Abstract

This study aims to answer two legal issues, namely, the enigma and nature of the concept of performing rights in music disputes in Indonesia and the orientation of the principle of fairness in realizing justice related to music disputes in Indonesia related to performing rights. This research is a normative legal research with a concept and statutory approach. The research results confirm that performing rights in music disputes in Indonesia must be seen in the important role of LMKNs as regulators, administrators, as well as mediators. Therefore, increasing the professionalism and capacity of LMKNs is needed so that the distribution of royalties can reflect aspects of justice for those involved in the world of music. The fairness principle in realizing justice related to music disputes in Indonesia related to performing rights is when the original position and vail of ignorance of the parties are strengthened through the role of LMKN in the mediation process, namely that disputes related to performing rights can be carried out effectively, efficiently and refers to the substantive aspects which are proportionally able to accommodate the rights of the parties.

Abstract

The purpose of this study is to examine how coercive fines, or dwangsom, are used as legal guarantees for parties who suffer losses due to breach of contract in land lease agreements. Land leases are civil law arrangements that can give rise to disputes, especially when one party fails to fulfill its obligations, such as paying rent after the agreed time or refusing to vacate the leased property after the lease term ends. In such circumstances, even though the court has issued a ruling, its implementation is often hampered by the absence of an effective enforcement mechanism. Therefore, dwangsom becomes an important instrument to ensure compliance with the judge's ruling through financial pressure on the defaulting party. This study uses a literature review method by examining primary, secondary, and tertiary legal materials, such as the Civil Code (KUH Perdata), Civil Procedure Regulations (RV), court decisions, scientific journals, and other legal literature. The analysis is conducted normatively by understanding the relevance and effectiveness of dwangsom in the Indonesian civil law system. The results of the study show that the application of dwangsom serves as a means of coercion so that court decisions can be implemented voluntarily and in a timely manner, thereby ensuring that the rights of the aggrieved party are fully protected. In addition, the application of dwangsom needs to be integrated with the principle of legal certainty in land administration to prevent disputes through clear registration and recording of rights.

Abstract

Discrimination against domestic tourists in popular tourism areas, such as Canggu in Badung Regency, raises serious concerns regarding consumer protection and social justice. As a state governed by law, Indonesia has established various legal instruments to safeguard the rights of consumers, including tourists, from discriminatory practices. However, challenges arise when the implementation of these regulations does not align with the spirit of legal protection mandated by statutory law. This situation reflects a gap between the normative framework and the practical reality in the field. This research aims to examine the legal position and responsibility of business actors toward domestic tourists who experience discrimination, as well as to assess the effectiveness of Indonesia’s positive law in providing real protection. The study adopts a normative legal research method (doctrinal research) employing both statutory and conceptual approaches. The data are drawn from national legislation, regional regulations, legal doctrines, and relevant scholarly literature. The findings reveal that business actors in the tourism sector bear clear legal responsibilities under the Consumer Protection Act, the Tourism Act, and regional regulations of Bali Province and Badung Regency, which emphasize the principle of non-discrimination. The novelty of this research lies in its in-depth analysis of the effectiveness of local regulations in addressing discrimination against domestic tourists, an issue that has received less attention compared to the protection of international visitors. This study contributes by highlighting the urgency of strengthening implementation, supervision, and accessible complaint mechanisms to ensure that the legal framework operates effectively in protecting domestic tourists.

Abstract

Perkembangan kecerdasan buatan atau Artificial Intelligence (AI) telah mengubah sistem hukum kekayaan intelektual, khususnya di bidang merek. Logo yang dihasilkan AI secara mandiri menimbulkan persoalan hukum terkait subjek dan kepemilikan hak eksklusif karena Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis (UU MIG) masih berpijak pada prinsip human authorship yang hanya mengakui manusia sebagai pencipta. Penelitian ini bertujuan menganalisis kekosongan hukum terhadap logo hasil AI serta menelaah relevansi Artificial Intelligence Act (AI Act) Uni Eropa sebagai model pembaruan hukum. Metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual, perundang-undangan, dan perbandingan. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki parameter normatif dan administratif untuk mengatur keterlibatan AI dalam penciptaan logo, sehingga menimbulkan ketidakpastian hukum. Sebaliknya, AI Act menerapkan risk-based approach dengan prinsip transparansi, pengawasan manusia, dan penilaian kepatuhan. Penerapan prinsip-prinsip ini dapat memperkuat sistem hukum merek nasional agar lebih adaptif terhadap inovasi teknologi tanpa mengabaikan kepastian hukum.

