Abstract

Penelitian ini merupakan penelitian lapangan yang bertujuan untuk menge­tahui tiga hal, yaitu: latar belakang perubahan fatwa MUI tentang vasektomi dari haram menjadi halal dengan syarat; tanggapan ulama; dan pengaruh fatwa terhadap peningkatan jumlah peserta vasektomi di Jawa Tengah. Pengumpulan data dilakukan dengan teknik do­kumentasi dan wawancara sedangkan analisis data dilakukan dengan teknik deskriptif kualitatif. Hasil penelitian ini adalah: 1) Alasan perubahan fatwa hukum vasek­tomi dari haram menjadi halal dengan syarat adalah karena adanya ‘illat baru, yaitu keberhasilan rekanalisasi. 2) Terhadap fatwa baru tersebut, Ulama Muhammadiyah menyetujui dengan pengetatan dan penambahan syarat tertentu. Sedangkan ulama NU kurang setuju terhadap fatwa ter­sebut karena bukti keberhasilan rekanalisasi dianggap belum me­yakin­kan (muḥaqqaqah). 3) Fatwa baru vasektomi tersebut belum ber­dampak pada peningkatan jumlah peserta vasektomi di Jawa Tengah.***This field research aims to determine three things: the background of the changing legal opinion (fatwa) of MUI on Vasectomy from ‘haram’ to ‘halal on condition’; responses from the Moslem scholars; and the impact of fatwa on increasing the number of Vasectomy participants in Central Java. Abstract

Terjadi fenomena ketenagakerjaan yang cukup unik di Indonesia seiring dengan berkembangnya ekonomi gig. Salah satu fenomena ketenagakerjaan yang berkembang dalam satu dekade terakhir yaitu munculnya hubungan kemitraan yang semakin booming akibat munculnya Gojek sebagai salah satu pelopor transportasi online di Indonesia. Pasar tenaga kerja di Indonesia tersegmentasi antara tenaga kerja formal dan tenaga kerja informal. Pada tahun 2022, share tenaga kerja di sektor formal sebesar 49,69% lebih kecil jika dibandingkan dengan sektor informal (59,31%). Hal ini menunjukan bahwa dorongan masyarakat untuk dapat bekerja di sektor informal masih tinggi. Kajian ini bertujuan untuk menganalisis serta mengidentifikasi kondisi kerja kemitraan pada transportasi online di Indonesia. Kajian ini menggunakan data primer yang diperoleh dari indepth interview dengan komunitas ojek online di tiga provinsi pada zonasi 1, yaitu D.I Yogyakarta, Jawa Timur, dan Jawa Barat. Data primer juga diperoleh melalui Focus Group Discussion (FGD) dengan stakeholder terkait seperti Dinas Tenaga Kerja yang berada di setiap wilayah kajian. Data primer selanjutnya dianalisis dengan menggunakan metode analisis deskriptif. Kajian ini juga menggunakan data sekunder yang diperoleh dari beberapa studi literatur terkait kondisi transportasi online di beberapa negara. Data sekunder yang diperoleh selanjutnya dianalisis menggunakan analisis komparatif. Hasil analisis menunjukan transportasi online berkembang dengan sangat cepat di Indonesia. Terdapat permasalahan umum terkait transportasi online di Indonesia, diantaranya (1) kekosongan pengaturan hukum terkait kemitraan; (2) Kekosongan pengaturan hukum terkait transportasi online ; dan (3) kerentanan-kerentanan yang dialami oleh pengemudi. Kebijakan terkait transportasi online berbeda-beda di setiap negara bergantung dengan peraturan yang dibuat oleh pemerintah setempat.

Abstract

Ketersediaan lapangan pekerjaan Indonesia masih belum seimbang dengan jumlah angkatan kerja yang ada terutama pada kelompok yang berpendidikan rendah, kesempatan kerja yang tinggi di luar negeri dianggap sebagai solusi untuk menjawab permasalahan tersebut. Pada tahun-tahun terakhir, beberapa Pemerintah Daerah Korea Selatan menawarkan kerja sama SWP dengan melakukan penjajakan langsung kepada beberapa Pemerintah Daerah di Indonesia. Tujuan kajian untuk memberikan rekomendasi terkait skema penempatan pekerja musiman dan pembagian hak dan kewajiban yang adil serta mitigasi benefit dan problem penempatan PMI. Metode yang digunakan dalam kajian ini adalah kualitatif dengan jenis studi kasus yakni bertujuan untuk menganalisis upaya penempatan PMI musiman ke Korea Selatan. Untuk mendukung keberhasilan SWP maka diperlukannya aturan tentang mekanisme proses pra-penerimaan di Korea Selatan dan pra-pengiriman di Indonesia oleh Kementerian Ketenagakerjaan, perlu penyesuaian mekanisme bagi pelaksanaan SWP di Indonesia melalui Penyusunan Petunjuk Teknis Kementerian Ketenagakerjaan oleh K/L di lingkungan Pemerintah Pusat dan Pemerintah Daerah, dan berkoordinasi langsung ke Pemerintah Korea Selatan (MOJ, MOEL, dan pemberi kerja) oleh Pemerintah Indonesia.

