Abstract

This article aims to comprehensively analyze the legal status of land use and spatial planning as a source of legal risk in construction projects, as well as its implications for private developers and contractors. This study uses a normative legal research method with a statutory, conceptual, and case study approach, by examining relevant laws and regulations, legal doctrine, and court decisions, including Supreme Court Decision Number 3053 K/Pdt/2011 and an apartment development dispute at the West Jakarta District Court. The results of the study indicate that land rights are not absolute and are always limited by spatial planning provisions as a public legal instrument. Weak synchronization of the RTRW/RDTR, zoning changes, and low internalization of the social function of land in development practices are dominant factors in the occurrence of disputes and project terminations. This study also found that contractors can no longer be positioned solely as technical implementers, but rather as active subjects of spatial planning compliance who potentially bear legal risks if they continue to carry out work that conflicts with spatial designations.These findings and proposals are expected to strengthen legal certainty, improve projectgovernance, and minimize disputes in private sector development.

Abstract

Construction contract disputes in government projects funded thru the State Revenue and Expenditure Budget (APBN) and the Regional Revenue and Expenditure Budget (APBD) are legal issues that frequently occur and have wide-ranging implications for public interests. One of the dominant forms of disputes is default in the execution of construction contracts, whether committed by the service provider or the service user. This research aims to analyze the characteristics of default in government project construction contracts and to examine the legal considerations of the Supreme Court in Decision Number 171 PK/PDT/2025. This research uses a normative legal research method with an approach based on legislation, conceptual, and case approaches. The scope of this research is limited to the analysis of default in construction contracts for government projects funded by the state budget (APBN/APBD) and the legal considerations of the Supreme Court at the review stage, without discussing the technical aspects of construction or the overall procurement process of goods and services. The research results show that default in government construction contracts has complex characteristics because it lies at the intersection of civil law and public law. The Supreme Court in that ruling consistently applied the principle of legal certainty and the principle of pacta sunt servanda by limiting the scope of the Review process to the aspect of law application. This decision has important implications in strengthening legal certainty and providing guidance for the parties involved in the implementation of construction contracts for government projects funded by the state budget (APBN/APBD).

Abstract

Penelitian ini melakukan analisis komprehensif terhadap implementasi arbitrase dalam penyelesaian sengketa konstruksi di Indonesia. Menggunakan metodologi yuridis normatif dengan pendekatan kualitatif-deskriptif, penelitian ini mengkaji Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Undang-Undang Nomor 2 Tahun 2017 tentang Jasa Konstruksi. Analisis data BANI periode 2019-2023 mengungkapkan mekanisme arbitrase yang sistematis meliputi prosedur pengajuan, pemilihan arbiter (45% praktisi hukum konstruksi, 30% akademisi hukum, 25% ahli teknik), proses pemeriksaan, dan implementasi putusan. Penelitian mengidentifikasi empat tantangan utama: biaya awal tinggi (30% di atas litigasi), keterbatasan upaya hukum pasca putusan (23% responden keberatan), kompleksitas prosedural (35% kasus tertunda), dan potensi konflik kepentingan (18% kasus). Meski menghadapi tantangan, arbitrase menunjukkan efektivitas melalui standardisasi kualifikasi arbiter (tingkat kompetensi 92%), perlindungan kerahasiaan (tingkat kepuasan 87%), dan kepatuhan sukarela tinggi (75% putusan). Penelitian menyimpulkan bahwa meskipun arbitrase menawarkan mekanisme penyelesaian sengketa yang efisien, dibuktikan dengan rata-rata waktu penyelesaian 180 hari berbanding 2-3 tahun untuk litigasi, diperlukan penyempurnaan sistematis dalam struktur biaya, mekanisme review, modernisasi prosedur, dan verifikasi independensi arbiter

