Abstract

Introduction: Performing rights are rights attached to copyright as an integral part of the creation of a work. In the context of copyrights to songs or music, performing rights relate to the need to pay royalties to songwriters or music for attempts to use songs or music commercially.Purposes of the Research: Implications of performing rights for café singers to continue paying royalties based on statutory regulations and how the performing rights orientation for café singers is ideal in ensuring justice for songwriters or music as well as for café singers.Methods of the Research: Normative legal research with a concept and statutory approach.Results of the Research: The implications of performing rights for café singers to continue paying royalties based on statutory regulations, namely that there is no legal certainty for café singers because there is no specific regulation governing them. The performing rights orientation for café singers is ideal in ensuring justice, namely by excluding royalty payments for café singers because the commercialization impact received by café singers is not large and only sufficient to make ends meet.

Abstract

The urgency of this research is an effort to examine geographic indications (IG) in the perspective of legal globalization. This study aims to analyze the nature of communal ownership rights in GIs and the existence of GI communal ownership rights in the perspective of legal globalization. This research is a normative legal research with a concept and statutory approach. The results of the study show that the nature of communal ownership rights in GIs has its own characteristics that are different from other intellectual property rights. The nature of communal ownership rights in GI is a construction on the conception of ownership rights which are not only owned individually, but also include communal ownership. The essence of communal ownership rights in GIs has not actually received specific arrangements in various international rules and conventions. The existence of IG communal ownership rights in the perspective of legal globalization is actually still weak and needs to be strengthened. This strengthening is necessary to emphasize the style and characteristics of GI as intellectual property rights with special characteristics. This can be done by revising various international provisions governing GI as well as revising national rules that discuss GI where revisions are made to emphasize the characteristics of GI as separate intellectual property rights which are different from trademark rights and have special characteristics in the form of intellectual property rights. communal ownership. Abstract

The development of the idea of ​​intellectual property has become a separate debate related to countries in the Global South and countries in the Global North. Global South and Global North are concepts used to distinguish between developed and developing countries in social, economic, and political contexts. This study aims to analyze the views of utilitarianism versus communalism in understanding intellectual property rights in Global North and Global South countries. This study is a normative legal study that prioritizes conceptual, historical, and philosophical approaches. The results of the study confirm that the differences in views between Global North and Global South countries on intellectual property reflect global economic and political inequality. Global North countries support strict intellectual property protection to maintain their economic and technological dominance, while Global South countries want a more flexible system to ensure fair access to technology, medicines, and protection of traditional knowledge. Global North countries see IP protection as a driver of innovation and economic growth, based on the theory of utilitarianism, while Global South countries prioritize the principle of communalism to ensure fair access to technology and knowledge. To achieve balance, inclusive policies, international cooperation in research and development, and integration of communal values ​​in IP policies are needed, in order to create social justice and redistribution of global wealth

Abstract

 This legal research aims to examine the existence of Constitutional Court Decision No. 91/PUU-XVIII/2020 from utilitarian philosophy while paying attention to the concept of utilitarianism in Constitutional Court Decision No. 91/PUU-XVIII/2020. The urgency of this research stems from the controversy over the birth of the Job Creation Law which continues after the Constitutional Court Decision No. 91/PUU-XVIII/2020. The 'conditionally unconstitutional' decision on the Job Creation Law provides intellectual property from legal scholars; Remember, several points of view examine the problem. This legal research uses an approach and approaches to laws and regulations based on primary legal materials, secondary legal materials, and non-legal materials. The study results stated that the decision of the Constitutional Court no. 91/PUU-XVIII/2020 has the spirit of the utilitarian philosophy, which aims to maintain the proportionality aspect and provide guarantees for implementing the Implementing Regulations of the Job Creation Law. On the other hand, the spirit of utilitarianism in the Constitutional Court Decision No. 91/PUU-XVIII/2020 explains social issues by transforming a legal instrument of sequence from the issuance of the Job Creation Law.Penelitian hukum ini bertujuan untuk mengkaji keberadaan Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 dalam perspektif filsafat utilitarianisme; sekaligus menelaah berkenaan dengan implikasi dari adanya konsepsi utilitarianisme dalam Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Urgensi penelitian ini bermula dari Kontroversi lahirnya UU Cipta Kerja terus berlanjut pasca hadirnya Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Putusan inkonstitusional bersyarat terhadap UU Cipta Kerja nyatanya memberikan perdebatan intelektual dari kalangan para sarjana hukum; mengingat, terdapat beberapa perspektif yang mengkaji persoalan tersebut. Penelitian hukum ini menggunakan pendekatan konseptual dan pendekatan peraturan perundang-undangan dengan didasarkan atas bahan hukum primer, bahan hukum sekunder, dan bahan non-hukum. Hasil penelitian menyatakan bahwa putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 memiliki semangat filsafat utilitarianisme sebagaimana bertujuan guna menjaga aspek proporsionalitas serta memberikan jaminan terhadap terselenggaranya Peraturan Pelaksana dari UU Cipta kerja. Di sisi lain, implikasi semangat utilitarianisme dalam Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 yaitu memberikan jaminan ketertiban sosial berkenaan dengan transformasi suatu instrumen hukum sebagaimana persekuensi dari terbitnya UU Cipta kerja.

