Abstract

Government procurement of goods/services always changes in the context of presidential regulations (Perpres), by making these regulations complete and in more detail; In this case, it is certainly a positive development to provide legal protection for contracting parties in the form of goods/services procurement agreements. Agreement or akad (Arabic) which is interpreted as a bond or conclusion; Meanwhile, according to the term, a contract is a mutual agreement or commitment, whether verbal, signed or written, between two/more parties which has binding legal consequences to carry it out. This research analyzes the principle of freedom of contract and balance, which is a principle that is generally used as a reference, even though it seems that there has been a violation of this principle, legally the contract is still acceptable; On the legal side, there is a backbone in the field of civil law, but in its development it often overlaps with the field of criminal law (corruption), and in this research it is linked to Islamic law. The perspective of Islamic law has stated that in the context of civil law a broken promise is qualified as a group that betrays Allah SWT; Meanwhile, according to criminal law, corruption is contrary to the theory of benefit.

Abstract

Kualitas maupun kuantitas tindak pidana korupsi di Indonesia saat ini semakin canggih dan kompleks, sehingga sulit untuk dibuktikan. Maka peran whistleblower serta justice collaborator diharapkan dapat membantu mengungkap modus/ rangkaian tindak pidana korupsi dengan lebih mudah dan menyeluruh. Sayangnya, para pelapor dan justice collaborator dalam kasus korupsi di Indonesia masih khawatir terhadap perlindungan hukum yang maksimal; orang yang akan melaporkan acapkali khawatir nasibnya dikemudian hari atas potensi serang balik dari para koruptor (corruptors fight back). Perlindungan hukum yang ideal adalah dengan memberikan reward, dan perlindungan dari segala tuntutan sebagai imbalan atas apa yang diungkapkan oleh seorang whistleblower, baik dirinya merupakan salah satu pelaku maupun bukan, ini merupakan stimulus yang baik sebagai pembinaan, dan pengejaran terhadap asset hasil tindak pidana korupsi. Permasalahan yang disajikan peneliti adalah peran justice collaborator dan whistleblower dalam upaya penegakan hukum tindak pidana korupsi. Penulis menyimpulkan bahwa pada hakekatnya meskipun sebagai pelaku utama namun tersangka/terdakwa yang berperan sebagai justice collaborator tetap saja menunjukkan berkontribusi dalam mengungkap kasus tersebut, maka penegak hukum harus menghargai atau mengapresiasi dalam perwujudan yang layak dalam perspektif hukum pidana sebagai sarana pembinaan. Kemudian whistleblower penghargaan dan perlindungan yang lebih maksimal.

Abstract

The phenomenon of klitih in Yogyakarta represents a form of street violence perpetrated by adolescents, often rooted in complex criminogenic factors such as moral degradation, weak family control, the influence of social media, and the glorification of violence by peer groups. This study employs a descriptive qualitative approach through case analysis and an examination of structural, cultural, and systemic factors influencing juvenile delinquency. The implementation of restorative justice as regulated in Law No. 11 of 2012 on the Juvenile Criminal Justice System is deemed ineffective in providing a deterrent effect, particularly in cases of recidivism that neglect the rights of victims. Data from concrete cases indicate patterns of violent behaviour driven by alcohol consumption, possession of sharp weapons, and parental neglect. Social media exacerbates the situation by serving as a medium for glorifying violence and coordinating actions. Therefore, reform of the juvenile justice system is necessary, combining rehabilitative approaches with firm sanctions, especially for repeat offenders. Additionally, digital campaigns promoting counter-narratives to youth violence must be intensified.

Abstract

The Covid-19 pandemic that has hit the world since early 2020 has had an impact on various aspects including the fields of communication and information. Several cases had ended  in the legal realm relate to the ITE Law. This research examines cases of fake and misleading news that are widespread in Indonesia, in 3 fields, namely Health, Government and General Elections. The urgency of fake news  related to consumer losses. Not all fake news causing consumer harm. What are the factors that delays in law enforcement for criminal acts of spreading false and misleading news related to the pandemic and what efforts should be made to deal with it? This research uses normative juridical methods with secondary legal materials; Criminal acts conected to spreading fake news are regulated in the qualifications of Article 35 of the ITE Law 11/2008, which places more emphasis on the phrase manipulation and destruction of information if the result arises, namely consumer losses, then Article 28 (1) of the ITE Law is imposed. Meanwhile, those that cause riots in society in general can be recognized as Article 28 (3).

