Abstract

Tujuan penelitian untuk mengetahui Penegakan hukum pasca reformasi dalam membangun kehidupan yang harmonis, berkeadilan dan berkepastian dalam masyarakat yang tertib ternyata tidak sesuai dengan kenyataan bahwa amanat reformasi dalam penegakan hukum ternyata menjadi sangat memilukan. Penegakan hukum yang bersifat “ tebang pilih “ tak terhindarkan , meski penyebabnya bukanlah faktor politis seperti pada era sebelumnya. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana arah pembangunan hukum dan bagaimana menegakan supremasi hukum berdasarkan nilai – nilai demokrasi. Hasil penelitian menunjukan bahwasanya Supremasi hukum sebagai upaya penegakan hukum dan penempatan hukum pada posisi tertinggi dari segalanya, serta menjadikan hukum sebagai panglima ataupun komandan dalam upaya untuk menjaga dan melindungi tingkat stabilitas dalam kehidupan suatu bangsa dan negara memberikan jaminan terciptanya keadilan bagi masyarakat. Keadilan harus diposisikan secara netral, artinya setiap orang memiliki kedudukan dan perlakuan yang sama tanpa terkecuali. Supremasi hukum merupakan prasyarat mutlak bagi penyelenggaraan kehidupan bernegara berdasarkan kedaulatan rakyat. Tujuan utama adanya supremasi hukum adalah menjadikan hukum sebagai pimpinan dalam menjalankan kehidupan berbangsa dan bernegara, yang mana apabila tujuan tersebut tercapai dapat menghasilkan beberapa hal seperti meningkatkan integritas sumber daya manusia, memberikan keadilan sosial, menjaga nilai moral bangsa, menciptakan masyarakat yang demokratis, serta memberi jaminan perlindungan hak individu dalam bernegara dan bermasyarakat

Abstract

International trade principally aims to exploit the market, thus traditionally speaking, have a little concern about protecting the environment. Only after entering this new era of international trade, the Indonesian government then finds the challenge in controlling the trade’s speed and market since the everything is regulated under a specific international trade regulation that is not entirely concern with protecting national interests. Many Indonesian popular products could not compete internationally, since they tend to fail in fulfilling the international standards of exported goods. This will inevitably hinder the national economy, more specifically in gaining foreign investments. One example of the challenges posed by regulation that interfere with the economic growth in the context of international trade is the way environment regulation dampens the effort to export the Indonesian fishery products. The primary problem is that even though Indonesian domestic regulation has put some sort of legal protection for Indonesian fishery products, they still fail to fulfil the environmental standard set by some export-destination countries, such as the USA and the European. Against this backdrop, this research aims to analyze the application of domestic regulation on fishery in Indonesia. We are using the socio-legal approach to understand the way the domestic regulation has failed to fulfill its legal aim, which is to implement the act of law related to fishery, environment, and quality standards to fit the market’s demand, as well as to improve the environment surrounding the fishery industry according to the Code of Conduct for Responsible Fisheries. Based on primary and secondary data from observations and interviews, we contend that there are at least three issues surrounding the failure: 1. The problem regarding the substance of the regulation itself, 2. The disorganized authority within the institutional structure, and 3. The legal culture surrounding the people involved as resulted from their beliefs and personal economic consideration

Abstract

The purpose of this study is to examine the implementation and model of the principle of horizontal separation in the granting of dependent rights in the community, issues related to the Deed of Encumbrance of Dependent Rights, that land rights can be considered as proof of ownership of everything that stands on the land. The research method uses a type of literature research, with a statutory approach, secondary data suber, descriptive analytical data analysis. The results of the study showed. Based on the principle of horizontal separation according to the UUPA, proof of ownership of the right to the land does not necessarily become proof of ownership of everything that consists of the land. This can give the holder ownership authority over the land only to the extent of the land surface, while the building or anything attached to the land is different from the ownership rights of the land. However, until now, this proof of ownership of land rights has always been considered to be evidence of ownership of anything that stands horizontally as regulated by the UUPA and which should be applied, but the encumbrance of Dependent Rights in Land Rights, still shows the application of the principle of vertical attachment to land certificates. A written agreement between the landowner and the owner of the building on it is an appropriate model in the application of the principle of horizontal separation in execution auctions under the Dependent Rights Act, as the agreement will apply as a law to those who agree.

