Abstract

Penelitian ini mengkaji praktik nikah siri di Kecamatan Tanjung Raya yang terbagi menjadi dua jenis, yaitu nikah yang tidak sah menurut agama dan negara serta nikah yang hanya sah menurut agama. Praktik nikah siri yang hanya sah secara agama lebih dominan terjadi, terutama disebabkan oleh ketidakmampuan salah satu pihak menunjukkan akta cerai, yang dianggap sulit, rumit, dan memakan waktu dalam pengurusannya. Logika hukum masyarakat pelaku nikah siri didominasi oleh pemahaman hukum Islam, di mana pernikahan yang memenuhi rukun dan syarat agama dianggap sah, sementara pencatatan di KUA hanya dipandang sebagai urusan administratif. Selain itu, kondisi sosio-kultural masyarakat turut memengaruhi praktik ini, dengan faktor-faktor seperti kuatnya pengaruh ulama, karakteristik wilayah yang agamis, budaya instan, lemahnya penegakan hukum, dan kebiasaan masyarakat yang mendukung praktik tersebut. Sebagai solusi, diperlukan kolaborasi berbagai pihak untuk melarang nikah siri, termasuk penyusunan aturan khusus di tingkat nagari, mendorong pengajuan kasus secara kolektif ke pengadilan, inovasi di tingkat KUA, dan penyederhanaan proses administrasi di Pengadilan Agama, khususnya terkait biaya pengurusan. Temuan ini menyoroti perlunya pendekatan komprehensif dalam menangani fenomena nikah siri secara holistik.

Abstract

The development of information technology today has made the social media platforms YouTube and Instagram very popular and has given birth to many YouTuber and Celebgram content creators. Content creators use this social media platform as a means to earn income with fantastic financial value of up to hundreds of millions, even billions of rupiah every month. This article aims to discuss zakat for YouTubers and Celebgrams. By using the library research method with a normative approach, this article provides answers to the issue of zakat for YouTubers and Celebgrams. This article concludes that: First, Yusuf al-Qardhawi views income YouTubers and Celebgram is included in al-mâl al-mustafâd, and must be given zakat. Second, there are differences of opinion as to whether zakat is paid to gold and silver zakat, or agricultural zakat. Yusuf al-Qardhawi in one condition qiyas the provisions of agricultural zakat. In other conditions, if the nisab is not met then zakat is paid to gold and silver. Meanwhile, based on MUI Fatwa No. 3 of 2003 concerning Income Zakat, reinforced by MUI Fatwa No. 04 of 2024 concerning Zakat for YouTubers, Celebrities, and Other Digital Creative Economy Actors, its implementation is subject to zakat on gold and silver. Al-Qardhawi's opinion and the provisions contained in the MUI Fatwa, provide an answer to the need to determine zakat law for the income of YouTubers and Instagram celebrities, as part of the dynamic development of information technology which has resulted in the development of contemporary law in the field of zakat. Perkembangan teknologi informasi saat ini menjadikan platform media sosial YouTube dan Instagram menjadi sangat diminati dan melahirkan banyak pelaku konten kreator YouTuber dan Selebgram. Pelaku konten kreator menjadikan platform media sosial ini sebagai sarana untuk meraup penghasilan dengan nilai finansial yang fantastis hingga mencapai ratusan juta, bahkan milyaran rupiah setiap bulannya. Artikel ini bertujuan untuk mendiskusikan zakat bagi YouTuber dan Selebgram. Dengan menggunakan metode library research dengan pendekatan normatif, artikel ini memberikan jawaban terhadap persoalan zakat bagi YouTuber dan Selebgram. Artikel ini menyimpulkan bahwa: Pertama, Yusuf al-Qardhawi memandang pengasilan YouTuber dan Selebgram termasuk dalam al-mâl al-mustafâd, dan wajib untuk dizakatkan. Kedua, terdapat perbedaan pendapat apakah penunaian zakatnya diqiyaskan kepada zakat emas dan perak, atau zakat pertanian. Yusuf al-Qardhawi pada satu kondisi meng-qiyaskan pada ketentuan zakat pertanian. Pada kondisi lain, jika nisabnya tidak terpenuhi maka diqiyaskan kepada zakat emas dan perak. Sementara, berdasarkan Fatwa MUI No. 3 Tahun 2003 tentang Zakat Penghasilan, diperkuat dengan Fatwa MUI No. 04 Tahun 2024 tentang Zakat YouTuber, Selebgram, dan Pelaku Ekonomi Kreatif Digital Lainnya, pelaksanaanya diqiyaskan kepada zakat emas dan perak. Pendapat al-Qardhawi serta ketentuan yang termuat pada Fatwa MUI, memberikan jawaban terhadap kebutuhan penetapan hukum zakat bagi penghasilan YouTuber dan Selebgram, sebagai bahagian dari dinamika perkembangan teknologi informasi yang berakibat pada perkembangan hukum kontemporer dalam bidang zakat.