Abstract

The ideal tax policy should balance social justice through income redistribution, as proposed by John Rawls, with economic freedom and individual property rights, as emphasized by Robert Nozick, to create a fair and sustainable system. This study analyzes the differences and similarities in the theories of distributive justice according to John Rawls and Robert Nozick in normative, philosophical, and sociological aspects, as well as examine their implications for tax policy to formulate an ideal taxation system. This article employs a normative legal method with conceptual, legislative, and comparative approaches to analyze the theories of distributive justice by Rawls and Nozick in tax policy, using a literature study technique and descriptive-comparative analysis of tax regulations in various countries. The findings reveal that differences in the theories of distributive justice between Rawls and Nozick have significant implications for tax policy, where Rawls advocates progressive taxation to reduce social inequality and improve the welfare of disadvantaged groups, whereas Nozick rejects tax redistribution as it violates individual property rights and supports a proportional tax system instead. An ideal tax policy could adopt a mixed approach, with moderate progressive taxation to support social welfare and lower corporate taxes to encourage investment and economic growth, thereby effectively balancing social justice and individual freedom.

Abstract

This study aims to compare business law policies in Indonesia, Ghana, and Vietnam from the perspective of dignified justice and analyze the challenges and opportunities in their implementation. This research employs a normative legal method with statutory, comparative, and conceptual approaches to analyze business law policies in Indonesia, Ghana, and Vietnam from the perspective of dignified justice. The study’s findings reveal that business law policies in Indonesia, Ghana, and Vietnam have unique characteristics influenced by their respective legal systems, histories, and socio-economic conditions. The main challenges include complex bureaucracy, regulatory uncertainty, weak law enforcement, and widespread corruption, which hinder transparency and fair business competition. Indonesia adopts a mixed legal system with reforms such as the Omnibus Law (Job Creation Law) to simplify regulations. However, it still faces issues in licensing and legal protection for SMEs. Ghana, operating under a common law system, seeks to strengthen corporate governance through the Companies Act 2019 but continues to struggle with capital access and burdensome bureaucracy for businesses. Meanwhile, Vietnam, with its socialist legal system, has encouraged private sector growth through reforms like the Law on Enterprises 2020 but still faces challenges related to regulatory transparency and labor protection. All three countries have opportunities to enhance economic competitiveness through bureaucratic digitalization, more transparent legal reforms, and broader support for SMEs and startups. With more inclusive and stable policies, they can establish a fairer and more sustainable business law system from the perspective of dignified justice.

Abstract

The role of the philosophy of justice in business law as a moral and normative foundation that ensures economic activities are not only oriented towards technical efficiency but also uphold principles of justice such as distributive, commutative, and fairness. The philosophy of justice is closely related to constitutional values because the constitution not only regulates legal norms but also contains ethics and social goals that must be reflected in business regulations. This research aims to analyze the philosophy of justice in business law in relation to the principles and values in the constitution and ethical values of a country, with a legal comparison between Indonesia and Ghana. This research is a normative legal study with a conceptual, comparative legal, and legislative approach. The research findings affirm that a comparative study with Ghana shows that although both countries emphasize the importance of ethical and just economic governance based on constitutional values, their approaches differ. Indonesia has a structured system based on the constitution and the interpretation of the Constitutional Court, whereas Ghana relies on a pluralistic legal framework and sectoral regulations that are not fully integrated with the constitution. This difference highlights the importance of the role of the constitution and the judiciary in realizing fair, transparent, and sustainable business law.

