Abstract

Consumer protection is an integral part of sound business activities. In ahealthy business activity there is a balance of legal protection between consumersand producers. The absence of balanced protection leaves consumers in a weakposition. Moreover, if the product produced by the producer is a limited type ofproduct, the producer can abuse his monopolistic position.This type of research can be classified in the type of normative legalresearch, which discloses laws and regulations relating to legal theories that arethe object of research. The approach taken is using a qualitative analysisapproach by searching for data in books, journals and other scientific worksrelated to this research. The data sources used are primary and secondary legalmaterials.The conclusions that can be obtained from the results of the study areFirst, the legal consequences of differences in the writing of information onsubstances contained in SMS bottled water products with products sold by PT.Agrimitra Utama Persada, a producer of SMS bottled water, has an impact onconsumer health due to dishonesty by business actors and is contrary to Article 4Numbers 1 and 3, Article 8 Paragraph 1 letters d and f of Law Number 8 of 1999concerning Consumer Protection. Second, the responsibility of PT. AgrimitraUtama Persada against consumers who are harmed due to differences in thewriting of substance descriptions in the sms drink labels are fully responsible forthese claims. If the label attached to the packaging of the product being tradeddoes not match the truth or is misleading, it can be subject to sanctions as statedin the Consumer Protection Law Article 62 paragraph (1).Keywords: Consumer Protection, Bottled Water, Consumer Rights, LegalConsequences, Liability.

Abstract

The Criminal Code Drafting Team made an effort to renew the offense of similar sexual relations , namely regarding obscene perpetrators who are of the same age as other people of the same sex who are known to be not old enough as stipulated in positive law in the 2017 Penal Code Draft Article 495 Paragraph (1) includes namely providing age limit, and an increase in criminal sanctions, which were originally sentenced to five years imprisonment in Article 292 of the Criminal Code to a maximum of 9 years. In addition to giving rise to pros and cons, this is exacerbated by the protracted discussion of the RKUHP, which has not yet been approved, since 1963 until the idea of criminal law policy arises in the criminalization of similar relations in article 292 of the Criminal Code for conducted a judicial review by the Court Constitution but precisely rejected the lawsuit on the grounds that as tested by the applicant is not the authority of Court Constitution as negative legislato r . The impact of these types of sexual acts can damage the moral values and religious rallies that exist in Indonesian society based on almighty divinity, so that these actions will gradually become legalized because there are no legal rules in positive Indonesian law and be a threat to national identity, meanwhile there are a number of countries which can regulate criminal sanctions against similar sexual relations , such as Malaysia and Nigeria. The purpose of writing this thesis, namely; First, to find out the urgency of criminal law policies in the criminalization of similar sexual relations in Indonesia . Second, to find out the criminal law policy towards similar sexual relations in Indonesia .This type of research used in this legal research is the normative juridical method , this research is descriptive, which is a study that aims to make a clear and detailed description of the problem . Data sources used secondary data and tertiary legal materials . Techniques of collecting data in this study with the methods of literature study after the data is collected and analyzed to be drawn kesimpulan.Dari results of research and discussion can be concluded that the U rgensi criminal law policy in criminalizing same-sex relations in Indonesia , because it has a lot of unrest in the community reap Indonesia, uphold eastern customs .. Abstract

As a developing country, Indonesia is a country that has the fourth largest population in the world. With this large population, Indonesia must be more careful in the distribution of grants and social assistance so that there are no errors in the distributionin accordance with Riau Governor Regulation Number 35 of 2017 concerning Guidelines for Grants and Social Assistance Expenditures Sourced from Regional Revenue and Expenditure Budgets.This type of research can be classified as sociological juridical, namely a research approach related to the legal aspects of the subject matter to be discussed, with the reality on the ground. This research was conducted at the Social Service of Siak Regency, while the sample population was all parties related to the problem under study. Sources of data used are primary data and secondary data, data collection techniques in this study is by observation, questionnaires, interviews and literature review.In the results of the research problem there are three main things that can be concluded. First, the implementation of the distribution of grant funds in Siak Regency is classified as safe. The second implementation of the distribution of grant funds in Siak Regency is in accordance with Riau Governor Regulation No. 35 of 2017. The three administrative law enforcement efforts are to focus on recovering state or regional losses, in the case of determining the payment of replacement money in the form of money.Keywords : Implementation – Distribution – Bequest – Social Assistance

