Abstract

Penal mediation is an alternative solution to criminal cases outside the court. In the settlement of criminal cases if taking a line of reasoning, there is always a criminal conviction by the judge against the perpetrator, this is philosophically sometimes not satisfying all parties, therefore it is necessary to have a criminal case resolution through ADR (Alternative Dispute Resolution) with the intention can resolve conflicts that occur between perpetrators and victims.This research can be classified in sociological legal research, namely the effort to approach the problem under study with the nature of the law that is real or in accordance with the reality that lives in society. This research is seen from the nature of description, namely a study that illustrates clearly and in detail the review of the role of advocates in applying reason mediation as an alternative to criminal dispute resolution by limiting the discussion and analysis of two aspects, namely the role of advocates, and the legal consequences of the peace agreement from the results of the reasoning mediation.From the results of the problem research there are three main things that can be concluded. First, the Role of Advocates in Applying Penal Mediation to Completion of Criminal Cases Outside the Court is an advocate acting as a third party who is impartial and seeks to find solutions and provide solutions to the disputing parties but the solutions provided are not binding the parties to the dispute, the success of mediation remains dependent on the parties who want peace as a solution outside the court. Second, the legal strength of the peace agreement produced by the mediation of the process of handling criminal cases in the peace agreement produced by reasoning mediation will be legally enforceable for the parties (perpetrators and victims) based on the principle of pacta sunt servanda that the agreement is a law for the maker so obeyed. But the peace agreement is actually not binding on investigators or creates an obligation for investigators to stop the investigation. Even though an act of accountability is desired by the victim, the perpetrator can still be prosecuted until the judge is sentenced.The author's advice, First, should the Central Government and the Regional Government conduct legal development management on the importance of resolving legal issues through the reasoning mediation path. Second, a policy from the government is needed that supports penal mediation through legal institutions by harmonizing the criminal justice system. Third, conducting reasoning mediation needs to be supervised by an advocate organization so that penal mediation is truly implemented because of reasons for the benefit of the parties.Keywords: Role - Penal Mediation - LBH Tuah Negeri Nusantara

Abstract

A state or government exists to ensure the welfare of its people, so it is necessary to supervise the management of natural resources. Supervision in the natural resource management sector is important in Indonesia, this is in accordance with the mandate in Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945). Supervision of the mining natural resource sector, especially community mining of rock excavation, is the authority of the state as control over mining and the government as the executor of the supervisory authority. Supervision of mining has undergone many changes in accordance with the issuance of regulations in new regulations, the latest Law, namely Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining, reinstating the authority of the provincial government by revoke the authority over the concurrent affairs of the regional government over mining, so that the authority over mining is carried out or regulated directly by the central government.This type of legal research can be categorized as normative-empirical legal research with the live case study category, the live case study approach is an approach to a legal event that is still in progress or has not ended. The data sources used are secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data collection technique comes from the literature study method, after the data is collected, conclusions are drawn.From the results of the study obtained 2 (two) main things, namely first the central government wishes to build a licensing system in the mining sector as well as possible with the new Mining Law, secondly the changing authority system which in accordance with the applicable regulations causes many problems in terms of supervision and licensing in the mining sector. The researcher's suggestions are first to improve Human Resources who play an important role in the mining sector so that the desired system can be achieved, secondly to coordinate in terms of mining supervision with local governments in regional regulations.Keywords: People's Mining Rock Quarry – Supervision -Authority

Abstract

All of constitution always have a change clausul in the text. It same with constitution of Indonesia that exist in article 37 constitution 1945. But unfortunatelly, because of the power of politic in the new era that build extrem autority had been make the constitution be sacred. Except passed by referendum that is decision of people‟s Consultative Council No.IV/MPR/1983 and Civil Law number 5 1985. Author‟s opinion in practis the changes to constitution 1945 is not suitable with the written on the constitution. In the reformation euphoria of Soeharto then make a claim to do an amendment close to the reality that is implementation in 1999-2002 (the first, the second, the third, and the fourth changes ). Author have an opinion there are the developments in the law section that have a relation with constititution 1945 changes procedure. The core is how the change on the theory and the constitution also implementation and practice in Indonesia. The last are flexibility or rigid of the constitution categorized. Because if we talking about amendment almost relevance with the grade of easy or difficult of constitution is changed. Therefor based on the amendment procedure the author interest to make a correlation the suitable with the general principles of the constitution amendment in the generally modern constitution in the practice of constitution in Indonesia.Keyword: Procedure – Amendment – Constitution 1945