Abstract

Tujuan penelitian ini adalah peneliti akan melakukan peninjauan dan analisa sampai sejauh mana kondisi pendemi covid-19 mempengaruhi kinerja biaya dan kinerja waktu pada proyek- proyek pembangkit listrik nasional sehingga memunculkan potensi klaim konstruksi yang berujung pada sebuah sengketa konstruksi. Penelitian ini bersifat deskriptif kuantitatif dimana tahapan yang akan dilaksanakan oleh peneliti dalam rangka mencapai tujuan penelitian ini adalah dengan membuat pertanyaan sebagai pertanyaan penelitian (research question). Peneliti akan melakukan penelitian di beberapa proyek pembangkit listrik baik itu milik perusahaan swasta maupun milik BUMN yang sedang dalam fase proses konstruksi di periode pandemic Covid-19. Hasil penelitian ini menunjukkan ada pengaruh antara kinerja waktu dan biaya pada masa pandemi covid-19 terhadap munculnya potensi klaim pada proyek-proyek pembangkit listrik nasional. Dampak pendemi Covid-19 mempengaruhi secara dominan penurunan kinerja waktu yang mengakibatkan keterlambatan waktu pada proyek-proyek konstruksi pembangkit listrik nasional. Dampak Pendemi Covid-19 mempengaruhi kinerja biaya sehingga meningkatkan biaya proyek konstruksi pada proyek-proyek konstruksi pembangkit listrik nasional namun tidak dominan atau pengaruhnya tidak sebesar kinerja waktu.

Abstract

ABSTRACT The Government of Indonesia was committed to encouraging public-private partnership (PPP) schemes to address gaps in infrastructure development. But not all projects offered through the PPP scheme have a high degree of eligibility because the project is a long-term investment with a considerable degree of risk challenge. Efforts to improve the feasibility of investing in toll road PPP projects were made such as investment guarantees and incentives for the private sector. This study is a continuation of previous research that was an implementation of the incentive system in PPP project contract to increase investment feasibility. In this study, the authors want to obtain a general description of:(1) Existing condition of research location and land use based on Local Regulation around Bali Mandara Highway (Field Observation and Local Regulation), (2) To know the wishes of the people around Highway in a location that allows applied spatial use incentive system (Interview Method), (3) Assessing the spatial plan at the foot of the toll road regarding spatial use plan with guidance on incentives and density utilization of space on the highway (method of cropping the map). From the result of the research, it can be seen the general description of the people's desire to play a role in the utilization of space around the Nusa Dua toll, where the results of satellite image analysis and the spatial regulation on spatial planning allow the availability of land for spatial use activities around highway about 10 hectares. Abstract

Gaps Infrastructure financing in Indonesia must be sought out, one of which is to improve the performance of PPP projects to be bankable / economically viable / investment-worthy so that investors / private companies are willing / interested in investing in infrastructure projects. with Malaysia which now has more than 3000 km of toll roads. The incentive system is implemented in developed countries to improve the performance of feasibility and anticipate risks in toll road KPS projects that have long-term contract / concession time. Burris, Baker, Geiselbrecht (2014). The government needs to make a breakthrough to provide space utilization incentives as a form of controlling the use of space where investors and the public can participate by working together to increase toll revenues. The intended use of space is the management of the area around the toll road with a certain amount of area and the allocation of the management plan that has the maximum economic impact so that investors can obtain other income that can be included in the toll revenue cash flow. This study uses the AHP method with digital analysis with Expert Choice to produce the following analysis: the highest criteria for incentive for space utilization activities. The highest sub-criteria are in the physical provision of compensation from the government to the community where the land is applied to incentives for spatial use.

Abstract

Legal protection for construction workers in employment contracts is an important aspect of employment law in Indonesia. Construction workers often face high risks related to work safety, uncertainty of employment status, and normative rights that have not been fully fulfilled. This study aims to analyze legal protection for construction workers based on Law Number 11 of 2020 concerning Job Creation and its derivative regulations, including Government Regulation Number 35 of 2021 concerning Fixed-Term Employment Agreements, Outsourcing, Working Hours, and Rest Time and Termination of Employment. The method used is a normative legal approach by examining laws and regulations, court decisions, and relevant academic literature. The results of the study show that legal protection for construction workers includes guarantees of work safety and health, certainty of employment relationships, the right to decent wages, and social protection. However, challenges still arise in the implementation of regulations, especially in the supervision and compliance of companies with applicable regulations. Therefore, it is necessary to strengthen policies, increase government supervision, and increase legal awareness for workers and employers to ensure optimal protection of construction workers' rights.