Abstract

Introduction: The issue of vehicle loss in paid parking areas has frequently led to disputes between consumers and parking operators in Indonesia. In practice, parking operators often attempt to avoid liability by including exemption clauses on parking tickets, thereby creating legal uncertainty for consumers. This situation becomes particularly significant when examined in relation to the role of the Regional Public Company (Perusahaan Umum Daerah / Perumda) Bhukti Praja Sewakadarma, which manages parking facilities in Denpasar City as part of its public service function. This study seeks to examine the legal framework governing the liability of parking operators for vehicle loss under Indonesian legislation and to analyze the scope and limits of Perumda Bhukti Praja Sewakadarma’s legal responsibility within the framework of positive law.Purposes of the Research: The purpose of this research is to analyze the legal standing of parking service users vis-à-vis parking operators and to determine the form of liability that may be imposed on Perumda Bhukti Praja Sewakadarma in the event of vehicle loss.Methods of the Research: The research employs normative legal methods with statutory, conceptual, and case approaches, supported by descriptive qualitative analysis.Findings of the Research: The findings indicate that parking operators, including Perumda Bhukti Praja Sewakadarma, bear strict liability in protecting consumers against losses arising from vehicle theft or disappearance. Jurisprudence, particularly the Central Jakarta District Court Decision Number: 551/Pdt.G/2000/PN Jkt.Pst, confirms that exemption clauses contained in parking tickets are legally invalid. The originality of this research lies in its emphasis on delineating the scope of liability of Perumda as a regional public company, demonstrating the integration of public service principles with consumer protection in the context of parking management.

Abstract

The development of digital transportation services such as Gojek is highly dependent on personal data, but various cases of data leaks highlight the weakness of legal protection in Indonesia. This has prompted the need for comparison with Japan, which has stronger regulations through the APPI. This study aims to identify and examine the regulation of personal data of users of digital transportation services in Indonesia and compare it with the law in Japan. This study applies a normative legal research method using a legislative approach and legal concept analysis. The findings show that data protection in Indonesia is regulated in the 1945 Constitution and the PDP Law, which require data controllers such as Gojek to ensure lawful, secure, and accountable data management. However, its implementation still faces institutional challenges. In comparison, Japan, through its independent supervisory agency PPC, shows progress in supervision and a high culture of compliance. While Indonesia's PDP Law is normatively comprehensive, its effectiveness still awaits the establishment of a supervisory agency and complete implementing regulations.

Abstract

The implementation of AI-based FRT creates a fundamental conflict between security innovation and the protection of the human right to personal data. This research aims to (1) analyze the fundamental juridical-ethical challenges of AI-based identity systems; (2) examine the effectiveness and limitations of the GDPR (European Union) and the PDP Law (Indonesia) in responding to these risks; and (3) formulate recommendations for an adaptive regulatory framework. This research employs a normative legal research method, utilizing critical-comparative and prescriptive approaches. The analysis reveals two main findings. First, FRT presents unique systemic risks. These risks include discriminatory algorithmic bias, the normalization of mass surveillance, and an accountability crisis resulting from its “black-box” nature. These risks cannot be mitigated by conventional legal frameworks for privacy. Second, critical analysis proves that the GDPR and the PDP Law, as lex generalis instruments, are normatively and practically insufficient in regulating the specific and predictive dynamics of AI technology. This limitation creates a significant rechtsvacuüm, wherein technology adoption operates without adequate juridical oversight. Therefore, this research concludes that reliance on these two regulations is no longer sufficient. This research recommends a shift in Indonesia’s regulatory paradigm. The prescriptive solution proposed is the adoption of a lex specialis (derivative regulation) framework that is proactive, preventive, and adopts a risk-based approach. This framework is essential to ensure that AI innovation remains aligned with the principles of data protection and human dignity.

