Abstract

Peraturan Pemerintah Nomor 24 Tahun 2022 mengatur bahwa kekayaan intelektual yang telah tercatat atau terdaftar dapat dijadikan sebagai objek jaminan utang ke instansi keuangan baik bank maupun bukan bank. Penelitian ini bertujuan untuk mengetahui perlindungan kekayaan intelektual terhadap produk ekonomi kreatif dalam Peraturan Pemerintah Nomor 24 Tahun 2022 Tentang Peraturan Pelaksana Undang-Undang Nomor 24 Tahun 2019 Tentang Ekonomi Kreatif dan mengkaji dampak yang timbul pasca terbitnya Peraturan Pemerintah Nomor 24 Tahun 2022 Tentang Peraturan Pelaksana Undang-Undang Nomor 24 Tahun 2019 Tentang Ekonomi Kreatif terhadap prospek perlindungan kekayaan intelektual bagi produk ekonomi kreatif. Jenis penelitian yang digunakan adalah kepustakaan. Pendekatan yang digunakan adalah perundang-undangan. Sumber data yang digunakan adalah data sekunder. Metode pengumpulan data yang digunakan berupa penelusuran secara online dan offline. Metode analisis data yang digunakan adalah kualitatif. Hasil penelitian ini menunjukkan, dalam Peraturan Pemerintah Nomor 24 Tahun 2022 mengakui kekayaan intelektual yang telah tercatat atau terdaftar dapat diajukan sebagai jaminan ke instansi keuangan baik bank maupun bukan bank. Namun, dalam perjalanannya masih terdapat beberapa kendala diantaranya, tenggang waktu perlindungan HKI yang terbatas, belum tersedianya aturan yang transparan mengenai due diligence, penilaian aset Hak Kekayaan Intelektual, dan lembaga appraisal Hak Kekayaan Intelektual di Indonesia, dan belum ada dukungan yuridis baik dalam wujud regulasi mengenai aset Hak Kekayaan Intelektual sebagai objek jaminan kredit perbankan (Peraturan mengenai pencatatan data atau informasi kekayaan intelektual).

Abstract

Salah satu negara yang menganut sistem hukum Civil Law adalah Indonesia. Pasal 1233 buku ketiga KUH Perdata yang mengatur tentang perikatan mengatur tentang syarat-syarat perjanjian dan kontrak. Pemutusan suatu kontrak dapat disebabkan oleh wanprestasi, yaitu ketidakmampuan salah satu pihak untuk memenuhi kewajiban kontraknya. Cara penyelesaian wanprestasi, termasuk pemutusan kontrak dengan kompensasi, diatur oleh hukum kontrak Indonesia. Amerika menganut sistem hukum Common Law yang berbeda dengan peraturan di Indonesia. Dalam hukum kontrak AS, wanprestasi dapat diselesaikan dengan salah satu dari dua cara. Salah satu pendekatannya adalah melalui prosedur hukum common law, yang mencakup kompensasi dan upaya hukum yang adil termasuk administrasi pengadilan dan kinerja khusus. Tujuan dari penelitian ini adalah untuk mengumpulkan data tentang bagaimana perjanjian hukum antara Indonesia dan AS diselesaikan ketika terjadi pelanggaran kontrak.

Abstract

This research aims to find out and examine industrial relations dispute resolution models in Indonesia. This research is normative legal research using a qualitative approach. The results of the research show that there are several types of disputes, namely Rights Disputes, Interest Disputes, Termination of Employment Disputes (PHK), Disputes between Trade Unions/Labor Unions. The author took the example of the case of PT Holcim Indonesia Tbk's unilateral layoff of its employees which was resolved through litigation in court. Industrial relations. With the enactment of Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes, there is a guarantee of protection for workers regarding the basic rights of workers/laborers and guarantees of equality, opportunity and equal treatment without discrimination on any basis.

Abstract

Ekspansi aset kripto yang pesat sebagai alat keuangan di seluruh dunia telah menyebabkan masalah hukum terkait warisan di beberapa negara, seperti undang-undang di Brazil dan Indonesia yang berkaitan dengan warisan aset kripto. Tujuan dari penelitian ini adalah untuk menyelidiki kerangka peraturan di Brazil dan Indonesia menangani pewarisan aset kripto secara berbeda, serta memberikan pendapat mengenai implikasi dan perlindungan bagi pemegang atau ahli waris aset kripto. Memanfaatkan tinjauan literatur dari publikasi, buku, serta asal lain yang tentang menggunakan pokok bahasan penelitian, penelitian ini membandingkan sistem hukum Brazil dan Indonesia dalam kaitannya dengan aset digital. Penelitian ini menyoroti perbedaan hukum penting antara Indonesia dan Brazil mengenai suksesi kepemilikan aset kripto. Meskipun upaya sedang dilakukan di Indonesia untuk menyesuaikan peraturan dengan kemajuan teknologi, aspek perpajakan dan perlindungan hak waris menjadi fokus utama di Brazil. Penelitian ini membantu pemahaman kerangka hukum yang berlaku dalam konteks warisan di kedua negara oleh ahli hukum dan pemilik aset kripto

