Abstract

Program dalam kegiatan ini berupa Penyuluhan Hukum Terkait Pengelolaan Badan Usaha Milik Desa (BUMDes) dari perspektif Peraturan Perundang-undangan, Pendampingan Terhadap Masyarakat Dalam Penelusuran Potensi Desa dan Pendampingan terhadap masyarakat dan Aparat Desa dalam penyusunan rencana Pengelolaan Potensi Desa. Tujuannya adalah memberikan manfaat khususnya terhadap pengurus dan aparat pemerintah desa dalam pengelolaan BUMDes berdasarkan peraturan perundang-undangan maupun regulasi yang berlaku. Selain itu, memberikan manfaat dalam pengembangan kehidupan perekonomian masyarakat ke arah yang lebih baik, melalui penguatan tata kelola dan pemahaman pengurus terhadap pengelolaan baik secara administrasi maupun teknis BUMDes di Biluhu Timur, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum, dengan menetapkan Biluhu Timur Sebagai Desa Binaan FH UNG. Hasil pelaksanaan kegiatan yakni terdapat masukan dalam hal kolaborasi dan pendampingan Perdes serta penyusunan AD/ART oleh Fakultas Hukum, tindak lanjut pelatihan aplikasi BUMDES serta masukan terkait data potensi yang dapat dikelola melalui Usaha BUMDes yaitu Pasar Ikan yang dibentuk melalui Perdes termasuk masukan terhadap litigasi bencana di desa dan Perdes Pencegahan Stunting. Pengelolaan Potensi Ikan menjadi salah satu usaha BUMDes dapat dilakukan dengan membentuk Perdes terlebih dahulu sehingga menjadi wadah Desa untuk melakukan usaha khususnya bidang ekspor ikan.

Abstract

AbstrakHasil yang ingin dicapai dari kegiatan KKS ini adalah (1) adanya peningkatan pemahaman pemerintah desa dalam pembentukan peraturan desa; (2) terbentuknya Peraturan Desa tentang Pencegahan dan Penurunan Stunting sebagai dasar hukum bagi pemerintah Desa Manawa Kecamatan Patilanggio Kabupaten Pohuwato; (3) meningkatnya pengetahuan dan pemahaman dan partisipasi masyarakat dalam gerakan pencegahan dan penurunan stunting di Desa Manawa  sebagai bagian dari ikhtiar bersama untuk mencapai target Pemerintah Kabupaten Pohuwato dalam penurunan stunting di Kabupaten Pohuwato. Metode yang akan digunakan dalam pencapaian tujuan ini adalah pelatihan dan pendampingan penyusunan Peraturan Desa Manawa tentang Pencegahan dan Penurunan Stunting sebagai dasar hukum pemerintah desa, serta sosialisasi dan pelatihan untuk kader desa dan masyarakat dalam pencegahan dan penurunan stunting.Kata Kunci: Desa Bebas Stunting; Pendampingan; Peraturan Desa.

Abstract

This study aims to find out and analyze the role of the police in tackling illegal drug trafficking and find out what obstacles the police face in dealing with illegal drug trafficking at the Gorontalo City Police, based on the title raised in this study, researchers see the weakness of Indonesia's defense From the invasion of things that endanger society, thousands of illegal drugs have been circulating throughout Indonesia. This study uses empirical methods. The data collection process examined by researchers in this study were primary data and secondary data. Data collection techniques that support and relate to this research are interviews, observation and literature studies..The results of this study indicate that the cause of people becoming perpetrators of illegal drug distribution is because they want to get rich quickly, perpetrators take advantage of the lack of public knowledge about illegal drugs and the correct distribution mechanism according to the rules. There are several factors that support perpetrators involved in illegal drug trafficking. , namely: Economic factors and environmental and social factors. Illegal drug distribution in Indonesia is regulated in Law no. 36 of 2009 concerning health. The free circulation of illegal drugs in Indonesia has turned out to be used by many elements to gain large profits. Some transactions also occur online. The opportunity to buy cheap drugs and sell them at high/profitable prices is the motive of several individuals who have been caught in illegal drug trafficking. This will not happen if people are educated about economics and law. This is a joint responsibility of the government, the community, BPOM and the Indonesian National Police.

