Abstract

Oil and Gas plays an important role in the fulfillment of fuel needs from both the industrial and transportation sectors. This regulation on Oil and Gas has provided a legal basis in its implementation.  The presence of retail fuel businesses "Pertamini" is causing legal problems, this is because the existence of these businesses do not have a formal business license at all.This paper analyzes the sale of fuel under the brand "Pertamini" which does not have a business license. This research uses normative legal research method with statute approach and conseptual approach.The results showed that, with the increasing number of "Pertamini" fuel traders without a license, it will certainly have implications for the law and uncontrolled management of Oil and Gas. Therefore, the government and related agencies can issue permits to "Pertamini" fuel traders. Because by obtaining a legal business license, in terms of its management can be carried out optimal supervision to prevent the occurrence of fuel misuse. This also includes efforts to provide certainty and legal protection to "Pertamini" Fuel Traders.

Abstract

This paper aims to examine the regulation of land use by the Limboto Lake community. This study uses an empirical juridical approach. The study results show that the regulation of land rights, especially land along the banks, has been regulated by the government and local governments, starting from laws and regulations, regional regulations, and other decisions. The existence of laws and regulations has given legitimacy to the state, in this case, the government, regarding the control and utilization of the land on the banks of the lake because the state legally owns the land on Lake Limboto. However, the fact is that the land on the banks of the lake has changed its function to become a community settlement. , making it difficult to carry out an inventory of the surrounding population. In order to prevent mismanagement or management that is not based on the rule of law, it is necessary to have clear and accurate boundaries regarding the allotment of areas/zones for various interests so that there is no overlap between the government and the land agency, considering that some community lands already have land rights (land certificate). Thus, an alternative solution to save the lake is establishing a zoning system.

Abstract

The court as a law enforcement instrument has been implementing mediation since 2008. However, the success of mediation is still far from what was expected. This indicates that the integration of mediation in the court system has not been effective, especially related to divorce cases. The integration of mediation into court practice, on the one hand, aims to avoid the accumulation of cases and maximize the function of court institutions in resolving adjudicative disputes, but on the other hand, it increases the judges' workload. Therefore, integrating mediation into court proceedings can be an instrument in reducing the divorce rate. This research uses an empirical normative approach in terms of Supreme Court Regulation Number 1 of 2016. The obtained data will be analyzed qualitatively. The research results indicate that the integration of mediation in divorce cases at the Gorontalo City and Regency Religious Courts has prioritized societal values, particularly deliberation to reach the best solution for the parties involved. However, this approach does not seem to align well with the social dynamics in Gorontalo City.  This is because there are still several key factors that hinder achieving the best results through mediation. The failure to reach critical points in these deliberations results in a minimal success rate for mediation in resolving divorce cases, as evidenced by the relatively high number of divorce decisions. This is often due to the parties involved blaming each other and being unwilling to negotiate for a mutual agreement.