Abstract

Introduction: In the business world, law plays a crucial role as a guideline that maintains stability and justice. However, its implementation often benefits parties with significant influence, necessitating an approach that considers moral and ethical aspects to achieve true justice.Purposes of the Research:  Explore and analyze how the principles of justice and ethics rooted from the perspective of legal philosophy are applied in the practice of business lawMethods of the Research: This study employs a normative legal research method with a conceptual approach, examining legal norms, principles of distributive and commutative justice, and ethical responsibilities in business based on primary and secondary legal sources.Results Main Findings of the Research: The findings reveal that the principles of justice and ethics in legal philosophy are applied in business law practice by prioritizing distributive and commutative justice, as well as ethical responsibility toward society. Distributive justice seeks to ensure fair business competition and equal opportunities for business actors, while commutative justice guarantees equality of rights and obligations through fair contracts. However, significant challenges remain in implementing justice and business ethics in Indonesia, including weak oversight, the dominance of large corporations, and low awareness of social responsibility.

Abstract

Penelitian ini menganalisis pengaturan hak ekonomi bagi pencipta dalam pemutaran musik untuk tujuan komersial berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dari perspektif tujuan hukum. Latar belakang penelitian adalah kekaburan norma dalam Pasal 87 ayat (1) UUHC mengenai frasa "imbalan yang wajar" yang belum terjelaskan secara tegas, sehingga menghambat perlindungan hak ekonomi pencipta. Tujuan penelitian adalah menganalisis pengaturan hak ekonomi pencipta melalui teori kepastian hukum Gustav Radbruch yang mencakup keadilan, kemanfaatan, dan kepastian hukum. Penelitian ini menggunakan metode hukum normatif dengan pendekatan studi kepustakaan. Instrumen penelitian adalah peneliti itu sendiri, sementara teknik analisis data menggunakan analisis deskriptif yuridis kualitatif. Populasi mencakup seluruh peraturan perundang-undangan, jurnal hukum, dan literatur terkait hak cipta musik. Sampel dipilih melalui purposive sampling berdasarkan relevansi, kredibilitas, dan kebaruan publikasi tahun 2021 ke depan. Hasil penelitian menunjukkan bahwa UUHC dan Peraturan Pemerintah Nomor 56 Tahun 2021 telah menetapkan kepastian hukum melalui mekanisme pembayaran royalti yang jelas dan lembaga pengelola yang terstruktur dengan sistem sanksi yang tegas. Kesimpulan penelitian adalah pengaturan hak ekonomi pencipta telah mencerminkan ketiga tujuan hukum menurut Radbruch secara terintegrasi, meskipun masih memerlukan optimalisasi implementasi dalam hal kesadaran hukum, penegakan hukum yang konsisten, dan transparansi pengelolaan royalti.

Abstract

Traditional medicine in Indonesia actually has the potential to be developed and has economic value for society. One effort to develop it is by optimizing aspects of intellectual property, especially through simple patents. This research aims to answer two legal issues, namely: the urgency of a simple patent orientation for traditional medicines in Indonesia and the formulation of a simple patent orientation for traditional medicines in Indonesia. This research method uses normative legal research with a conceptual and statutory approach. The research results confirm that the urgency of a simple patent orientation for the management of traditional medicines in Indonesia has three benefits at once, namely from the aspect of technology development, developing types of traditional medicine products, to increasing economic value. In the aspect of technology development, a simple patent for traditional medicine entrepreneurs can increase the value of creativity and innovation to always develop existing technology. Future arrangements that can be made are by establishing special regulations that regulate increasing the economic value of traditional medicines through the development of simple patents. Ideally, this regulation must also regulate three main substances, namely: an inventory of the potential for traditional medicines in a place, the potential for technological development through simple patents, and an effective and efficient marketing network for traditional medicines.
