Abstract

The existence of the Integrated Law Enforcement Center (Gakkumdu) Pekanbaru City in completing the follow criminal offense Election maximum rated yet. So hopefully, there is a coordination of the parties involved in Gakkumdu, namely Bawaslu / Supervisory Committee and the Police and the Prosecutor in the city of Pekanbaru. Based on this understanding, then writing this essay to formulate three formulation of the problem, namely: first, how tasks of Integrated Law Enforcement Agencies in Pekanbaru City Election based on Law No. 8 of 2012 on the Election of the Board of Representatives and Regional Representative Council of the Regional Representatives Council year 2014? Secondly, What are the constraints faced Integrated Law Enforcement Agencies Pekanbaru? Thirdly, what the efforts of Integrated Law Enforcement Agencies Pekanbaru to improve its work in the Election? The research method in this study, first, this kind of research is legal sociological and descriptive. Second, research sites Pekanbaru. Hoarse data sources supported by the primary data, secondary data sources and tertiary data sources. Thirdly, data collection techniques used were interviews, and a review of literature. After the data collected then analyzed qualitatively, then draw conclusions with deduktitf thinking method is to analyze the problems of the general form into special shapes. From the research, there are three fundamental problems that it can be concluded, first, the effectiveness of the Integrated Law Enforcement Center tasks (Gakkumdu) in the Crime Case Management legislative elections in 2014 in the city of Pekanbaru is still not optimal, second, Gakkumdu obstacles in carrying out their duties is the level of understanding diantarannya still less to the laws and regulations governing legislative elections, lack of socialization rules and regulations relating to the implementation of legislative elections and the lack of coordination between the personnel sitting in the Sentra Gakkumdu. Third, efforts to improve its work diantarannya Gakkumdu is to improve understanding are still lacking for legislation governing legislative elections, improving socialization rules and regulations relating to the implementation of legislative elections and improve coordination between the personnel sitting in the Sentra Gakkumdu.Keywords : Task - Gakkumdu - General Elections

Abstract

Indonesia is a country that is based on state law. Then surely the actions of the government should be based on the applicable law. Principles of the State Administration of justice, to put the judicial control in the implementation of good governance a bias in the state system of Indonesia. Where a State Administrative Court's decision does not have the power eksekutorial, how could the law and the public can supervise the government that carried out by officials of the Administration Negara.maka required an ordinance implementing the forced money and administrative sanctions tegasa that the decision of Justice State Administration can be executed properly. The purpose of this thesis is to find an idea about the procedures of money forced and administrative sanctions in the State Administrative Court.This type of research is research with normative juridical approach, yatu approach is to discuss the principles of law. This research was conducted by examining the library materials or secondary data such as legislation and books written by lawyers. Source data used are primary data source, secondary data sources, and tertiary data sources. Data pengupulan technique is the method of literature study.The conclusion is the first forceful measures as mandated in Article 116 of Law No. 51 of 2009 has yet to be implemented effectively related to the absence of implementing regulations regarding the forced currency and the administrative sanctions. Both for the payment of money shall be drawn from the paka personal finances because yangbersangkutan officials had deliberately not implementing the court ruling. In the case of the imposition of administrative sanctions, types of penalties can be adjusted by judges with huge losses suffered by the plaintiffs for not implementation of the court ruling.Advice authors to the problems studied were first need uniform laws to formulate the idea of the researchers stated in the form of government regulation that material containing cargo the ordinance. Both the State Administrative Court (Chief Justice) need to be proactive in monitoring the implementation of court decisions that have permanent legal force. Abstract

Human trafficking is a crime that is extraordinary, because impact of human trafficking on the victim and the darting of an environmental bad about. Governments find it difficult to handle the cases of human trafficking, because the perpetrators of the actors using various modes in carrying out the action. in District Tenayan Kingdom trade in human beings handling legal cases less effective, karana in some villages are still many open nightclubs and the localization of the localization tends to occur crime of trafficking in women under age.This type of research to be conducted sociological research that want to see the correlation between law and society, so as to reveal the effectiveness of the rule of law in society. This study bersifatdeskriptif which the author tries to give an idea of the reality of the complete, detailed, and clear about the issues examined. The conclusions that can be drawn from the enforcement of criminal law in the legal protection of women from the crime of trafficking in women in the Police Sector Tenayan Kingdom has not run as it should be proven because their public reports of trafficking cases was revealed.If people do not report these cases may be the case is still going on until today. Factors pengahambat the Police Sector Tenayan Kingdom in enforcing the law against women from the crime of human trafficking victims are just tough questioning. As well as the extent of the districts Tenayan Kingdom who make less than the maximum performance of the police, so that the public report is needed. An attempt by the Police Sector Tenayan Kingdom in addressing cases of human trafficking in the village Maridan District of Tenyan Kingdom improve relations with Waraga living in the border region of Pekanbaru Regency Siak because they in coastal areas are common crimes and dikarnakan them away from the Police Sector Tenayan Kingdom so that people do not want to know the crimes that occur in their territory.Keywords: Law Enforcement - Crime - Human Trafficking

