developed for investment activities to purchase benefit rights to State Property leased by the government to procurement projects (project businesses). So the rewards are clearly taken or shared from the profits from the investment activities. To add to the clarity of how these benefits are obtained, it is described through 8 (eight) investment benefits issued by the Ministry of Finance as an extension of the Indonesian government. Therefore, the Government has a definite goal where the issuance of retail sukuk is to help finance the APBN and finance the development of various infrastructures in Indonesia. Abstract

Kegiatan muamalah merupakan kegiatan yang melibatkan setiap anggota masyarakat dalam upaya memenuhi kebutuhan hidupnya sehari-hari. Sebagaimana yang dilakukan oleh masyarakat di Desa Margo Leastari Kecamatan Jati Agung Kabupaten Lampung Selatan yang melakukan praktik jual beli angsuran tanah kavling. Perjanjian jual beli angsuran tersebut melibatkan dua pihak, yakni pihak debitur (penjual tanah) dengan pihak kreditur (pembeli tanah), jual beli tersebut dilakukan secara angusran atau menggunakan sistem cicilan. Praktik jual beli kredit tanah kavling tersebut ditetapkan dalam sebuah perjanjian yang memuat jumlah dan besaran cicilan, jangka waktu serta hak dan kewajiban setiap pihak yang harus dipenuhi. Apabila terdapat hal yang penting namun belum tertulis dalam perjanjian, kedua belah pihak harus membuat kesepakatan yang disetujui oleh kedua belah pihak. Salah satu masalah yang terjadi dalam praktik tersebut adalah terkait sengketa tunggakan, dalam perjanjian tidak terdapat pasal mengenai penghapusan uang muka apabila terjadi tunggakan dalam pembayaran cicilan, sedangkan debitur melakukan penghapusan uang muka secara sepihak tanpa kesepakatan kreditur apabila kreditur mengalami tunggakan dalam pembayan angsuran dalam jual beli tanah kavling.

Abstract

Dutch colonialism made Indonesia embrace the legal positivism system. Legal positivism views the law as a a fixed, logical and closed system. The written law is so exalted and does not allow contextual interpretation. The truth that is believed is the truth that can be proven (pragmatic). Along with the development of the era, which is marked by the increasingly complex problems that arise, including sharia economics, it cannot be solved with a positivistic paradigm. The law must develop along with the development of problems in society in order to create the ideals of justice. with similar thought, satjipto rahardjo then sparked his progressive legal concept which places humans and humanity as the main discourse or primus in the discussion and enforcement of law and formulated an adagium "law is for human, not human for law". The progressive law that place "law for humans" and "substantive justice" are in line with the goals of as-Shari'a in creating law, namely for the maslahah. Thus, the use of a progressive legal paradigm in resolving sharia economic disputes is appropriate. The urgency of progressive law itself in resolving sharia economic disputes, including: as a new paradigm of legal discovery, reconstructing the role of judges who are passive to active, and supporting mediation as an alternative dispute resolution in sharia economic disputes.

Abstract

This article discusses the problems of handling domestic violence according to Islamic law and positive law, the occurrence of domestic violence because many parties do not understand the handling of domestic violence both according to Islamic law and positive law. The purpose of this paper is to provide insight into the handling of domestic violence from the perspective of Islamic law and positive law, considering that previous articles have not comprehensively discussed the handling of domestic violence. The method in this research is library research, collecting data from books, journals and other library materials that discuss domestic violence. The results of this study are that in positive law there are differences between the Criminal Procedure Code and Law 23 of 2004. The Criminal Procedure Code prioritizes the perpetrators to be investigated immediately, while Law 23 of 2004 emphasizes victim services first to get protection as victims of violence. Meanwhile, according to Islamic law, sanctions or punishments are given, according to the type of crime committed. However, if the victim forgives and tends to make peace, it is permissible under Islamic law

This success can be  measured to the extent to wich each teacher is ebel to present teaching material properly and easily digensted by student  as well,In edition to the ability and goog anderstanding of the subject they have, mastery of learning matterials, learning strategies ang edition to a sense of empathy, as wel as a wealth of ideas in the teaching –learning procces. One the Muhibbah  lecture model is  an educational  model that focuses  on how students enjoy  and have fun   interacting  with their lecturers. Abstract

