Abstract

Perkembangan ilmu pengetahuan dibidang teknologi merupakan keniscayaan dan menunjukkan tanda kemajuan, hal ini terjadi di seluruh belahan dunia; mensinergikan antara kegiatan manusia dengan teknologi informatika merupakan loncatan perkembangan teknologi bahkan peradaban. Jika kita cermati UU ITE ini mengandung 2 unsur, yaitu unsur yang benar-benar persoalan informasi dan transaksi elektronik dan unsur pidana yang sebenarnya telah diatur dalam KUHP; secara khusus dalam penelitian ini terkait pencemaran nama baik. Kesimpulan ini berpendapat bahwa, pertama:  penulis berpendapat saat ini belum efektif, namun seiring berjalannya waktu dan dalam konteks kecepatan penegak hukum untuk menegakkan hukum sudah memiliki progres yang baik, mengingat argumentasi bahwa hukum tidak harus mengatur sesuatu yang menjadi tujuan maksimal, tetapi setidaknya aturan untuk mencapai tujuan minimal, dikaitkan dengan mengikuti perkembangan masyarakat.

Abstract

Corruption is a major challenge, especially in developing countries, which has a significant impact on the economy and politics. In Indonesia, this corruption problem has long occurred with one of the important points being the establishment of the Corruption Eradication Commission, and currently the independence of the Corruption Eradication Commission is actually decreasing. This article draws one formulation of the problem, namely how are the dynamics of the economy and politics in the grip of corruption in Indonesia? Through empirical research methods and theoretical approaches. The results of this analysis indicate that corruption has a very negative impact on the Indonesian economy and politics, damaging the economic structure, exacerbating social inequality, and weakening democracy and public trust. To overcome this, laws such as the Corruption Eradication Law, the State Finance Law, and the Election Law are important in creating a transparent and accountable government. Strengthening the mechanism for preventing and eradicating corruption is concluded to be able to improve economic and political conditions, as well as provide greater benefits to society. ___ Referensi Books with an author: Klitgaard, R. Abstract

BUMN (Badan Usaha Milik Negara) maupun BUMD merupakan kepanjangan tangan pemerintah dalam bidang kegiatan perekonomian nasional yang berasaskan demokrasi ekonomi, demikian amanat Pasal 33 UUD 1945, pemerintah memiliki peran sentral dalam mewujudkan kesejahteraan umum/ hajat hidup orang banyak dan daya saing global (PDB). Permasalahan yang melanda BUMN/BUMD adalah kerap ditemukannya tindak pidana korupsi. Pemberantasan korupsi merupakan topik yang sangat menarik dibidang hukum dan pemerintahan, sedangkan asumsi penulis adalah korupsi merupakan salah satu sumber penyebab kemiskinan rakyat dan penghambat pembangunan, disisi lain acapkali juga pihak swasta atau yang berunsur swasta yang seolah menjadi tujuan penegakan hukum represif, sedangkan pejabat seringkali hanya yang muncul di media televisi atau media online. Dalam pelaksanaannya, BUMN sebagai salah satu subjek korporasi memiliki pertanggungjawaban atas Tindak Pidana Korupsi yang terjadi. Berbagai pendapat tentang pengertian keuangan negara, kerugian keuangan negara atau perekonomian negara, disparitas putusan peradilan, ketidaktepatan konsep denda, sifat pidana formal maupun material dan label tindak pidana korupsi adalah “extra ordinary crime” dan sebagainya. Sehingga dibutuhkan konsep yang berkepastian untuk menentukan posisi hukum keuangan dalam BUMN, dalam hal ini disistematikakan dengan BUMD dalam perspektif sumber dana dari pemerintah, apakah dipisahkan ataukah tercampur (menjadi unsur didalamnya), disisi lain pengisian pejabat BUMN/BUMD erat hubungannya dengan proses politik sehinga otomatis rentan bergesernya penegakan hukum dengan pengaruh politik. Terkait dengan modal yang disertakan oleh pemerintah kepada BUMN/BUMD maka perlu dipahami adanya keuangan negara yang dipisahkan, artinya uang negara tersebut berubah menjadi modal berupa saham yang merupakan milik negara (penyertaan saham perseroan).

Abstract

Desa merupakan kata yang menghantarkan sebagian kita kepada suatu daerah yang asri atau nyaman, namun di era sekarang mereka diberikan kesempatan untuk maju dan mandiri dengan mengelola keuangannya sendiri mendasarkan pada UU No. 6 Tahun 2014 tentang Desa, desa memiliki kewenangan untuk mengelola keuangan sendiri, dan periode jabatan kepala desa yang relatif lebih panjang sejak disahkan UU No 3 Tahun 2024. Tahun 2023 lalu, pemerintah mengalokasikan dana sebesar Rp 68 triliun untuk pembangunan di tingkat desa, dengan rerata tiap desa mendapat lebih dari Rp 900 juta dari anggaran, namun setiap tahunnya justru angka korusi dana desa semakin naik. Penelitian menggunakan pendekatan yuridis normatif dengan metode studi kepustakaan, yang mengkaitkan korupsi pada dana desa dengan whistleblowing system, kemudian untuk mengetahui efektivitasnya. Penelitian-penelitian yang ada menyatakan whistleblowing system cukup berpengaruh untuk mencegah korupsi bahkan mengungkapnya, namun disisi lain masih belum banyak masyarakat yang berani menjadi whistleblower, mengingat perlindungan hukumnya masih diragukan, sekalipun ada LPSK, bahkan penelitian diluar negeri menunjukkan fakta bahwa whistleblower cukup rentan mendapat balasan dari para koruptor dan jaringannya. Maka penulis berpendapat bahwa alternatif reward, maupun teknis pelaporan harus disederhanakan dan jaminan kerahasiaan pelapor harus lebih konkrit (tidak sebatas undang-undang).