Abstract

Students (undergraduate programs) have various titles, including agents of change and critical intellectual groups, in various histories of national struggles, as well as today, students are always at the forefront of change and struggle for society; In the context of legal aid, students are also expected to play an active role in realizing justice. The history of legal aid has existed since before independence, but its development can be said to be slow, while poor people often ignore their right to seek legal aid as seekers of justice. The right to obtain legal aid is the state's obligation to provide services to the community through various programs, as an embodiment of a legal state that respects human rights. In this post-reform era, it is worth discussing again what is the role of law faculty students in legal aid? This research uses normative research methods, namely Law no. 16 of 2016 concerning Legal Aid with the role of students in particular and the role of community organizations/advocates in general. On the other hand, legal assistance must also be provided by advocates and community organizations, with various requirements that must be met first.

Abstract

Penelitian ini membahas konflik sosial yang terjadi di masyarakat yang disebabkan oleh perbedaan pendapat dan konflik. Maka memerlukan faktor/upaya untuk mengurangi persinggungan atas perbedaan, perbedaan dapat terjadi dan berkembang menjadi konflik. Menurut perspektif kontemporer tentang konflik, konflik adalah konsekuensi logis dari interaksi manusia dan merupakan salah satu konflik sosial yang menjadi isu nasional. Namun, masalahnya bukan sebatas meminimalkan atau menahan konflik, tetapi upaya-upaya menyelesaikannya dengan benar sehingga tidak merusak hubungan atau organisasi. Konflik dapat membahayakan atau justru menguntungkan suatu hubungan (relasi sosial), tergantung motif dan penyelesaiannya. Konflik menimbulkan emosi yang kuat, jadi harus menggunakan akal sehat untuk menyelesaikan masalah. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, memanfaatkan data sekunder, untuk menjawab rumusan masalah konflik sosial dalam undang-undang tentang penanganan konflik sosial di era internet. Potensi konflik lebih mudah dan lebih cepat tersebar di era internet. Unsur sosiologis dalam pembentukan undang-undang (norma) hanya sering kali bersifat artifisial atau hanya bersifat menempel untuk memenuhi syarat formil pembentukan peraturan perundang-undangannya. UU No. 7 Tahun 2012 tentang Penanganan Konflik Sosial belum tersosialisasi dengan baik atau bahkan terdapat masalah dalam penyusunannya, sehingga konflik sosial masih sporadis terjadi. Pemerintah maupun pejabat partai politik ke depannya perlu menghindari penggunaan dikotomi orang kaya dan orang miskin dalam kaitannya untuk menjalankan program/kebijakan.

Abstract

Cases of sexual violence against children increase every year in Indonesia. Based on data from the Ministry of Women's Empowerment and Child Protection (Kempppa), the total number of children who were victims of sexual violence from 2019 to 2021 increased. From 2019 to 2020, cases of sexual violence against children increased to 6,980 cases, then from 2020 to 2021 there was another increase to 8,730 cases. This study aims to determine and analyze the imposition of prison sentences for perpetrators of sexual intercourse with children in Indonesia; about chemical castration for perpetrators of sexual violence against children in Indonesia; about children as victims of sexual violence against children. The research method used is normative juridical which is sourced from secondary data, the material legal analysis is qualitative. The results of the study found that the imposition of prison sentences for perpetrators of sexual intercourse with children is threatened with a minimum prison sentence of 5 (five) years to the death penalty (in certain cases), as well as how many additional chemical castration sentences meet the requirements as decisions that cannot be accepted by human reason. Sexual violence against children is a criminal act regulated in several Constitutions and other laws in Indonesia. The punishment of chemical castration is a decision that has become positive law, but several parties consider it inhumane, including the statement of Komnas HAM.