Abstract

The issuance of Presidential Decree No. 64 of 2020 concerning HealthInsurance certainly raises question marks in the community. This regulationemerged after the Supreme Court's Decision on Presidential Regulation No. 75 of2020 which has the same substance, namely the increase in BPJS contributions.Presidential Regulation Number 64 of 2020 is considered to have violated theSupreme Court's decision and the laws above it. Therefore, the purpose of writingthisthesis is: first, why does the President continue to issue Presidential RegulationNo. 64 of 2020 concerning Increases in Health Insurance Contributions while theSupreme Court has decided Presidential Decree No. 75 of 2019 with Decision No.7/P/HUM/2020 which contains the same content. . Second, to find out the urgencyof the formation of Presidential Decree No. 64 of 2020.This research is a normative research. This is based on library researchthat takes quotes from reading books, or supporting books related to what theauthor isresearching. The data sourcesthat the researcher uses are secondary datasources consisting of primary, secondary ortertiary legal materials. This study usesqualitative data analysis and produces descriptive data.From the results of the research conducted, there are several conclusionsobtained, namely: First, in this case the President has the right to issue aPresidential Regulation. However, judging from the Supreme Court's decision aswell as the reasons for the rejection of the previous Presidential Regulation, it cancertainly be used as a reason why the President does not need to issue a newPresidential Regulation which basically contains the same content as the previousPresidential Decree. In addition, the President must pay attention to the impact andthe current state of society. Second, the reason for the President in issuing thisPresidential Regulation is in stark contrast to the principles of the social securitysystem, which in the hierarchy should not conflict with the regulations above.Keywords: Presidential Regulation-Health Insurance-Supreme Court Decision

Abstract

Implementation of the principles contained in the quick coordination between law enforcement agencies, one of which is an investigator with the prosecutor in the case of submission of the Notice of Commencement of Investigation hereinafter abbreviated SPDP, by the investigator to the prosecutor to initiate an investigation. Fast, should be interpreted as a strategic attempt to make the justice system as an institution that can ensure the accomplishment / achievement of justice in law enforcement quickly litigants. Not only quickly resolved origin are applied but juridical considerations, accuracy, precision, and considerations that guarantee sosilogis sense of justice was also considered. SPDP stipulated in Article 109 paragraph (1) Criminal Code, namely: "In the event that investigators have begun an investigation of an event that is a crime, investigators notify the public prosecutor". Period setting SPDP not support fast principle in the criminal justice system in Indonesia. SPDP time period setting is not firm and does not provide legal certainty to cause adverse effects in law enforcement. The purpose of this thesis are: First, to determine whether the arrangement period of submission of the notification the commencement of an investigation by the investigator to the prosecutor's office has supported the principle of fast in the criminal justice system of Indonesia, the Second, to determine the ideal setting of the period for the submission of the notification the commencement of an investigation by investigators to the prosecutor. This research is a normative legal research or can be also called the doctrinal legal research. From the research problem there are two main things that concluded, first, setting a period of submission of SPDP by the investigator to the prosecutor stipulated in Article 109 paragraph (1) Criminal Procedure Code does not yet support fast principle in the criminal justice system in Indonesia. Abstract

Reconsideration is one of extraordinary law efforts, based Article 263 paragraph (1) Criminal Procedure Code states that only the convicted person or his heirs can submit a reconsideration. Fundamental philosophy of this states based on that country has miscarriage justice the civils who doesn’t to be sinful and can’t repaired by the ordinary law efforts. But, in criminal justice practices, remedy reconsideration may be filed by the public prosecutor. The purpose of this study, to determine the urgency of the committee reconsideration in Indonesia, to determine the meaning of fundamental philosofi in Article 263 Criminal Procedure Code to give emphasis that only the convicted person or his heirs can submit a reconsideration, to determine the Rights of the public prosecutor asking reconsideration the decision of the judge who already have permanent legal force in positive law’s Indonesia. This type of research is a normative legal research or can referred to as the doctrinal legal research. The results of this research is, The urgency of the committee reconsideration for enforced law to reach a justice for the convicted person or his heirs toward a decision of the judge who already have permanent legal as one of efforts can be able to endure by the convicted person or his heirs can submit a reconsideration, Article 263 paragraph (1) Criminal Procedure Code to give emphasis that only the convicted person or his heirs can submit a reconsideration as redeeming the contry sinful to the convict, the Rights of the public prosecutor asking reconsideration in positive law’s Indonesia there’s no a regulation about it and there’s no a prohibition to do that.Keywords : Reconsideration-Public Prosecutor-Criminal Justice System