Abstract

Pengabdian masyarakat dengan memberikan materi “Teknik Penyusunan Putusan dan Metode Penulisan Bahasa Hukum” dalam Rapat Koordinasi Penyelesaian Sengketa Proses Pemilihan Kepala Daerah Tahun 2024 yang diselenggarakan oleh Bawaslu Provisi Jawa Tengah bertujuan untuk memperkuat pengetahuan dan kapasitas Anggota Bawaslu Kabupaten/Kota dalam Menyelesaikan Sengketa Proses pada Pemilihan Kepala Daerah 2024. Kegiatan dilaksanakan menggunakan pendekatan kombinasi. Metode kombinasi memberi ruang peserta untuk aktif dalam proses pembelajaran, dan mengungkapkan pengalaman praktis sebelumnya. Hasil pembahasan menunjukan bahwa ada peningkatan dalam pemahaman peserta dengan rentang rata-rata 10%. Kenaikan ini mencerminkan kegiatan efektif guna mempersiapkan anggota Bawaslu dalam dalam membuat keputusan sengketa proses dengan menggunakan bahasa hukum yang sesuai kaidah. Kegiatan juga dalam rangka memperkuat hubungan antara Bawaslu dengan stakeholder

Abstract

This study examines the civil laws of India and Russia in the context of economic growth, focusing on a comparison between the two countries within the BRICS framework. The methodology employed is a literature review to identify differences and similarities in the development of civil laws in India and Russia. The analysis reveals that while India and Russia may not exhibit remarkable environmental performance compared to other BRICS nations, both prioritize environmental sustainability as a primary focus in their economic development policies. The research underscores the role of environmental laws in achieving sustainable impacts on the environment in both countries. Regarding intellectual property, Russia emerges as the most actively involved nation in intellectual property agreements within BRICS, especially when compared to India. Despite differences in trademark registration procedures, both countries demonstrate compliance with an integrated model. The study notes that Russia's intellectual property laws tend to be more general compared to India, which has more specific regulations. Practically, the research suggests the need for continuous efforts to maintain environmental achievements in both countries, with significant potential for collaboration in renewable energy production. In the realm of intellectual property, the identified patterns offer opportunities for collaboration and knowledge exchange between India and Russia. The findings of this study can guide policymakers and stakeholders in formulating strategies for environmental protection and intellectual property management within the BRICS context. This research makes a significant contribution to a deeper understanding of the differences and similarities in civil laws between India and Russia in the context of the BRICS economy. Abstract

This article endeavors to conduct a comprehensive legal juxtaposition of moral and economic rights within the contexts of Indonesia and France. Intellectual property rights, specifically copyright, constitute the focal point of analysis, safeguarding various forms of creative expression encompassing literary, artistic, and scientific works. Within the realm of copyright, a fundamental distinction exists between economic rights, which are subject to arbitrary transfer, and moral rights, which inherently vest with the creator or artist and resist divestiture. Employing conceptual and normative approaches, supplemented by data procured from library resources, this research adopts qualitative data analysis techniques, encompassing both traditional and online research methodologies.The findings of this investigation illuminate dissimilarities in the legal frameworks governing intellectual property rights protection between Indonesia and France. France accentuates the significance of cultural and moral rights, prioritizing the intrinsic connection between the creator and their creation. In contrast, Indonesia places greater emphasis on economic considerations and the protection of economic interests. These disparities manifest in the divergent regulatory structures governing industrial design and copyright in each jurisdiction. Notwithstanding these distinctions, the article contends that achieving harmonization and fostering a nuanced understanding of these regulations is imperative to facilitate cross-border collaborations within the global economy and creative industries. Such harmonization is pivotal for advancing the collective interests of nations and creators alike.

Abstract

The aim of this article is to describe the form of land rescue resolution using normative juridical analysis techniques. Settlements and land-related cases are usually settled through the official legal system and the applicable courts. There are some studies on the settlement of land disputes in Indonesia. This research uses a qualitative descriptive method, namely explaining the phenomenon or relationship of a problem in text form. The data source for this research is obtained through primary and secondary data. Primary data from this research uses legal materials consisting of: 1) the 1945 Constitution; 2) the Civil Code; and 3) Law No. 30 of 1999 regarding arbitration and settlement. The results of this research show that the form of land dispute resolution through arbitration and mediation is very appropriate to use, considering that the costs are not expensive and do not cause losses to the parties in the dispute. Mediation is a dispute settlement process involving third parties as intermediaries to help the parties reach an agreement. Mediation has been used in the settlement of land disputes in various areas of Indonesia, such as Kelurahan Mauliru District of East Sumba and Yogyakarta City. Mediation and arbitration are also methods of dispute resolution involving neutral third parties. The application of mediation and arbitration in the settlement of land disputes is expected to bring about justice and legal certainty.