Abstract

In 2023, amidst the complexities of a volatile global economy, Indonesia demonstrated economic resilience, propelled by its dynamic workforce. This abstract synthesizes the intricate interplay between macroeconomic forces and employment trends within Indonesia, drawing from comprehensive data analyses and policy evaluations. The report encapsulates a year marked by economic recovery despite global headwinds such as the Russia-Ukraine conflict, inflation surges, and supply chain interruptions. With a predicted global growth of 3.6% by the IMF, Indonesia's economy experienced fluctuations but maintained a growth trajectory from Q2 2022 to Q2 2023. Labor force data indicates a predominance of the working-age population, signaling potential for sustained productivity and economic fortitude. The demographic composition, skewed towards a younger populace, underpins the vibrant labor market. Employment policies have been responsive to digitalization, globalization, and demographic transitions, focusing on skill development, vocational training, and job safety. Notably, vocational training for SMK graduates was prioritized to match industry requirements. Regulatory advancements aim to balance worker protections with corporate operational efficiency. Amidst COVID-19's lingering impact, policy adaptations were crucial to support workers and businesses, exemplifying Indonesia’s agility in times of crisis. The landscape of employment disputes, predominantly centered around termination, underscores the necessity for robust conflict resolution mechanisms. With 71.15% of industrial disputes tied to terminations, mediation emerged as the preferred dispute resolution strategy. Regional data unveiled disparities in job placements and complaints, spotlighting the need for equitable workforce distribution and grievance redressal mechanisms. The report concludes that Indonesia's labor policies and employment conditions are dynamically evolving, poised to sculpt a robust, inclusive, and sustainable labor market landscape.

Abstract

Law No. 11 of 2020 on Job Creation has been reported by ITUC, KSPI, and KSBSI for violating ILO Convention No. 98. The Indonesian government is considered not involving Trade Unions/Labor Unions in terms of collective bargaining when drafting the Job Creation Law and the substance of the Job Creation Law which is considered to limit the role of Trade Unions/Labor Unions. The United States Government, the United States Labor Association, the Belgium Labor Association, Netherlands Labor Association, Republic of Korean Labor Association, and the Brazil Labor Association provide different views from Indonesia on the report. This study uses a qualitative approach supported by a literature study with FGD discussions. Based on the results of the study, reports by Trade Unions to the ILO regarding violations of ILO Convention No. 98 are generally still conjectural and do not depart from cases or violations of the law that have occurred. The government can report data on labor practices in Indonesia to show that there are no efforts to limit the role of Trade Unions/Labor Unions as evidence that the Government of Indonesia has implemented the principles in the ILO Convention. The government of Indonesia has an important role in increasing the provision of training and improving work competencies, increasing labor placement and expanding employment opportunities, as well as continuing to oversee the implementation of this Job Creation Law in companies and continuing to protect workers by providing legal protection and social security. The Government of Indonesia is currently receiving ILO Technical Assistance, and can propose to continue implementing the Job Creation Law regulations and continue to provide regular reports to the ILO. If this provision in practice is detrimental to workers and trade unions, then this provision can be challenged procedurally with the support of valid evidence.

Abstract

Fluctuations in the national economy caused by several things, such as a decline in economic growth, the global economic crisis, and the COVID-19 pandemic, often lead to layoffs (PHK). Layoffs have various negative impacts on life, such as depression, mental health, financial problems, social relationships, decreased physical health, and impacts on careers. The JKP program is one of the policies to overcome these negative impacts. The JKP program is designed to provide financial support, job training, and access to labor market information for laid-off workers, with the aim of reducing the social and economic impact of layoffs and helping workers return to the labor market with better skills. The aim of this research is to explain the JKP program as a response to government policy in overcoming the negative impacts of layoffs. This research uses a qualitative and quantitative descriptive approach. The implementation of the JKP program has shown positive results, such as increasing people's purchasing power and contributing to economic recovery. However, there are several challenges in its implementation, including infrastructure, technical problems and uneven socialization. Periodic program evaluation is needed to address this problem and ensure the long-term effectiveness of the JKP program. This article also emphasizes the importance of collaboration between government and industry in improving the relevance and quality of vocational training. It is hoped that the JKP program can continue to adapt and improve protection for workers in Indonesia, thereby providing better economic and social stability