Abstract

The Government of Indonesia and Malaysia made an International treaty in the form of a Memorandum of Understanding (MoU) on Domestic Workers or about the recruitment and placement of Indonesian migrant Workers (TKI), especially domestic helpers (Housemaid) or so-called female workers informal sector in Malaysia in 2006 applicable 5 years. In practice, in 2009 Indonesia suspend implementation of the agreement to a moratorium on sending migrant workers to Malaysia for reasons of torture cases migrant workers in Malaysia. Furthermore, the MoU was amended in 2011 to change some settings on legal protection for migrant workers in Malaysia. As known in international law which applies the principle of pacta sunt servanda, where the agreement was binding and enforceable as a law for the parties.The problems posed in this paper is about the termination of the MoU Indonesia and Malaysia in point of view of the Vienna Convention 1969 and Indonesian Act No. 24 of 2000 about International Treaties, legal protection for workers contained in the MoU, and legal protection for workers after the expiry of the MoU. This research is a normative study, which examines the legal principle.From this research, it can be seen a few things. First, that the expiry of the MoU and amendment procedures are actually the MoU is in conformity with the agreement of the parties as to which is set also in the Vienna Convention of 1969 and Indonesian Act No. 24 of 2000 on International Treaties. Second, the legal protection for workers contained in the MoU is weak, because the MoU is set to a technical recruitment and placement of migrant workers and not paying attention more specifically on the protection of Indonesian migrant workers in Malaysia. Third, after the amendment of the MoU there are some changes for the better, but still not able to reach better legal protection for Indonesian domestic workers.Keywords: termination of the agreement, MoU, Indonesian Workers Protection Law.

Abstract

The Republic of Indonesia is a constitutional state, where all actions and behavior mustbe based on law. Muslims in Indonesia often face problems due to technological advancesand times that require legal certainty in accordance with Islamic law. In order to deal withthis problem, the Indonesian Ulema Council as an institution engaged in the field of religionas well as a government partner provides answers through fatwas. Fatwas in positive lawoccupy a position as a source of law and cannot be enforced. Therefore, fatwas must betransformed into positive law.This type of research is normative research, where this research uses a researchmethodology of the legal principles that exist in the formation of legislation, namely theprinciple of openness and the principle of legal certainty. The data source used wassecondary data, with the literature review method, after the data was collected then analyzedto draw conclusions.From the research results, it is concluded that, First, the Indonesian Ulema Council isnot a state institution, it is in the infrastructure element (the socio political sphere), moreprecisely non-governmental organizations (NGOs). Second, the contribution of the MUI fatwain the formation of positive law in Indonesia is quite influential, this can be seen by the birthof various kinds of laws and regulations whose source comes from the MUI fatwa itself,considering the MUI fatwa in Islamic law as a source of law and in positive law in Indonesiacan be categorized as a source of law in the form of legal or religious doctrine / opinion.Keywords: Positive Law - Fatwa - Indonesian Ulema Council

Abstract

The decision of Rengat District Court No. 192/Pid.B/2015/PN.Rgt does not fully comply with the pro-visions of the Criminal Event Law (KUHAP) especially Article 197 paragraph (1) letter k, and will certainly cause legal consequences. The purpose of writing this thesis: first, to know the legal certain-ty of convicts who have been convicted without amar restraining orders in Verdict No. 192/Pid.B/2015/PN.Rgt). Second, to find out the legal consequences of a verdict against a convicted felon without amar restraining order in Verdict No. 192/Pid.B/2015/PN.Rgt).The type of research used in this legal research is normative juridical method. Therefore in this research the data analysis used is qualitative analysis. In drawing conclusions the author uses deduc-tive thinking methods that are ways of thinking that draw conclusions from a statement or evidence that is general in nature into a statement of a special nature.From the results of the study, there are two main things that can be concluded. First, the legal certainty of convicts who have been convicted without amar restraining orders in the verdict No. 192/Pid.B/2015/PN.Rgt is actually not met, because the convicted who has in fact been convicted re-mains outside or still in a free state so that there is no guarantee of justice or legal certainty in the verdict. Verdict No. 192/Pid.B/2015/PN.Rgt does not contain Article 197 paragraph (1) letter k of the Criminal Code (KUHAP) does not provide legal certainty, so the purpose of the law itself is not achieved because the true criminal law is legalistic. Second, as a result of the law of the verdict that does not include Article 197 paragraph (1) letter k of the Criminal Event Law (KUHAP) as the verdict of case No. 192/Pid.B/2015/PN.Rgt) among others: By itself the verdict is null and void, any verdict that is null and void is an invalid verdict and was originally considered to have never existed, Such a verdict is not binding so that the verdict is not attached to the executive force (non-executive), if the public prosecutor executes it means that the act is arbitrary and unconstitutional and violates human rights because it is contrary to Article 28D paragraph (1) and Article 28J of the Constitution of the Republic of Indonesia as well as Article 17 and Article 34 of Law No. 39 of 1999 on human rights.Keywords : Restraining Order – Article 197 of the Criminal Code – Legal Certainty