Abstract

Land is an important element of the formation of the State, in achieving the goals of the State, government intervention is needed, but the cultural diversity of each region is one of the obstacles to the implementation of national law, pawning land is one of the land transactions that still exists and is the needs of Indonesian indigenous peoples including customary law Minangkabau. Where transactions are carried out by Minangkabau indigenous people especially in Kanagarian Koto Tinggi, Agam Regency where many transactions have taken place for decades without any time limit, either orally or in writing.The purpose of this research is to find out how the implementation of the existing pawn apprenticeships in Koto Tinggi Kanagarian and what are the legal consequences of the implementation of the pawn apprenticeship. This type of research is sociological juridical, analytic descriptive research. The research location was Kanagarian Koto Tinggi, Baso Subdistrict, Agam Regency, West Sumatra Province. Data sources used, primary data, secondary data and tertiary data. Data collection techniques with interviews and literature review.From the results of this study, it was concluded that, first, the pawning process in Koto Tinggi Kanagarian began with the agreement of families and people who would pawn the fields and the implementation did not use a time limit. Second, it has been going on for decades ago redemption is based on the price of gold at the time of redemption so that debtors are unable to cut down especially the middle to lower class because the price of gold has gradually increased in price. The author's suggestion is, first, the Government of Agam Regency, West Sumatra Province in general, make a written rule regarding the implementation of pawning apprenticeships, so that with this regulation facilitate the implementation of pawning apprenticeships by the Minangkabau community and mutual benefit between the parties. Second, the Government must be able to socialize, so that the purpose of Article 7 of Law No. 56 of 1960 concerning the Determination of Agricultural Land Area can be achieved.Keywords: Pawn Merchants - Customary Law - In Minangkabau

Abstract

In Law Number 20 Year 2001 states that the phrase or other person or a corporation in Article 2 paragraph (1) and Article 3 of the Corruption Act, is very detrimental and / or potentially detrimental to the applicant, who in carrying out their duties and His authority in government positions in regional government, cannot avoid the act of issuing decisions, especially in terms of determining the implementation of government projects, certainly benefits others or a corporation. There is no individual or corporation that is willing to carry out what government project work if it does not bring profit to him, because they are entrepreneurs who work for profit. This research is limited to two problem formulations, First, How is the juridical analysis of the use of the phrase "another person or a corporation" that harms one party based on the decision of the Constitutional Court Number 25 / PUU-XIV / 2016 concerning Corruption Crimes ?, and Second, What are the legal consequences the application of the phrase "Another person or a corporation" in the Corruption case in Indonesia ?.This type of research can be classified in normative juridical research, because this research was conducted by examining secondary data and approaches to the law, this normative study examines the principles of legality principle. Source of data used are primary data, secondary data, tertiary data, data collection techniques in this study are normative juridical, the data used is literature study.From the results of the study it can be concluded, First, that the phrase "or another person or a corporation" in article 2 paragraph (1) and article 3 of the Corruption Crime Act contains ambiguous, vague and uncertain meanings, because it will encompass all intentional, unintentional or even acts that begin with good intentions. Second, that in court practice, there is no common understanding between law enforcers regarding the two articles. Not infrequently in a case, there is a difference between one law enforcement institution and another law enforcement institution. The author then gives a suggestion, First, That the phrase "or another person or a corporation" in article 2 paragraph (1) and article 3 should be deleted, revised or amended to emphasize a legislation so as not to cause multiple interpretations. Secondly, law enforcement officials must understand an act whether entering corruption criminal sanctions or administrative or civil tensions. What if there is an administrative error of the policy taken enough to do administrative improvements or administrative measures, not criminal.

Abstract

The abundance of marine biological resources and the position that borders directly with other countries with the North Natuna Sea has resulted in many foreign fishing vessels violating the provisions by utilizing biological resources without the permission of the Indonesian state. This study regarding the provisions regarding the utilization of Indonesia's fishery biological resources in the waters of the Exclusive Economic Zone in the North Natuna Sea aims to find out the provisions that are violated and the efforts made in overcoming and reducing the number of fisheries violations.This type of research can be classified in the type of sociological research, because in this study the authors directly conduct research at the location or place of study in order to provide a complete and clear picture of the problem under study. This research was conducted in the West Maritime Zone Bakamla, Lantamal IV Tanjung Pinang, PSDKP Batam, the Marine and Fisheries Service of the Riau Islands Province and the POLDA Dipolairud Riau Islands, while the population and sample are all parties related to the problems examined in this study, the source of the data used, primary data, secondary data, and tertiary data, data collection techniques in this study with observation and interviews.From the results of the study as follows: the provisions violated 182 foreign fishing vessels in the North Natuna Sea in the 2016-2018 period were fishing without permits, the use of prohibited fishing gear, containing protected fish. Whereas the efforts to impose strict sanctions in the form of confiscation, fines or destruction of evidence, establish cooperation with fishermen, monitoring through MSC (Monitoring, Control and Surveillance), officers conduct routine patrol and the government adopts or international regulations. While the obstacles include the lack of fleets and patrol support facilities and the small number of Fisheries PPNS that cannot cover the vast North Natuna Sea.Keywords: EEZ, Biodiversity Resources, Fisheries, Violations, UNCLOS, Foreign Fishing Vessels