Abstract

Revolusi industri sudah beranjak dari 4.0 mengarah ke 5.0 berbagai dinamika yang diwarnai internet telah kita alami hingga hari ini dan terus berkembang. Budaya dalam masyarakat semakin dinamis dan cepat berubah-ubah.. Disini perliku masyarakat dalam memenuhi kebutuhan ekonominya maupun kebutuhan akan sosialisasi menjadi makin berkembang dan terasa mengarah liberal. Banyak konten yang secara sadar atau tidak sadar mengeksploitasi hal tertentu, misalnya anak maupun perbuatan-perbuatan lain yang negatif;; sedangkan media sosial yang digunakan bervariatif, salah satunya media sosial/youtube. Penelitian yang bersifat normative/yuridis normatif dengan permasalahan adalah bagaimana urgensi perlindungan hukum pada eksploitasi anak melalui konten pada sosial media/ youtube. Menyuruh dan atau menggunakan anak untuk membuat konten di sosial media memiliki indikasi/ dapat berakibat sebagai eksploitasi anak secara ekonomi, sosial, bahkan berpotensi eksploitasi seksual tentu terkait jika ada pihak-pihak yang menyalahgunakan dengan niat jahat

Abstract

Perkembangan e-commerce saat ini menjadi pasar yang besar dalam dunia perdagangan. Hal ini juga berpotensi menjadi ancaman bagi pelaku usaha dengan adanya praktik penipuan online. Sehingga perlu serangkaian perlindungan hukum, untuk mengatasi permasalahan tersebut penelitian ini menggunakan keseimbangan monodualistik yang ada dalam UU ITE. Asas monodualistik pun telah diakomodir oleh KUHP Baru dimana dalam konsep ini mengedepankan kepentingan antara individu/ perorangan dengan kepentingan umum/ masyarakat, termasuk adanya keseimbangan anatara kepentingan pelaku dan korban. Jenis penelitian dalam penulisan ini adalah yuridis normatif, yaitu penelitian hukum doktriner, juga disebut sebagai penelitian perpustakaan atau studi dokumen. Hasil penelitian ini frasa mengakibatkan “…kerugian konsumen”, menurut pendapat penulis merupakan ketidak seimbangan, mengingat dewasa ini yang dapat melakukan tindak pidana tidak hanya produsen, melainkan juga para konsumen yang memang memiliki itikad tidak baik, maka dalam UU ITE yang menitikberatkan perlindungan kepada konsumen dalam porsi yang lebih besar justru merupakan kriminalisasi berlebihan kepada produsen/ penjual, kriminalisasi harus dilakukan secara hati-hati untuk mencegah adanya kriminalisasi.

Abstract

The Indonesian state has a firm and constitutional obligation to advance national culture as mandated in Article 32, paragraph (1) of the 1945 Constitution. This article guarantees the freedom of the community to preserve and develop cultural values. Indonesian culture, reflecting the noble values of the nation, must be embraced by all citizens to strengthen national identity, enhance dignity, and reinforce unity to achieve the nation's future goals. The preamble of the 1945 Constitution of the Republic of Indonesia outlines the national goals of protecting all Indonesians and their homeland, promoting general welfare, educating the nation's life, and participating in maintaining world order based on freedom, eternal peace, and social justice. The diversity of ethnic groups, customs, languages, local knowledge and technology, traditions, local wisdom, and arts are valuable cultural heritages that shape the nation's identity amid global development. According to various articles in the 1945 Constitution of the Republic of Indonesia, the country possesses extraordinary artistic and cultural wealth that must be protected. Local governments, as the forefront of governance, have an obligation to preserve culture to strengthen the nation's identity. Purworejo Regency, with its rich local traditions, has the responsibility to preserve regional cultural expressions through protection, development, utilization, coaching, and cultural supervision. Copyright protection of traditional art works is considered an economic asset and a national identity. The Purworejo Regional House of Representatives (DPRD) has taken the initiative to draft regional regulations to protect and preserve traditional cultural expressions, demonstrating the local government's commitment to safeguarding cultural heritage and promoting the development of local cultural wealth for the welfare of the community and regional advancement.