Abstract

The use of a research approach in legal research will determine the results. There are three categories of approaches in legal research. The normative approach is the most widely used. This research aims to examine how the approach should be implemented in legal research. This research uses a conceptual approach which is still within the scope of the normative approach. Research data was collected by searching articles published in 23 law journals. The results of this research show that the approach to legal research is the use of perspective in discussing legal issues. There are three legal research approaches, namely normative, empirical, and philosophical approaches with all their variants. The normative approach reviews legal problems from a positive law perspective. The empirical approach examines legal problems as a cultural reality. A philosophical approach examines legal problems from an ideal perspective. The approach to legal research should be applied according to the type of research, research data, and level of research. The normative approach is the most widely used. This is because law is mostly understood as a set of rules. Sequentially, of the 256 articles studied, 70% of legal research used a “normative approach”, 19% empirical, and 11% philosophical.

Abstract

The purpose of this research, to find out the extent to which customary law community land rights are recognized in Indonesian legislation. This article is legal research type of library research by using a statutory regulatory approach (Statute Approach). For customary law communities, Land is part of their lives that is controlled and managed jointly with the responsibility given by nature to maintain and protect it. In reality, a lot of customary land has been taken by the government and used as agricultural land, Even though customary law communities have legal standing regulated in the 1945 Constitution, Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles, MPR Decree No. IX/2001, Law Number 39 of 1999 concerning human rights. However, in reality, the government still takes customary land which is then given to investors to manage. This of course infringes the rights of customary law communities. This problem is exacerbated because in article 5 paragraph (1) of Law number 41 of 1999 concerning Forestry states that customary forests are part of state forests.

Abstract

Improving the legal literacy of Generation Z (Gen-Z) especially among the students of the twelfth grade of Higher State High School, is essential to equip them with the knowledge necessary to live in an increasingly complex and globally connected society. Gen-Z is facing a variety of problems in the traffic and specific documentation of the current. The main problems are non-compliance with traffic rules, restricted understanding of traffic regulations, high mobility, less popular use of public transport, reliance on navigation applications can cause drivers to pay less attention to signs and changes in road conditions. Related documents include a lack of understanding of the importance of documents such as a ID card, family card, or birth certificate. Technology and data security challenges where technological advances can bring challenges related to data security and potential risks of population data hacking, restricted access to population services. Improving legal literacy for Gen-Z in Higher State High Schools 1 Advocates require an innovative, holistic, and tailored approach to the characteristics and needs of students. Through effective and inclusive education, Gen- Z, Class XII students of High State High school 1 advocates can better understand their rights and responsibilities in the legal community, including improved understanding of traffic rules and occupation documents, adequate regulation, violation of administrative processes that facilitate access to Gen Z occupation papers and the use of technology to enhance safety and driving awareness among Gen-Z.

Abstract

Political parties hold a strategic position and serve as a primary pillar in Indonesia's democratic system, acting as a bridge between government policies and the aspirations of the people. However, personal-oligarchic leadership and an inadequate cadre system have resulted in party decision-making being frequently dominated by the interests of individual chairpersons, thereby threatening the future of democracy. An inclusive, transparent, and tiered cadre system is essential to uphold democratic principles in political recruitment and the nomination of public officials. The phenomena of factionalism and internal patronage within parties further exacerbate the political landscape, evidenced by conflict cases in several major parties. The process of electing regional heads, as a key component of democracy, is also influenced by the failures in recruitment. The Constitutional Court's Decision Number 60/PUU-XXII/2024 abolished the discriminatory nomination threshold for regional head candidates that previously disadvantaged smaller parties and independent candidates, thereby broadening opportunities for inclusive political participation. A community-based method is employed in community service within political parties in Tegal Regency to enhance legal literacy regarding this decision, involving party cadres and community leaders through workshops and interactive socialisation. This initiative aims to promote healthy and democratic political participation at the local level, strengthen inclusive democracy, and foster legal awareness among the populace. This study provides a comprehensive overview of the political dynamics and changes in the electoral system within the context of contemporary Indonesian democracy.

Abstract

This research examines the impact of food law politics on community empowerment and sustainable agriculture in Indonesia, focusing on the Sustainable Food Garden Program (P2L). Utilizing a normative juridical analysis, it explores how legal frameworks can support or obstruct community-led agricultural initiatives. The study highlights the empowering effect of laws aligned with community goals and the challenges arising from legislation favoring industrial agriculture. It proposes legal reforms to address ambiguities and barriers, such as clarifying land tenure rights and simplifying organic certification processes. Recommendations aim to foster a legal environment conducive to sustainable, community-driven agriculture, enhancing food security and environmental sustainability. This paper contributes insights into legal and policy reforms needed to empower communities and promote sustainable agricultural practices in Indonesia.