Abstract

The phenomenon of unregistered marriage in Tanah Datar, West Sumatra, reflects the complex interplay between customary traditions (adat), Islam, and the state within contemporary Minangkabau society. This article investigates how the traditional triadic authority—Tungku Tigo Sajarangan, consisting of ninik mamak (customary leaders), alim ulama (religious scholars), and cadiak pandai (intellectuals)—understands and responds to the increasing prevalence of unregistered marriage. Employing a qualitative approach through in-depth interviews and field observations, the study reveals that unregistered marriage is perceived not merely as a bureaucratic irregularity due to its absence in the state legal registry, but also as a deviation from both communal norms and the socio-cultural structure of the Minangkabau. This practice signals a broader shift in societal authority, wherein the influence of Tungku Tigo Sajarangan has diminished amid the rise of individualistic religious interpretations, the pressures of modernity, and the weakening of customary mechanisms of social control. The article argues that unregistered marriage serves as an indicator of the delegitimation of local cultural values, contributing to social fragmentation within the community. Addressing this issue necessitates a revitalization of customary institutions to restore their mediating role in balancing customary norms, Islamic principles, and national legal frameworks. Reinforcing local authority is thus imperative to counteract social disintegration and reestablish harmony within the marital order of Minangkabau society. [Fenomena nikah siri di Tanah Datar, Sumatera Barat, merupakan cerminan dari kompleksitas relasi antara adat, agama, dan negara dalam masyarakat Minangkabau kontemporer. Artikel ini mengeksplorasi bagaimana Tungku Tigo Sajarangan—yakni ninik mamak (pemimpin adat), alim ulama (otoritas agama), dan cadiak pandai (kaum intelektual)—memahami dan merespons praktik nikah siri yang kian marak. Penelitian ini menggunakan pendekatan kualitatif melalui wawancara mendalam dengan tokoh-tokoh adat dan observasi di lapangan. Hasil penelitian menunjukkan bahwa nikah siri tidak semata-mata dianggap sebagai pelanggaran administratif karena tidak dicatatkan dalam sistem hukum negara, melainkan juga sebagai bentuk penyimpangan terhadap norma adat dan struktur sosial komunal. Praktik ini menandai terjadinya pergeseran otoritas dalam masyarakat: peran Tungku Tigo Sajarangan semakin terpinggirkan akibat dominasi tafsir individual atas ajaran agama, pengaruh modernitas, serta melemahnya fungsi pengawasan sosial dari institusi adat. Lebih jauh, artikel ini mengemukakan bahwa nikah siri merupakan salah satu indikator delegitimasi terhadap nilai-nilai kultural lokal, yang berdampak pada disintegrasi sosial dalam komunitas Minangkabau. Situasi ini menuntut adanya revitalisasi peran lembaga adat agar dapat menjalankan fungsi mediasi antara kepentingan adat, syariat Islam, dan regulasi negara secara seimbang. Abstract

The Indonesian legal system comprises three main components: customary law, Islamic law, and European law. These three systems serve as foundational elements in the construction of a holistic and comprehensive national legal framework through national legal politics. This study aims to examine the position and role of Islamic law in Indonesia, focusing on Ijtihad in the context of social change and the positivization of Islamic law. Employing a normative juridical method, this research relies on secondary data sources, including primary and secondary legal materials. The findings reveal that the adaptive and dynamic character of Islamic law allows it to grow and develop in the Indonesian legal system, which is transforming codification and official and binding legal enforcement. This development cannot be separated from the direction and policy of legal politics that influence the process of Islamic legal legislation. Although its application is not yet comprehensive and is still limited to certain fields, Islamic law has gained recognition in the form of independence, legitimacy, and authority as part of national law

Abstract

Objective: This article seeks to elucidate the causes, impacts, and potential solutions to the issue of unregistered marriages in Tanah Datar Regency. Research on unregistered marriages has been extensively conducted in Indonesia, revealing an increasing array of reasons for their occurrence. Prior studies identified three to five primary causes of unregistered marriages. This article presents additional findings regarding these causes, highlights specific violations of customary law provisions, and discusses the solutions implemented by relevant agencies to address the problem of unregistered marriages. The research adopts a qualitative approach and utilises both primary and secondary data sources. Methods: Data collection techniques involved interviewing 35 community leaders, analysing documentation from pertinent agencies, and conducting Focus Group Discussions (FGDs) with 50 participants from related sectors. Results: The research identified 11 distinct causes of unregistered marriages, including specific violations of customary rules, tribal marriages, non-conforming marriages, and marriages involving 'melompat pagar'. The negative consequences stemming from unregistered marriages are significant; most unregistered marriages within the community lack legal validity. This situation leads to complications for children born as a result of these unions, as issues surrounding custody and divorce in unregistered marriages are often resolved solely through customary law, lacking formal legal recognition. Conclusion: Given the substantial prevalence of unregistered marriages in Tanah Datar Regency, various solutions have been implemented by relevant agencies to address the challenges faced by individuals involved in such marriages. Initiatives by the DUKCAPIL include the issuance of a letter of absolute responsibility (SPTJM) for the purpose of creating family cards, birth certificates, and ID cards. The Batusangkar Religious Court addresses cases of isbat marriage and cumulative requests for divorce and polygamy. Additionally, the KUA offers solutions such as remarriage and the formalisation of new marriages.