Abstract

Registering a trademark is very important for entrepreneurs today. Trademarks include company names and logos, names and symbols of certain products from companies and company slogans. As you know, there are still many digital startups that have not registered their trademarks. In fact, the existence of IPR certificates is considered quite important to protect its business from piracy, imitation or other problems and when there are investors who are interested in working together. Where IPR in general or trademark specifically is the foundation of a digital startup company Regulations related to brands are regulated in Law Number 20 Year 2016 Regarding Trademarks and Geographical Indications. Even though the various phenomena present show the enormous potential of the creative economy, it turns out that there are not many startups who consider IC to be an important issue, which is the problem at hand.The purpose of this thesis is; First, legal protection of trademark rights at digital startup companies that do not register trademarks in Bandung. Second, barriers faced against trademark rights in digital startup companies that do not register trademarks, Third, solutions or efforts made by the Creative Economy Agency. This type of research is sociological juridical research, which is research that emphasizes the legal aspects of the subject matter to be discussed, related to the reality in the field.From the results of research and discussion, there are three main things that can be concluded, First, legal protection of the rights to trademarks in digital startup companies that do not register trademarks can be done, based on the provisions of Article 21 paragraphs (1) letters b and c which contain the application refusal registration and be strengthened by Article 76 regarding the claim for cancellation of the mark. Second, the obstacles faced by digital startups in trademark registration are the lack of knowledge and understanding of the importance of IP protection, the lack of understanding of IP by the organizers and the Time Management related to trademark registration. Third, solutions or efforts made by Bekraf to increase awareness of digital startup companies on trademark registration by holding programs such as Facilitation of IPR registration, IPR protection seminars for ecraf products and IPR socialization etc.Keywords : Trademark, Startup Digital,Trademark Registrasion.

Abstract

Reproduction and distribution of books without the permission of the copyright holder is a violation of law 28 of 2014. Copyright consists of economic rights and moral rights. Economic rights are rights to obtain economic benefits from creations and related rights products. Moral rights are rights inherent in the creator or actor that cannot be removed or deleted without any reason, even though the Copyright or Related Rights have been transferred. The purpose of writing this thesis: first, to find out how the legal position of the parties in a copyright license without a written agreement according to the copyright law Second, to find out what are the efforts to resolve problems between the creator of the copyright holder and the third party who reproduces the Riau Malay Culture Book without permission in the Prefective Law Number 28 of 2014 concerning Copyright The research that the author conducted is included in the type of normative juridical research which means finding the truth of the coherence of how the law operates in society. If viewed from the nature of this research is descriptive.          The author's suggestion in this study is to suggest that an agreement be made between the copyright holder and the publisher either orally or in writing so as to provide legal force that binds the copyright agreement. As the copyright holder has exclusive rights to the results of his creation (books) if not done the agreement, the legal consequences of granting a copyright license without a written agreement, the agreement is null and void, Suggest that the case be resolved in a commercial court because copyright prohibition is a prohibition that is included in the violation of intellectual property rights in the form of a book Keywords: Copyright, -Agreement

Abstract

Bagi pelaku usaha mikro kecil dan menengah (UMKM) untuk memulai usahanya perlu memikirkan perlindungan Hak Kekayaan Intelektual (selanjutnya disebut HKI). Jikalau, para pelaku usaha mikro kecil dan menengah (UMKM) tidak memikirkan perlindungan HKI, maka karya para pelaku usaha dapat mudah terjadi pelanggaran HKI. Oleh karena itu, pada masa awal memulai bisnisnya, mereka seharusnya sudah memberikan perlindungan HKI-nya, sebab HKI sejatinya dapat menjadi aset berharga yang bisa menyelamatkan perusahaan di masamasa sulit. HKI sejatinya adalah hak yang muncul dari hasil oleh pikir atau kreasi manusia yang pada akhirnya menghasilkan suatu produk atau proses yang berguna bagi manusia. Dalam dunia bisnis, HKI bisa menjadi elemen penting karena dapat memberikan keunggulan berkompetisi ketika bermain di pasar yang dibidik bagi pemiliknya. Bahkan, tak menutup kemungkinan pula HKI ini dapat menjadi pemicu untuk memunculkan berbagai inovasi baru bagi pelaku usaha mikro kecil dan menengah (UMKM) yang pada akhirnya dapat menguntungkan publik juga para pelaku usaha itu sendiri, misalnya dalam menghadapi perdagangan bebas ASEAN. Tujuan dilaksanakan kegiatan pengabdian masyarakat ini adalah sosialisasi aspek HKI bagi para pelaku UMKM di Kabupaten Kampar. Metode penerapan yang dipilih adalah sosialisasi atau desiminasi ilmu pengetahuan, dalam hal ini adalah penyebaran informasi tentang HKI dan tata cara pendaftaran HKI. Dari kegiatan pengabdian ini, pelaku usaha UMKM di Kabupaten Kampar menyadari penting aspek HKI untuk kemajuan usaha.

Abstract

The creation of musical creation has the right to perform his creation in public including in any way and process the communication of his performance. For example, the copyright of a song may give birth to the related rights in the form of Performer's Rights if the creator gives permission to the artist to perform (to perform) the song in question, both in a Live Show and in the form of recording work. The type of research used is normative juridical. Until 2021, Performing Rights is still a thorny issue in the Indonesian music industry so one of the steps taken by the government is to issue Government Regulation No. 56 of 2021 on The Management of Song and/or Music Copyright Royalties.