Digital banking services in Islamic banking continue to progress and improve. Digital banking services can ease Sariah Bank customers to transact by only using a mobile phone in 24-hour service. One of the digital banking services in Islamic banking is ZISWAF fundraising and fund management. ZISWAF is one of the products that will be the focus of the company in business development in the future because ZISWAF is a source of funds for Muslims who are expected to realize prosperity, social justice and reduce poverty. In order to increase the potential of zakat in Indonesia, the National Amil Zakat Agency has officially appointed the Zakat Management Unit (UPZ) of Bank Syar'ah Indonesia by utilizing digital banking. Therefore, this research was conducted to find out how the Sharia Economic Law Perspective towardThe Digital Banking  Based of ZISWAFfundraising and fund management at PT. BSI KCP Bandar Lampung TelukBetung. The results of the field research show that ZISWAF fundraising based on digital banking uses the BSI Mobile platform, BSI ATM, and the Jadiberkah.id platform. About fund management, ZISWAF funds are managed through charity programs and sustainable programs. If it is viewed from the perspective of Sharia Economic Law, The Digital Banking  Based of ZISWAF fundraising andfund managementis legal because it is included in providing convenience benefits, as explained in the surat Al-A̒lᾱ [87]: 8 The paragraphs explain that Allah SWT provides convenience for everyone. Muslims to get a way of convenience (in all matters) and have the value of benefit and be able to maintain the interests or objectives of Islamic law and are maṣlaḥah al-ḥᾱjjiyah, namely making it easier for BSI customers in paying ZISWAF and easing in worship.

Abstract

The objective of this study is to analyze the influence of the digital sharia banking system on cash waqf among the millennial population in the Sumatran Island. This study is a quantitative research that focuses on the millennial generation in the Sumatran Island. The sample size for this study consists of 349 respondents. The data analysis approach employed is the Partial Least Squares (PLS) Test utilizing smart PLS software version 7.0. The findings indicate that Perceived Usefulness (PU) does not exert a substantial impact on the decision to waqf money. This implies that the level of benefits experienced by users of the digital sharia banking system does not have the ability to affect the decision to donate money through waqf. The perceived ease of use (PEU) positively and significantly influences the decision to waqf money. This implies that the higher the comfort felt by the millennial generation through the digital sharia banking system, the more likely they are to decide to waqf money. The sense of the surrounding environment, known as Subjective Norm (SN), has a positive and considerable influence on the decision to waqf money through the digital sharia system. Hubristic Pride (HP) does not exert a substantial influence on the inclination to donate money through the digital sharia system, indicating that the decision of the millennial generation to engage in this practice is not driven by hubris pride in the form of narcissism.

Abstract

The Omnibus Law, which encompasses the Constitutional Law and the Islamic Law, has been the subject of intense dispute since its inception. The controversy has occurred from the inception to the promulgation of the design process within larger communities. Multiple issues emerged from the outset when the administration introduced the proposal for an Omnibus Law in the Indonesian People's Consultative Assembly of the Republic of Indonesia (DPR RI) to its enactment. This study uses normative legal methodologies, which are examined through the lens of the constitutional law theory and the Islamic law. The study determined that the Omnibus Law is a legislative tool commonly employed by countries that follow a common law legal system. However, it was subsequently embraced by nations that follow a civil law framework, such as Indonesia. The Omnibus Law was enacted to ensure the efficient and effective execution of laws, particularly in the area of copyright regulations, in order to prevent any duplication or overlap. Consequently, public perceives the law as lacking ambition and instead favoring the concerns of the community, particularly in relation to employee compensation, employment agreements, and the practice of subcontracting. Based on the constitutional law, this state policy is deemed conditionally unlawful, despite the ongoing application of these legal standards by the executive and parliamentary parties. Within the framework of Islamic jurisprudence, it can be regarded as a component of siyasah syar'iyah or governmental strategy that aligns with the principles of maqāṣid al-sharī'ah, particularly hifdz al-mal, which involves preserving economic stability and promoting halal certification. However, this article contends that the judgment of the Constitutional Court to deem it unlawful is contingent. It advocates for a modification of the copyright law pertaining to creative works, with the aim of ensuring broader adherence to legal regulations.
