Abstract

This socialization aims to increase the knowledge and awareness of voting rights among the elderly at PSTW Wana Seraya Denpasar. Enhancing voter participation is crucial for the success of elections. However, ironically, the elderly often get overlooked in election socialization and education, leading to low voter turnout. The community service activity at PSTW Wana Seraya was conducted through an election socialization and education program utilizing the Participatory Action Research (PAR) method in a sharing session. Topics discussed included exercising voting rights, properly using the ballot and the dangers of abstaining from voting. This community service, conducted using the sharing session method, has increased voters' knowledge and awareness of voting rights. This is evidenced by the enthusiasm of the elderly in asking and answering questions and the positive feedback in participating in the socialization program.

Abstract

Traditional medicine in Indonesia actually has the potential to be developed and has economic value for society. One effort to develop it is by optimizing aspects of intellectual property, especially through simple patents. This research aims to answer two legal issues, namely: the urgency of a simple patent orientation for traditional medicines in Indonesia and the formulation of a simple patent orientation for traditional medicines in Indonesia. This research method uses normative legal research with a conceptual and statutory approach. The research results confirm that the urgency of a simple patent orientation for the management of traditional medicines in Indonesia has three benefits at once, namely from the aspect of technology development, developing types of traditional medicine products, to increasing economic value. In the aspect of technology development, a simple patent for traditional medicine entrepreneurs can increase the value of creativity and innovation to always develop existing technology. Future arrangements that can be made are by establishing special regulations that regulate increasing the economic value of traditional medicines through the development of simple patents. Ideally, this regulation must also regulate three main substances, namely: an inventory of the potential for traditional medicines in a place, the potential for technological development through simple patents, and an effective and efficient marketing network for traditional medicines.

Abstract

Hak cipta melindungi karya intelektual, termasuk yang berbasis agama, namun pengaturannya masih diperdebatkan karena bersinggungan dengan moralitas. Perspektif Ronald Dworkin mengenai hukum sebagai praktik interpretasi dapat diterapkan dalam menyelesaikan sengketa hak cipta atas karya keagamaan. Penelitian ini bertujuan untuk menganalisis pengaturan perlindungan hak cipta atas karya berbasis agama di Indonesia dan penerapan konsep moralitas Ronald Dworkin untuk perlindungan hukum yang adil. Penelitian ini menggunakan metode normatif dengan pendekatan konseptual dan legislasi untuk menganalisis data primer dan sekunder terkait perlindungan hukum hak cipta atas karya berbasis agama. Hasil analisis disajikan secara deskriptif dan kualitatif untuk merumuskan argumen menjawab permasalahan penelitian. Temuan penelitian menunjukkan bahwa pengaturan hak cipta di Indonesia berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta telah memberikan perlindungan mendasar terhadap karya intelektual yang berdasarkan nilai-nilai agama. Kitab suci, buku, musik, seni, dan cerita rakyat bertema keagamaan umumnya dilindungi dalam domain publik dan pribadi. Namun, ada pengecualian untuk penggunaan non-komersial dan tujuan akademis tanpa memerlukan izin pencipta. Hak moral tetap dihormati dengan mengakui sumbernya. Aturan tersebut dinilai mampu menyeimbangkan antara melindungi hak ekonomi pencipta dan memberikan akses masyarakat terhadap karya keagamaan. Konsep moralitas Ronald Dworkin relevan untuk diterapkan dalam Undang-Undang Hak Cipta Indonesia untuk menjamin perlindungan hukum yang adil terhadap karya keagamaan. Penggunaan karya keagamaan secara komersial tanpa izin tetap dianggap sebagai pelanggaran hak cipta. Namun, penggunaan non-komersial untuk tujuan akademis dan sosial harus diperbolehkan dengan tetap menyebutkan sumbernya. Durasi perlindungan juga perlu dipersingkat untuk mempercepat transisi nilai-nilai agama ke ranah publik. Penerapan konsep moral Dworkin memerlukan revisi UU Hak Cipta melalui diskusi publik dengan tujuan merumuskan peraturan yang adil bagi pencipta dan masyarakat.

Abstract

The objective of this scholarly publication is to investigate and assess the Consumer Dispute Settlement Body's (BPSK) authority and the conclusive and legally binding nature of its decisions. This investigation employs normative legal research. The authority and responsibilities of the Consumer Dispute Resolution Agency (BPSK) are specified in Article 52 UUPK. The consumer dispute resolution body is obligated to render a final and binding decision within twenty-one (21) business days from the date of receipt of the lawsuit. This adheres to the provisions outlined in Article 54 paragraph 3 UUPK and Article 55. The ultimate and enforceable interpretation of a Consumer Dispute Settlement Agency decision is fundamentally distinct from that of a court institution's decision bearing the same meaning. This shows that the status and position of the Consumer Dispute Resolution Agency (BPSK) is assessed from an administrative perspective, it only has administrative authority. Therefore, it was deemed that the decision could not have judicial attributes. Consequently, BPSK may be categorized as a quasi-judicial institution, deviating in character from the principal court institutions in terms of the substance of its rulings. Therefore, in light of the BPSK decision's "final and binding" nature, it is possible to interpret it only as an agreement or agreement.