Abstract

The response to changes in legal frameworks is of paramount importance, particularly in the context of Indonesia's vision for an ideal legal system grounded in Pancasila. This article asserts that legal development should be attentive to existing legal sources, with a strong emphasis on norms that have been deeply integrated into cultural contexts and local wisdom. Central to Pancasila is a humanist philosophy, primarily encapsulated in its second precept, which underpins the values embraced by Indonesian society. The principles inherent in Pancasila humanism advocate for a shared national understanding, respect for democratic freedoms, social equity, and recognition of diverse religious beliefs, all while upholding human dignity and rights. This article constructs arguments for the integration of local wisdom into the legal framework governing environmental management and protection, highlighting its crucial role in ecological preservation and the well-being of the human environment. Indigenous knowledge, characterized by principles such as non-discrimination, deliberation, honesty, and harmony, emerges as a vital source of social capital that can significantly enhance the development of environmental law from the perspective of Pancasila humanism.

Abstract

Kegiatan Sosialisasi Lelang sebagai instrumen jual beli berkarakter khusus dan pencegahan cyber crimed di Desa Cikalahang Kabupaten Cirebon. Kegiatan ini dilatarbelakangi dengan potensi desa dimana perikanan, dan pariwisata yang berkembang sebagai sentral produk olahan ikan dan wisata kuliner ikan bakar air tawar. Pandemi Covid-19 telah berdampak pada ekonomi, menyebabkan penurunan aktivitas bisnis. Fokus pemerintah desa pada tanggung jawab sosial dapat mendorong generasi muda untuk menjadi pemilik bisnis yang bertanggung jawab dan mempromosikan produk lokal. Di era digital, strategi pemasaran dan metode komunikasi harus disesuaikan untuk memastikan pertumbuhan ekonomi dan partisipasi. Metode kegiatan pengabdian ini yakni community development yang dipadukan dengan service learning. Lelang sebagai salah satu instrumen jual beli yang berkarakter khusus yang dapat meningkatkan pendapatan dari penjualan produk dan bahaya kejahatan cyber crime dibalik penggunaan media sosial untuk memasarkan produk. Hasil pengabdian kini adalah tumbuhnya semangat warga masyarakat, pelaku usaha untuk menggunakan lelang sebagai salah satu cara memasarkan dan meningkatkan penjualan produk mereka, serta adanya sikap waspada masyarakat dalam penggunaan media sosial.

Abstract

Kekerasan anak di Indonesia adalah kekerasan yang terdiri dari segala usia, yang berbeda dalam konteks sosial, budaya, dan hukum. Kekerasan anak tercakup berbagai bentuk, seperti kekerasan fisik, kekerasan verbal, kekerasan emosional, pelecehan seksual, dan penelantaran. United Nations Convention on the Rights of the Child menegaskan hak anak untuk dilindungi dari segala bentuk kekerasan dan menekankan perlunya perlindungan khusus untuk anak-anak yang berisiko lebih tinggi. Pusat Informasi Kriminal Nasional (Pusiknas) Bareskrim Polri menghimpun data kejahatan dan kekerasan anak sepanjang Januari-Juli 2023. Pusiknas Polri, anak perempuan lebih banyak menjadi korban kekerasan dan kejahatan. UNICEF tahun 2015 menunjukkan bahwa 40% anak berusia antara 13 dan 15 tahun melaporkan pernah diserang secara fisik sekali setahun, 26% melaporkan pernah mendapat hukuman fisik dari orang tua atau pengasuh mereka di rumah, dan 50% anak melaporkan bully di sekolah. Bullying merupakan salah satu tindakan kekerasan yang dilakukan secara berulang dan melibatkan adanya kekuatan fisik antara korban dan pelaku. Perilaku bullying di Indonesia tercatat sebesar 43,7% untuk tingkat SMA dengan kategori tertinggi berupa kekerasan psikologis (pengucilan). Pentingnya literasi hukum adalah proses penyampaian pengetahuan dan pemahaman tentang sistem hukum, norma, aturan, dan prinsip hukum kepada masyarakat, bertujuan meningkatkan kesadaran hukum dan pemahaman tentang hak dan kewajiban dalam suatu masyarakat.