Abstract

This research aims to discuss efforts to protect children who are victims of abuse by fellow school children. This research uses empirical legal methods and is based on phenomena and realities in the field, then analyzed descriptively qualitatively. The results of the research show that the Gorontalo Regional Police's efforts to protect victims of abuse of fellow school children include providing security for perpetrators of abuse by the police when they receive information from the victim's parents or the school regarding allegations of child abuse in the school environment. The police followed up by sending officers to check and arrest the perpetrators; Carrying out examinations in a family atmosphere and fulfilling the victims' rights during the legal process; and Ensure that victims receive compensation, where a victim is entitled to compensation, as well as medical rehabilitation and recovery for the physical and psychological suffering they have experienced. In several cases of abuse, the perpetrator paid for the losses suffered by the victim, especially material compensation in the form of compensation payments due to the victim's physical, mental and psychological losses during the recovery and rehabilitation process. The perpetrator paid all the compensation suffered by the victim, using assets belonging to the perpetrator's family, especially hospital treatment costs.

Abstract

This research aims to find out what the position of Inafis is in uncovering criminal acts in the interests of justice and to find out what are the inhibiting factors for the Inafis unit in uncovering criminal acts in the interests of justice. This research uses empirical methods. The results of this research show that the position of the Inafis Unit has a crucial role in uncovering criminal acts in the interests of justice. The position of the inafis init includes the duties and functions of the inafis unit, the role of the inafis unit in uncovering criminal acts, the importance of justice in uncovering criminal acts, compliance with legal procedures: ensuring that all evidence collected is fair, valid and acceptable in court. Factors Inhibiting the implementation of the tasks of the Gorontalo Police Inafis Unit in Revealing Criminal Acts in the Interests of Justice which could hinder its performance and effectiveness. Where these factors are divided into 2 factors which include Internal Factors and External Factors.

Abstract

Legislation regarding judicial examination procedures requires forensic experts, article 133 of the Criminal Procedure Code paragraph (1), explains that in the case of an investigator for the purposes of justice regarding a victim who has been injured, poisoned or died allegedly because of an incident which constitutes a criminal act, the judiciary has the authority to submit a request expert information. In medical experts, justice and other experts. Why do you need a forensic doctor? Because it is impossible for investigators, judges, prosecutors to know all the knowledge in the field of medicine which will later be used to deal with criminal cases related to the human body, for example: violence, murder, suicide. With this, the authorities will ask for help from a doctor as an expert witness, the doctor's testimony as an expert witness, the doctor's testimony is regulated by law. In handling murder cases, a forensic autopsy is needed which will provide clear information regarding criminal cases. Accordingly, a forensic autopsy will produce tools that can be used as evidence in deciding a case by a judge. With a forensic autopsy, the cause of a person's death will be known. Therefore, an autopsy is very much needed in the investigation of criminal acts of murder and during the trial process. This research aims to understand the process of proving the criminal act of murder in the Gorontalo District Court with case number 61/PID.B/2023/PN.GTO. and the use of autopsy evidence in the process of proving this research is analyzed normatively, namely research that analyzes the reciprocal relationship between legal facts and social facts which can be seen as independent variables and social facts as dependent variables. murder that was not accompanied by an autopsy.

Abstract

This study aims to determine the police's efforts in tackling the crime of child abuse, and to find out the factors that hinder the police in handling cases of child abuse in the jurisdiction of the Bone Bolango Police. The type of research used is empirical research with a case approach. The results of the study show that the police's efforts to deal with criminal acts of child molestation are carried out through preventive and repressive efforts. Preventive efforts are anticipating sexual immorality by providing legal counseling, the negative effects of promiscuity among students, and carrying out raids or patrols to ensure a sense of security in society. Abstract

The unlawful teachings in the explanation of Article 2 paragraph (1) of the Law on the Eradication of Corruption have been considered by the Constitutional Court as a norm that is contrary to the Constitution of the Republic of Indonesia in 1945, and does not have binding legal force. This condition has legal implications for the meaning of unlawful elements in Article 2 paragraph (1) of the Law on the Eradication of Corruption, becoming vague (vague norm). The purpose of this study is to analyze the unlawful teachings in the Law on the Eradication of Corruption in Ius Constituendum. This research uses normative legal research, which formulates the aspired law (ius constituendum) on the meaning of the element against the law (wederrechtelijkeheid) in the Corruption Eradication Law after the Constitutional Court Decision Number 003/PUU-IV/2006. The results of the discussion show that by assessing the basis of the Constitutional Court's legal considerations (ratio decidendi) Number 003/PUU-IV/2006. The cancellation of the explanation of Article 2 paragraph (1) of the Law on the Eradication of Corruption which adheres to the teachings of the nature of the act of violating formal and material laws, because it is considered that the concept of materiele wederechtelijk, which refers to unwritten law, is an uncertain measure.  The unlawful element in Article 2 paragraph (1) of the Law on the Eradication of Corruption Crimes is still interpreted as against formiele wedderechtelijkeheid and against materiele wedderecjhtelijkeheid in its negative function. As for its positive function, it must be considered contrary to the principle of protection and fair legal certainty regulated in Article 28D of the 1945 Constitution.

