Abstract

Free Trade Zone or commonly called FTZ is one of the containers in the SpecialEconomic Zone (SEZ) which is related to a free trade zone that provides access for thecountry in terms of exemption from import duties, Value Added Tax (VAT), Value Added Taxand Luxury Goods (STLG), and excise. The access granted by a country creates a policy thatmust be implemented, such as licensing. This is confirmed in the Regulation of the Head ofthe Batam Free Trade Zone and Free Port Regulatory Agency Number 8 of 2019 concerningthe Implementation of the Entry and Exit of Goods To and From the Free Trade Zone andFree Port of Batam Article 27 Paragraph (3), where every activity in the FTZ area must havea license, one of which is licensing the distribution of cigarettes.The high contribution of cigarettes and the existence of large profits, makes a problemarise, namely the case of illegal cigarettes. So that the state issued Government Regulation ofthe Republic of Indonesia Number 41 of 2021 concerning the Implementation of Free TradeAreas and Free Ports as a juridical basis for its implementation. This is considered importantso that state revenue related to cigarette excise, especially in Batam City, can beimplemented properly and maximally.Based on the results of temporary observations, the implementation of PP No. 41 of2021 concerning the Implementation of Free Trade Areas and Free Ports has not gone asexpected. This is based on the presence of companies that do not have distribution licensesissued by BP Batam, so that it was found that 68% of the number of cigarettes did not havedistribution licenses with a projected state loss of IDR 78.8 billion, so that the target of staterevenue is not in accordance with the number of cigarette distribution activities.Keywords: Free Trade Zone, Excise, Illegal Cigarettes.

Abstract

ABSTRAKKonflik muncul berasal dari kondisi kemajemukan struktur masyarakat dan konflik merupakan fenomena yang sering terjadi sepanjang kehidupan manusia dalam masyarakat. Salah satu fenomena atau permasalahan yang terjadi saat ini adalah konflik tanah ulayat antara masyarakat hukum adat Kenegerian Kopah dengan PT. Duta Palma Nusantara. Konflik ini telah terjadi bertahun-tahun yang lalu akan tetapi sampai saat sekarang belum dapat terselesaikan dengan baik di antara kedua belah pihak. Penyebab terjadinya konflik antara lain: tumpang tindih hak di atas hak ulayat dan HGU, Konflik batas penguasaan lahan, Pembangunan Parit Gajah, Corporate Social Responsibility tidak dilaksanakan; Pembangunan kebun masyarakat yang tidak dilaksanakan; terjadinya tindakan kekerasan terhadap masyarakat hukum adat kenegerian kopah. Oleh sebab itu pemerintah harus memberikan solusi dalam penyelesaian konflik tanah ulayat dengan cara pemerintah memaksa perusahaan menyerahkan 20 % lahan HGU untuk dikelola oleh masyarakat hukum adat kalau tidak ditaati maka pemerintah membatalkan HGU perusahaan; atau Pemerintah dapat mempertimbangkan lebih lanjut untuk tidak memberikan perpanjangan HGU perusahaan yang memiliki konflik berkepanjangan dengan masyarakat hukum adat terkait dengan tanah ulayat.Kata kunci: tanah ulayat; faktor penyebab konflik; masyarakat hukum adat. ABSTRACTConflict arises from the condition of the plurality of the structure of society and conflict is a phenomenon that often occurs throughout human life in society. One of the phenomena or problems that occur today is the ulayat land conflict between the customary law community of Kenegerian Kopah and PT. Duta Palma Nusantara. This conflict occurred many years ago but until now has not been able to be resolved properly between the two parties. The cause of conflict between others: overlap on the rights of the ulayat and HGU, Conflicted land rule boundaries, Building elephant trench, Corporate social responsibility not carried out, Development of unexerted community gardens, The occurrence of violence against the customary law kenegerian kopah. Therefore the government must provide solutions to conflict resolution ulayat land with the way the government forces companies to hand over 20 % of HGU land to be managed by the customary law community if not heeded the government cancel HGU company or government may consider further not to provide extra HGU that has prolonged conflict with the customary law community relating to the ulayat.Keywords: ulayat land; factors causing conflict; customary law community.

Abstract

Local governments have an interest in building permits. In order to carry out the construction of a building, whether carried out by individuals or private parties who have business functions, they are required to have a Building Construction Permit (IMB) and this permit is needed to fulfill one of the construction requirements. However, since the Job Creation Law came into force, Building Construction Permits have changed to Building Construction Approvals. One of the provisions in building permits is the Building Boundary Line (GSB). For Jalan HR Soebratas, the building must have a GSB of 40 meters from the road axle. In reality, there are still many buildings, especially shophouses, adding buildings beyond the building boundaries. Some of the consequences are traffic jams because land that should be used for parking is used. Based on Pekanbaru City Regional Regulation Number 07 of 2012 concerning Building Permit Levy, specifically in Article 106, there are administrative sanctions imposed on violators of the Regional Regulation, especially shop owners who add buildings beyond the GSB. From the results of the research that has been carried out, implementation has gone quite well. This is because the relevant agencies move through reports or complaints.

Abstract

Indonesia continues to experience persistent territorial disparities as a result of the long-standing application of symmetric decentralization, under which uniform administrative standards are imposed on regions with fundamentally different structural capacities. This approach has contributed to chronic governance underperformance and spatial injustice. The resulting mismatch between regional heterogeneity and policy uniformity underscores the need for a conceptual reorientation grounded in normative theories of justice and constitutional principles. This article aims to develop a coherent framework for asymmetric regional development capable of addressing structural inequalities while remaining consistent with the constitutional architecture of the Unitary State. Using a normative legal research approach that combines statutory analysis with case studies of Aceh, Papua, and Yogyakarta, this study investigates how asymmetric arrangements can be operationalized as both legally legitimate and philosophically justified governance models.The article presents four key contributions: first, it reconceptualizes asymmetric regional development as an ethical and constitutional imperative, grounded in Rawlsian distributive justice, Sen’s capability approach, and contemporary spatial justice theory; second, it highlights the policy pitfalls of symmetric decentralization through a critical assessment of historical and empirical evidence, including failures in regions such as Malaka; third, it introduces the Regional Inclusion Feasibility Index (IKPD) as a juridical and technocratic innovation, providing objective, multidimensional criteria for regional expansion; and fourth, it situates Indonesia’s asymmetric model within global comparative practices, demonstrating its alignment with principles of proportional autonomy and contextual justice. Collectively, these contributions position asymmetric regional development as a viable pathway toward equitable and sustainable territorial governance in Indonesia.
