Abstract

Disputes against well-known brands often occur in Indonesia. One of them is in the case of the Central Jakarta Commercial Court decision Number 70/PDT.SUS-MEREK/2022/PNNIAGA JKTPST. The issues raised are 1) what is the legal protection for holders of well-known farmstay brands for similar classes based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications and 2) what are the judge's considerations in Decision Number 70/PDT.SUS-MEREK/2022/PN NIAGA JKT PST is seen from Law Number 20 of 2016 concerning Marks and Geographical Indications. The research method is of the normative type with the nature of descriptive research, the data used is secondary data which is carried out through literature study and then qualitative analysis and deductive logic are carried out to draw conclusions. From the results of the research, it can be seen that legal protection for holders of well-known farmstay brands for similar classes is by granting an application to be able to apply for cancellation of a brand, in this case the trademark registration was carried out by Monica based on Article 21 paragraph (1) letter b and paragraph (3) Law on Trademarks and Geographical Indications. The judge, in his legal considerations, rejected the application for cancellation of a trademark, which was not in accordance with the provisions of Article 21 paragraph (1) letter b and paragraph (3) of the Trademark Law, which is the reason a registered mark can be canceled as contained in the provisions of Article 76 paragraph (1) of the Law. -Law on Trademarks and Geographical Indications.

Abstract

Trademark infringement occurs because there is a similarity in substance or in its entirety to a brand, as is the case in case Number 24/Pdt.Sus-Merek/2021/PN.Niaga.Jkt.Pst. Problems 1) What are the regulations for the protection of rights holders of the HELP brand whose marks are used by other parties based on Law no. 20 of 2016 concerning Brands and Geographical Indications?. 2) Is the Commercial Court judge's decision regarding the HELP trademark dispute in accordance with Law no. 20 of 2016 concerning Brands and Geographical Indications?. This research is of the normative type with the nature of descriptive research with secondary data carried out by literature study and then carried out qualitative analysis and deductive logic to draw conclusions. The results of the research can be seen. Legal protection against Melia Lustojoputro as the owner of the rights to the "HELP" brand whose brand is used by another party, namely PT Solusi Solusi Digital without permission, can file a trademark cancellation lawsuit against the HELPOLD brand owned by PT Solusi Solusi Digital based on the provisions of Article 76 of the Law. Trademarks and Geographical Indications and the Commercial Court judge's decision regarding the HELP trademark dispute are not in accordance with the provisions contained in Article 21 paragraph (1) and paragraph (3) of Law no. 20 of 2016 concerning Brands and Geographical Indications

Abstract

Brands are included in intellectual property rights where the rights holder of the brand is given legal protection for both local and foreign brands. The issues raised are how was the protection of Jollibee brand holder in Indonesia according to Law Number 20 of 2016 concerning Brands and Geographical Indications, and how was the Commercial Court Judge's decision in deciding the Jollibee brand dispute based on Law Number 20 of 2016 concerning Brands and Geographical Indications. This research is conducted by normative legal research with a descriptive nature, the data used is secondary data obtained through literature studies, then the data is analyzed by qualitative with drawing conclusions deductively. The results of the study showed that Legal Protection for the holder of the Jollibee Brand Owned by Karsino is given due to Brand Certification he has, however, for the first registered trademark can be cancelled if it violates the provisions of Article 21 Paragraph (3). The judge's decision in case Number 9/PDT.SUS-MEREK/2023/PN.NIAGA.JKT.PST that rejected the application to cancel the Jollibee trademark owned by Karsino is not in accordance with Article 21 paragraph (3) of the Trademarks and Geographical Indications Law.