Abstract

This study aims to uncover the reasons why Nahwu manuscripts are found in almost every surau in Minangkabau and how Nahwu, a branch of Arabic grammar, was taught in these traditional Islamic educational institutions. This research is qualitative research employing a philological approach, which seeks to describe and reveal the phenomena surrounding surau education in Minangkabau. Based on the discovery of Nahwu manuscripts, and to explore the instructional process of Nahwu in these institutions. Primary data sources include several Nahwu manuscripts, along with the leaders of Inyik Jaho Surau, Surau Labai Sati Malalo, and the SurauSyaikh Abbas Padang Japang. Secondary data sources comprise various books, articles, and other related references. The research finds that the Nahwu manuscripts discovered in these surau represent the most authentic evidence of Islamic educational traditions in historical Minangkabau. Nahwu was not only considered essential for understanding religious texts but also regarded as an integral part of religious life. Instruction was delivered through the sorogan method, whereby teachers would recite and guide the memorization of Nahwu texts, translate them, and apply them to the study of other religious books. Nahwu material was taught progressively in three levels: elementary, intermediate, and advanced, each with its respective classical texts.

Abstract

This research focuses on Islamic philanthropy in Minangkabau and its contribution to building social solidarity through the integration of local customs and religion. The method used is a literature review, collecting data from relevant articles, books, and case studies. The purpose of this study is to explore how Minangkabau traditional values, such as "gotong royong" (mutual cooperation) and "badunsanak" (kinship solidarity), play a role in facilitating philanthropic practices. The findings indicate that these local traditions, combined with Islamic teachings, strengthen social bonds and enhance community welfare. Furthermore, the role of women in managing family resources and the contributions of organizations like Muhammadiyah and Nahdlatul Ulama help reinforce structured philanthropic practices. Education in Islamic boarding schools (pesantren) also plays a crucial role in instilling philanthropic values in the younger generation. In conclusion, Islamic philanthropy based on local customs in Minangkabau not only strengthens social solidarity but also contributes to poverty alleviation and community well-being.

Abstract

Popular fiqh literature addresses practical aspects of life. A considerable portion of this literature portrays women within a conservative framework. This research aims to investigate the tendency of spousal relationships as depicted in those popular fiqh literature. Subsequent to cataloging, a random selection of literary samples underwent qualitative content analysis. The findings revealed that popular fiqh literature on the household, especially on marital relations, is dominated by gender biased discourse by placing women only in the domestic realm where their position is inferior. This dominance stems from the authors’ references projecting back to the provisions of classical fiqh, which are gender biased and lack authoritative interpretation of the texts. The presence of this literature is also due to the market demands of the publishing industry. Furthermore, societal understanding dominated by patriarchal ideology contributes significantly to the prevalence of gender-biased popular fiqh literature.[Abstrak: Literatur fiqh populer mengatasi aspek praktis kehidupan. Sebagian besar dari literatur ini menggambarkan perempuan dalam kerangka konservatif. Penelitian ini bertujuan untuk menyelidiki kecenderungan hubungan suami istri seperti yang digambarkan dalam literatur fiqh populer tersebut. Setelah proses katalogisasi, seleksi acak sampel-sampel dianalisis dengan pendekatan konten kualitatif. Hasil temuan menunjukkan bahwa literatur fiqh populer tentang rumah tangga, terutama dalam hubungan pernikahan, didominasi oleh wacana bias gender yang menempatkan perempuan hanya dalam ranah domestik di mana posisi mereka lebih rendah dibanding laki-laki. Dominasi ini berasal dari referensi penulis yang mencerminkan kembali ketentuan fiqh klasik, yang memiliki bias gender dan kurangnya interpretasi otoritatif dari teks-teks tersebut. Kehadiran literatur ini juga karena tuntutan pasar industri penerbitan. Selain itu, pemahaman masyarakat yang didominasi oleh ideologi patriarki turut berkontribusi secara signifikan pada prevalensi literatur fiqh populer yang bersifat bias gender.]