Abstract

Di tengah pandemi Covid-19 dalam tahun 2020, kinerja pembangunan sektor energi bervariasi. Konsumsi energi, baik BBM, maupun listrik menurun terutama karena pembatasan kegiatan transportasi dan produksi industri (termasuk UMKM). Produksi energi primer seperti minyak bumi, gas bumi, dan batubara juga menurun atau di bawah target karena terganggunya sistem logistik dan rantai pasok. Investasi di sektor energi menurun, subsidi energi meningkat. Walaupun produksi dan konsumsi energi menurun, namun sumbangan energi kepada pendapatan negara tahun 2020 lebih besar daripada yang ditargetkan. Tahun 2020 menunjukkan perkembangan menggembirakan dalam peningkatan rasio elektrifikasi, sebaran program “BBM Satu Harga”, dan peningkatan jumlah rumah tangga yang tersambung aliran gas bumi. Pemanfaatan energi terbarukan dalam pembangkitan listrik dan bio-diesel meningkat, namun pangsa energi terbarukan dalam bauran energi nasional masih rendah untuk dapat mencapai target 23 persen pada tahun 2025.

Abstract

Masalah pengangguran dan kebijakan ketenagakerjaan menjadi prioritas pemerintahan melalui kebijakan pemerintah yang berorientasi pada full employment yang diharapkan akan berdampak pada peningkatan investasi dan pertumbuhan ekonomi. Konsep welfare to work (WTW) saat ini telah menjadi pembahasan sentral di banyak negara saat berbicara tentang isu pengangguran dan ketenagakerjaan. Model ini adalah salah satu oprasional dari pendekatan Active Labour Market Policy (ALMP) yang muncul sebagai kritik atas pendekatan lama yaitu Passive Labour Market Policy (PLMP). Untuk mengatasi hal tersebut maka perlu dikembangkan sebuah pendekatan yang secara jelas dan sistematis benar-benar mengantarkan para pencari kerja untuk dapat kembali bekerja. Tujuan dari penelitian ini adalah: (1) melakukan identifikasi atas faktor-faktor penentu atas dukungan implementasi Program Kartu Prakerja; (2) Menyusun disain hubungan antar lembaga antar pemerintah pelaksana Program Kartu Prakerja dengan lembaga penyedia jasa swasta dan organisasi lokal; (3) Menyusun mekanisme insentif baik bagi pencari kerja maupun lembaga penyedia layanan WTW khususnya pada pencari kerja dari kelompok rentan; (4) Menyusun desain program peningkatan kapasitas dan profesioanalitas petugas penyedia pelayanan lapangan (frontliner-activation workers) 5) Memetakan persepsi kelompok terdampak atas keberadaan Program Kartu Prakerja di Indonesia. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif. Program Kartu Prakerja adalah suatu kebijakan yang dikeluarkan pemerintah ditengah kondisi pandemi COVID-19 sebagai suatu social safety net dan untuk melatih serta meningkatkan kompetensi angkatan kerja menghadapi bonus demografi pada tahun 2030. Sosialisasi yang digunakan oleh pihak dinas secara intensif hanya dilakukan melalui satu platform media sosial (instagram). Selain itu, interaksi yang terjadi dalam akun tersebut dapat dikatakan sangat minim dan kurang efektif.

Abstract

The purpose of this study is to evaluate the Wage Subsidy Assistance Program (Bantuan Subsidi Upah/BSU) distribution in 2021, which the Government has distributed since August 2021. In contrast to the distribution of BSU in the previous year, this program targets 8.8 million workers with the amount of assistance and criteria slightly different compared to the BSU in 2020. This evaluation becomes important to find out how the process of implementing BSU distribution will be in 2021 and to provide recommendations for improving BSU distribution policies and future policies related to the distribution of similar assistance. Data were obtained from various sources, both primary and secondary. Primary data collection was carried out in five regions, namely the provinces of Banten, West Java, Central Java, Yogyakarta, and East Java, with samples consisting of companies, Labor Offices, Labor Social Security Administering Body (BPJS TK), and Banking operators in the regions. The consideration of the research locus refers to the amount of data on BSU recipients, where Java is the region with the largest number of recipients by region. Secondary data is obtained from various scientific literature and government publication. The qualitative research method using interview guidelines as a data collection tool and root cause analysis matrices as an analytical tool was chosen to get a clear picture of the BSU distribution process in 2021. The findings concluded that the 2021 BSU distribution model was not as good as the 2020 BSU distribution model. There were three main problems within, namely 1) data validity, 2) information services, and 3) bank account opening (Burekol). The suggestions for this study are 1) to change the distribution model, which was originally through individual transfers, to be collective (through companies/institutions) and 2) if continue to use the previous model (Burekol), cooperation between field agencies (Disnaker, regional BPJS TK, and banking branch) is strengthened in an integrated system.
