Abstract

This research is related to the Juridical Review of the vote of no confidence in the chairman of the Pekanbaru City House of Representatives by its members which was reviewed based on the laws and regulations in Indonesia. The vote of no confidence is one of the efforts used to overthrow the government in parliamentary countries. While Indonesia is a country whose form of government is presidential, it needs to be studied stimulantly. First, how is the mechanism for replacing the chairman of the Pekanbaru City People's Representative Council based on laws and regulations, Second, the implications of a motion of no confidence in the chairman of the Pekanbaru People's Representative Council based on laws and regulations. This research is a sociological legal research, because it is based on field research, namely by collecting data from observations, interviews and literature reviews that are related to the problems studied, assisted by primary, secondary and tertiary data. This study uses quantitative analysis, produces descriptive data and  From the results of this study, it was concluded that,, the First mechanism for replacing the chairman of the Pekanbaru City House of Representatives based on laws and regulations does not regulate through a vote of no confidence. Reimbursement can only be made through the DPRD honorary body after the honorary body has investigated, verified and clarified the complaint. Abstract

Journalists in areas of international armed conflict play an important role, namely to convey information to the world about events that occur in conflict directly from the scene.But in carrying out their work, journalists and media workers conducting coverage in areas of international armed conflict often face a variety of dangerous risks.They can be victims in military attacks or other acts of violence.This thesis will discuss the protection given to journalists in international armed conflicts based on International Humanitarian Law and its application.Journalists who are in the area of international armed conflict obtain protection as civilians as stipulated in Article 4 (A) paragraph (4) Geneva Convention III 1949 and Article 79 Additional Protocol I 1977.This research is normative juridical research.Namely the research carried out on the principles of law starting from certain fields of legal governance, by first identifying the rules of law that have been formulated in certain laws.In this study, the data sources used were secondary data with primary, secondary and tertiary legal materials carried out by means of library research.From the results of the study it was found that journalists who were in areas of armed conflict were considered as civilians and enjoyed protection that was generally accepted by civilians, as stated in article 4 (A) paragraph (4) III Geneva Conventions 1949 and Article 79 Additional Protocol I 1977. Protection of safety for journalists who carry out their duties at home and abroad, is the responsibility of the country where the journalist originates and the country where the journalist is located.Keywords: Journalists, International Armed Conflict, State Responsibility

Abstract

Indonesia meratifikasi Protokol Kyoto dengan Undang-Undang Nomor 17 Tahun 2004 sehingga Indonesia dapat berpartisipasi melalui salah satu mekanisme Protokol Kyoto yaitu Clean Development Mechanism (CDM). Salah satu mekanisme penurunan emisi di dalam CDM adalah Reducing Emission from Deforestation and Forest Degradation (REDD+)dimana negara-negara berkembang dapat berpartisipasi dalam upaya pengurangan emisi karbon dioksida (CO2) di sektor kehutanan, dengan cara menanam hutan, mencegah deforestasi dan mengelola hutan dan sebagai imbalannya negara berkembang mendapat bantuan dan kompensasi keuangan dengan memperdagangkan kredit karbon yang diproleh. Pemerintah Indonesia kemudian mengeluarkan Peraturan Menteri Kehutanan Nomor 30 tahun 2009 tentang Tata Cara Pengurangan Emisi dari Deforestasi dan Degradasi Hutan. Deforestasi dan degradasi hutan menyumbang sekitar 17% dari total emisi global. Indonesia sebagai negara pemilik hutan tropis terbesar ketiga di dunia melalui mekanisme REDD+.memiliki peran yang sangat penting untuk memitigasi perubahan iklim.Jenis penelitian ini dapat digolongkan dalam jenis penetilian yuridis normatif, karena penelitian ini dilakukan dengan cara meneliti bahan pustaka atau data sekunder, sehingga dapat dinamakan penelitian hukum normatif atau penelitian hukum kepustakaan.Dari hasil penelitian masalah ada dua hal pokok yang dapat disimpulkan, Pertama, pengaturan REDD+ telah mempengaruhi kebijakan mitigasi perubahan iklim di Indonesia namun belum memberikan pengaruh yang signifikan terhadap pengurangan emisi gas rumah kaca. Kedua, yang menjadi faktor penghambat pelaksanaan REDD+ adalah terjadinya bencana alam El Nino yang menyebabkan kebakaran hutan, permasalahan tenurial, desakan pembangunan ekonomi dan korupsi. Sedangkan, faktor pendukung pelaksanaan REDD+ adalah besarnya potensi yang disediakan hutan Indonesia, banyaknya dana internasional yang diperuntukkan untuk REDD+ dan ditetapkannya kebijakan moratorium hutan. Pemerintah Indonesia harus lebih serius dalam menanggapi perubahan iklim. Peraturan REDD+ harus dibuat secara jelas dan sejalan dengan peraturan terkait serta harus adanya tranparansi terhadap pengaliran dana yang diproleh dari proyek REDD+.Kata Kunci: Perubahan Iklim-Mitigasi-REDD