Abstract

A Compilation of islamic law “Kompilasi Hukum Islam”, which was ratified through Presidential Instruction (or now decree) No. 1 of 1991, is a modern codification of Islamic individual and family law that becomes the standard of judges' reference in resolving cases in religious courts. One of the critical parts of KHI is inheritance, which is the main focus of this paper. The article on inheritance in KHI is interesting for further review because it has a different legal provision to fiqh or qanun. Through the study of libraries with a philosophical approach, this paper intends to analyze the provisions that become a barrier to inheritance from the perspective of Maqāṣid al-Sharia. This study shows that the obstacles to obtaining inheritance for reasons of persecution and slander, as mentioned in article 173 KHI, are some barriers to one obtaining inheritance that are not discussed as a barrier to inheritance in the classic fiqh book of severe persecution and slander. Through literature research, it is understood that the decree of persecution and slander is a barrier to inheritance in line with the Maqāṣid al-Sharia, namely to protect the soul (hifz al-nafsi), then guard the property (hifz al-māl) and further maintain self-respect (hifz al-'Ird) Thus. However, severe persecution and slander are not listed in classical Islamic jurisprudence as a barrier to inheritance. With the study of Maqāṣid al-Sharia, these two things are very appropriate to be applied in the rule of inheritance law, especially in Indonesia, so that these two acts cause very much harm to the victim (heir). “Kompilasi Hukum Islam”, yang disahkan melalui Instruksi Presiden No. 1 Tahun 1991, merupakan kodifikasi modern hukum perseorangan dan keluarga Islam yang menjadi standar rujukan para hakim dalam menyelesaikan perkara di pengadilan agama. Salah satu bagian penting KHI adalah kewarisan, yang menjadi fokus utama dalam tulisan ini. Pasal tentang waris dalam KHI menarik dikaji lebih lanjut karena memiliki ketentuan hukum yang berbeda dengan fiqh atau qanun. Melalui studi pustaka dengan pendekatan filosofis, tulisan ini bermaksud menganalisis ketentuan yang menjadi penghalang warisan dari perspektif Maqāṣid al-Syarī’ah. Hasil studi ini menunjukkan bahwa halangan mendapatkan warisan karena alasan penganiayaan dan fitnah, sebagaimana yang disebutkan dalam pasal 173 KHI terdapat beberapa penghalang seseorang mendapatkan hak waris yang tidak dibahas sebagai penghalang kewarisan dalam kitab fiqh klasik yaitu penganiayaan berat dan fitnah. Melalui penelitian kepustakaan, dipahami bahwa ketetapan penganiayaan dan memfitnah sebagai penghalang kewarisan sejalan dengan Maqāṣid al-Syarī’ah yakni yakni untuk menjaga jiwa (hifẓal-nafsi), kemudian  menjaga harta (hifẓal-māl) dan selanjutnya menjaga kehormatan diri (hifẓ al-‘Irḍ) Maka, sekalipun penganiayaan berat dan fitnah tidak tercantum dalam fiqh klasik sebagai penghalang kewarisan, namun dengan kajian Maqāṣid Syarī’ah, kedua hal ini sangat pantas diterapkan dalam aturan hukum waris, khususnya di Indonesia. Hal ini disebabkan karena dua perbuatan ini menyebabkan sangat banyak mudarat kepada korban (pewaris).

Abstract

This paper aims at explaining the background of the persistence of Pulang ka Bako marriage in Lasi area and its correlation to family resilience. This research is field research. The Minangkabaunese still carry out the tradition of Pulang ka Bako marriage (marrying the daughter of father’s female sibling) in Minangkabau community, especially in Lasi area. This marriage is considered the ideal type of marriage in Minangkabau. The data sources were obtained from the result of interview with married couples, traditional leaders, and religious leaders. The collected data were then reduced, presented, and concluded. This result showed that the background of Pulang ka Bako marriage was the community’s understanding that this type of marriage can guarantee the development and maintenance of inheritance, kinship social relations, and preservation of traditions and customs. This tradition can build family resilience in the terms of economic and social, and it strengthens cultural resilience as well. From the perspective of maqashid al-sharia, Pulang ka Bako marriage does not only bring benefit to the individual but also to the family. Besides fulfilling the elements of hifzun nasl (preserving offspring), hifzul mal (managing assets), and hifzul 'irdh (maintaining honor), Pulang ka Bako also fulfills the elements of tahqiqul sakn wal mawaddah wa rahmah (realizing the sense of peace, love, and compassion) and tanzimul janibul mali (managing family finances). It can be concluded that Pulang ka Bako type of marriage has fulfilled the objectives of Islamic law and is capable of being one of the solutions to family resilience issues.