Abstract

Political rights in relation to the preservation of state life, in article 7 paragraph 2 E Law, Number. 10 '' The year 2016 reads that every person who wants to nominate a regional head must be at least 30 (thirty) years old for the candidate for Governor and candidate for Deputy Governor, 25 (twenty five) Years for the candidate for Regent and candidate for Deputy Regent as well as for the candidate for Mayor and candidate for Deputy Mayor ''. There is a related gap in article 7 paragraph (2) huru e of the Law on Regional Head Elections which contradicts Article 28 J of the 1945 Constitution which contains restrictions on the rights of citizens, but with the intention of guaranteeing recognition and respect for the rights and freedoms of others and fulfilling demands that are just, according to considerations of moral, religious values, security and public order in a democratic society.This type of research is normative research. namely research conducted by means of library materials or secondary materials. In this case the researcher conducts normative legal research which discusses legal principles, in the form of an effort to discover basic philosophical principles. In this case, the researcher discusses the political age limit in the candidacy of regional heads based on statutory regulations. This research is conducted by examining secondary materials or research based on standard rules that have been recorded, also known as literature studies.In the results of the research, there are two points that can be concluded. First, the Legal Politics of determining the Age Limit for candidates for Regional Head in Law No. 10 of 2016 that in order to become a regional head, a person is required to meet the requirements including the minimum age limit to become a regional head, which basically means that the elected regional head will have knowledge and ability as regional leaders able to think and act and behave by prioritizing the interests of the nation, state and society. Second. for someone to serve as a public official, a leader is needed who has intellectual, high social sense, politeness, innovative, creative, and able to make the right decisions wisely to solve a problem that occurs. in this case the authors argue that at the age of 21 years.Keywords: Legal Politics - Age Limitation - Regional Head Candidates

Abstract

Management and financial responsibility of the State plays an important role in realizing the goal state, so that the founding fathers felt the need to form a special state institution which is independent, objective and free from the influence of the government to examine how the government uses the state budget approved by the House of Representatives ( DPR), such institution is the State Audit Board (BPK). One of the institutions of the State in the Constitution of the Republic of Indonesia Year 1945 is the State's financial supervisory powers stipulated in the Constitution of the Republic of Indonesia Year 1945, in article 23, letter e (1) states "To examine the financial management and responsibility of the State Audit Board held a free and independent. With the meaning of the word free and independent is expected CPC can be state institutions which can lead to the conclusion that true, objective, and critical and pro-truth and facts.The aim of this study is that the First Freedom and Independence of the State Audit Board in oversight of financial usage States under the Constitution of the Republic of Indonesia Year 1945, Second knowing Relations Working Procedures Audit Board with other institutions related to the supervision of the use of state finances by Law Law No. 15 of 2004 on the Management and State Financial Responsibility.From these results it can be concluded that the First Freedom and Independence of the CPC has been set in the 1945 Constitution in Article 23 letter e (1). The concept of freedom and kemadirian This meant that no intervention other state institutions as well as the constitutional guarantee that the work of the CPC can run optimally and objectively in accordance with the purpose of formation. The second relationship working procedures of the CPC and other state institutions, namely the House of Representatives, Parliament and the Government in order to carry out a report on the results of the examination to be followed up and taken into consideration the House if there is suspicion of a criminal act in the financial management of the country. Suggestions of Author, First expected to the government (President) and the Parliament did not intervene either in the structure of political aupun tools related to the implementation of the CPC function in each stage of the examination of the State institutions alleged to have committed irregularities use of state finances. Both are expected to be able to play its role BPK as an independent state by consolidating institutional and prioritize major cases detrimental to the State indicated in both the national and regional levels.Keywords: Freedom-Independence, The BPK.

The president is head of state in a presidential system of government. The post of president as head of state is very important, it is not impossible that the president did the wrong action of the constitution and the rule of law to the detriment of the people and country. Abstract

Regulation of the Minister of Transportation PM 15 of 2019 concerning the Implementation of Transportation of People with Public Motorized Vehicles on Routes. states that, every driver and public transportation company that operates the transportation of people by public motorized vehicles on routes is obliged to comply with the provisions concerning the license to carry out person transportation on the route, and the technical and other requirements for motorized roads. However, what can be seen in the field is that there are still many people who do not have a route permit. Therefore, it needs to be studied in a stimulant first, the implementation of the supervision of the permit for the transportation route for people between cities in one province in Riau Province based on the Regulation of the Minister of Transportation Number 15 of 2019 concerning the Implementation of Public Motorized Vehicles in Routes, secondly, the Inhibiting Factors for Granting Transport Routes Permits Person, third, efforts made to overcome obstacles in granting route permits in Riau Province. This research is a sociological legal research, because it is based on field research, namely by collecting data from interviews, questionnaires, and literature reviews that are related to the problems to be studied assisted by primary, secondary and tertiary data. Abstract