Abstract

  This study examines the implementation of criminal law policy within the field of taxation, with a particular emphasis on the application of the ultimum remedium principle and the implications of the repeal of Article 13A of the Law on General Provisions and Tax Procedures (UU KUP). In this context, taxation is understood as an integral part of criminal legal policy and the enforcement of law concerning tax-related offences that carry criminal consequences. The study aims to provide policy recommendations for relevant stakeholders in designing criminal enforcement strategies in taxation, ensuring that the ultimum remedium principle remains the central reference for maintaining proportionality and justice. The research employs a normative juridical approach, focusing on regulatory analysis and the examination of legal arguments regarding the impact of Article 13A’s removal on the direction of tax criminal law policy. The findings highlight that the presence of the ultimum remedium principle in tax law is essential to ensuring a balance between state interests and the protection of taxpayers' rights. The repeal of Article 13A may give rise to new dynamics in the practice of tax criminal enforcement, particularly in shaping enforcement strategies that are responsive to current socio-economic conditions

Abstract

Government policies in Indonesia can have an impact on Indonesia's social and political dynamics regarding issues such as religious law, beliefs and customs. At the same time, the government seeks to strengthen the values of nationalism and unity. However, just as there is no ivory that is not cracked, there are still various pros and cons in the legal perspective, namely religion, beliefs, and customs as a source of law or vice versa as law by legalizing “as is” in positive law. Religion has consistently played an important role in shaping the values, ethics, and moral frameworks that support public policy, both as a source of inspiration and a source of pros and cons. This research method is normative juridical, with secondary data related to doctrines, books, laws and regulations related to government policies with correlations to religion, belief, and custom. The problem studied is how the probelmatics of government policies and legal sources of religion, belief, and custom in Indonesia. Religion in Indonesia is gradually a source of law that is accommodated in Indonesian law, one of which is in the reform of criminal law, namely Law No. 1 of 2024, but several things need attention in policy and implementation, in order to maintain equality between religious communities for the sake of unity and integrity.

Abstract

Government procurement of goods/services always changes in the context of presidential regulations (Perpres), by making these regulations complete and in more detail; In this case, it is certainly a positive development to provide legal protection for contracting parties in the form of goods/services procurement agreements. Agreement or akad (Arabic) which is interpreted as a bond or conclusion; Meanwhile, according to the term, a contract is a mutual agreement or commitment, whether verbal, signed or written, between two/more parties which has binding legal consequences to carry it out. This research analyzes the principle of freedom of contract and balance, which is a principle that is generally used as a reference, even though it seems that there has been a violation of this principle, legally the contract is still acceptable; On the legal side, there is a backbone in the field of civil law, but in its development it often overlaps with the field of criminal law (corruption), and in this research it is linked to Islamic law. The perspective of Islamic law has stated that in the context of civil law a broken promise is qualified as a group that betrays Allah SWT; Meanwhile, according to criminal law, corruption is contrary to the theory of benefit.

Abstract

The phenomenon of klitih in Yogyakarta represents a form of street violence perpetrated by adolescents, often rooted in complex criminogenic factors such as moral degradation, weak family control, the influence of social media, and the glorification of violence by peer groups. This study employs a descriptive qualitative approach through case analysis and an examination of structural, cultural, and systemic factors influencing juvenile delinquency. The implementation of restorative justice as regulated in Law No. 11 of 2012 on the Juvenile Criminal Justice System is deemed ineffective in providing a deterrent effect, particularly in cases of recidivism that neglect the rights of victims. Data from concrete cases indicate patterns of violent behaviour driven by alcohol consumption, possession of sharp weapons, and parental neglect. Social media exacerbates the situation by serving as a medium for glorifying violence and coordinating actions. Therefore, reform of the juvenile justice system is necessary, combining rehabilitative approaches with firm sanctions, especially for repeat offenders. Additionally, digital campaigns promoting counter-narratives to youth violence must be intensified.

Abstract

The Covid-19 pandemic that has hit the world since early 2020 has had an impact on various aspects including the fields of communication and information. Several cases had ended  in the legal realm relate to the ITE Law. This research examines cases of fake and misleading news that are widespread in Indonesia, in 3 fields, namely Health, Government and General Elections. The urgency of fake news  related to consumer losses. Not all fake news causing consumer harm. What are the factors that delays in law enforcement for criminal acts of spreading false and misleading news related to the pandemic and what efforts should be made to deal with it? This research uses normative juridical methods with secondary legal materials; Criminal acts conected to spreading fake news are regulated in the qualifications of Article 35 of the ITE Law 11/2008, which places more emphasis on the phrase manipulation and destruction of information if the result arises, namely consumer losses, then Article 28 (1) of the ITE Law is imposed. Meanwhile, those that cause riots in society in general can be recognized as Article 28 (3).

Abstract

Students (undergraduate programs) have various titles, including agents of change and critical intellectual groups, in various histories of national struggles, as well as today, students are always at the forefront of change and struggle for society; In the context of legal aid, students are also expected to play an active role in realizing justice. The history of legal aid has existed since before independence, but its development can be said to be slow, while poor people often ignore their right to seek legal aid as seekers of justice. The right to obtain legal aid is the state's obligation to provide services to the community through various programs, as an embodiment of a legal state that respects human rights. In this post-reform era, it is worth discussing again what is the role of law faculty students in legal aid? This research uses normative research methods, namely Law no. 16 of 2016 concerning Legal Aid with the role of students in particular and the role of community organizations/advocates in general. On the other hand, legal assistance must also be provided by advocates and community organizations, with various requirements that must be met first.