Abstract

The law always exists in every society. In the Limo Koto Kenegarian Region, Rumbio Jaya District, the community still uses their customary law in resolving criminal acts or crimes, especially crimes in the theft of jungle timber / customary forest prohibitions. The purpose of this thesis writer is: First, how is the application of sanctions against the perpetrators of illegal logging of forest timber in Nagari Limo Koto, Rumbio Jaya District. Second, what is the position and constraints of customary law on law enforcement and how is the practice in Nagari Limo Koto, Rumbio Jaya District. This type of research uses direct sociological research methods at the location or place to be studied. This research was conducted in Kanagarian Limo Koto, Rumbio Jaya District, Kampar Regency, Riau Province. While the population and sample are all parties related to the problems examined in this research, the data sources used are primary data, secondary data and tertiary data, the technique of data collection in this study is by interview and document study. Conclusion that the existence of the imposition of sanctions against perpetrators of illegal logging / forest prohibition of customary laws such as social sanctions and criminal fines in terms of practice in the field has begun to fade and the lack of supervision of the forest / jungle ban until now, people are still taking wood silently and stout motive or method used by the perpetrator. Abstract

Electricity is the object of the transaction for the installation of the installation which contains a large enough risk. In the installation of electrical installations from PLN, an agreement must be made between the electricity customer and the company. This incident creates a relationship between the two people which is called an engagement. However, in reality there are still many accomplishments that have not been carried out, causing default. For example, the problem in Kepenghuluan Village, Rokan Hilir Regency, where their right to get an electricity installation until it turns on is not fulfilled because of the negligence of the company, namely PT. RTU that causes default.The purpose of this research is to find out about the implementation of cooperation as well as the rights and obligations of PT.RTU and the community as parties that bind themselves to the agreement, to find out the obstacles in implementing the agreement and to find out how to solve them that arise in the agreement process. The type of legal research the writer uses is sociological research. This sociological legal research is a type of research that is viewed from the purpose of legal research. Sociological or empirical legal research consists of legal identification (unwritten) and research on the effectiveness of the lawIn the results of research and discussion there are 3 main problems that can be concluded. First, the party that binds itself to the agreement has rights and obligations that must be fulfilled, namely the first party as the people of Kepenghuluam Village has the right to get an electricity installation until it turns on, and the second party who has the obligation to complete the work of installing electrical installations in Kepenghuluan Village to electricity in the village can light up. Abstract

So far, both food products in the form of raw and ready-to-eat ingredients and drinks with a varietyof flavors and colors have been circulating widely on the market. The number of circulating productsrequires strong control from the government and related parties to ensure that food products on the marketmeet the proper standards and labeled halal for consumption. Therefore, consumers have the right to getinformation about the product content, ingredients made and halal products. will be consumed.This type of research can be classified in the type of sociological (empirical) legal research, becausein this study the authors directly conduct research at the location or place of study in order to provide acomplete and clear picture of the problem under study. This research was conducted research in PekanbaruCity. The reason the author chose the research location in Pekanbaru is because there are still manybusiness actors who have not included a halal label on the goods being traded. While the population andsample are the Chairperson of the Indonesian Ulema Council (MUI) of Riau Province, PekanbaruBreadtalk Employees and Pekanbaru Breadtalk Consumers. Data sources used are primary data andsecondary data. Data collection techniques in this study were interviews, questionnaires, and literaturereview.The conclusions that can be obtained from the results of the study are: First, the factors underlyingthe producers who do not carry out halal certification of their products in the city of Pekanbaru consist ofignorance and lack of understanding of business actors regarding the existence of Law Number 33 of 2014concerning Halal Product Guarantee, Actors Businesses Not Knowing the Procedures for Registering HalalCertification, Businesses that are Goed by Business Actors are still on a Small Business scale, Businessactors assume that the raw materials used in products are Halal, business actors or producers are dishonestand commit fraud or fraud to consumers and the level of public knowledge about halal label food productsis still low. Second, legal protection for consumers of products that do not have halal certification in the cityof Pekanbaru is not yet maximally implemented. This is indicated by the fact that there are still manyproducts that do not yet have certification and have not been labeled as halal. Abstract