Abstract

Introduction: The development of the sports industry inherently provides opportunities related to economic orientation and job creation within the sports industry.Purposes of the Research: This study focuses on analyzing the legal-political aspects in sports law following the enactment of the Sports Law. The research aims to address two legal issues: (i) issues concerning the sports industry within the Sports Law, and (ii) the legal-political dynamics of the sports industry within the Sports Law and future regulatory efforts.Methods of the Research: This research employs a normative legal research approach, emphasizing conceptual and legislative analysis.Results of the Research: There are three issues and weaknesses in the regulation of the Sports Law concerning the sports business: the lack of provisions regarding the empowerment of micro, small, and medium enterprises (MSMEs) in the sports business sector, the non-integration of sports law regulations with general business regulations potentially leading to regulatory overlaps that hinder sports business operations, and the partial nature of corporate social responsibility regulations in aiding sports development, limited to financial contributions by sports entities. Generally, the legal-political framework of the sports industry under the Sports Law has provided regulations concerning sports business and involved parties. To optimize the legal-political framework of the sports industry, future regulatory efforts are needed to refine the Sports Law through revisions aimed at enhancing the sports business environment, accommodating meaningful participation from relevant stakeholders. Another critical aspect is the formulation of implementing regulations within the Sports Law, particularly those pertaining to the sports business, to ensure integrated regulations between sports-specific implementing rules and those of other sectors sharing similar business orientations.

Abstract

This research aims to analyze the legal responsibility of former Directors for the management of the Company which was carried out when the term of office of the Directors and Board of Commissioners had ended before the re-appointment GMS was held. In this case, the Board of Directors is the organ of the Company which is fully responsible for the management of the Company and represents the Company both inside and outside the Court. Directors whose term of office ends do not automatically continue their position as before, except by re-appointment based on a GMS decision. So that the management carried out after the term of office ends may conflict with the law and the Company's articles of association. The approaches used are the statutory approach and the case approach. The results of legal actions carried out by former Directors while continuing to manage and represent the Company are illegal actions and can be held personally responsible. However, if it can be proven that the management actions are carried out in good faith for the sake of the law and provide good benefits for the Company and all of the Company's stakeholders, then based on the authority possessed by UUPT and the Company's articles of association, the GMS can decide to make all legal actions in the form of management. What is done by the former Director becomes a legal act and the Company's responsibility, so that the former Director is free from personal responsibility.

Abstract

This research aims to analyze the implementation of legality regulations for Traditional Complementary Healers (TCH) based on Health Law No. 36 of 2009. The study focuses on Denpasar, with an emphasis on acupuncture and muscle massage practices. Using a qualitative approach, this study identifies that a majority of TCHs in Denpasar (around 90%) have not yet complied with the legality requirements set by Health Law No. 36 of 2009. Factors influencing the fulfillment of legality encompass legislative aspects that lack specificity in regulating traditional healing, limited attention from law enforcement, as well as challenges in infrastructure and insufficient support from professional organizations and local authorities. Society tends to deprioritize legality when choosing TCHs due to the deep-rooted cultural belief in traditional healing methods. This research underscores the need for stronger guidance and supervision from Local Governments to assist TCHs in meeting legality prerequisites. In conclusion, the implementation of legality regulations for TCHs based on Health Law No. 36 of 2009 in Denpasar still encounters significant challenges involving various factors, including culture and inadequate regulations.

Abstract

This study examines the intersection of justice within the framework of business law by analyzing its effectiveness and implementation in Indonesia, Vietnam, and Ghana three nations navigating the challenges of globalization. Justice is conceptualized through the lens of fairness, efficiency, and inclusivity in legal frameworks. By adopting a comparative normative legal research method, this study identifies the critical factors influencing business law implementation: regulatory quality, institutional capacity, political stability, and technological infrastructure. Findings reveal disparities in achieving justice due to corruption, bureaucratic inefficiencies, and weak enforcement mechanisms. While Indonesia grapples with regulatory overlap and decentralized governance challenges, Vietnam demonstrates progressive reforms but struggles with legal clarity. Ghana, despite leveraging political stability, faces significant limitations in infrastructure and enforcement. The study highlights the need for enhanced legal certainty, equitable stakeholder protections, and institutional reforms to align domestic business laws with global standards. Addressing these disparities can foster a more just and competitive business environment, ensuring fair treatment for all economic actors.

Abstract

Credit agreements with personal guarantees often cause legal problems when the debtor defaults. Individual guarantees cannot be bound with a mortgage instrument or fiduciary guarantee, thus increasing the risk for banks. This research aims to understand and systematically examine the concept of regulating personal guarantees according to positive law in Indonesia and the legal consequences that arise if the debtor defaults in a credit agreement with personal guarantees. This research uses normative juridical method with concept approach. The data sources of this research are primary legal materials such as laws and jurisprudence, as well as secondary legal materials such as legal textbooks and journals. The results show that personal guarantees have an important function in advancing the economy through lending. However, this guarantee also poses a high risk for banks if not accompanied by careful analysis. Law No. 4 of 2023 on Financial Sector Development and Strengthening strengthens the role of the Financial Services Authority in supervising credit agreements with personal guarantees to maintain financial sector stability.

Abstract

Mendaftarkan tanah pada Badan Pertanahan Nasional merupakan bagian dari tata cara peralihan hak jual beli yang harus dilakukan terlebih dahulu. Persyaratan pendaftaran hak Jual Beli sudah tercantum dalam Peraturan Pemerintah Nomor 24 Republik Indonesia Tahun 1997 tentang Pendaftaran Tanah. Pengecekan kelengkapan dokumen pada berkas pencatatan merupakan langkah pertama yang dilakukan oleh petuga loket di BPN. Apabila terdapat kekuarangan pada berkas ataupun kesalahan pada penulisan surat permohonan dan surat pernyataan maka berkas yang sudah didaftarkan akan dikembalikan dengan tujuan dilakukannya perbaikan atas kesalahan dan dilengkapi lagi kekurangan pada berkas. Dengan memberi edaran dan pemberitahuan maka diharapkan agar kesalahan-kesalahan yang sering terjadi dapat diminimalisir. Kesalahan pada berkas yang didaftarkan dapat menghambat waktu untuk diprosesnya berkas sehingga penerbutan sertifikat akan semakin lama.