The judge's verdict accepts pretrial in order to protect the rights ofsuspects and defendants for the unauthorized conduct of investigation. In this casethe pretrial verdict number. 19/ Pid.Pra / 2016 / PBR. However, pursuant toArticle 82 Paragraph (1) Sub-Paragraph (d) of the Criminal Procedure Code ofPublic Prosecutor for its authority to delegate the principal matter to the districtcourt registered in the case number 535 / Pid.B / 2016 / PN.RHL. Pursuant toArticle 137 of the Criminal Procedure Code does not have a principle ofpresumption of innocence for the rights of suspects and defendants faced beforethe court.The purpose of this thesis writing is: First, to know the setting ofdelegation of principal case to the district court is associated with the pretrialdecision accepted according to the Criminal Procedure Code. Secondly, to knowthe ideal setting of the principal issue of the case to the district court is related tothe pretrial ruling received under the Criminal Procedure Code. Thirdly, to knowthe legal consequences of the transfer of principal case to the district court isrelated to the pretrial decision accepted according to the Criminal ProcedureCode.This type of research is normative legal research or can be called alsoresearch doctrinal law. From the research result of the problem, there are threemain points that are concluded. Firstly, the regulation of the main issue of thecase to the District Court is related to the pretrial ruling which is accepted basedon Ius Constitutum Article 137 KUHAP there is no legal certainty of regulatingrules. So that the principle of Presumption of Innocence (presumption ofinnocence) has ignored the rights of suspects / defendants. Secondly, the idealarrangement of the central delegation mechanism to the District Court is relatedto the pretrial ruling received that the pretrial judgment received by the judgethen the trial in the district court can not be continued so that it is clearlymentioned in the legislation in this case the Book Criminal Procedure Code.Thirdly, the consequence of the law of delegating the principal case to the districtcourt is related to the pretrial decision received, namely the case investigated isthe cessation of prosecution, the case is null and void. Abstract

Law enforcement against narcotics crime has been carried out by law enforcement officers and has received a judge's decision in a court hearing. In the Supreme Court Circular Letter Number 3 of 2011 concerning the Placement of Narcotics Abuse in the Institute of Medical Rehabilitation and Social Rehabilitation, every narcotics addict and victim of narcotics abuse must undergo medical rehabilitation and social rehabilitation.The purpose of this thesis is: First, to find out the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court. Second, to find out the inhibiting factors for the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court.This type of research can be classified as a type of sociological legal research, because in this study the authors directly conduct research at the location or places that are examined to provide a complete and clear picture of the problem under study. This research was conducted at the Pekanbaru District Court, while the population and sample were all sections related to this research, the data sources used included primary data, secondary data and tertiary data, data collection techniques, namely interviews and literature studies.From the results of the research and discussion it can be concluded that, First, the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court has not been going well and maximally. Second, Obstacles in the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court, namely that doctors have not been checked or delayed for narcotics abusers before trial in court, the second is budgetary problems, and thirdly the lack of cooperation with other Pekanbaru agencies in providing a place that is feasible in carrying out rehabilitation because so far in Pekanbaru City the place to do rehabilitation is done at the Tampan Mental Hospital.Keywords: Narcotics – Abuser – Implementation – Rehabilitation.

Abstract

Currently, the implementation of the work discipline as the initial capital in the smooth running of the tasks of civil servants, particularly Civil Servants, which is still minimal from what had been expected, the various forms of breach of discipline is still done employees. In the sense that Civil Servants are government employees who have met certain requirements, in the lift as employees Apparatus Civil State as fixed by the Trustees personnel officer to occupy the post of government as well as by applicable regulations. The applicable provision is exactly what is used as the legal basis for the Civil Servants itself. Making it as a form of discipline that must be complied with and run by Civil Servants. The discipline of Civil Servants is the ability of the employee to obey the obligations and avoids the prohibitions specified in laws and regulations and/or violated sentenced discipline.However, various attempts have been made for the enforcement of labor discipline, ranging from coaching to administration of sanctions for employees who committed the violation. In this case the writer wanted to know how the implementation of Government Regulation No. 53 Year 2010 Concerning Discipline of Civil Servants towards the authority of the Trustees of the Civil State Apparatus itself as well as how the efforts in overcoming the obstacles of the implementation of the punishment against the breach of discipline of Civil Servants.Keywords: Authority, Discipline, Law Enforcement