Abstract

Pihak yang melakukan pembelaan diri akibat adanya tindakan pembegalan diatur dalam KUHP sehingga upaya pemberian restorative justice kepada pihak pembelaan diri diperlukan adanya kriteria yang jelas pada posisi penerima restorative justice yang melakukan pembelaan diri. Oleh sebab itu, dilakukan kajian tentang kriteria penerapan  restorative justice terhadap pelaku pembelaan diri akibat tindakan kriminal yang mengancam nyawa. Penelitian ini merupakan penelitian normative dengan menggunakan pendekatan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan Penerapan  restorative justice terhadap pelaku pembelaan diri akibat tindakan kriminal yang mengancam nyawa harus memenuhi adanya kriteria yakni terpenuhinya unsur objektif dari tindakan pembelaan diri yang dilakukan oleh korban dari tindakan kriminalitas begal, terpenuhinya unsur subjektif perbuatan mengancam nyawa orang yang dilakukan oleh pelaku begal, serta pemberian restorative justice didasarkan pada Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif Justice

Abstract

 The study explores how Islamic law and local culture influence democracy in the United Arab Emirates (UAE) and Indonesia and how each country's constitution facilitates the implementation of democracy based on Islamic principles. In the context of the UAE, Islamic law (sharia) is the primary source of law, while in Indonesia, Pancasila and the 1945 Constitution establish a more inclusive and pluralist legal framework, enabling the practice of Islamic law in a context that respects religious freedom. The research employs juridical legal research with historical, comparative, and Islamic legal approaches and will be analyzed with descriptive-analytical methods. The results showed the role of Islamic law, constitution, and culture in shaping democracy in the UAE and Indonesia through public policies and laws that accommodate the wider community's interests. With its sharia law and authoritarian constitution, the UAE shows a democracy different from Indonesia, which implements an inclusive democracy based on Pancasila and the 1945 Constitution. Cultural factors also play a role, with the UAE influenced by the monarchy and ruling family loyalties, while Indonesia is influenced by ethnic and cultural diversity. Implementing Islamic democracy requires transforming power, inclusive dialogue, and balancing Islamic values and universal democracy. Abstrak: Penelitian ini mengeksplorasi bagaimana hukum Islam dan budaya lokal mempengaruhi demokrasi di Uni Emirat Arab (UEA) dan Indonesia serta bagaimana konstitusi masing-masing negara memfasilitasi penerapan demokrasi berdasarkan prinsip-prinsip Islam. Dalam konteks UEA, hukum Islam (syariah) merupakan sumber hukum utama sedangkan di Indonesia, Pancasila dan UUD 1945 membentuk kerangka hukum yang lebih inklusif dan pluralis. Hal ini memungkinkan penerapan hukum Islam dalam konteks yang menghormati kebebasan beragama. Penelitian ini menggunakan penelitian hukum yuridis dengan pendekatan sejarah, komparatif, dan hukum Islam yang  dianalisis dengan metode deskriptif-analitis. Temuan penelitian menunjukkan peran hukum Islam, konstitusi, dan budaya dalam membentuk demokrasi di UEA dan Indonesia melalui kebijakan publik dan undang-undang yang mengakomodasi kepentingan masyarakat luas. UEA dengan hukum syariah dan konstitusi otoriternya menunjukkan demokrasi yang berbeda dengan Indonesia yang menerapkan demokrasi inklusif berdasarkan Pancasila dan UUD 1945. Faktor budaya juga berperan, UEA dipengaruhi oleh monarki dan kesetiaan keluarga penguasa sedangkan Indonesia dipengaruhi oleh keragaman etnis dan budaya. Penerapan demokrasi Islam memerlukan transformasi kekuasaan, dialog inklusif, dan keseimbangan nilai-nilai Islam dan demokrasi universal.