Abstract

Sustainable environmental management in Tenganan Pegringsingan Indigenous Village reflects harmony between local wisdom, environmental preservation, and ecotourism development. This village preserves the Bali Aga tradition, which upholds customary values in protecting nature, such as the awig-awig system and the Tri Hita Karana philosophy. The local community practices conservation by limiting natural resource use, prohibiting harmful chemicals, and protecting forests and water sources. Ecotourism is developed participatively and sustainably, emphasizing community involvement, cultural integrity, and minimal environmental impact. Through this community service activity, assistance was provided to strengthen local capacity, enhance community awareness of environmental management, and identify potential tourism based on culture and nature. This collaborative approach, integrating customary values and academic knowledge, demonstrates that local wisdom can serve as a fundamental basis for supporting the Sustainable Development Goals (SDGs), particularly in environmental conservation and community empowerment.

Abstract

Corporations as legal subjects have great potential to cause environmental pollution, especially in the era of increasingly massive industrialization. Legal protection for the environment in Indonesia was initially strengthened through the application of the strict liability concept in Article 88 of the Environmental Protection and Management Law (UU PPLH). However, since the enactment of the Job Creation Law, the principle of absolute responsibility has experienced significant degradation, which has an impact on weak law enforcement against corporations that pollute the environment. This study aims to analyze in detail the legal regulations for corporate crimes in cases of environmental pollution in Indonesia, with a focus on significant changes after the enactment of the Job Creation Law and their impact on environmental protection efforts and justice for affected communities. This study used a normative juridical method with a statutory approach and a conceptual approach. Data are analyzed qualitatively by examining laws and regulations, court decisions, legal doctrines, and relevant literature. The results of the study show that the elimination of the phrase “… without the need for proof of guilt …” in Article 88 of the PPLH Law by the Job Creation Law has weakened the application of the strict liability principle, making it more difficult for business actors to be held legally accountable. This has the potential to increase environmental damage because the burden of proof is now shifted back to the victim. As a result, substantive justice for the community and the effectiveness of environmental protection are increasingly threatened. In addition, the presence of PP No. 22 of 2021 and Law No. 6 of 2023 emphasizes legal uncertainty and opens loopholes for corporate actors to avoid criminal responsibility.

Abstract

Urban farming merupakan kegiatan budidaya tumbuhan di lingkup perkotaan. Hal ini penting dilakukan mengingat kondisi perkotaan yang relatif panas sehingga dibutuhkan sesuatu yang dapat menahan panas suhu tersebut, selain itu minimnya insftrastruktur atau lahan di area rumah warga sehingga kegiatan ini penting dilakukan agar area rumah dapat meresap air. Kegiatan urban farming yang dilakukan melalui Penanaman Tanaman Obat Keluarga (TOGA) tidak hanya sebagai bentuk budidaya tanaman kota tetapi melalui penanaman tersebut dapat dimanfaatkan sebagai alternatif obat guna menjaga kesehatan masyarakat. Tujuan utama dari kegiatan ini adalah untuk membantu meningkatkan kesehatan masyarakat Banjar Mertanadhi yang diakibatkan oleh suhu cuaca yang tidak stabil. Metode yang digunakan pada kegiatan urban farming ini menggunakan 3 tahapan atau fase yang dimulai dari persiapan, pelaksanaan dan evaluasi. Hasil dari kegiatan ini diharapkan masyarakat dapat lebih memperhatikan lingkungan dan memanfaatkan alam. Dengan kita mencintai lingkungan maka dampak yang ditimbulkan sangat positif salah satunya yaitu meningkatkan kesehatan dan memperbesar peluang dalam meningkatkan perekonomian.
