Abstract

The Indonesian criminal justice system struggles to achieve substantive justice due to the dominance of a retributive approach, resulting in prison overcrowding and high recidivism rates. Restorative justice offers an alternative emphasizing reconciliation and social balance, consistent with long-standing indigenous justice practices in the archipelago. This study analyzes the juridical construction of customary justice recognition within the national legal system, explores the opportunities and challenges of integrating it as an instrument of restorative justice, and formulates an ideal synergy model between customary and formal justice systems. This systematic review examines the role, opportunities, and challenges of indigenous justice systems in promoting restorative justice in Indonesia. Operating under a rigorous systematic protocol to eliminate convenience sampling bias, electronic searches were conducted across the Scopus, Web of Science, and Garuda databases using the query (indigenous justice or adat) and (restorative justice) Indonesia. Strict, explicit selection criteria requiring peer-reviewed journal articles published between 2021 and 2026 that directly analyze Indonesian customary law and localized restorative values narrowed a total of 142 initially identified articles down to exactly five core publications. Synthesizing these five selected studies reveals that formal recognition remains a primary opportunity, while human rights standardization and statutory synchronization present significant hurdles. Furthermore, conflict resolution effectiveness is highlighted through comparative illustrative examples extracted directly from the reviewed literature specifically focusing on the customary practices of the Baduy community and dispute resolution in Peniti Village rather than through empirical field data collected by the author. Ultimately, rather than overreaching to formulate an absolute ideal model, this targeted review proportionately proposes a conceptual framework and identifies key design principles to guide policymakers in harmonizing customary mechanisms with Indonesia's national criminal justice reform.

Abstract

Flood disasters frequently transform or eliminate the physical characteristics of land, generating legal uncertainty regarding the continuity of land rights. This article analyzes the legal status of land rights over land destroyed by floods under Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 3 of 2024, which amends Regulation Number 17 of 2021 concerning Procedures for Determining Destroyed Land. Employing normative juridical research with statutory and conceptual approaches, the study demonstrates that land rights are not automatically extinguished when land is affected by floods, mudflows, or temporary inundation. Rather, rights may be terminated only after the land is legally determined to be destroyed, namely when it has permanently lost its original physical characteristics, can no longer be identified, and is no longer capable of being used or utilized. The findings further reveal that the 2024 regulation strengthens legal certainty by establishing clearer criteria and administrative procedures for determining destroyed land while affirming the state's obligation to update land registration records and facilitate recovery measures, including relocation and social assistance for affected rights holders. This study contributes to the development of disaster-responsive land law by clarifying the legal distinction between temporary disaster impacts and the permanent extinction of land rights.

Abstract

Kegiatan ini bertujuan untuk membekali masyarakat dan aparatur desa Alue Rime, Kabupaten Aceh Utara dengan pengetahuan terkait dengan teknik penyusunan peraturan desa peraturan desa (qanun desa). Setelah mengikuti pelatihan ini, peserta diharapkan dapat menjalankan proses perancangan peraturan perundang-undangan sesuai dengan asas, kaidah, norma dan peraturan yang berlaku. Selama proses pembelajaran peserta akan memperoleh pemaparan materi terkait terkait jenis hierarki dan materi muatan peraturan perundang-undangan, perencanaan penyusunan dan pembahasan peraturan perundang-undangan, naskah akademik, teknik penyusunan peraturan perundang-undangan, legislasi semu, teknik penyusunan harmonisasi penetapan pengundangan peraturan, pengesahan hingga pada praktek simulasi penyusunan peraturan perundang-undangan. Penyampaian materi dilakukan dengan metode pembelajaran diskusi dan ceramah untuk penyampaian materi pembelajaran dan diskusi untuk memperdalam materi yang diberikan. Untuk mengukur peningkatan pengetahuan peserta maka panitia akan mengerjakan pre-test sebelum pelaksanaan pembelajaran dan post-test setelah pembelajaran terstruktur selesai dilaksanakan.

Abstract

Bullying in education is a despicable and illegal act. Bullying can hurt the victim both physically and mentally. Perpetrators and victims of bullying in schools are generally still minors, so that the settlement of these cases must pay attention to the rights of children which have been regulated in Law Number 35 of 2014 Jo. Law Number 17 of 2016 concerning Child Protection. In-Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, the mechanism for resolving cases involving children uses a restorative justice approach through a diversionary case settlement mechanism. The diversion mechanism is carried out outside the court (non-litigation) by carrying out mediation between the perpetrator and the victim and attended by both families of the perpetrators and victims, law enforcers, and the community. Diversion must be pursued by law enforcement at every stage of the judiciary, both at the stage of the investigation, prosecution and examination of cases in court. However, if the diversion mechanism fails or the perpetrator of bullying does not meet the requirements for the diversion mechanism, the crime of bullying will be resolved through litigation through juvenile justice.

Abstract

Saat ini marak terjadi dikalangan remaja khsusnya remaja yang masih dibangku sekolah melakukan tindak pidana judi online. Dampak negatif tindak pidana judi online terhadap pelajar sangat berbahaya dan dapat merusak masa depan pelajar. Oleh karena itu, dosen Fakultas Hukum Universitas Malikussaleh berinisiatif melaksanakan kegiatan penyuluhan tindak pidana judi online terhadap pelajar Sekolah Menegah Atas (SMA) Negeri 1 Matang Kuli, Aceh Utara. Oleh karena itu, kegiatan penyuluhan hukum kepada pelajar terhadap tindak pidana judi online sangat dibutuhkan secara berkelanjutan. Untuk mengatasi permasalahan tersebut, Dosen Fakultas Hukum Universitas Malikussaleh telah mengadakan penyuluhan hukum tentang tindak pidana judi online di Sekolah Menegah Atas (SMA) Negeri 1 Matang Kuli Kabupaten Aceh Utara. Setelah kegiatan penyuluhan hukum dilakukan, maka kesadaran pelajar terhadap dampak negatif daripada judi online semakin meningkat, sehingga para pelajar menghindari tidak tindak pidana judi online.