Dispute resolution is expected not only to win or lose but to try to reach an agreement between the parties in dispute with consensus and win-win solution This article describes how the settlement of disputes that occur in the Kerinci customary law community in the Regency Kerinci, Jambi Province. Writing this article is taken from the results of research with this type of research conducted with the type of research to be used is sociological juridical (empirical legal research) that is empirical studies to find theories about the process of occurrence and about the process of working of law in society. Efforts to resolve disputes through mediation certainly do not always succeed in achieving peace between the disputing parties. The problem that often occurs in the Kerinci customary law community is the problem of managing the shifting paddy land instead of the Kerinci customary law community which is a typical inheritance system belonging to the Kerinci indigenous people. Settlement of disputes in Kerinci customary law has 4 levels, namely kitchen institutions, institutions, traditional institutions and natural institutions. The dispute resolution process began in stages starting from Tengganai to Depati. The purpose of writing this thesis is first To find out the management system of the shifting paddy field system in the Kerinci customary law community, second To find out the settlement of the dispute from the rotating paddy field using Kerinci customary law in the Kerinci customary law community and third As a brainstorm of the writer's thoughts on the alma mater in adding khasanah civil law and customary law relating to the resolution of the rotating paddy field dispute in the Kerinci customary law community.Keywords: Indigenous Institutions, Legal, Dispute Resolution

Abstract— Covid-19 pandemic in 2020 is a prove that pandemic is something that continues in human history, start from the black death, cholera, and Spain flu. Those out�breaks had been classified as pandemic through any decision in the past and became a regulation that has affected international law development. Through qualitative method, these research-based paper, using seconder historical data founds that the response of the state that affected by pandemic required state to make sanitation regulation, conducted a quarantine and other related methods in control and prevention that applied to interna�tional scope aimed not to effect international traffic and trade. Those all had become a base to regulate the global public health law in controlling and preventing diseases as a form of preparedness of the global community to face another event that might be pandem�ic in the future. Abstract

The number of people who are still dependent on public transportation, the need for transportation will increasingly increase, causing more complex transportation problems, such transportation problems include transportation route licenses and regulations for these types of transportation modes are not matched by the provision of adequate public transportation, especially in terms of transportation capacity, not even a few of the public transport companies make these vehicles as service transportation and delivery of goods.This study uses a sociological juridical research method. This research was conducted in the city of Pekanbaru by taking data through interviews with PT Ayah Ibu Transport and also users of the transportation service. The collected data is analyzed qualitatively and deductive conclusions are drawn, that is, drawing conclusions from general to specific.The results of this study indicate that: First, the responsibilities of PT. Ayah Ibu Transport to the transport of goods using human transportation should have been able to be carried out by PT. Ayah Ibu Transport, because a civil engagement was born between the Bus Driver and also the owner of the goods. Unlawful Actions Bus Drivers who cause loss to the owner of the goods must be accounted for by PT Ayah Ibu Transport based on Article 1365 Civil Code, Article 193 Law No. 22 of 2009 concerning Traffic and Public Transportation and Article 19 of Law Number 8 of 1998 concerning Consumer Protection. Second, the factors that cause people to use passenger transportation services to send safekeeping goods are due to 3 (three) things, which are practical, cheaper costs and faster goods arrive. As for the advice of the author, first, To PT Ayah Ibu Transport to take control measures to the drivers who are responsible for driving the bus, so that safekeeping of goods alongside the road can no longer be done. Secondly, PT. Ladies and Gentlemen in order to use the services of PT. Abstract

The increase in the number of traffic accidents from year to year showsthat there is a lack of public awareness about the culture of orderly driving.. Oneof the traffic infrastructure that often causes traffic accidents is the speed limitingdevice or the name of the road embankment or road safety embankment. Theprovisions for the installation of “speed limiting devices” on public roads arealready listed in Article 25 paragraph 1 Letter e Law Number 22 Year 2009. Thepurpose of writing this thesis, namely: First, to determine law enforcementagainst the perpetrators of making speed limiting devices that are not inaccordance with the Law on Traffic and Road Transportation. Second, to find outthe constraints of law enforcement against the perpetrators of makinginappropriate speed limiting devices. Third, to find out the efforts against theperpetrators of making inappropriate speed limiting devices. This type of research can be classified in this type of sociological juridicalresearch, because this research author directly conduct research on the locationsor places studied in order to give a complete and clear picture of the issuesexamined. This research was conducted at the Kandis District, whereas thesample population is a whole party with regard to the issues examined in thisstudy, the data source used, primary data, secondary data and data tertiary,technical data collectors in this study with interviews and literature study.From the results of research and discussion it can be concluded that,First, law enforcement against perpetrators of speed limiting devices that are notin accordance with Law Number 22 of 2009 in Kandis District, Siak Regency stillnot seriously done. Second, constraints in law enforcement due to a lack ofcounseling from the police, lack of cooperation between related parties, and nocomplaints from the public. Third, efforts made by law enforcers includecoordinating with related parties, checking the shop, after which the speed limiteris dismantled, and conducting counseling. prosecutors, conducting training andeducation on diversion and seeking good cooperation between institutions.Keywords: Law Enforcement – Speed Bump - Traffic
